Section <bold>41-26-102.1</bold> is amended to read:</secline><catline lineno="41"><bold>41-26-102.1<parens/>. Definitions.</bold></catline><sectionText lineno="42"><para/><amend anum="0" ea="amend" pairid="131" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this chapter:</amend></sectionText><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="43" slineno="1-4" level="1"><display>(1)</display>"ADS-dedicated vehicle" means a vehicle<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="4-92" dnum="_-o:a-i" numlevel="1" lineno="44" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>designed to be operated exclusively by a level four <amend anum="0" ea="amend" pairid="106" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both">ADS </amend>or <amend anum="0" ea="amend" pairid="107" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both">level </amend>five ADS for all <ln numlevel="1" lineno="45" slineno="1-6"/>trips within the given operational design domain limitations of the ADS, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="4-87" dnum="_-o:b-i" numlevel="1" lineno="46" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">that conforms to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="47" slineno="1-8"/>prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection><subsection ssid="4-93" dnum="_-o:2-i" numlevel="1" lineno="48" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">"ADS-equipped vehicle" means a vehicle with a level three, level four, or level five <ln numlevel="1" lineno="49" slineno="1-10"/>ADS that is designed for:</amend><subsection ssid="4-94" dnum="_-o:a-i" numlevel="1" lineno="50" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">complete trips in driverless operation under routine or normal operating conditions <ln numlevel="1" lineno="51" slineno="1-12"/>within the vehicle's operation design domain; or</amend></subsection><subsection ssid="4-95" dnum="_-o:b-i" numlevel="1" lineno="52" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">operation by an in-vehicle driver.</amend></subsection></subsection><subsection ssid="4-null-2" dnum="2-o:3-i" numlevel="1" lineno="53" slineno="1-14" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display><subsection ssid="4-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Automated driving system" or "ADS" means the hardware and software that <ln numlevel="1" lineno="54" slineno="1-15"/>are<amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="4-85" dnum="_-o:i-i" numlevel="1" lineno="55" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>collectively capable of performing the entire dynamic driving task on a sustained <ln numlevel="1" lineno="56" slineno="1-17"/>basis, regardless of whether the ADS is limited to a specific operational design <ln numlevel="1" lineno="57" slineno="1-18"/>domain, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="4-88" dnum="_-o:ii-i" numlevel="1" lineno="58" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">conforming to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="59" slineno="1-20"/>prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="60" slineno="1-21" level="2"><display>(b)</display>"Automated driving system" or "ADS" is used specifically to describe a level three, <ln numlevel="1" lineno="61" slineno="1-22"/>four, or five driving automation system.</subsection></subsection><subsection ssid="4-null-5" dnum="3-o:4-i" numlevel="1" lineno="62" slineno="1-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Commission" means the State Tax Commission as defined in Section <xref depth="3" refnumber="59-1-101" start="0">59-1-101</xref>.</subsection><subsection ssid="4-null-6" dnum="4-o:5-i" numlevel="1" lineno="63" slineno="1-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Conventional driver" means a human driver who is onboard the motor vehicle and <ln numlevel="1" lineno="64" slineno="1-25"/>manually performs some or all of the following actions in order to operate a vehicle:<subsection ssid="4-null-7" dnum="a-o" numlevel="1" lineno="65" slineno="1-26" level="2"><display>(a)</display>braking;</subsection><subsection ssid="4-null-8" dnum="b-o" numlevel="1" lineno="66" slineno="1-27" level="2"><display>(b)</display>accelerating;</subsection><subsection ssid="4-null-9" dnum="c-o" numlevel="1" lineno="67" slineno="1-28" level="2"><display>(c)</display>steering; and</subsection><subsection ssid="4-null-10" dnum="d-o" numlevel="1" lineno="68" slineno="1-29" level="2"><display>(d)</display>transmission gear selection input devices.