Section <bold>53F-2-415</bold> is amended to read:</secline><catline lineno="23"><bold>53F-2-415<parens/>. Student health and counseling support -- Qualifying personnel -- <ln numlevel="1" lineno="24" slineno="1-3"/>Distribution formula -- Rulemaking.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="26" slineno="1-5" level="2"><display>(a)</display>"Behavioral health support personnel" means an individual who:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="27" slineno="1-6" level="3"><display>(i)</display>works under the direct supervision of qualifying personnel to:<subsection ssid="1-null-4" dnum="A-o" numlevel="1" lineno="28" slineno="1-7" level="4"><display>(A)</display>support and track a student's progress and access to and completion of school <ln numlevel="1" lineno="29" slineno="1-8"/>curriculum; and</subsection><subsection ssid="1-null-5" dnum="B-o" numlevel="1" lineno="30" slineno="1-9" level="4"><display>(B)</display>support students by prompting, redirecting, encouraging, and reinforcing <ln numlevel="1" lineno="31" slineno="1-10"/>positive behaviors;</subsection></subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="32" slineno="1-11" level="3"><display>(ii)</display>is not certified or licensed in mental health; and</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="33" slineno="1-12" level="3"><display>(iii)</display>meets the professional qualifications as defined by state board rule.</subsection></subsection><subsection ssid="1-null-8" dnum="b-o:_-i" numlevel="1" lineno="34" slineno="1-13" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="147" groupid="111" style="2" owner="ahaskell" level="1" deltag="end">"Qualifying personnel" means a school counselor or other counselor, a school <ln numlevel="1" lineno="35" slineno="1-14"/>psychologist or other psychologist, a school social worker or other social worker, or a <ln numlevel="1" lineno="36" slineno="1-15"/>school nurse who:</amend><amendoutend style="2"/><subsection ssid="1-null-9" dnum="i-o:_-i" numlevel="1" lineno="37" slineno="1-16" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="151" groupid="115" style="2" owner="ahaskell" level="1" deltag="end">is licensed; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-10" dnum="ii-o:_-i" numlevel="1" lineno="38" slineno="1-17" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart pairid="43" groupid="34" style="1" owner="ahaskell" level="1" amendtag="end">is licensed or working under qualified personnel as an intern; and</amend></subsection><subsection ssid="1-61" dnum="_-o:B-i" numlevel="1" lineno="45" slineno="1-24" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" slineno="1-28"/>for the student's academic achievement.</amend></subsection></subsection></subsection><subsection ssid="1-64" dnum="_-o:ii-i" numlevel="1" lineno="50" slineno="1-29" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">"Qualifying personnel" includes the following individuals if the individual meets <ln numlevel="1" lineno="51" slineno="1-30"/>the requirements of Subsection <xref depth="4" refnumber="53F-2-415(1)(b)(i)">(1)(b)(i)</xref>, a:</amend><subsection ssid="1-66" dnum="_-o:A-i" numlevel="1" lineno="52" slineno="1-31" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="58" style="1" owner="ahaskell" level="1" amendtag="end">school counselor;</amend></subsection><subsection ssid="1-67" dnum="_-o:B-i" numlevel="1" lineno="53" slineno="1-32" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="88" style="1" owner="ahaskell" level="1" amendtag="end">certified social worker under Title 58, Chapter 60, Part 2, Social Worker <ln numlevel="1" lineno="59" slineno="1-38"/>Licensing Act;</amend></subsection><subsection ssid="1-72" dnum="_-o:G-i" numlevel="1" lineno="60" slineno="1-39" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(G)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">licensed clinical social worker under Title 58, Chapter 60, Part 2, Social <ln numlevel="1" lineno="61" slineno="1-40"/>Worker Licensing Act;</amend></subsection><subsection ssid="1-73" dnum="_-o:H-i" numlevel="1" lineno="62" slineno="1-41" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(H)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="93" style="1" owner="ahaskell" level="1" amendtag="end">clinical mental health counselor licensed under Title 58, Chapter 60, Part 4, <ln numlevel="1" lineno="63" slineno="1-42"/>Clinical Mental Health Counselor Licensing Act;</amend></subsection><subsection