Section <bold>41-6a-1119</bold> is amended to read:</secline><catline lineno="40"><bold>41-6a-1119<parens/>. Personal delivery device.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="41" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="17-null-2" dnum="a-o" numlevel="1" lineno="42" slineno="1-4" level="2"><display>(a)</display>"Eligible entity" means a corporation, partnership, association, firm, sole <ln numlevel="1" lineno="43" slineno="1-5"/>proprietorship, or other entity engaged in a business that includes the operation of a <ln numlevel="1" lineno="44" slineno="1-6"/>personal delivery device.</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="45" slineno="1-7" level="2"><display>(b)</display>"Main-traveled way" means the same as that term is defined in Section <xref depth="3" refnumber="72-7-502" start="0">72-7-502</xref>.</subsection><subsection ssid="17-null-4" dnum="c-o" numlevel="1" lineno="46" slineno="1-8" level="2"><display>(c)</display>"Pedestrian area" means a sidewalk, crosswalk, school crosswalk, school crossing <ln numlevel="1" lineno="47" slineno="1-9"/>zone, or safety zone.</subsection><subsection ssid="17-null-5" dnum="d-o" numlevel="1" lineno="48" slineno="1-10" level="2" space="false"><display>(d)</display><subsection ssid="17-null-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Personal delivery device" means an electrically powered device to which all of <ln numlevel="1" lineno="49" slineno="1-11"/>the following apply:<subsection ssid="17-null-7" dnum="A-o" numlevel="1" lineno="50" slineno="1-12" level="4" tab="1"><display>(A)</display>the device is manufactured for transporting cargo and goods; and</subsection><subsection ssid="17-null-8" dnum="B-o" numlevel="1" lineno="51" slineno="1-13" level="4" tab="1"><display>(B)</display>the device is equipped with automated driving technology, including hardware <ln numlevel="1" lineno="52" slineno="1-14"/>and software, that enables the operation of the device with or without active <ln numlevel="1" lineno="53" slineno="1-15"/>control or monitoring by a person.</subsection></subsection><subsection ssid="17-null-9" dnum="ii-o" numlevel="1" lineno="54" slineno="1-16" level="3"><display>(ii)</display>A mobile carrier as defined in Section <xref depth="3" refnumber="41-6a-1120" start="0">41-6a-1120</xref> is not a personal delivery <ln numlevel="1" lineno="55" slineno="1-17"/>device.</subsection><subsection ssid="17-null-10" dnum="iii-o" numlevel="1" lineno="56" slineno="1-18" level="3"><display>(iii)</display>"Personal delivery device" does not include:<subsection ssid="17-null-11" dnum="A-o" numlevel="1" lineno="57" slineno="1-19" level="4"><display>(A)</display>a motor vehicle; or</subsection><subsection ssid="17-null-12" dnum="B-o" numlevel="1" lineno="58" slineno="1-20" level="4"><display>(B)</display>an <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">ADS-dedicated</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">ADS-equipped</amend> vehicle as that term is defined in Section <xref depth="3" refnumber="41-26-102.1" start="0"><ln numlevel="1" lineno="59" slineno="1-21"/>41-26-102.1</xref>.</subsection></subsection></subsection><subsection ssid="17-null-13" dnum="e-o" numlevel="1" lineno="60" slineno="1-22" level="2" space="false"><display>(e)</display><subsection ssid="17-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Personal delivery device operator" means an employee or agent of an eligible <ln numlevel="1" lineno="61" slineno="1-23"/>entity who exercises active physical control over, or monitoring of, the navigation <ln numlevel="1" lineno="62" slineno="1-24"/>and operation of a personal delivery device.</subsection><subsection ssid="17-null-15" dnum="ii-o" numlevel="1" lineno="63" slineno="1-25" level="3"><display>(ii)</display>"Personal delivery device operator" does not include:<subsection ssid="17-null-16" dnum="A-o" numlevel="1" lineno="64" slineno="1-26" level="4"><display>(A)</display>with respect to a delivery or other service rendered by a personal delivery <ln numlevel="1" lineno="65" slineno="1-27"/>device, the person who requests the delivery or service; or</subsection><subsection ssid="17-null-17" dnum="B-o" numlevel="1" lineno="66" slineno="1-28" level="4"><display>(B)</display>a person who only arranges for and dispatches a personal delivery device for a <ln numlevel="1" lineno="67" slineno="1-29"/>delivery or other service.</subsection></subsection></subsection></subsection><subsection ssid="17-null-18" dnum="2-o" numlevel="1" lineno="68" slineno="1-30" level="1"><display>(2)</display>An eligible entity may operate a personal delivery device so long as all of the following <ln numlevel="1" lineno="69" slineno="1-31"/>requirements are met:<subsection ssid="17-null-19" dnum="a-o" numlevel="1" lineno="70" slineno="1-32" level="2"><display>(a)</display>the personal delivery device is operated at a maximum speed of:<subsection ssid="17-null-20" dnum="i-o" numlevel="1" lineno="71" slineno="1-33" level="3"><display>(i)</display>10 miles per hour when in a pedestrian area; or</subsection><subsection ssid="17-null-21" dnum="ii-o" numlevel="1" lineno="72" slineno="1-34" level="3"><display>(ii)</display>20 miles per hour on a highway in an area