Peterson</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions related to the Utah Homes Investment Program.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">expands the projects for which a qualified depository may offer loan financing to a <ln numlevel="1" lineno="9" slineno="0-9"/>developer or city under the Utah Homes Investment Program (program) to include:<hl numlevel="1" lineno="10" slineno="0-10" level="2">multi-family housing development projects that meet specified criteria;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="2">affordable rental projects;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">acquisition of housing development projects that meet specified criteria; and</hl><hl numlevel="1" lineno="13" slineno="0-13" level="2">city-operated programs that provide low-interest loans to income-eligible homeowners <ln numlevel="1" lineno="14" slineno="0-14"/>to make improvements;</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">allows a municipality with an eligible shelter to obtain financing through the program;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">following the end of the program, directs the state treasurer to complete a study that <ln numlevel="1" lineno="17" slineno="0-17"/>analyzes the economic effect of the program;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">allows the state treasurer to contract with a third party to complete the study;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">removes the limitation on the rate at which a qualified depository may offer loan <ln numlevel="1" lineno="20" slineno="0-20"/>financing to a developer or city; ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display>"Attainable home" means a residence that costs the purchaser no more than the <ln numlevel="1" lineno="50" slineno="1-9"/>amount a qualifying residential unit may be purchased in accordance with Section <xref depth="3" refnumber="63H-8-501"><ln numlevel="1" lineno="51" slineno="1-10"/>63H-8-501</xref> at the time the state treasurer deposits with a qualified depository.</subsection><subsection ssid="14-null-2" dnum="2-o:3-i" numlevel="1" lineno="52" slineno="1-11" space="true">(6)</amend></display>"Political subdivision" means:<subsection ssid="14-null-6" dnum="a-o" numlevel="1" lineno="58" slineno="1-17" level="2"><display>(a)</display>the municipality in which the attainable home is located; or</subsection><subsection ssid="14-null-7" dnum="b-o" numlevel="1" lineno="59" slineno="1-18" level="2"><display>(b)</display>the county, if the attainable home is located in an unincorporated portion of the <ln numlevel="1" lineno="60" slineno="1-19"/>county.</subsection></subsection><subsection ssid="14-null-8" dnum="6-o:7-i" numlevel="1" lineno="61" slineno="1-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Qualified depository" means: <subsection ssid="14-null-9" dnum="a-o" numlevel="1" lineno="62" slineno="1-21" level="2"><display>(a)</display>the same as that term is defined in Section <xref depth="3" refnumber="51-7-3">51-7-3</xref>; or</subsection><subsection ssid="14-null-10" dnum="b-o" numlevel="1" lineno="63" slineno="1-22" level="2"><display>(b)</display>the Utah Housing Corporation as described in Title 63H, Chapter 8, Utah Housing <ln numlevel="1" lineno="64" slineno="1-23"/>Corporation Act.</subsection></subsection><subsection ssid="14-null-11" dnum="7-o:_-i" numlevel="1" lineno="65" slineno="1-24" ea="erase" anum="0" owner="ahaskell" style="2" level="1" lineno="68" slineno="1-27" ea="erase" anum="0" owner="ahaskell" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" slineno="1-50" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both">(iv)</amend></display>including in the deed of sale for an attainable home a restriction, in favor of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="90" groupid="74" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="92" slineno="1-51"/>city of the first or second class</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="86" groupid="70" style="1" owner="ahaskell" level="1" amendtag="both" space="true">qualifying city</amend>, that the attainable home be <ln numlevel="1" lineno="93" slineno="1-52"/>owner-occupied for no fewer than five years;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="92" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="14-null-23" dnum="iv-o:b-i" numlevel="1" lineno="94" slineno="1-53" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>expanding an existing effort to acquire and rehabilitate <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="93" style="2" owner="ahaskell" level="1" deltag="both">single-family homes as <ln numlevel="1" lineno="95" slineno="1-54"/>described in Subsections <xref depth="4" refnumber="51-12-101(7)(c)(ii)">(7)(c)(ii)</xref> and <xref depth="4" refnumber="51-12-101(iii)">(iii)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="47" style="1" owner="ahaskell" level="1" amendtag="both" space="true">residential units as attainable homes as <ln numlevel="1" lineno="96" slineno="1-55"/>described in Subsections <xref depth="4" refnumber="51-12-101(8)(a)(ii)">(8)(a)(ii)</xref> through <xref depth="4" refnumber="51-12-101(iv)">(iv)</xref>;</amend></subsection><subsection