ssid="1-74" dnum="_-o:I-i" numlevel="1" lineno="64" slineno="1-43" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(I)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="103" style="1" owner="ahaskell" level="1" amendtag="end">marriage and family therapist licensed under Title 58, Chapter 60, Part 3, <ln numlevel="1" lineno="65" slineno="1-44"/>Marriage and Family Therapist Licensing Act; or</amend></subsection><subsection ssid="1-75" dnum="_-o:J-i" numlevel="1" lineno="66" slineno="1-45" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(J)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="102" style="1" owner="ahaskell" level="1" amendtag="end">psychologist licensed under Title 58, Chapter 61, Psychologist Licensing Act.</amend></subsection></subsection></subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="67" slineno="1-46" level="2"><display>(c)</display>"Telehealth services" means the same as that term is defined in Section <xref depth="3" refnumber="26B-4-704">26B-4-704</xref>.</subsection></subsection><subsection ssid="1-null-14" dnum="2-o" numlevel="1" lineno="68" slineno="1-47" level="1" space="false"><display>(2)</display><subsection ssid="1-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to legislative appropriations, and in accordance with Subsection <xref depth="4" refnumber="53F-2-415(2)(b)">(2)(b)</xref>, <ln numlevel="1" lineno="69" slineno="1-48"/>the state board shall distribute money appropriated under this section to LEAs to <ln numlevel="1" lineno="70" slineno="1-49"/>provide targeted school-based mental health support, including clinical services and <ln numlevel="1" lineno="71" slineno="1-50"/>trauma-informed care, through:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="72" slineno="1-51" level="3" tab="1"><display>(i)</display>employing qualifying personnel;</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="73" slineno="1-52" level="3" tab="1"><display>(ii)</display>employing behavioral health support personnel; or</subsection><subsection ssid="1-null-18" dnum="iii-o" numlevel="1" lineno="74" slineno="1-53" level="3" tab="1"><display>(iii)</display>entering into contracts for services provided by qualifying personnel, including <ln numlevel="1" lineno="75" slineno="1-54"/>telehealth services.</subsection></subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="76" slineno="1-55" level="2" space="false"><display>(b)</display><subsection ssid="1-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state board shall, after consulting with LEA governing boards, develop a <ln numlevel="1" lineno="77" slineno="1-56"/>formula to distribute money appropriated under this section to LEAs.</subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="78" slineno="1-57" level="3"><display>(ii)</display>The state board shall ensure that the formula described in Subsection <xref depth="4" refnumber="53F-2-415(2)(b)(i)">(2)(b)(i)</xref> <ln numlevel="1" lineno="79" slineno="1-58"/>incentivizes an LEA to provide school-based mental health support in <ln numlevel="1" lineno="80" slineno="1-59"/>collaboration with the local mental health authority of the county in which the <ln numlevel="1" lineno="81" slineno="1-60"/>LEA is located.</subsection><subsection ssid="1-null-22" dnum="iii-o" numlevel="1" lineno="82" slineno="1-61" level="3"><display>(iii)</display>The state board shall provide guidance for LEAs regarding the training, <ln numlevel="1" lineno="83" slineno="1-62"/>qualifications, roles, and scopes of practice for qualifying personnel and <ln numlevel="1" lineno="84" slineno="1-63"/>behavioral health support personnel that incorporates parent consent and <ln numlevel="1" lineno="85" slineno="1-64"/>partnership as key components in addressing the mental health and behavioral <ln numlevel="1" lineno="86" slineno="1-65"/>health needs of students.</subsection></subsection></subsection><subsection ssid="1-null-23" dnum="3-o" numlevel="1" lineno="87" slineno="1-66" level="1"><display>(3)</display>To qualify for money under this section, an LEA shall submit to the state board a plan <ln numlevel="1" lineno="88" slineno="1-67"/>that includes:<subsection ssid="1-null-24" dnum="a-o" numlevel="1" lineno="89" slineno="1-68" level="2"><display>(a)</display>measurable goals approved by the LEA governing board on improving student <ln numlevel="1" lineno="90" slineno="1-69"/>safety, student engagement, school climate, or academic achievement;</subsection><subsection ssid="1-null-25" dnum="b-o" numlevel="1" lineno="91" slineno="1-70" level="2"><display>(b)</display>how