that is not a pedestrian area;</subsection></subsection><subsection ssid="17-null-22" dnum="b-o" numlevel="1" lineno="73" slineno="1-35" level="2"><display>(b)</display>the eligible entity maintains an insurance policy that includes general liability <ln numlevel="1" lineno="74" slineno="1-36"/>coverage of not less than $100,000 for damages arising from the operation of the <ln numlevel="1" lineno="75" slineno="1-37"/>personal delivery device by the eligible entity and any agent of the eligible entity; and</subsection><subsection ssid="17-null-23" dnum="c-o" numlevel="1" lineno="76" slineno="1-38" level="2"><display>(c)</display>the personal delivery device is equipped with all of the following:<subsection ssid="17-null-24" dnum="i-o" numlevel="1" lineno="77" slineno="1-39" level="3"><display>(i)</display>a marker that clearly identifies the name and contact information of the eligible <ln numlevel="1" lineno="78" slineno="1-40"/>entity operating the personal delivery device and a unique identification number;</subsection><subsection ssid="17-null-25" dnum="ii-o" numlevel="1" lineno="79" slineno="1-41" level="3"><display>(ii)</display>a braking system that enables the personal delivery device to come to a controlled <ln numlevel="1" lineno="80" slineno="1-42"/>stop; and</subsection><subsection ssid="17-null-26" dnum="iii-o" numlevel="1" lineno="81" slineno="1-43" level="3"><display>(iii)</display>if the personal delivery device is being operated between sunset and sunrise, a <ln numlevel="1" lineno="82" slineno="1-44"/>light on both the front and rear of the personal delivery device that is visible on all <ln numlevel="1" lineno="83" slineno="1-45"/>sides of the personal delivery device in clear weather from a distance of at least <ln numlevel="1" lineno="84" slineno="1-46"/>500 feet to the front and rear of the personal delivery device when directly in front <ln numlevel="1" lineno="85" slineno="1-47"/>of low beams of headlights on a motor vehicle.</subsection></subsection></subsection><subsection ssid="17-null-27" dnum="3-o" numlevel="1" lineno="86" slineno="1-48" level="1"><display>(3)</display>A personal delivery device operator may not allow a personal delivery device to do any <ln numlevel="1" lineno="87" slineno="1-49"/>of the following:<subsection ssid="17-null-28" dnum="a-o" numlevel="1" lineno="88" slineno="1-50" level="2"><display>(a)</display>fail to comply with traffic or pedestrian control devices and signals;</subsection><subsection ssid="17-null-29" dnum="b-o" numlevel="1" lineno="89" slineno="1-51" level="2"><display>(b)</display>unreasonably interfere with pedestrians or traffic; or</subsection><subsection ssid="17-null-30" dnum="c-o" numlevel="1" lineno="90" slineno="1-52" level="2"><display>(c)</display>transport hazardous material that is:<subsection ssid="17-null-31" dnum="i-o" numlevel="1" lineno="91" slineno="1-53" level="3"><display>(i)</display>regulated under 49 U.S.C. Chapter 51, Transportation of Hazardous Material; and</subsection><subsection ssid="17-null-32" dnum="ii-o" numlevel="1" lineno="92" slineno="1-54" level="3"><display>(ii)</display>required to be placarded under 49 C.F.R., Part 172, Subpart F, Placarding.</subsection></subsection></subsection><subsection ssid="17-null-33" dnum="4-o" numlevel="1" lineno="93" slineno="1-55" level="1" space="false"><display>(4)</display><subsection ssid="17-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When operating on a highway, the personal delivery device:<subsection ssid="17-null-35" dnum="i-o" numlevel="1" lineno="94" slineno="1-56" level="3" tab="1"><display>(i)</display>shall operate as close as practicable to the edge of the highway in the direction of <ln numlevel="1" lineno="95" slineno="1-57"/>authorized traffic movement; and</subsection><subsection ssid="17-null-36" dnum="ii-o" numlevel="1" lineno="96" slineno="1-58" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="41-6a-1119(4)(b)" start="0">(4)(b)</xref>, may not travel in the main-traveled way.</subsection></subsection><subsection ssid="17-null-37" dnum="b-o" numlevel="1" lineno="97" slineno="1-59" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="41-6a-1119(4)(a)" start="0">(4)(a)</xref>, a personal delivery device:<subsection ssid="17-null-38" dnum="i-o" numlevel="1" lineno="98" slineno="1-60" level="3"><display>(i)</display>if practical and with due regard for safety and traffic conditions may temporarily <ln numlevel="1" lineno="99" slineno="1-61"/>operate in the main-traveled way to avoid a parked car or other obstacle on the <ln numlevel="1" lineno="100" slineno="1-62"/>edge of the highway; and</subsection><subsection ssid="17-null-39" dnum="ii-o" numlevel="1" lineno="101" slineno="1-63" level="3"><display>(ii)</display>shall return to the edge of the highway as described in Subsection <xref depth="4" refnumber="41-6a-1119(4)(a)" start="0">(4)(a)</xref> as soon <ln numlevel="1" lineno="102" slineno="1-64"/>as conditions allow.