ssid="14-37" dnum="_-o:c-i" numlevel="1" lineno="97" slineno="1-56" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">an affordable rental project that includes revenue sharing with tenants; or</amend></subsection><subsection ssid="14-42" dnum="_-o:d-i" numlevel="1" lineno="98" slineno="1-57" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="104" style="1" owner="ahaskell" level="1" amendtag="end">a program operated by a qualifying city that:</amend><subsection ssid="14-46" dnum="_-o:i-i" numlevel="1" lineno="99" slineno="1-58" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">provides low interest loans to income-eligible homeowners to complete one or <ln numlevel="1" lineno="100" slineno="1-59"/>more of the following on the homeowner's residential unit located within the <ln numlevel="1" lineno="101" slineno="1-60"/>qualifying city's boundaries:</amend><subsection ssid="14-44" dnum="_-o:A-i" numlevel="1" lineno="102" slineno="1-61" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="102" style="1" owner="ahaskell" level="1" amendtag="end">exterior improvements to stabilize the residential unit's structure;</amend></subsection><subsection ssid="14-45" dnum="_-o:B-i" numlevel="1" lineno="103" slineno="1-62" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="108" style="1" owner="ahaskell" level="1" amendtag="end">interior improvements that address health or safety concerns or code <ln numlevel="1" lineno="104" slineno="1-63"/>violations; or</amend></subsection><subsection ssid="14-47" dnum="_-o:C-i" numlevel="1" lineno="105" slineno="1-64" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">improvements designed to enable an individual to safely reside in the <ln numlevel="1" lineno="106" slineno="1-65"/>residential unit as the individual ages by reducing barriers to accessibility, <ln numlevel="1" lineno="107" slineno="1-66"/>improving safety, or supporting independent living; and</amend></subsection></subsection><subsection ssid="14-48" dnum="_-o:ii-i" numlevel="1" lineno="108" slineno="1-67" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="120" style="1" owner="ahaskell" level="1" amendtag="end">requires the homeowner to execute a deed restriction requiring that if the <ln numlevel="1" lineno="109" slineno="1-68"/>homeowner sells the residential unit within five years after the day on which the <ln numlevel="1" lineno="110" slineno="1-69"/>homeowner first receives funds under the program, the homeowner must sell the <ln numlevel="1" lineno="111" slineno="1-70"/>residential unit to an owner-occupant buyer.</amend></subsection></subsection></subsection><subsection ssid="14-29" dnum="_-o:9-i" numlevel="1" lineno="112" slineno="1-71" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">"Qualified project" means:</amend><subsection ssid="14-39" dnum="_-o:a-i" numlevel="1" lineno="113" slineno="1-72" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">acquisition of or new construction, including infrastructure, of a housing <ln numlevel="1" lineno="114" slineno="1-73"/>development project in the state for which the developer:</amend><subsection ssid="14-30" dnum="_-o:i-i" numlevel="1" lineno="115" slineno="1-74" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">commits to:</amend><subsection ssid="14-31" dnum="_-o:A-i" numlevel="1" lineno="116" slineno="1-75" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">offering for sale no fewer than 60% of the total units within the project as <ln numlevel="1" lineno="117" slineno="1-76"/>attainable homes;</amend></subsection><subsection ssid="14-32" dnum="_-o:B-i" numlevel="1" lineno="118" slineno="1-77" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">including in the deed of sale for an attainable home a restriction, in favor of <ln numlevel="1" lineno="119" slineno="1-78"/>the political subdivision, that the attainable home be owner-occupied for no <ln numlevel="1" lineno="120" slineno="1-79"/>fewer than five years; and</amend></subsection><subsection ssid="14-33" dnum="_-o:C-i" numlevel="1" lineno="121" slineno="1-80" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">having a plan to provide information to potential buyers of attainable homes <ln numlevel="1" lineno="122" slineno="1-81"/>about the First-Time Homebuyer Assistance Program created in Section <xref depth="3" refnumber="63H-8-502"><ln numlevel="1" lineno="123" slineno="1-82"/>63H-8-502</xref>; and</amend></subsection></subsection><subsection ssid="14-34" dnum="_-o:ii-i" numlevel="1" lineno="124" slineno="1-83" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="31" style="1" owner="ahaskell" level="1" amendtag="end">executes a valid agreement with the political subdivision or the Utah Housing <ln numlevel="1" lineno="125" slineno="1-84"/>Corporation to develop housing meeting the requirements of Subsections <xref depth="4" refnumber="51-12-101(9)(a)(i)(a)"><ln numlevel="1" lineno="126" slineno="1-85"/>(9)(a)(i)(A)</xref> and <xref depth="4" refnumber="51-12-101(b)">(B)</xref>; or</amend></subsection></subsection><subsection ssid="14-40" dnum="_-o:b-i" numlevel="1" lineno="127" slineno="1-86" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">a qualified municipal project.