the LEA intends to meet the goals described in Subsection <xref depth="4" refnumber="53F-2-415(3)(a)">(3)(a)</xref> through the <ln numlevel="1" lineno="92" slineno="1-71"/>use of the money;</subsection><subsection ssid="1-null-26" dnum="c-o" numlevel="1" lineno="93" slineno="1-72" level="2"><display>(c)</display>how the LEA is meeting the requirements related to parent education described in <ln numlevel="1" lineno="94" slineno="1-73"/>Section <xref depth="3" refnumber="53G-9-703">53G-9-703</xref>; and</subsection><subsection ssid="1-null-27" dnum="d-o" numlevel="1" lineno="95" slineno="1-74" level="2"><display>(d)</display>whether the LEA intends to provide school-based mental health support in <ln numlevel="1" lineno="96" slineno="1-75"/>collaboration with the local mental health authority of the county in which the LEA is <ln numlevel="1" lineno="97" slineno="1-76"/>located.</subsection></subsection><subsection ssid="1-null-28" dnum="4-o" numlevel="1" lineno="98" slineno="1-77" level="1"><display>(4)</display>The state board shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="21" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-78" dnum="_-o:a-i" numlevel="1" lineno="99" slineno="1-78" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="119" style="1" owner="ahaskell" level="1" amendtag="end">provide guidance for services in schools that:</amend><subsection ssid="1-79" dnum="_-o:i-i" numlevel="1" lineno="100" slineno="1-79" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="129" style="1" owner="ahaskell" level="1" amendtag="end">align with scope of practice, supervision, and clinical oversight requirements the <ln numlevel="1" lineno="101" slineno="1-80"/>Division of Professional Licensing establishes; and</amend></subsection><subsection ssid="1-77" dnum="_-o:ii-i" numlevel="1" lineno="102" slineno="1-81" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="124" style="1" owner="ahaskell" level="1" amendtag="end">comply with the definition of practice of mental health therapy, as that term is <ln numlevel="1" lineno="103" slineno="1-82"/>defined in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>; and</amend></subsection></subsection><subsection ssid="1-56" dnum="_-o:b-i" numlevel="1" lineno="104" slineno="1-83" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>distribute money appropriated under this section to an LEA that qualifies under <ln numlevel="1" lineno="105" slineno="1-84"/>Subsection <xref depth="4" refnumber="53F-2-415(3)">(3)</xref>, based on the formula described in Subsection <xref depth="4" refnumber="53F-2-415(2)(b)">(2)(b)</xref>.</subsection></subsection><subsection ssid="1-null-29" dnum="5-o" numlevel="1" lineno="106" slineno="1-85" level="1"><display>(5)</display>An LEA may not use money distributed by the state board under this section to supplant <ln numlevel="1" lineno="107" slineno="1-86"/>federal, state, or local money previously allocated to:<subsection ssid="1-null-30" dnum="a-o" numlevel="1" lineno="108" slineno="1-87" level="2"><display>(a)</display>employ qualifying personnel;</subsection><subsection ssid="1-null-31" dnum="b-o" numlevel="1" lineno="109" slineno="1-88" level="2"><display>(b)</display>employ behavioral health support personnel; or</subsection><subsection ssid="1-null-32" dnum="c-o" numlevel="1" lineno="110" slineno="1-89" level="2"><display>(c)</display>enter into contracts for services provided by qualified personnel, including telehealth <ln numlevel="1" lineno="111" slineno="1-90"/>services.</subsection></subsection><subsection ssid="1-null-33" dnum="6-o" numlevel="1" lineno="112" slineno="1-91" level="1"><display>(6)</display>In accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="113" slineno="1-92"/>state board shall make rules that establish:<subsection ssid="1-null-34" dnum="a-o" numlevel="1" lineno="114" slineno="1-93" level="2"><display>(a)</display>procedures for submitting a plan for and distributing money under this section;</subsection><subsection ssid="1-null-35" dnum="b-o" numlevel="1" lineno="115" slineno="1-94" level="2"><display>(b)</display>the formula the state board will use to distribute money to LEAs described in <ln numlevel="1" lineno="116" slineno="1-95"/>Subsection <xref depth="4" refnumber="53F-2-415(2)(b)">(2)(b)</xref>; and</subsection><subsection ssid="1-null-36" dnum="c-o" numlevel="1" lineno="117" slineno="1-96" level="2"><display>(c)</display>in accordance with Subsection <xref depth="4" refnumber="53F-2-415(7)">(7)</xref>, annual reporting requirements for an LEA that <ln numlevel="1" lineno="118" slineno="1-97"/>receives money under this section.