</subsection></subsection><subsection ssid="17-null-40" dnum="c-o" numlevel="1" lineno="103" slineno="1-65" level="2"><display>(c)</display>Notwithstanding Subsections <xref depth="4" refnumber="41-6a-1119(4)(a)" start="0">(4)(a)</xref> and <xref depth="4" refnumber="41-6a-1119(4)(b)" start="0">(b)</xref>, a personal delivery device may not <ln numlevel="1" lineno="104" slineno="1-66"/>operate on a:<subsection ssid="17-null-41" dnum="i-o" numlevel="1" lineno="105" slineno="1-67" level="3"><display>(i)</display>highway with a speed limit of 45 miles per hour or higher; or</subsection><subsection ssid="17-null-42" dnum="ii-o" numlevel="1" lineno="106" slineno="1-68" level="3"><display>(ii)</display>limited access highway.</subsection></subsection></subsection><subsection ssid="17-null-43" dnum="5-o" numlevel="1" lineno="107" slineno="1-69" level="1"><display>(5)</display>A personal delivery device has the rights and obligations applicable to a pedestrian <ln numlevel="1" lineno="108" slineno="1-70"/>under the same circumstances, except that a personal delivery device shall yield the <ln numlevel="1" lineno="109" slineno="1-71"/>right-of-way to a pedestrian.</subsection><subsection ssid="17-null-44" dnum="6-o" numlevel="1" lineno="110" slineno="1-72" level="1"><display>(6)</display>A person may not operate a personal delivery device unless the person complies with <ln numlevel="1" lineno="111" slineno="1-73"/>this section.</subsection><subsection ssid="17-null-45" dnum="7-o" numlevel="1" lineno="112" slineno="1-74" level="1"><display>(7)</display>An eligible entity is responsible for both of the following:<subsection ssid="17-null-46" dnum="a-o" numlevel="1" lineno="113" slineno="1-75" level="2"><display>(a)</display>a violation of this section that is committed by a personal delivery device operator <ln numlevel="1" lineno="114" slineno="1-76"/>operated for the benefit of the eligible entity; and</subsection><subsection ssid="17-null-47" dnum="b-o" numlevel="1" lineno="115" slineno="1-77" level="2"><display>(b)</display>any other circumstance, including a technological malfunction, in which a personal <ln numlevel="1" lineno="116" slineno="1-78"/>delivery device operates in a manner prohibited by Subsection <xref depth="4" refnumber="41-6a-1119(3)" start="0">(3)</xref>.</subsection></subsection><subsection ssid="17-null-48" dnum="8-o" numlevel="1" lineno="117" slineno="1-79" level="1" space="false"><display>(8)</display><subsection ssid="17-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Following discussions with and input from eligible entities, a local authority or <ln numlevel="1" lineno="118" slineno="1-80"/>political subdivision may reasonably regulate the operation of personal delivery <ln numlevel="1" lineno="119" slineno="1-81"/>devices on a highway or pedestrian area.</subsection><subsection ssid="17-null-50" dnum="b-o" numlevel="1" lineno="120" slineno="1-82" level="2"><display>(b)</display>This section does not affect the authority of a peace officer of a local authority or <ln numlevel="1" lineno="121" slineno="1-83"/>political subdivision to enforce the laws of this state relating to the operation of a <ln numlevel="1" lineno="122" slineno="1-84"/>personal delivery device.</subsection></subsection><subsection ssid="17-null-51" dnum="9-o" numlevel="1" lineno="123" slineno="1-85" level="1"><display>(9)</display>A violation of this section is an infraction.</subsection></section></bsec><bsec buid="4" num="41-26-102.1" type="amend" src="code" uid="C41-26-S102.1_2026050620260506" sort="41 26 01020120260506" numlevel="1" lineno="124" slineno="2-1" sn="2"><section number="41-26-102.1" numlevel="1" lineno="125" slineno="2-2" type="amend"><secline lineno="124">Section 2. ssid="4-72" dnum="_-o:i-i" numlevel="1" lineno="127" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>designed to be operated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="108" groupid="80" style="2" owner="jchristopherson" level="1" deltag="both">exclusively </amend><amendoutend style="2"/>by a level four <amend anum="0" ea="amend" pairid="106" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both">ADS </amend>or <amend anum="0" ea="amend" pairid="107" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both">level </amend>five ADS for <ln numlevel="1" lineno="128" slineno="2-5"/>all trips within the given operational design domain limitations of the ADS, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" owner="jchristopherson" level="1" amendtag="end">that conforms to all applicable U.S. federal motor vehicle safety, bumper, and <ln numlevel="1" lineno="131" slineno="2-8"/>theft prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection></subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="132" slineno="2-9" level="1" space="false"><display>(2)</display><subsection ssid="4-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Automated driving system" or "ADS" means the hardware and software that are<amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="4-85" dnum="_-o:i-i" numlevel="1" lineno="133" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>collectively capable of performing the entire dynamic driving task on a sustained <ln numlevel="1" lineno="134" slineno="2-11"/>basis, regardless of whether the ADS is limited to a specific operational design <ln numlevel="1" lineno="135" slineno="2-12"/>domain, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="4-88" dnum="_-o:ii-i" numlevel="1" lineno="136" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">that conforms to all applicable U.S. federal motor vehicle safety, bumper, and <ln numlevel="1" lineno="137" slineno="2-14"/>theft prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="138" slineno="2-15" level="2"><display>(b)</display>"Automated driving system" or "ADS" is used specifically to describe a level three, <ln numlevel="1" lineno="139" slineno="2-16"/>four, or five driving automation system.