</amend></subsection></subsection><subsection ssid="14-49" dnum="_-o:10-i" numlevel="1" lineno="128" slineno="1-87" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="151" style="1" owner="ahaskell" level="1" amendtag="end">"Qualifying city" means:</amend><subsection ssid="14-50" dnum="_-o:a-i" numlevel="1" lineno="129" slineno="1-88" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="152" style="1" owner="ahaskell" level="1" amendtag="end">a city of the first class or a city of the second class; or</amend></subsection><subsection ssid="14-51" dnum="_-o:b-i" numlevel="1" lineno="130" slineno="1-89" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="192" groupid="154" style="1" owner="ahaskell" level="1" amendtag="end">a municipality with an eligible shelter described in Subsection <xref depth="4" refnumber="35A-16-401(5)(a)">35A-16-401(5)(a)</xref> Reporting.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="134" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The state treasurer shall share the information reported in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="19" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="51-12-202"><ln numlevel="1" lineno="135" slineno="2-4"/>51-12-202</xref>(2)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="51-12-202(2)(c)">51-12-202(2)(c)</xref></amend> with the governor's office.</subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="136" slineno="2-5" level="1"><display>(2)</display>Before December 31 of each year, the state treasurer and the governor's office or the <ln numlevel="1" lineno="137" slineno="2-6"/>governor's office's designee shall report to the Legislative Management Committee:<subsection ssid="4-null-3" dnum="a-o" numlevel="1" lineno="138" slineno="2-7" level="2"><display>(a)</display>the dollar amount of deposits and the number of qualified depositories in which a <ln numlevel="1" lineno="139" slineno="2-8"/>deposit is made in accordance with Part 2, Investment Program;</subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="140" slineno="2-9" level="2"><display>(b)</display>the information reported in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="51-12-202">51-12-202</xref>(2)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="51-12-202(2)(c)"><ln numlevel="1" lineno="141" slineno="2-10"/>51-12-202(2)(c)</xref></amend>; and</subsection><subsection ssid="4-null-5" dnum="c-o" numlevel="1" lineno="142" slineno="2-11" level="2"><display>(c)</display>the impact of the Utah Homes Investment Program on the availability of housing in <ln numlevel="1" lineno="143" slineno="2-12"/>the state.</subsection></subsection><subsection ssid="4-6" dnum="_-o:3-i" numlevel="1" lineno="144" slineno="2-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="4-7" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">Beginning after June 30, 2028, the state treasurer shall conduct a study that <ln numlevel="1" lineno="145" slineno="2-14"/>analyzes whether the lending activity under the Utah Homes Investment Program <ln numlevel="1" lineno="146" slineno="2-15"/>resulted in measurable local economic benefits.</amend></subsection><subsection ssid="4-9" dnum="_-o:b-i" numlevel="1" lineno="147" slineno="2-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="ahaskell" level="1" amendtag="end">On or before October 1, 2028, the state treasurer shall submit a report summarizing <ln numlevel="1" lineno="148" slineno="2-17"/>the results of the study to the Legislative Management Committee and the governor.</amend></subsection><subsection ssid="4-8" dnum="_-o:c-i" numlevel="1" lineno="149" slineno="2-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">The state treasurer may contract with a third party to complete the study and report <ln numlevel="1" lineno="150" slineno="2-19"/>described in this Subsection <xref depth="4" refnumber="51-12-102(3)">(3)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="6" num="51-12-202" type="amend" src="code" uid="C51-12-S202_2026050620260506" sort="51 12 02020020260506" numlevel="1" lineno="151" slineno="3-1" sn="3"><section number="51-12-202" numlevel="1" lineno="152" slineno="3-2" type="amend"><secline lineno="151">Section 3. Terms of deposit.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="153" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>The state treasurer shall enter into a deposit agreement with an approved qualified <ln numlevel="1" lineno="154" slineno="3-4"/>depository in accordance with Section <xref depth="3" refnumber="51-12-201">51-12-201</xref>.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="155" slineno="3-5" level="1"><display>(2)</display>The deposit agreement shall provide that the qualified depository:<subsection ssid="6-null-3" dnum="a-o:_-i" numlevel="1" lineno="156" slineno="3-6" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="ahaskell" level="1" deltag="end">shall offer loan financing to a developer or city of the first or second class of a <ln numlevel="1" lineno="157" slineno="3-7"/>qualified project at a rate no higher than 150 basis points above the federal funds <ln numlevel="1" lineno="158" slineno="3-8"/>effective rate at the time of the deposit;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-4" dnum="b-o:a-i" numlevel="1" lineno="159" slineno="3-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>shall return the amount of deposit:<subsection