Section <bold>51-12-102</bold> is amended to read:</secline><catline lineno="29"><bold>51-12-102<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>07/01/27</date></paren></parens>. Reporting.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The state treasurer shall share the information reported in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="51-12-202"><ln numlevel="1" lineno="31" slineno="1-4"/>51-12-202</xref>(2)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="51-12-202(2)(c)">51-12-202(2)(c)</xref></amend> with the governor's office.</subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="32" slineno="1-5" level="1"><display>(2)</display>Before December 31 of each year, the state treasurer and the governor's office or the <ln numlevel="1" lineno="33" slineno="1-6"/>governor's office's designee shall report to the Legislative Management Committee:<subsection ssid="4-null-3" dnum="a-o" numlevel="1" lineno="34" slineno="1-7" level="2"><display>(a)</display>the dollar amount of deposits and the number of qualified depositories in which a <ln numlevel="1" lineno="35" slineno="1-8"/>deposit is made in accordance with Part 2, Investment Program;</subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="36" slineno="1-9" level="2"><display>(b)</display>the information reported in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="51-12-202">51-12-202</xref>(2)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="51-12-202(2)(c)"><ln numlevel="1" lineno="37" slineno="1-10"/>51-12-202(2)(c)</xref></amend>; and</subsection><subsection ssid="4-null-5" dnum="c-o" numlevel="1" lineno="38" slineno="1-11" level="2"><display>(c)</display>the impact of the Utah Homes Investment Program on the availability of housing in <ln numlevel="1" lineno="39" slineno="1-12"/>the state.</subsection></subsection><subsection ssid="4-6" dnum="_-o:3-i" numlevel="1" lineno="40" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="4-7" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning after June 30, 2028, the state treasurer shall conduct a study that <ln numlevel="1" lineno="41" slineno="1-14"/>analyzes whether the lending activity under the Utah Homes Investment Program <ln numlevel="1" lineno="42" slineno="1-15"/>resulted in measurable local economic benefits.</amend></subsection><subsection ssid="4-9" dnum="_-o:b-i" numlevel="1" lineno="43" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">On or before October 1, 2028, the state treasurer shall submit a report summarizing <ln numlevel="1" lineno="44" slineno="1-17"/>the results of the study to the Legislative Management Committee and the governor.</amend></subsection><subsection ssid="4-8" dnum="_-o:c-i" numlevel="1" lineno="45" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The state treasurer may contract with a third party to complete the study and report <ln numlevel="1" lineno="46" slineno="1-19"/>described in this Subsection <xref depth="4" refnumber="51-12-102(3)">(3)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="6" num="51-12-202" type="amend" src="code" uid="C51-12-S202_2026050620260506" sort="51 12 02020020260506" numlevel="1" lineno="47" slineno="2-1" sn="2"><section number="51-12-202" numlevel="1" lineno="48" slineno="2-2" type="amend"><secline lineno="47">Section 2. Section <bold>51-12-202</bold> is amended to read:</secline><catline lineno="48"><bold>51-12-202<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>07/01/27</date></paren></parens>. Terms of deposit.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The state treasurer shall enter into a deposit agreement with an approved qualified <ln numlevel="1" lineno="50" slineno="2-4"/>depository in accordance with Section <xref depth="3" refnumber="51-12-201">51-12-201</xref>.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="51" slineno="2-5" level="1"><display>(2)</display>The deposit agreement shall provide that the qualified depository:<subsection ssid="6-null-3" dnum="a-o:_-i" numlevel="1" lineno="52" slineno="2-6" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">shall offer loan financing to a developer or city of the first or second class of a <ln numlevel="1" lineno="53" slineno="2-7"/>qualified project at a rate no higher than 150 basis points above the federal funds <ln numlevel="1" lineno="54" slineno="2-8"/>effective rate at the time of the deposit;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-4" dnum="b-o:a-i" numlevel="1" lineno="55" slineno="2-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>shall return the amount of deposit:<subsection ssid="6-null-5" dnum="i-o" numlevel="1" lineno="56" slineno="2-10" level="3"><display>(i)</display>with interest at a rate equal to the greater