</subsection></subsection><subsection ssid="4-null-5" dnum="3-o" numlevel="1" lineno="140" slineno="2-17" level="1"><display>(3)</display>"Commission" means the State Tax Commission as defined in Section <xref depth="3" refnumber="59-1-101" start="0">59-1-101</xref>.</subsection><subsection ssid="4-null-6" dnum="4-o" numlevel="1" lineno="141" slineno="2-18" level="1"><display>(4)</display>"Conventional driver" means a human driver who is onboard the motor vehicle and <ln numlevel="1" lineno="142" slineno="2-19"/>manually performs some or all of the following actions in order to operate a vehicle:<subsection ssid="4-null-7" dnum="a-o" numlevel="1" lineno="143" slineno="2-20" level="2"><display>(a)</display>braking;</subsection><subsection ssid="4-null-8" dnum="b-o" numlevel="1" lineno="144" slineno="2-21" level="2"><display>(b)</display>accelerating;</subsection><subsection ssid="4-null-9" dnum="c-o" numlevel="1" lineno="145" slineno="2-22" level="2"><display>(c)</display>steering; and</subsection><subsection ssid="4-null-10" dnum="d-o" numlevel="1" lineno="146" slineno="2-23" level="2"><display>(d)</display>transmission gear selection input devices.</subsection></subsection><subsection ssid="4-null-11" dnum="5-o" numlevel="1" lineno="147" slineno="2-24" level="1" space="false"><display>(5)</display><subsection ssid="4-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dispatch" means to place an ADS-equipped vehicle into service in driverless <ln numlevel="1" lineno="148" slineno="2-25"/>operation by engaging the ADS.</subsection><subsection ssid="4-null-13" dnum="b-o" numlevel="1" lineno="149" slineno="2-26" level="2"><display>(b)</display>"Dispatch" includes software-enabled dispatch of multiple ADS-equipped motor <ln numlevel="1" lineno="150" slineno="2-27"/>vehicles in driverless operation that may complete multiple trips involving pick-up <ln numlevel="1" lineno="151" slineno="2-28"/>and drop-off of passengers or goods throughout a day or other pre-defined periods of <ln numlevel="1" lineno="152" slineno="2-29"/>service, and which may involve multiple agents performing various tasks related to <ln numlevel="1" lineno="153" slineno="2-30"/>the dispatch function.</subsection></subsection><subsection ssid="4-null-14" dnum="6-o" numlevel="1" lineno="154" slineno="2-31" level="1"><display>(6)</display>"Division" means the Motor Vehicle Division of the commission, created in Section <xref depth="3" refnumber="41-1a-106" start="0"><ln numlevel="1" lineno="155" slineno="2-32"/>41-1a-106</xref>.</subsection><subsection ssid="4-null-15" dnum="7-o" numlevel="1" lineno="156" slineno="2-33" level="1"><display>(7)</display>"Driverless operation" means the operation of an ADS-equipped vehicle in which:<subsection ssid="4-null-16" dnum="a-o" numlevel="1" lineno="157" slineno="2-34" level="2"><display>(a)</display>no on-board user is present; or</subsection><subsection ssid="4-null-17" dnum="b-o" numlevel="1" lineno="158" slineno="2-35" level="2"><display>(b)</display>no on-board user is a human driver with a valid driver license or fallback-ready user.</subsection></subsection><subsection ssid="4-null-18" dnum="8-o" numlevel="1" lineno="159" slineno="2-36" level="1"><display>(8)</display>"Driverless operation dispatcher" means a user who dispatches an ADS-equipped <ln numlevel="1" lineno="160" slineno="2-37"/>vehicle in driverless operation.</subsection><subsection ssid="4-null-19" dnum="9-o" numlevel="1" lineno="161" slineno="2-38" level="1"><display>(9)</display>"Driving automation system" means the hardware and software collectively capable of <ln numlevel="1" lineno="162" slineno="2-39"/>performing part or all of the dynamic driving task on a sustained basis.</subsection><subsection ssid="4-null-20" dnum="10-o" numlevel="1" lineno="163" slineno="2-40" level="1"><display>(10)</display>"Driving automation system feature" means a specific function of a driving automation <ln numlevel="1" lineno="164" slineno="2-41"/>system.</subsection><subsection ssid="4-null-21" dnum="11-o" numlevel="1" lineno="165" slineno="2-42" level="1" space="false"><display>(11)</display><subsection ssid="4-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dynamic driving task" means all of the real-time operational and tactical <ln numlevel="1" lineno="166" slineno="2-43"/>functions required to operate a motor vehicle in on-road traffic, including:<subsection ssid="4-null-23" dnum="i-o" numlevel="1" lineno="167" slineno="2-44" level="3" tab="1"><display>(i)</display>lateral vehicle motion control through steering;</subsection><subsection ssid="4-null-24" dnum="ii-o" numlevel="1" lineno="168" slineno="2-45" level="3" tab="1"><display>(ii)</display>longitudinal motion control through acceleration and deceleration;</subsection><subsection ssid="4-null-25" dnum="iii-o" numlevel="1" lineno="169" slineno="2-46" level="3" tab="1"><display>(iii)</display>monitoring the driving environment through object and event detection, <ln numlevel="1" lineno="170" slineno="2-47"/>recognition, classification, and response preparation;</subsection><subsection ssid="4-null-26" dnum="iv-o" numlevel="1" lineno="171" slineno="2-48" level="3" tab="1"><display>(iv)</display>object and event response execution;</subsection><subsection ssid="4-null-27" dnum="v-o" numlevel="1" lineno="172" slineno="2-49" level="3" tab="1"><display>(v)</display>maneuver planning; and</subsection><subsection ssid="4-null-28" dnum="vi-o" numlevel="1" lineno="173" slineno="2-50" level="3" tab="1"><display>(vi)</display>enhancing conspicuity with lighting, signaling, and gesturing.