Section <bold>53E-6-603</bold> is amended to read:</secline><catline lineno="35"><bold>53E-6-603<parens/>. Ineligibility for educator license.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The state board may refuse to issue a license to a license applicant if the state board <ln numlevel="1" lineno="37" slineno="1-4"/>finds good cause for the refusal, including behavior of the applicant:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="38" slineno="1-5" level="2"><display>(a)</display>found pursuant to a criminal, civil, or administrative matter after reasonable <ln numlevel="1" lineno="39" slineno="1-6"/>opportunity for the applicant to contest the allegation; and</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="40" slineno="1-7" level="2"><display>(b)</display>considered, as behavior of an educator, to be:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="41" slineno="1-8" level="3"><display>(i)</display>immoral, unprofessional, or incompetent behavior; or</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="42" slineno="1-9" level="3"><display>(ii)</display>a violation of standards of ethical conduct, performance, or professional <ln numlevel="1" lineno="43" slineno="1-10"/>competence.</subsection></subsection></subsection><subsection ssid="1-null-6" dnum="2-o" numlevel="1" lineno="44" slineno="1-11" level="1"><display>(2)</display>The state board may not issue, renew, or reinstate an educator license if the license <ln numlevel="1" lineno="45" slineno="1-12"/>applicant or educator:<subsection ssid="1-null-7" dnum="a-o" numlevel="1" lineno="46" slineno="1-13" level="2"><display>(a)</display>was convicted of a felony of a sexual nature;</subsection><subsection ssid="1-null-8" dnum="b-o" numlevel="1" lineno="47" slineno="1-14" level="2"><display>(b)</display>pled guilty to a felony of a sexual nature;</subsection><subsection ssid="1-null-9" dnum="c-o" numlevel="1" lineno="48" slineno="1-15" level="2"><display>(c)</display>entered a plea of no contest to a felony of a sexual nature;</subsection><subsection ssid="1-null-10" dnum="d-o" numlevel="1" lineno="49" slineno="1-16" level="2"><display>(d)</display>entered a plea in abeyance to a felony of a sexual nature;</subsection><subsection ssid="1-null-11" dnum="e-o" numlevel="1" lineno="50" slineno="1-17" level="2"><display>(e)</display>was convicted of a sexual offense under <xref depth="2" refnumber="76-5-4" start="0">Title 76, Chapter 5, Part 4, Sexual Offenses</xref>, <ln numlevel="1" lineno="51" slineno="1-18"/>against a minor child;</subsection><subsection ssid="1-null-12" dnum="f-o" numlevel="1" lineno="52" slineno="1-19" level="2"><display>(f)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103" start="0">76-5b-103</xref>, with a student <ln numlevel="1" lineno="53" slineno="1-20"/>who is a minor;</subsection><subsection ssid="1-null-13" dnum="g-o" numlevel="1" lineno="54" slineno="1-21" level="2"><display>(g)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103" start="0">76-5b-103</xref>, with a student <ln numlevel="1" lineno="55" slineno="1-22"/>who:<subsection ssid="1-null-14" dnum="i-o" numlevel="1" lineno="56" slineno="1-23" level="3"><display>(i)</display>is not enrolled in an adult education program in an LEA;</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="57" slineno="1-24" level="3"><display>(ii)</display>is not a minor; and</subsection><subsection ssid="1-null-16" dnum="iii-o" numlevel="1" lineno="58" slineno="1-25" level="3" space="false"><display>(iii)</display><subsection ssid="1-null-17" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is enrolled in an LEA where the license applicant or educator is employed; <ln numlevel="1" lineno="59" slineno="1-26"/>or</subsection><subsection ssid="1-null-18" dnum="B-o" numlevel="1" lineno="60" slineno="1-27" level="4"><display>(B)</display>is a participant in an extracurricular program in which the educator is <ln numlevel="1" lineno="61" slineno="1-28"/>involved; or</subsection></subsection></subsection><subsection ssid="1-null-19" dnum="h-o" numlevel="1" lineno="62" slineno="1-29" level="2"><display>(h)</display>admits to the state board or UPPAC that the license applicant or educator committed <ln numlevel="1" lineno="63" slineno="1-30"/>conduct that amounts to:<subsection ssid="1-null-20" dnum="i-o" numlevel="1" lineno="64" slineno="1-31" level="3"><display>(i)</display>a felony of a sexual nature; or</subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="65" slineno="1-32" level="3"><display>(ii)</display>a sexual offense or sexually explicit conduct described in Subsection <xref depth="4" refnumber="53E-6-603(2)(e)" start="0">(2)(e)</xref>, <xref