Section <bold>77-36-2.2</bold> is amended to read:</secline><catline lineno="22"><bold>77-36-2.2<parens/>. Powers and duties of law enforcement officers to arrest -- Reports of <ln numlevel="1" lineno="23" slineno="1-3"/>domestic violence cases -- Reports of parties' marital status.</bold></catline><subsection ssid="6-null-43" dnum="1-o" numlevel="1" lineno="24" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>The primary duty of law enforcement officers responding to a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="179" groupid="149" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence call</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="178" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="25" slineno="1-5"/>call regarding a domestic violence offense</amend> is to protect the victim and enforce the law.</subsection><subsection ssid="6-null-44" dnum="2-o" numlevel="1" lineno="26" slineno="1-6" level="1" space="false"><display>(2)</display><subsection ssid="6-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the arrest powers described in Section <xref depth="3" refnumber="77-7-2" start="0">77-7-2</xref>, when a peace officer <ln numlevel="1" lineno="27" slineno="1-7"/>responds to a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="140" groupid="110" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence call</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="133" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">call regarding a domestic violence offense</amend> and <ln numlevel="1" lineno="28" slineno="1-8"/>has probable cause to believe that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">an act of domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a domestic violence <ln numlevel="1" lineno="29" slineno="1-9"/>offense</amend> has been committed, the peace officer shall arrest without a warrant<amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">shall </amend><amendoutend style="2"/><ln numlevel="1" lineno="30" slineno="1-10"/>issue a citation to<amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> any <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="201" groupid="169" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="200" groupid="168" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> that the peace officer has probable cause to <ln numlevel="1" lineno="31" slineno="1-11"/>believe has committed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">an act of domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a domestic violence offense</amend>.</subsection><subsection ssid="6-null-46" dnum="b-o" numlevel="1" lineno="32" slineno="1-12" level="2" space="false"><display>(b)</display><subsection ssid="6-null-47" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the peace officer has probable cause to believe that there will be continued <ln numlevel="1" lineno="33" slineno="1-13"/>violence against the alleged victim, or if there is evidence that the perpetrator has <ln numlevel="1" lineno="34" slineno="1-14"/>either recently caused serious bodily injury or used a dangerous weapon in the <ln numlevel="1" lineno="35" slineno="1-15"/>domestic violence offense, the officer shall<amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="6-null-48" dnum="_-o:A-i" numlevel="1" lineno="36" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>arrest and take the alleged perpetrator into custody<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="6-null-49" dnum="_-o:B-i" numlevel="1" lineno="37" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(B)</amend></display>may not utilize the option of issuing a citation under this section.</subsection></subsection><subsection ssid="6-null-50" dnum="ii-o" numlevel="1" lineno="38" slineno="1-18" level="3"><display>(ii)</display>For purposes of Subsection <xref depth="4" refnumber="77-36-2.2(2)(b)(i)" start="0">(2)(b)(i)</xref>, "serious bodily injury" and "dangerous <ln numlevel="1" lineno="39" slineno="1-19"/>weapon" mean the same as those terms are defined in Section <xref depth="3" refnumber="76-1-101.5" start="0">76-1-101.5</xref>.</subsection></subsection><subsection ssid="6-null-51" dnum="c-o" numlevel="1" lineno="40" slineno="1-20" level="2"><display>(c)</display>If a peace officer does not immediately exercise arrest powers or initiate criminal <ln numlevel="1" lineno="41" slineno="1-21"/>proceedings by citation or otherwise, the officer shall notify the victim of the right to <ln numlevel="1" lineno="42" slineno="1-22"/>initiate a criminal proceeding and of the importance of preserving evidence, in <ln numlevel="1" lineno="43" slineno="1-23"/>accordance with the requirements of Section <xref depth="3" refnumber="77-36-2.1" start="0">77-36-2.1</xref>.