</subsection></subsection><subsection ssid="4-null-11" dnum="5-o:6-i" numlevel="1" lineno="69" slineno="1-30" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="4-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dispatch" means to place an ADS-equipped vehicle into service in driverless <ln numlevel="1" lineno="70" slineno="1-31"/>operation by engaging the ADS.</subsection><subsection ssid="4-null-13" dnum="b-o" numlevel="1" lineno="71" slineno="1-32" level="2"><display>(b)</display>"Dispatch" includes software-enabled dispatch of multiple ADS-equipped motor <ln numlevel="1" lineno="72" slineno="1-33"/>vehicles in driverless operation that may complete multiple trips involving pick-up <ln numlevel="1" lineno="73" slineno="1-34"/>and drop-off of passengers or goods throughout a day or other pre-defined periods of <ln numlevel="1" lineno="74" slineno="1-35"/>service, and which may involve multiple agents performing various tasks related to <ln numlevel="1" lineno="75" slineno="1-36"/>the dispatch function.</subsection></subsection><subsection ssid="4-null-14" dnum="6-o:7-i" numlevel="1" lineno="76" slineno="1-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Division" means the Motor Vehicle Division of the commission, created in <ln numlevel="1" lineno="77" slineno="1-38"/>Section <xref depth="3" refnumber="41-1a-106" start="0">41-1a-106</xref>.</subsection><subsection ssid="4-null-15" dnum="7-o:8-i" numlevel="1" lineno="78" slineno="1-39" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Driverless operation" means the operation of an ADS-equipped vehicle in which:<subsection ssid="4-null-16" dnum="a-o" numlevel="1" lineno="79" slineno="1-40" level="2"><display>(a)</display>no on-board user is present; or</subsection><subsection ssid="4-null-17" dnum="b-o" numlevel="1" lineno="80" slineno="1-41" level="2"><display>(b)</display>no on-board user is a human driver with a valid driver license or fallback-ready user.</subsection></subsection><subsection ssid="4-null-18" dnum="8-o:9-i" numlevel="1" lineno="81" slineno="1-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Driverless operation dispatcher" means a user who dispatches an ADS-equipped <ln numlevel="1" lineno="82" slineno="1-43"/>vehicle in driverless operation.</subsection><subsection ssid="4-null-19" dnum="9-o:10-i" numlevel="1" lineno="83" slineno="1-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Driving automation system" means the hardware and software collectively <ln numlevel="1" lineno="84" slineno="1-45"/>capable of performing part or all of the dynamic driving task on a sustained basis.</subsection><subsection ssid="4-null-20" dnum="10-o:11-i" numlevel="1" lineno="85" slineno="1-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Driving automation system feature" means a specific function of a driving <ln numlevel="1" lineno="86" slineno="1-47"/>automation system.</subsection><subsection ssid="4-null-21" dnum="11-o:12-i" numlevel="1" lineno="87" slineno="1-48" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display><subsection ssid="4-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dynamic driving task" means all of the real-time operational and tactical <ln numlevel="1" lineno="88" slineno="1-49"/>functions required to operate a motor vehicle in on-road traffic, including:<subsection ssid="4-null-23" dnum="i-o" numlevel="1" lineno="89" slineno="1-50" level="3" tab="1"><display>(i)</display>lateral vehicle motion control through steering;</subsection><subsection ssid="4-null-24" dnum="ii-o" numlevel="1" lineno="90" slineno="1-51" level="3" tab="1"><display>(ii)</display>longitudinal motion control through acceleration and deceleration;</subsection><subsection ssid="4-null-25" dnum="iii-o" numlevel="1" lineno="91" slineno="1-52" level="3" tab="1"><display>(iii)</display>monitoring the driving environment through object and event detection, <ln numlevel="1" lineno="92" slineno="1-53"/>recognition, classification, and response preparation;</subsection><subsection ssid="4-null-26" dnum="iv-o" numlevel="1" lineno="93" slineno="1-54" level="3" tab="1"><display>(iv)</display>object and event response execution;</subsection><subsection ssid="4-null-27" dnum="v-o" numlevel="1" lineno="94" slineno="1-55" level="3" tab="1"><display>(v)</display>maneuver planning; and</subsection><subsection ssid="4-null-28" dnum="vi-o" numlevel="1" lineno="95" slineno="1-56" level="3" tab="1"><display>(vi)</display>enhancing conspicuity with lighting, signaling, and gesturing.