</subsection></subsection><subsection ssid="1-null-37" dnum="7-o" numlevel="1" lineno="119" slineno="1-98" level="1"><display>(7)</display>An LEA that receives money under this section shall submit an annual report to the state <ln numlevel="1" lineno="120" slineno="1-99"/>board, including:<subsection ssid="1-null-38" dnum="a-o" numlevel="1" lineno="121" slineno="1-100" level="2"><display>(a)</display>progress toward achieving the goals submitted under Subsection <xref depth="4" refnumber="53F-2-415(3)(a)">(3)(a)</xref>;</subsection><subsection ssid="1-null-39" dnum="b-o" numlevel="1" lineno="122" slineno="1-101" level="2"><display>(b)</display>if the LEA discontinues a qualifying personnel position or a behavioral health <ln numlevel="1" lineno="123" slineno="1-102"/>support personnel position, the LEA's reason for discontinuing the positions; and</subsection><subsection ssid="1-null-40" dnum="c-o" numlevel="1" lineno="124" slineno="1-103" level="2"><display>(c)</display>how the LEA, in providing school-based mental health support, complies with the <ln numlevel="1" lineno="125" slineno="1-104"/>provisions of Section <xref depth="3" refnumber="53E-9-203">53E-9-203</xref>.</subsection></subsection><subsection ssid="1-null-41" dnum="8-o" numlevel="1" lineno="126" slineno="1-105" level="1"><display>(8)</display>Beginning on or before July 1, 2019, the state board shall provide training that instructs <ln numlevel="1" lineno="127" slineno="1-106"/>school personnel on the impact of childhood trauma on student learning, including <ln numlevel="1" lineno="128" slineno="1-107"/>information advising educators against practicing medicine, giving a diagnosis, or <ln numlevel="1" lineno="129" slineno="1-108"/>providing treatment.</subsection><subsection ssid="1-null-42" dnum="9-o" numlevel="1" lineno="130" slineno="1-109" level="1"><display>(9)</display>The state board may use up to:<subsection ssid="1-null-43" dnum="a-o" numlevel="1" lineno="131" slineno="1-110" level="2"><display>(a)</display>2% of an appropriation under this section for costs related to the administration of <ln numlevel="1" lineno="132" slineno="1-111"/>the provisions of this section; and</subsection><subsection ssid="1-null-44" dnum="b-o" numlevel="1" lineno="133" slineno="1-112" level="2"><display>(b)</display>$1,500,000 in nonlapsing balances from fiscal year 2022 for the purposes described <ln numlevel="1" lineno="134" slineno="1-113"/>in this section to provide scholarships for up to four years to certain LEA employees, <ln numlevel="1" lineno="135" slineno="1-114"/>as defined by the state board, for education and training to become a school social <ln numlevel="1" lineno="136" slineno="1-115"/>worker, a school psychologist, or other school-based mental health worker.</subsection></subsection><subsection ssid="1-null-45" dnum="10-o" numlevel="1" lineno="137" slineno="1-116" level="1"><display>(10)</display>Notwithstanding the provisions of this section, money appropriated under this section <ln numlevel="1" lineno="138" slineno="1-117"/>may be used, as determined by the state board, for:<subsection ssid="1-null-46" dnum="a-o" numlevel="1" lineno="139" slineno="1-118" level="2"><display>(a)</display>the SafeUT Crisis Line described in Section <xref depth="3" refnumber="53H-4-210">53H-4-210</xref>; </subsection><subsection ssid="1-null-47" dnum="b-o" numlevel="1" lineno="140" slineno="1-119" level="2" space="false"><display>(b)</display><subsection ssid="1-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>youth suicide prevention programs described in Section <xref depth="3" refnumber="53G-9-702">53G-9-702 </xref>; or</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="141" slineno="1-120" level="3"><display>(ii)</display>a comprehensive prevention plan, as that term is defined in Section <xref depth="3" refnumber="53F-2-525">53F-2-525</xref>; or</subsection></subsection><subsection ssid="1-null-50" dnum="c-o" numlevel="1" lineno="142" slineno="1-121" level="2"><display>(c)</display>providing grants to LEAs as provided in Subsection <xref depth="4" refnumber="53F-2-522(5)">53F-2-522(5)</xref>.</subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="143" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="143">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="144"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6,