</subsection></subsection><subsection ssid="4-null-29" dnum="b-o" numlevel="1" lineno="174" slineno="2-51" level="2"><display>(b)</display>"Dynamic driving task" does not include strategic functions such as trip scheduling <ln numlevel="1" lineno="175" slineno="2-52"/>and selection of destinations and waypoints.</subsection></subsection><subsection ssid="4-null-30" dnum="12-o" numlevel="1" lineno="176" slineno="2-53" level="1"><display>(12)</display>"Engage" as it pertains to the operation of a vehicle by a driving automation system <ln numlevel="1" lineno="177" slineno="2-54"/>means to cause a driving automation system feature to perform part or all of the dynamic <ln numlevel="1" lineno="178" slineno="2-55"/>driving task on a sustained basis.</subsection><subsection ssid="4-null-31" dnum="13-o" numlevel="1" lineno="179" slineno="2-56" level="1"><display>(13)</display>"External event" is a situation in the driving environment that necessitates a response <ln numlevel="1" lineno="180" slineno="2-57"/>by a human driver with a valid driver license or driving automation system.</subsection><subsection ssid="4-null-32" dnum="14-o" numlevel="1" lineno="181" slineno="2-58" level="1"><display>(14)</display>"Fallback-ready user" means the user of a vehicle equipped with an engaged level <ln numlevel="1" lineno="182" slineno="2-59"/>three ADS who is:<subsection ssid="4-null-33" dnum="a-o" numlevel="1" lineno="183" slineno="2-60" level="2"><display>(a)</display>a human driver with a valid driver license; and</subsection><subsection ssid="4-null-34" dnum="b-o" numlevel="1" lineno="184" slineno="2-61" level="2"><display>(b)</display>ready to operate the vehicle if:<subsection ssid="4-null-35" dnum="i-o" numlevel="1" lineno="185" slineno="2-62" level="3"><display>(i)</display>a system failure occurs; or</subsection><subsection ssid="4-null-36" dnum="ii-o" numlevel="1" lineno="186" slineno="2-63" level="3"><display>(ii)</display>the ADS issues a request to intervene.</subsection></subsection></subsection><subsection ssid="4-null-37" dnum="15-o" numlevel="1" lineno="187" slineno="2-64" level="1" space="false"><display>(15)</display><subsection ssid="4-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Human driver" means a natural person who performs in real-time all or part of <ln numlevel="1" lineno="188" slineno="2-65"/>the dynamic driving task.</subsection><subsection ssid="4-null-39" dnum="b-o" numlevel="1" lineno="189" slineno="2-66" level="2"><display>(b)</display>"Human driver" includes a:<subsection ssid="4-null-40" dnum="i-o" numlevel="1" lineno="190" slineno="2-67" level="3"><display>(i)</display>conventional driver; and</subsection><subsection ssid="4-null-41" dnum="ii-o" numlevel="1" lineno="191" slineno="2-68" level="3"><display>(ii)</display>remote driver.</subsection></subsection></subsection><subsection ssid="4-null-42" dnum="16-o:_-i" numlevel="1" lineno="192" slineno="2-69" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1097" style="2" owner="o" level="1" deltag="start">(16)</amend></display><amend anum="0" ea="erase" pairid="59" groupid="47" style="2" owner="jchristopherson" level="1" deltag="end">"Level five automated driving system" or "level five ADS" means an ADS feature <ln numlevel="1" lineno="193" slineno="2-70"/>that has the capability to perform on a sustained basis the entire dynamic driving task <ln numlevel="1" lineno="194" slineno="2-71"/>under all conditions that can reasonably be managed by a human driver, as well as any <ln numlevel="1" lineno="195" slineno="2-72"/>maneuvers necessary to respond to a system failure, without any expectation that a <ln numlevel="1" lineno="196" slineno="2-73"/>human user will respond to a request to intervene.