</subsection></subsection><subsection ssid="4-null-29" dnum="b-o" numlevel="1" lineno="96" slineno="1-57" level="2"><display>(b)</display>"Dynamic driving task" does not include strategic functions such as trip scheduling <ln numlevel="1" lineno="97" slineno="1-58"/>and selection of destinations and waypoints.</subsection></subsection><subsection ssid="4-null-30" dnum="12-o:13-i" numlevel="1" lineno="98" slineno="1-59" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1036" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Engage" as it pertains to the operation of a vehicle by a driving driving task on a sustained basis.</subsection><subsection ssid="4-null-31" dnum="13-o:14-i" numlevel="1" lineno="101" slineno="1-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"External event" is a situation in the driving environment that necessitates a <ln numlevel="1" lineno="102" slineno="1-63"/>response by a human driver with a valid driver license or driving automation system.</subsection><subsection ssid="4-null-32" dnum="14-o:15-i" numlevel="1" lineno="103" slineno="1-64" level="1"><display><amendoutstart style="2"/><amend Licensing -- Responsibility for compliant operation of ADS-equipped <ln numlevel="1" lineno="192" slineno="2-3"/>vehicles.</bold></catline><sectionText lineno="193"><tab/>For the purpose of assessing compliance with applicable traffic or motor vehicle laws:</sectionText><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="194" slineno="2-5" level="1" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When an ADS is operating a motor vehicle, the ADS is the operator, and shall <ln numlevel="1" lineno="195" slineno="2-6"/>satisfy electronically all physical acts required by a conventional driver in operation <ln numlevel="1" lineno="196" slineno="2-7"/>of the vehicle.</subsection><subsection ssid="15-null-3" dnum="b-o" numlevel="1" lineno="197" slineno="2-8" level="2"><display>(b)</display>The ADS is responsible for the compliant operation of the vehicle and is not required <ln numlevel="1" lineno="198" slineno="2-9"/>to be licensed to operate the vehicle.</subsection></subsection><subsection ssid="15-null-4" dnum="2-o" numlevel="1" lineno="199" slineno="2-10" level="1" space="false"><display>(2)</display><subsection ssid="15-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a vehicle with an engaged level three ADS issues a request to intervene, the <ln numlevel="1" lineno="200" slineno="2-11"/>ADS is responsible for the compliant operation of the vehicle until disengagement of <ln numlevel="1" lineno="201" slineno="2-12"/>the ADS.</subsection><subsection ssid="15-null-6" dnum="b-o" numlevel="1" lineno="202" slineno="2-13" level="2"><display>(b)</display>If a vehicle with an engaged level four or five ADS issues a request to intervene, the <ln numlevel="1" lineno="203" slineno="2-14"/>ADS is responsible for the compliant operation of the vehicle until or unless a human <ln numlevel="1" lineno="204" slineno="2-15"/>user begins to operate the vehicle.</subsection></subsection><subsection ssid="15-null-7" dnum="3-o" numlevel="1" lineno="205" slineno="2-16" level="1"><display>(3)</display>The ADS is responsible for compliant operation of an <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">ADS-dedicated</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">ADS-equipped</amend> <ln numlevel="1" lineno="206" slineno="2-17"/>vehicle.</subsection></section></bsec><bsec buid="26" num="63I-1-278" type="amend" src="code" uid="C63I-1-S278_2026050620260506" sort="63I01 02780020260506" numlevel="1" lineno="207" slineno="3-1" sn="3"><section number="63I-1-278" numlevel="1" lineno="208" slineno="3-2" type="amend"><secline lineno="207">Section 3. numlevel="1" lineno="271" slineno="6-4"/>vehicle while the automated driving system is engaged.</amend></subsection><subsection ssid="12-2" dnum="_-o:b-i" numlevel="1" lineno="272" slineno="6-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not apply to an incident that involves any driving assistance or task <ln numlevel="1" lineno="273" slineno="6-6"/>not performed by an ADS-dedicated vehicle while the automated driving system is <ln numlevel="1" lineno="274" slineno="6-7"/>operating.