</subsection></subsection><subsection ssid="6-null-55" dnum="3-o" numlevel="1" lineno="44" slineno="1-24" level="1" space="false"><display>(3)</display><subsection ssid="6-null-60" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>If a law enforcement officer receives complaints of domestic violence<amend anum="0" ea="amend" pairid="138" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="both"> offenses</amend> <ln numlevel="1" lineno="45" slineno="1-25"/>from two or more opposing persons, the officer shall evaluate each complaint <ln numlevel="1" lineno="46" slineno="1-26"/>separately to determine who the predominant aggressor was<amend anum="0" ea="amend" pairid="185" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="both"> in the situation</amend>.  </subsection><subsection ssid="6-null-61" dnum="_-o:b-i" numlevel="1" lineno="47" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>If the officer determines that one person was the predominant physical aggressor, the <ln numlevel="1" lineno="48" slineno="1-28"/>officer need not arrest the other person alleged to have committed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="170" groupid="140" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="161" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="49" slineno="1-29"/>a domestic violence offense</amend>.  </subsection><subsection ssid="6-null-62" dnum="_-o:c-i" numlevel="1" lineno="50" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both">(c)</amend></display>In determining who the predominant aggressor was, the officer shall consider:<subsection ssid="6-null-56" dnum="a-o:i-i" numlevel="1" lineno="51" slineno="1-31" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>any prior complaints of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="171" groupid="141" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="163" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a domestic violence offense</amend>;</subsection><subsection ssid="6-null-57" dnum="b-o:ii-i" numlevel="1" lineno="52" slineno="1-32" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the relative severity of injuries inflicted on each person;</subsection><subsection ssid="6-null-58" dnum="c-o:iii-i" numlevel="1" lineno="53" slineno="1-33" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the likelihood of future injury to each of the parties; and</subsection><subsection ssid="6-null-59" dnum="d-o:iv-i" numlevel="1" lineno="54" slineno="1-34" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>whether one of the parties acted in self defense.</subsection></subsection></subsection><subsection ssid="6-null-63" dnum="4-o" numlevel="1" lineno="55" slineno="1-35" level="1"><display>(4)</display>A law enforcement officer may not threaten, suggest, or otherwise indicate the possible <ln numlevel="1" lineno="56" slineno="1-36"/>arrest of all parties in order to discourage any party's request for intervention by law <ln numlevel="1" lineno="57" slineno="1-37"/>enforcement.</subsection><subsection ssid="6-null-64" dnum="5-o" numlevel="1" lineno="58" slineno="1-38" level="1" space="false"><display>(5)</display><subsection ssid="6-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A law enforcement officer who does not make an arrest after investigating a <ln numlevel="1" lineno="59" slineno="1-39"/>complaint of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="174" groupid="144" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="166" groupid="136" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a domestic violence offense</amend>, or who arrests two or <ln numlevel="1" lineno="60" slineno="1-40"/>more parties, shall submit a detailed, written report specifying the grounds for not <ln numlevel="1" lineno="61" slineno="1-41"/>arresting any party or for arresting both parties.</subsection><subsection ssid="6-null-66" dnum="b-o" numlevel="1" lineno="62" slineno="1-42" level="2"><display>(b)</display>A law enforcement officer who does not make an arrest shall notify the victim of the <ln numlevel="1" lineno="63" slineno="1-43"/>right to initiate a criminal proceeding and of the importance of preserving evidence.</subsection></subsection><subsection ssid="6-null-67" dnum="6-o" numlevel="1" lineno="64" slineno="1-44" level="1" space="false"><display>(6)</display><subsection ssid="6-null-68" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A law enforcement officer responding to a complaint of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="175" groupid="145" style="2" owner="jchristopherson" level="1" deltag="both">domestic violence</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="167" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a <ln numlevel="1" lineno="65" slineno="1-45"/>domestic violence offense</amend> shall prepare an incident report that includes:<subsection ssid="6-null-69" dnum="i-o" numlevel="1" lineno="66" slineno="1-46" level="3" tab="1"><display>(i)</display>the officer's disposition of the case; and</subsection><subsection ssid="6-null-70" dnum="ii-o" numlevel="1" lineno="67" slineno="1-47" level="3" tab="1"><display>(ii)</display>the results of any lethality assessment completed in accordance with Section <xref depth="3" refnumber="77-36-2.1" start="0"><ln numlevel="1" lineno="68" slineno="1-48"/>77-36-2.1</xref>.