</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-43" dnum="17-o:_-i" numlevel="1" lineno="197" slineno="2-74" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1098" style="2" owner="o" level="1" deltag="start">(17)</amend></display><amend anum="0" ea="erase" pairid="70" groupid="53" style="2" owner="jchristopherson" level="1" deltag="end">"Level four automated driving system" or "level four ADS" means an ADS feature <ln numlevel="1" lineno="198" slineno="2-75"/>that, without any expectation that a human user will respond to a request to intervene, <ln numlevel="1" lineno="199" slineno="2-76"/>has:</amend><amendoutend style="2"/><subsection ssid="4-null-44" dnum="a-o:_-i" numlevel="1" lineno="200" slineno="2-77" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart owner="jchristopherson" level="1" deltag="end">the capability to perform on a sustained basis the entire dynamic driving task within <ln numlevel="1" lineno="201" slineno="2-78"/>its operational groupid="55" style="2" owner="jchristopherson" level="1" deltag="end">the capability to perform any maneuvers necessary to achieve a minimal risk <ln numlevel="1" lineno="203" slineno="2-80"/>condition in response to:</amend><amendoutend style="2"/><subsection ssid="4-null-46" dnum="i-o:_-i" numlevel="1" lineno="204" slineno="2-81" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="73" groupid="56" style="2" owner="jchristopherson" level="1" deltag="end">an exit from the operational design domain of the ADS; or</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-47" dnum="ii-o:_-i" numlevel="1" lineno="205" slineno="2-82" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart ssid="4-null-53" dnum="a-o" numlevel="1" lineno="233" slineno="2-110" level="2"><display>(a)</display>monitoring the driving environment; and</subsection><subsection ssid="4-null-54" dnum="b-o" numlevel="1" lineno="234" slineno="2-111" level="2"><display>(b)</display>executing an appropriate response in order to perform the dynamic driving task.</subsection></subsection><subsection ssid="4-null-55" dnum="21-o:22-i" numlevel="1" lineno="235" slineno="2-112" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1114" style="2" owner="o" level="1" numlevel="1" lineno="346" slineno="6-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">the registered owner of the ADS-equipped vehicle; or</amend></subsection><subsection ssid="12-13" dnum="_-o:ii-i" numlevel="1" lineno="347" slineno="6-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">a person that dispatched the ADS-equipped vehicle into driverless operation, <ln numlevel="1" lineno="348" slineno="6-25"/>including a driverless operation dispatcher or an on-demand autonomous vehicle <ln numlevel="1" lineno="349" slineno="6-26"/>network.</amend></subsection></subsection></subsection><subsection ssid="12-14" dnum="_-o:3-i" numlevel="1" lineno="350" slineno="6-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">A plaintiff establishes liability under this section by proving, by a preponderance of the <ln numlevel="1" lineno="351" slineno="6-28"/>evidence, that:</amend><subsection ssid="12-15" dnum="_-o:a-i" numlevel="1" lineno="352" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" the injury or property damage.</amend></subsection></subsection><subsection ssid="12-34" dnum="_-o:4-i" numlevel="1" lineno="354" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" or</amend></subsection><subsection ssid="23-9" dnum="_-o:C-i" numlevel="1" lineno="396" slineno="8-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">failed to timely respond to the request to intervene.</amend></subsection></subsection></subsection><subsection ssid="23-19" dnum="_-o:b-i" numlevel="1" lineno="397" slineno="8-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">In an action for personal injury or property damage arising from the operation of a <ln numlevel="1" lineno="398" slineno="8-17"/>vehicle equipped with a level two DAS, a defendant may assert an affirmative <ln numlevel="1" lineno="399" slineno="8-18"/>defense that the human driver:</amend><subsection ssid="23-20" dnum="_-o:i-i" numlevel="1" lineno="400" slineno="8-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">was inattentive, negligent, or reckless; or</amend></subsection><subsection ssid="23-22" dnum="_-o:ii-i" numlevel="1" lineno="401" slineno="8-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">failed to maintain reasonable vigilance over the operation of the vehicle.</amend></subsection></subsection></subsection><subsection ssid="23-10" dnum="_-o:3-i" numlevel="1" lineno="402" slineno="8-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">An affirmative defense under Subsection <xref depth="4" refnumber="78B-4-905(2)">(2)</xref> is established if the defendant proves, by a <ln numlevel="1" lineno="403" slineno="8-22"/>preponderance of the evidence, that the human driver's conduct described in Subsection <xref depth="4" refnumber="78B-4-905(2)(b)"><ln numlevel="1" lineno="404" slineno="8-23"/>(2)(b)</xref> was a proximate cause of the incident.</amend></subsection><subsection ssid="23-11" dnum="_-o:4-i" numlevel="1" lineno="405" slineno="8-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="78B-4-905(5)">(5)</xref>, nothing in this section:</amend><subsection ssid="23-12" dnum="_-o:a-i" numlevel="1" lineno="406" slineno="8-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">limits the application of comparative fault under Section <xref depth="3" refnumber="78B-5-818">78B-5-818</xref>; or</amend></subsection><subsection ssid="23-14" dnum="_-o:b-i" numlevel="1" lineno="407" slineno="8-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">alters the duties of a human driver imposed under Title 41, Chapter 6a, Traffic Code.