</amend></subsection><subsection ssid="12-29" dnum="_-o:c-i" numlevel="1" lineno="275" slineno="6-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">An action brought under this section is the exclusive civil remedy for injury or <ln numlevel="1" lineno="276" slineno="6-9"/>property damage arising out of the driverless operation of an ADS-dedicated vehicle.</amend></subsection><subsection ssid="12-30" dnum="_-o:d-i" numlevel="1" lineno="277" slineno="6-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">A plaintiff who brings an action under this section may not bring, plead, or maintain <ln numlevel="1" lineno="278" slineno="6-11"/>any other civil action or theory of recovery, including negligence, strict liability, or <ln numlevel="1" lineno="279" slineno="6-12"/>product liability, against any defendant for the same injury or property damage.</amend></subsection><subsection ssid="12-31" dnum="_-o:e-i" numlevel="1" lineno="280" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Section <xref depth="3" refnumber="78B-4-902">78B-4-902</xref> and any other provision of law, the total amount <ln numlevel="1" lineno="281" slineno="6-14"/>recoverable by a plaintiff under this section, including all damages, costs, and fees, <ln numlevel="1" lineno="282" slineno="6-15"/>may not exceed $100,000.</amend></subsection><subsection ssid="12-32" dnum="_-o:f-i" numlevel="1" lineno="283" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">A prevailing plaintiff may recover compensatory damages available under this <ln numlevel="1" lineno="284" slineno="6-17"/>section, subject to the limitation described in Subsection <xref depth="4" refnumber="78B-4-903(1)(e)">(1)(e)</xref>.</amend></subsection></subsection><subsection ssid="12-9" dnum="_-o:2-i" numlevel="1" lineno="285" slineno="6-18" ea="amend" anum="0" owner="jchristopherson" lineno="286" slineno="6-19"/>ADS-dedicated vehicle operating in driverless operation has a right of action under <ln numlevel="1" lineno="287" slineno="6-20"/>this section.</amend></subsection><subsection ssid="12-11" dnum="_-o:b-i" numlevel="1" lineno="288" slineno="6-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">An person who suffers injury or property damage directly caused by an <ln numlevel="1" lineno="289" slineno="6-22"/>ADS-dedicated vehicle operating in driverless operation may bring an action against:</amend><subsection ssid="12-12" dnum="_-o:i-i" numlevel="1" lineno="290" slineno="6-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">the registered owner of the ADS-dedicated vehicle; or</amend></subsection><subsection ssid="12-13" dnum="_-o:ii-i" numlevel="1" lineno="291" slineno="6-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">a person that dispatched the ADS-dedicated vehicle into driverless operation, <ln numlevel="1" lineno="292" slineno="6-25"/>including a driverless operation dispatcher or an on-demand autonomous vehicle <ln numlevel="1" lineno="293" slineno="6-26"/>network.</amend></subsection></subsection></subsection><subsection ssid="12-14" dnum="_-o:3-i" numlevel="1" lineno="294" slineno="6-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">A plaintiff establishes liability under this section by proving, by a preponderance of the <ln numlevel="1" lineno="295" slineno="6-28"/>evidence, that:</amend><subsection ssid="12-15" dnum="_-o:a-i" numlevel="1" lineno="296" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">the vehicle was in driverless operation at the time of the incident; and</amend></subsection><subsection ssid="12-16" dnum="_-o:b-i" numlevel="1" lineno="297" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">the driverless operation was a proximate cause of the injury or property damage.</amend></subsection></subsection><subsection ssid="12-34" dnum="_-o:4-i" numlevel="1" lineno="298" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">Any liability established under this section may be mitigated in proportion to the degree <ln numlevel="1" lineno="299" slineno="6-32"/>that the claimant's or a third party's negligence, recklessness, or breach of duty of care <ln numlevel="1" lineno="300" slineno="6-33"/>contributed to the occurrence of the incident or the resulting harm.