</subsection></subsection><subsection ssid="6-null-71" dnum="b-o:_-i" numlevel="1" lineno="69" slineno="1-49" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="89" groupid="69" style="2" owner="jchristopherson" level="1" deltag="end">From January 1, 2009, until December 31, 2013, any law enforcement officer <ln numlevel="1" lineno="70" slineno="1-50"/>employed by a city of the first or second class responding to a complaint of domestic <ln numlevel="1" lineno="71" slineno="1-51"/>violence shall also report, either as a part of an incident report or on a separate form, <ln numlevel="1" lineno="72" slineno="1-52"/>the following information:</amend><amendoutend style="2"/><subsection ssid="6-null-72" dnum="i-o:_-i" numlevel="1" lineno="73" slineno="1-53" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="90" groupid="70" style="2" owner="jchristopherson" level="1" deltag="end">marital status of each of the parties involved;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-73" dnum="ii-o:_-i" numlevel="1" lineno="74" slineno="1-54" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="91" groupid="71" style="2" owner="jchristopherson" level="1" deltag="end">social, familial, or legal relationship of the suspect to the victim; and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-74" dnum="iii-o:_-i" numlevel="1" lineno="75" slineno="1-55" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="92" groupid="72" style="2" owner="jchristopherson" level="1" deltag="end">whether or not an arrest was made.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="6-null-75" dnum="c-o:_-i" numlevel="1" lineno="76" slineno="1-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="104" groupid="79" style="2" owner="jchristopherson" level="1" deltag="end">The information obtained in Subsection <xref depth="4" refnumber="77-36-2.2(6)(b)" start="0">(6)(b)</xref>:</amend><amendoutend style="2"/><subsection ssid="6-null-76" dnum="i-o:_-i" numlevel="1" lineno="77" slineno="1-57" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="107" groupid="82" style="2" owner="jchristopherson" level="1" deltag="end">shall be reported monthly to the department;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-77" dnum="ii-o:_-i" numlevel="1" lineno="78" slineno="1-58" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="108" groupid="83" style="2" owner="jchristopherson" level="1" deltag="end">shall be reported as numerical data that contains no personal identifiers; and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-78" dnum="iii-o:_-i" numlevel="1" lineno="79" slineno="1-59" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="109" groupid="84" style="2" owner="jchristopherson" level="1" deltag="end">is a public record as defined in Section <xref depth="3" refnumber="63G-2-103" start="0">63G-2-103</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="6-null-79" dnum="d-o:b-i" numlevel="1" lineno="80" slineno="1-60" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>The incident report shall be made available to the victim, upon request, at no <ln numlevel="1" lineno="81" slineno="1-61"/>cost.</subsection><subsection ssid="6-null-80" dnum="e-o:c-i" numlevel="1" lineno="82" slineno="1-62" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The law enforcement agency shall forward a copy of the incident report to the <ln numlevel="1" lineno="83" slineno="1-63"/>appropriate prosecuting attorney within five days after <amend anum="0" ea="amend" pairid="186" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="both">the day on which </amend>the <ln numlevel="1" lineno="84" slineno="1-64"/>complaint of domestic violence occurred.</subsection><subsection ssid="6-87" dnum="_-o:d-i" numlevel="1" lineno="85" slineno="1-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="end">If a peace officer did not arrest, or issue a citation to, an individual alleged to have <ln numlevel="1" lineno="86" slineno="1-66"/>committed a domestic violence offense as described in Subsection <xref depth="4" refnumber="77-36-2.2(2)">(2)</xref>, the law <ln numlevel="1" lineno="87" slineno="1-67"/>enforcement agency shall assign a peace officer to complete the investigation of the <ln numlevel="1" lineno="88" slineno="1-68"/>alleged domestic violence offense within 48 hours after the time at which the call <ln numlevel="1" lineno="89" slineno="1-69"/>regarding the domestic violence offense was made.</amend></subsection><subsection ssid="6-88" dnum="_-o:e-i" numlevel="1" lineno="90" slineno="1-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">If there is evidence that a domestic violence offense was committed, a law <ln numlevel="1" lineno="91" slineno="1-71"/>enforcement agency shall submit the appropriate charge for the offense to the <ln numlevel="1" lineno="92" slineno="1-72"/>prosecuting agency within five business days after the day on which the domestic <ln numlevel="1" lineno="93" slineno="1-73"/>violence offense occurs, unless the law enforcement agency has reasonable cause for <ln numlevel="1" lineno="94" slineno="1-74"/>the delay.