of:<subsection ssid="6-null-6" dnum="A-o" numlevel="1" lineno="57" slineno="2-11" level="4"><display>(A)</display>the federal funds effective rate at the time of the deposit minus 200 basis <ln numlevel="1" lineno="58" slineno="2-12"/>points; or</subsection><subsection ssid="6-null-7" dnum="B-o" numlevel="1" lineno="59" slineno="2-13" level="4"><display>(B)</display>0.5%; and</subsection></subsection><subsection ssid="6-null-8" dnum="ii-o" numlevel="1" lineno="60" slineno="2-14" level="3"><display>(ii)</display>at the earlier of:<subsection ssid="6-null-9" dnum="A-o" numlevel="1" lineno="61" slineno="2-15" level="4"><display>(A)</display>24 months from the day on which the deposit is made;</subsection><subsection ssid="6-null-10" dnum="B-o" numlevel="1" lineno="62" slineno="2-16" level="4"><display>(B)</display>repayment of the loan financing;</subsection><subsection ssid="6-null-11" dnum="C-o" numlevel="1" lineno="63" slineno="2-17" level="4"><display>(C)</display>the sale of the last home in the qualified project; or</subsection><subsection ssid="6-null-12" dnum="D-o" numlevel="1" lineno="64" slineno="2-18" level="4"><display>(D)</display>June 30, 2028;</subsection></subsection></subsection><subsection ssid="6-null-13" dnum="c-o:b-i" numlevel="1" lineno="65" slineno="2-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>is responsible for return of the amount of the deposit with accrued interest <ln numlevel="1" lineno="66" slineno="2-20"/>regardless of the completion of the qualified project or the repayment of the qualified <ln numlevel="1" lineno="67" slineno="2-21"/>depository's loan to the developer or city of the first or second class of the qualified <ln numlevel="1" lineno="68" slineno="2-22"/>project; and</subsection><subsection ssid="6-null-14" dnum="d-o:c-i" numlevel="1" lineno="69" slineno="2-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>shall report to the state treasurer the total number of housing units and the <ln numlevel="1" lineno="70" slineno="2-24"/>number of attainable homes each qualified project created.</subsection></subsection><subsection ssid="6-null-15" dnum="3-o" numlevel="1" lineno="71" slineno="2-25" level="1" space="false"><display>(3)</display><subsection ssid="6-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the provisions of Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"><xref tempid="622" depth="4" refnumber="51-12-202(2)(b)(ii)">(2)(b)(ii)</xref> and (2)(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(a)(ii) and <ln numlevel="1" lineno="72" slineno="2-26"/>(2)(b)</amend>, for a deposit made to the Utah Housing Corporation, the Utah Housing <ln numlevel="1" lineno="73" slineno="2-27"/>Corporation shall return the amount of the deposit with accrued interest when the <ln numlevel="1" lineno="74" slineno="2-28"/>Utah Housing Corporation has received:<subsection ssid="6-null-17" dnum="i-o" numlevel="1" lineno="75" slineno="2-29" level="3" tab="1"><display>(i)</display>repayment of the loan financing; or</subsection><subsection ssid="6-null-18" dnum="ii-o" numlevel="1" lineno="76" slineno="2-30" level="3" tab="1"><display>(ii)</display>proceeds from the sale or other disposition of the homes in the qualified project.</subsection></subsection><subsection ssid="6-null-19" dnum="b-o" numlevel="1" lineno="77" slineno="2-31" level="2"><display>(b)</display>The Utah Housing Corporation may return the deposit later than the time period <ln numlevel="1" lineno="78" slineno="2-32"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="51-12-202(2)(a)(ii)(a)">(2)(b)(ii)(A) or (D)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(a)(ii)(A) or <xref depth="4" refnumber="51-12-202(d)">(D)</xref></amend> without penalty.</subsection></subsection><subsection ssid="6-null-20" dnum="4-o" numlevel="1" lineno="79" slineno="2-33" level="1"><display>(4)</display>A qualified depository may return the deposit earlier than the time period described in <ln numlevel="1" lineno="80" slineno="2-34"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="51-12-202(2)(a)(ii)">(2)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(a)(ii)</amend> without penalty.</subsection><subsection ssid="6-null-21" dnum="5-o" numlevel="1" lineno="81" slineno="2-35" level="1"><display>(5)</display>The state treasurer shall deposit the return of the amount of the deposit, including <ln numlevel="1" lineno="82" slineno="2-36"/>interest, into the fund.</subsection></section></bsec><bsec buid="1" num="63I-1-251" type="amend" src="code" uid="C63I-1-S251_2026050620260506" sort="63I01 02510020260506" numlevel="1" lineno="83" slineno="3-1" sn="3"><section number="63I-1-251" numlevel="1" lineno="84" slineno="3-2" type="amend"><secline lineno="83">Section 3.