</amend></subsection><subsection ssid="12-17" dnum="_-o:5-i" numlevel="1" lineno="301" slineno="6-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">A plaintiff bringing an action under this section is not required to prove negligence, <ln numlevel="1" lineno="302" slineno="6-35"/>breach of duty, or product defect.</amend></subsection></section></bsec><bsec buid="21" num="78B-4-904" type="enact" src="code" uid="C78B-4-S904_2026050620260506" sort="78B04 09040020260506" numlevel="1" lineno="303" slineno="7-1" sn="7"><section numlevel="1" lineno="304" slineno="7-2" number="78B-4-904" type="enact"><secline lineno="303">Section 7. Section <bold>78B-4-904</bold> is enacted to read:</secline><catline lineno="304"><bold>78B-4-904<parens/>. Limitation of causes of action against manufacturers and developers <ln numlevel="1" lineno="305" slineno="7-3"/>of automated driving systems.</bold></catline><subsection ssid="21-1" dnum="_-o:1-i" numlevel="1" lineno="306" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">A manufacturer or developer of a level four ADS or level five ADS is not subject to <ln numlevel="1" lineno="307" slineno="7-5"/>liability under a theory of negligence for personal injury, death, or property damage <ln numlevel="1" lineno="308" slineno="7-6"/>arising from the operation of an ADS-dedicated vehicle equipped with level four ADS <ln numlevel="1" lineno="309" slineno="7-7"/>or level five ADS while the automated driving system is engaged.</amend></subsection><subsection ssid="21-2" dnum="_-o:2-i" numlevel="1" lineno="310" slineno="7-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">A manufacturer or developer of a level four ADS or level five ADS may be held liable <ln numlevel="1" lineno="311" slineno="7-9"/>for personal injury, death, or property damage arising from the operation of an <ln numlevel="1" lineno="312" slineno="7-10"/>automated driving system of an ADS-dedicated vehicle only under:</amend><subsection ssid="21-3" dnum="_-o:a-i" numlevel="1" lineno="313" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">Section <xref depth="3" refnumber="78B-4-903">78B-4-903</xref>; or</amend></subsection><subsection ssid="21-8" dnum="_-o:b-i" numlevel="1" lineno="319" slineno="7-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the application of comparative fault under Section <xref depth="3" refnumber="78B-5-818">78B-5-818</xref> to reduce a plaintiff's <ln numlevel="1" lineno="320" slineno="7-18"/>recovery based on the plaintiff's own conduct.</amend></subsection></subsection><subsection ssid="21-9" dnum="_-o:4-i" numlevel="1" lineno="321" slineno="7-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">For purposes of this section, a claim alleging that a manufacturer or developer of a level <ln numlevel="1" lineno="322" slineno="7-20"/>four ADS or level five ADS was negligent in the design, development, testing, <ln numlevel="1" lineno="323" slineno="7-21"/>manufacture, or deployment of the automated driving system is a product liability claim <ln numlevel="1" lineno="324" slineno="7-22"/>subject to Chapter 6, Part 7, Utah Product Liability Act, and not a claim for ordinary <ln numlevel="1" lineno="325" slineno="7-23"/>negligence.</amend></subsection></section></bsec><bsec buid="8" num="78B-6-702" type="amend" src="code" uid="C78B-6-S702_2026050620260506" sort="78B06 07020020260506" numlevel="1" lineno="326" slineno="8-1" sn="8"><section number="78B-6-702" numlevel="1" lineno="327" slineno="8-2" type="amend"><secline lineno="326">Section 8. Section <bold>78B-6-702</bold> is amended to read:</secline><catline lineno="327"><bold>78B-6-702<parens/>. Definitions.</bold></catline><sectionText lineno="328"><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both"><tab/>As used in this part, "unreasonably dangerous" means that the product was <ln numlevel="1" lineno="329" slineno="8-4"/>dangerous to an extent beyond which would be contemplated by the ordinary and prudent <ln numlevel="1" lineno="330" slineno="8-5"/>buyer, consumer, or user of that product in that community considering the product's <ln numlevel="1" lineno="331" slineno="8-6"/>characteristics, propensities, risks, dangers, and uses together with any actual knowledge, <ln numlevel="1" lineno="332" slineno="8-7"/>training, or experience possessed by that particular buyer, user, or consumer.