</amend></subsection></subsection><subsection ssid="23-23" dnum="_-o:5-i" numlevel="1" lineno="408" slineno="8-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">In an action for personal injury or property damage arising from the operation of a <ln numlevel="1" lineno="409" slineno="8-28"/>vehicle equipped with a level two DAS or level three ADS, the limitations on <ln numlevel="1" lineno="410" slineno="8-29"/>noneconomic and punitive damages outlined in Section <xref depth="3" refnumber="78B-4-902">78B-4-902</xref> apply.</amend></subsection><subsection ssid="23-15" dnum="_-o:6-i" numlevel="1" lineno="411" slineno="8-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not create a new cause of action and may not be construed to expand <ln numlevel="1" lineno="412" slineno="8-31"/>or limit existing theories of liability except as expressly provided in this section.</amend></subsection></section></bsec><bsec buid="8" num="78B-6-702" type="amend" src="code" uid="C78B-6-S702_2026050620260506" sort="78B06 07020020260506" numlevel="1" lineno="413" slineno="9-1" sn="9"><section number="78B-6-702" numlevel="1" lineno="414" slineno="9-2" type="amend"><secline lineno="413">Section 9. Section <bold>78B-6-702</bold> is amended to read:</secline><catline lineno="414"><bold>78B-6-702<parens/>. Definitions.</bold></catline><sectionText lineno="415"><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">As used in this part, "unreasonably dangerous" means that the product was <ln numlevel="1" lineno="416" slineno="9-4"/>dangerous to an extent beyond which would be contemplated by the ordinary and prudent <ln numlevel="1" lineno="417" slineno="9-5"/>buyer, consumer, or user of that product in that community considering the product's <ln numlevel="1" lineno="418" slineno="9-6"/>characteristics, propensities, risks, dangers, and uses together with any actual knowledge, <ln numlevel="1" lineno="419" slineno="9-7"/>training, or experience possessed by that particular buyer, user, or consumer.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="420" slineno="9-8"/>As used in this part:</amend></sectionText><subsection ssid="8-5" dnum="_-o:1-i" numlevel="1" lineno="421" slineno="9-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">"ADS-equipped vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-26-102.1">41-26-102.1</xref>.</amend></subsection><subsection ssid="8-1" dnum="_-o:2-i" numlevel="1" lineno="422" slineno="9-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Automated driving system" means the same as that term is defined in Section <xref depth="3" refnumber="41-26-102.1"><ln numlevel="1" lineno="423" slineno="9-11"/>41-26-102.1</xref>.</amend></subsection><subsection ssid="8-3" dnum="_-o:3-i" numlevel="1" lineno="424" slineno="9-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"State of the art knowledge" means the technical, mechanical, and scientific knowledge <ln numlevel="1" lineno="425" slineno="9-13"/>of manufacturing, designing, testing, or labeling the same or similar products that was in <ln numlevel="1" lineno="426" slineno="9-14"/>existence and reasonably feasible for use at the time of manufacture.</amend></subsection><subsection ssid="8-2" dnum="_-o:4-i" numlevel="1" lineno="427" slineno="9-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"Unreasonably dangerous" means that the product was dangerous to an extent beyond <ln numlevel="1" lineno="428" slineno="9-16"/>which would be contemplated by the ordinary and prudent buyer, consumer, or user of <ln numlevel="1" lineno="429" slineno="9-17"/>that product in that community considering the product's characteristics, propensities, <ln numlevel="1" lineno="430" slineno="9-18"/>risks, dangers, and uses together with any actual knowledge, training, or experience <ln numlevel="1" lineno="431" slineno="9-19"/>possessed by that particular buyer, user, or consumer.</amend></subsection></section></bsec><bsec buid="6" num="78B-6-703" type="amend" src="code" uid="C78B-6-S703_2026050620260506" sort="78B06 07030020260506" numlevel="1" lineno="432" slineno="10-1" sn="10"><section number="78B-6-703" numlevel="1" lineno="433" slineno="10-2" type="amend"><secline lineno="432">Section 10. Section <bold>78B-6-703</bold> is amended to read:</secline><catline lineno="433"><bold>78B-6-703<parens/>. Defect or defective condition making product unreasonably <ln numlevel="1" lineno="434" slineno="10-3"/>dangerous -- Rebuttable presumption.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="435" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>In any action for damages for personal injury, death, or property damage allegedly <ln numlevel="1" lineno="436" slineno="10-5"/>caused by a defect in a product<amend anum="0" ea="amend" pairid="117" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="both"> other than an ADS-equipped vehicle</amend>, a product may not <ln numlevel="1" lineno="437" slineno="10-6"/>be considered to have a defect or to be in a defective condition, unless at the time the <ln numlevel="1" lineno="438" slineno="10-7"/>product was sold by the manufacturer or other initial seller, there was a defect or <ln numlevel="1" lineno="439" slineno="10-8"/>defective condition in the product which made the product unreasonably dangerous to <ln numlevel="1" lineno="440" slineno="10-9"/>the user or consumer.