</amend></subsection></subsection><subsection ssid="6-null-81" dnum="7-o:_-i" numlevel="1" lineno="95" slineno="1-75" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="start">(7)</amend></display><amend anum="0" ea="erase" pairid="112" groupid="86" style="2" owner="jchristopherson" level="1" deltag="end">The department shall compile the information described in Subsections <xref depth="4" refnumber="77-36-2.2(6)(b)" start="0">(6)(b)</xref> and <xref depth="4" refnumber="77-36-2.2(6)(c)" start="0">(c)</xref> <ln numlevel="1" lineno="96" slineno="1-76"/>into a report and present that report to the Law Enforcement and Criminal Justice <ln numlevel="1" lineno="97" slineno="1-77"/>Interim Committee during the 2013 interim, no later than May 31, 2013.</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-82" dnum="8-o:7-i" numlevel="1" lineno="98" slineno="1-78" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start" space="true">(7)</amend></display><subsection ssid="6-null-83" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>Each law enforcement agency shall, as soon as practicable, make a written <ln numlevel="1" lineno="99" slineno="1-79"/>record and maintain records of all incidents of domestic violence reported to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="89" style="2" owner="jchristopherson" level="1" deltag="both">it, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="198" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="100" slineno="1-80"/>the law enforcement agency.</amend></subsection><subsection ssid="6-null-84" dnum="_-o:b-i" numlevel="1" lineno="101" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="192" groupid="160" style="1" owner="jchristopherson" level="1" amendtag="end">Each incident </amend>shall be identified by a law enforcement agency code for domestic <ln numlevel="1" lineno="102" slineno="1-82"/>violence.</subsection></subsection></section></bsec><bsec buid="1" num="77-36-2.6" type="amend" src="code" uid="C77-36-S2.6_2026050620260506" sort="77 36 00020620260506" numlevel="1" lineno="103" slineno="2-1" sn="2"><section number="77-36-2.6" numlevel="1" lineno="104" slineno="2-2" type="amend"><secline lineno="103">Section 2. Section <bold>77-36-2.6</bold> is amended to read:</secline><catline lineno="104"><bold>77-36-2.6<parens/>. Appearance required -- Considerations by court.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="105" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>An alleged perpetrator who is arrested for an offense involving domestic violence shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="106" slineno="2-4"/>appear in person or by video before the court or a magistrate within one judicial day <ln numlevel="1" lineno="107" slineno="2-5"/>after the day on which the arrest is made</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">be presented without unnecessary delay before <ln numlevel="1" lineno="108" slineno="2-6"/>a magistrate for the determination of probable cause in accordance with Utah Rules of <ln numlevel="1" lineno="109" slineno="2-7"/>Criminal Procedure, Rule 9</amend>.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="110" slineno="2-8" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">An</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If an</amend> alleged perpetrator <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">who </amend><amendoutend style="2"/>is charged by citation, indictment, or information <ln numlevel="1" lineno="111" slineno="2-9"/>with an offense involving domestic violence <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">but</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and</amend> has not been arrested, <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">the alleged <ln numlevel="1" lineno="112" slineno="2-10"/>perpetrator </amend>shall appear before the court in person for arraignment or initial appearance <ln numlevel="1" lineno="113" slineno="2-11"/>as soon as practicable<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/> but no later than 14 days after the next day on which court is in <ln numlevel="1" lineno="114" slineno="2-12"/>session following the issuance of the citation or the filing of the indictment or <ln numlevel="1" lineno="115" slineno="2-13"/>information.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="116" slineno="2-14" level="1"><display>(3)</display>At the time of an appearance under Subsection <xref depth="4" refnumber="77-36-2.6(1)" start="0">(1)</xref> or <xref depth="4" refnumber="77-36-2.6(2)" start="0">(2)</xref>, the court shall consider <ln numlevel="1" lineno="117" slineno="2-15"/>imposing a pretrial protective order in accordance with Section <xref depth="3" refnumber="78B-7-803" start="0">78B-7-803</xref>.</subsection><subsection ssid="1-6" dnum="_-o:4-i"