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="333" slineno="8-8"/>As used in this part:</amend></sectionText><subsection ssid="8-5" dnum="_-o:1-i" numlevel="1" lineno="334" slineno="8-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">"ADS-dedicated vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-26-102.1">41-26-102.1</xref>.</amend></subsection><subsection ssid="8-1" dnum="_-o:2-i" numlevel="1" lineno="335" slineno="8-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Automated driving system" means the same as that term is defined in Section <xref depth="3" refnumber="41-26-102.1"><ln numlevel="1" lineno="336" slineno="8-11"/>41-26-102.1</xref>.</amend></subsection><subsection ssid="8-3" dnum="_-o:3-i" numlevel="1" lineno="337" slineno="8-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"State of the art knowledge" means the technical, mechanical, and scientific knowledge <ln numlevel="1" lineno="338" slineno="8-13"/>of manufacturing, designing, testing, or labeling the same or similar products that was in <ln numlevel="1" lineno="339" slineno="8-14"/>existence and reasonably feasible for use at the time of manufacture.</amend></subsection><subsection ssid="8-2" dnum="_-o:4-i" numlevel="1" lineno="340" slineno="8-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"Unreasonably dangerous" means that the product was dangerous to an extent beyond <ln numlevel="1" lineno="341" slineno="8-16"/>which would be contemplated by the ordinary and prudent buyer, consumer, or user of <ln numlevel="1" lineno="342" slineno="8-17"/>that product in that community considering the product's characteristics, propensities, <ln numlevel="1" lineno="343" slineno="8-18"/>risks, dangers, and uses together with any actual knowledge, training, or experience <ln numlevel="1" lineno="344" slineno="8-19"/>possessed by that particular buyer, user, or consumer.</amend></subsection></section></bsec><bsec buid="6" num="78B-6-703" type="amend" src="code" uid="C78B-6-S703_2026050620260506" sort="78B06 07030020260506" numlevel="1" lineno="345" slineno="9-1" sn="9"><section number="78B-6-703" numlevel="1" lineno="346" slineno="9-2" type="amend"><secline lineno="345">Section 9. Section <bold>78B-6-703</bold> is amended to read:</secline><catline lineno="346"><bold>78B-6-703<parens/>. Defect or defective condition making product unreasonably <ln numlevel="1" lineno="347" slineno="9-3"/>dangerous -- Rebuttable presumption.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="348" slineno="9-4" level="1" placement="noreturn"><display>(1)</display>In any action for damages for personal injury, death, or property damage allegedly <ln numlevel="1" lineno="349" slineno="9-5"/>caused by a defect in a product<amend anum="0" ea="amend" pairid="117" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="both"> other than an ADS-dedicated vehicle</amend>, a product may not <ln numlevel="1" lineno="350" slineno="9-6"/>be considered to have a defect or to be in a defective condition, unless at the time the <ln numlevel="1" lineno="351" slineno="9-7"/>product was sold by the manufacturer or other initial seller, there was a defect or <ln numlevel="1" lineno="352" slineno="9-8"/>defective condition in the product which made the product unreasonably dangerous to <ln numlevel="1" lineno="353" slineno="9-9"/>the user or consumer.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="354" slineno="9-10" level="1"><display>(2)</display>There is a rebuttable presumption that a product<amend anum="0" ea="amend" pairid="119" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both"> described in Subsection <xref depth="4" refnumber="78B-6-703(1)">(1)</xref></amend> is free from <ln numlevel="1" lineno="355" slineno="9-11"/>any defect or defective condition where the alleged defect in the plans or designs for the <ln numlevel="1" lineno="356" slineno="9-12"/>product or the methods and techniques of manufacturing, inspecting and testing the <ln numlevel="1" lineno="357" slineno="9-13"/>product were in conformity with government standards established for that industry <ln numlevel="1" lineno="358" slineno="9-14"/>which were in existence at the time the plans or designs for the product or the methods <ln numlevel="1" lineno="359" slineno="9-15"/>and techniques of manufacturing, inspecting and testing the product were adopted.