ssid="6-null-5" dnum="i-o" numlevel="1" lineno="160" slineno="3-10" level="3"><display>(i)</display>with interest at a rate equal to the greater of:<subsection ssid="6-null-6" dnum="A-o" numlevel="1" lineno="161" slineno="3-11" level="4"><display>(A)</display>the federal funds effective rate at the time of the deposit minus 200 basis <ln numlevel="1" lineno="162" slineno="3-12"/>points; or</subsection><subsection ssid="6-null-7" dnum="B-o" numlevel="1" lineno="163" slineno="3-13" level="4"><display>(B)</display>0.5%; and</subsection></subsection><subsection ssid="6-null-8" dnum="ii-o" numlevel="1" lineno="164" slineno="3-14" level="3"><display>(ii)</display>at the earlier of:<subsection ssid="6-null-9" dnum="A-o" numlevel="1" lineno="165" slineno="3-15" level="4"><display>(A)</display>24 months from the day on which the deposit is made;</subsection><subsection ssid="6-null-10" dnum="B-o" numlevel="1" lineno="166" slineno="3-16" level="4"><display>(B)</display>repayment of the loan financing;</subsection><subsection ssid="6-null-11" dnum="C-o" numlevel="1" lineno="167" slineno="3-17" level="4"><display>(C)</display>the sale of the last home in the qualified project; or</subsection><subsection ssid="6-null-12" dnum="D-o" numlevel="1" lineno="168" slineno="3-18" level="4"><display>(D)</display>June 30, 2028;</subsection></subsection></subsection><subsection ssid="6-null-13" dnum="c-o:b-i" numlevel="1" lineno="169" slineno="3-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>is responsible for return of the amount of the deposit with accrued interest <ln numlevel="1" lineno="170" slineno="3-20"/>regardless of the completion of the qualified project or the repayment of the qualified <ln numlevel="1" lineno="171" slineno="3-21"/>depository's loan to the developer or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="ahaskell" level="1" deltag="both">city of the first or second class</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both" space="true">qualifying city</amend> <ln numlevel="1" lineno="172" slineno="3-22"/>of the qualified project; and</subsection><subsection ssid="6-null-14" dnum="d-o:c-i" numlevel="1" lineno="173" slineno="3-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>shall report to the state treasurer the total number of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="ahaskell" level="1" deltag="both">housing</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both" space="true">residential</amend> units <ln numlevel="1" lineno="174" slineno="3-24"/>and the number of attainable homes each qualified project created.</subsection></subsection><subsection ssid="6-null-15" dnum="3-o" numlevel="1" lineno="175" slineno="3-25" level="1" space="false"><display>(3)</display><subsection ssid="6-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the provisions of Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="ahaskell" level="1" deltag="both"><xref tempid="622" depth="4" refnumber="51-12-202(2)(b)(ii)">(2)(b)(ii)</xref> and (2)(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(2)(a)(ii) and <ln numlevel="1" lineno="176" slineno="3-26"/>(2)(b)</amend>, for a deposit made to the Utah Housing Corporation, the Utah Housing <ln numlevel="1" lineno="177" slineno="3-27"/>Corporation shall return the amount of the deposit with accrued interest when the <ln numlevel="1" lineno="178" slineno="3-28"/>Utah Housing Corporation has received:<subsection ssid="6-null-17" dnum="i-o" numlevel="1" lineno="179" slineno="3-29" level="3" tab="1"><display>(i)</display>repayment of the loan financing; or</subsection><subsection ssid="6-null-18" dnum="ii-o" numlevel="1" lineno="180" slineno="3-30" level="3" tab="1"><display>(ii)</display>proceeds from the sale or other disposition of the homes in the qualified project.</subsection></subsection><subsection ssid="6-null-19" dnum="b-o" numlevel="1" lineno="181" slineno="3-31" level="2"><display>(b)</display>The Utah Housing Corporation may return the deposit later than the time period <ln numlevel="1" lineno="182" slineno="3-32"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="51-12-202(2)(a)(ii)(a)">(2)(b)(ii)(A) or (D)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(2)(a)(ii)(A) or <xref depth="4" refnumber="51-12-202(d)">(D)</xref></amend> without penalty.</subsection></subsection><subsection ssid="6-null-20" dnum="4-o" numlevel="1" lineno="183" slineno="3-33" level="1"><display>(4)</display>A qualified depository may return the deposit earlier than the time period described in <ln numlevel="1" lineno="184" slineno="3-34"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="51-12-202(2)(a)(ii)">(2)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(2)(a)(ii)</amend> without penalty.</subsection><subsection ssid="6-null-21" dnum="5-o" numlevel="1" lineno="185" slineno="3-35" level="1"><display>(5)</display>The state treasurer shall deposit the return of the amount of the deposit, including <ln numlevel="1" lineno="186" slineno="3-36"/>interest, into the fund.</subsection></section></bsec><bsec buid="16" num="51-12-203" type="amend" src="code" uid="C51-12-S203_2026050620260506" sort="51 12 02030020260506" numlevel="1" lineno="187" slineno="4-1" sn="4"><section number="51-12-203" numlevel="1" lineno="188" slineno="4-2" type="amend"><secline lineno="187">Section 4.