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="441" slineno="10-10" level="1"><display>(2)</display>There is a rebuttable presumption that a product<amend anum="0" ea="amend" pairid="119" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both"> described in Subsection <xref depth="4" refnumber="78B-6-703(1)">(1)</xref></amend> is free from <ln numlevel="1" lineno="442" slineno="10-11"/>any defect or defective condition where the alleged defect in the plans or designs for the <ln numlevel="1" lineno="443" slineno="10-12"/>product or the methods and techniques of manufacturing, inspecting and testing the <ln numlevel="1" lineno="444" slineno="10-13"/>product were in conformity with government standards established for that industry <ln numlevel="1" lineno="445" slineno="10-14"/>which were in existence at the time the plans or designs for the product or the methods <ln numlevel="1" lineno="446" slineno="10-15"/>and techniques of manufacturing, inspecting and testing the product were adopted.</subsection><subsection ssid="6-29" dnum="_-o:3-i" numlevel="1" lineno="447" slineno="10-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">In any action for damages for personal injury, death, or property damage allegedly <ln numlevel="1" lineno="448" slineno="10-17"/>caused by a defect in an ADS-equipped vehicle, the ADS-equipped vehicle may not be <ln numlevel="1" lineno="449" slineno="10-18"/>considered to have a defect or to be in a defective condition, unless the plaintiff proves <ln numlevel="1" lineno="450" slineno="10-19"/>by clear and convincing evidence that:</amend><subsection ssid="6-20" dnum="_-o:a-i" numlevel="1" lineno="451" slineno="10-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">a reasonable and feasible alternative design existed at the time the ADS-equipped <ln numlevel="1" lineno="452" slineno="10-21"/>vehicle was designed and manufactured; and </amend></subsection><subsection ssid="6-24" dnum="_-o:b-i" numlevel="1" lineno="453" slineno="10-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">the use of the automated driving system, at scale and in the aggregate, causes more <ln numlevel="1" lineno="454" slineno="10-23"/>injuries to persons than would be caused by humans performing a similar task, at <ln numlevel="1" lineno="455" slineno="10-24"/>scale and in the aggregate, without an automated driving system.</amend></subsection></subsection><subsection ssid="6-19" dnum="_-o:4-i" numlevel="1" lineno="456" slineno="10-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">There is a rebuttable presumption that an ADS-equipped vehicle is free from any defect <ln numlevel="1" lineno="457" slineno="10-26"/>or defective condition if the automated driving system:</amend><subsection ssid="6-30" dnum="_-o:a-i" numlevel="1" lineno="458" slineno="10-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">conforms to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="459" slineno="10-28"/>prevention standards in effect on the date of the vehicle's manufacture; and</amend></subsection><subsection ssid="6-28" dnum="_-o:b-i" numlevel="1" lineno="460" slineno="10-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">was authorized for use or operation in the state.</amend></subsection></subsection></section></bsec><bsec buid="19" num="78B-6-708" type="enact" src="code" uid="C78B-6-S708_2026050620260506" sort="78B06 07080020260506" numlevel="1" lineno="461" slineno="11-1" sn="11"><section numlevel="1" lineno="462" slineno="11-2" number="78B-6-708" type="enact"><secline lineno="461">Section 11. Section <bold>78B-6-708</bold> is enacted to read:</secline><catline lineno="462"><bold>78B-6-708<parens/>. State of the art affirmative defense against product liability for an <ln numlevel="1" lineno="463" slineno="11-3"/>automated driving system.</bold></catline><sectionText lineno="464"><para/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">In an action based upon defective design, manufacture, or failure to warn related to an <ln numlevel="1" lineno="465" slineno="11-5"/>ADS-equipped vehicle brought against the manufacturer or developer of the automated driving <ln numlevel="1" lineno="466" slineno="11-6"/>system, liability is precluded if:</amend></sectionText><subsection ssid="19-null-9" dnum="_-o:1-i" numlevel="1" lineno="467" slineno="11-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the manufacturer or developer complied with the state of the art knowledge of scientific <ln numlevel="1" lineno="468" slineno="11-8"/>and technical knowledge and other circumstances that existed at the time of <ln numlevel="1" lineno="469" slineno="11-9"/>manufacture; or</amend></subsection><subsection ssid="19-null-10" dnum="_-o:2-i" numlevel="1" lineno="470" slineno="11-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">the automated driving system when deployed reduces injuries to persons, in the <ln numlevel="1" lineno="471" slineno="11-11"/>aggregate, as compared to humans conducting the same activity.</amend></subsection></section></bsec><bsec buid="24" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="472" slineno="12-1" sn="12"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="472">Section 12.  <bold>Effective Date.</bold></secline><sectionText lineno="473"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-12-26 12:19 PM</tm></rev></foot></leg>