</subsection><subsection ssid="6-29" dnum="_-o:3-i" numlevel="1" lineno="360" slineno="9-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">In any action for damages for personal injury, death, or property damage allegedly <ln numlevel="1" lineno="361" slineno="9-17"/>caused by a defect in the automated driving system operation, the ADS-dedicated <ln numlevel="1" lineno="362" slineno="9-18"/>vehicle may not be considered to have a defect or to be in a defective condition, unless <ln numlevel="1" lineno="363" slineno="9-19"/>the plaintiff proves by clear and convincing evidence that:</amend><subsection ssid="6-20" dnum="_-o:a-i" numlevel="1" lineno="364" slineno="9-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">a reasonable and feasible alternative design existed at the time the automated driving <ln numlevel="1" lineno="365" slineno="9-21"/>system of the ADS-dedicated vehicle was designed and manufactured; and </amend></subsection><subsection ssid="6-24" dnum="_-o:b-i" numlevel="1" lineno="366" slineno="9-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">the use of the automated driving system, at scale and in the aggregate, causes more <ln numlevel="1" lineno="367" slineno="9-23"/>injuries to persons than would be caused by humans performing a similar task, at <ln numlevel="1" lineno="368" slineno="9-24"/>scale and in the aggregate, without an automated driving system.</amend></subsection></subsection><subsection ssid="6-19" dnum="_-o:4-i" numlevel="1" lineno="369" slineno="9-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">There is a rebuttable presumption that an automated driving system of an <ln numlevel="1" lineno="370" slineno="9-26"/>ADS-dedicated vehicle is free from any defect or defective condition if the automated <ln numlevel="1" lineno="371" slineno="9-27"/>driving system:</amend><subsection ssid="6-30" dnum="_-o:a-i" numlevel="1" lineno="372" slineno="9-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">conforms to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="373" slineno="9-29"/>prevention standards in effect on the date of the vehicle's manufacture; and</amend></subsection><subsection ssid="6-28" dnum="_-o:b-i" numlevel="1" lineno="374" slineno="9-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">was authorized for use or operation in the state.</amend></subsection></subsection></section></bsec><bsec buid="19" num="78B-6-708" type="enact" src="code" uid="C78B-6-S708_2026050620260506" sort="78B06 07080020260506" numlevel="1" lineno="375" slineno="10-1" sn="10"><section numlevel="1" lineno="376" slineno="10-2" number="78B-6-708" type="enact"><secline lineno="375">Section 10. Section <bold>78B-6-708</bold> is enacted to read:</secline><catline lineno="376"><bold>78B-6-708<parens/>. State of the art affirmative defense against product liability for an <ln numlevel="1" lineno="377" slineno="10-3"/>automated driving system.</bold></catline><sectionText lineno="378"><para/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">In an action based upon defective design, manufacture, or failure to warn related to the <ln numlevel="1" lineno="379" slineno="10-5"/>automated driving system of an ADS-dedicated vehicle brought against the manufacturer or <ln numlevel="1" lineno="380" slineno="10-6"/>developer of the automated driving system, liability is precluded if:</amend></sectionText><subsection ssid="19-null-9" dnum="_-o:1-i" numlevel="1" lineno="381" slineno="10-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the manufacturer or developer complied with the state of the art knowledge of scientific <ln numlevel="1" lineno="382" slineno="10-8"/>and technical knowledge and other circumstances that existed at the time of <ln numlevel="1" lineno="383" slineno="10-9"/>manufacture; or</amend></subsection><subsection ssid="19-null-10" dnum="_-o:2-i" numlevel="1" lineno="384" slineno="10-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">the automated driving system when deployed reduces injuries to persons, in the <ln numlevel="1" lineno="385" slineno="10-11"/>aggregate, as compared to humans conducting the same activity.</amend></subsection></section></bsec><bsec buid="28" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="386" slineno="11-1" sn="11"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="386">Section 11.  <bold>Effective Date.</bold></secline><sectionText lineno="387"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-26-26 11:07 AM</tm></rev></foot></leg>