depth="4" refnumber="53E-6-603(2)(f)" start="0">(f)</xref>, or <xref depth="4" refnumber="53E-6-603(2)(g)" start="0"><ln numlevel="1" lineno="66" slineno="1-33"/>(g)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-22" dnum="3-o:_-i" numlevel="1" lineno="67" slineno="1-34" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="7" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">If an individual is ineligible for licensure under Subsection <xref depth="4" refnumber="53E-6-603(1)" start="0">(1)</xref> or <xref depth="4" refnumber="53E-6-603(2)" start="0">(2)</xref>, a public school <ln numlevel="1" lineno="68" slineno="1-35"/>may not:</amend><amendoutend style="2"/><subsection ssid="1-null-23" dnum="a-o:_-i" numlevel="1" lineno="69" slineno="1-36" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="9" style="2" owner="jchristopherson" level="1" deltag="end">employ the person in the public school; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-24" dnum="b-o:_-i" numlevel="1" lineno="70" slineno="1-37" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">allow the person to volunteer in the public school.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-31" dnum="_-o:3-i" numlevel="1" lineno="71" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-32" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">If an individual is ineligible for licensure under Subsection <xref depth="4" refnumber="53E-6-603(2)">(2)</xref>, a public school <ln numlevel="1" lineno="72" slineno="1-39"/>may not:</amend><subsection ssid="1-33" dnum="_-o:i-i" numlevel="1" lineno="73" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">employ the individual in the public school in a paid or unpaid capacity; or</amend></subsection><subsection ssid="1-34" dnum="_-o:ii-i" numlevel="1" lineno="74" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">allow the individual to volunteer in the public school.</amend></subsection></subsection><subsection ssid="1-35" dnum="_-o:b-i" numlevel="1" lineno="75" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">If an individual is ineligible for licensure under Subsection <xref depth="4" refnumber="53E-6-603(1)">(1)</xref> for conduct that does <ln numlevel="1" lineno="76" slineno="1-43"/>not fall within Subsection <xref depth="4" refnumber="53E-6-603(2)">(2)</xref>, the restriction described in Subsection <xref depth="4" refnumber="53E-6-603(3)(a)">(3)(a)</xref> applies <ln numlevel="1" lineno="77" slineno="1-44"/>only if:</amend><subsection ssid="1-36" dnum="_-o:i-i" numlevel="1" lineno="78" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the conduct underlying the ineligibility determination involved:</amend><subsection ssid="1-37" dnum="_-o:A-i" numlevel="1" lineno="79" slineno="1-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">actual physical, emotional, or psychological harm to a child;</amend></subsection><subsection ssid="1-38" dnum="_-o:B-i" numlevel="1" lineno="80" slineno="1-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">a credible risk of harm to a child;</amend></subsection><subsection ssid="1-39" dnum="_-o:C-i" numlevel="1" lineno="81" slineno="1-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">sexual misconduct, grooming, or boundary violations;</amend></subsection><subsection ssid="1-40" dnum="_-o:D-i" numlevel="1" lineno="82" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">abuse, exploitation, violence, or serious endangerment; or</amend></subsection><subsection ssid="1-41" dnum="_-o:E-i" numlevel="1" lineno="83" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">conduct demonstrating an ongoing threat to student safety; or</amend></subsection></subsection><subsection ssid="1-42" dnum="_-o:ii-i" numlevel="1" lineno="84" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">the state board issues written findings demonstrating:</amend><subsection ssid="1-43" dnum="_-o:A-i" numlevel="1" lineno="85" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">a specific, articulable risk to students or the school environment; and</amend></subsection><subsection ssid="1-44" dnum="_-o:B-i" numlevel="1" lineno="86" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">that a lesser restriction is insufficient to protect student safety.</amend></subsection></subsection></subsection><subsection ssid="1-45" dnum="_-o:c-i" numlevel="1" lineno="87" slineno="1-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">The restriction described in Subsection <xref depth="4" refnumber="53E-6-603(3)(a)">(3)(a)</xref> does not apply automatically to an <ln numlevel="1" lineno="88" slineno="1-55"/>individual who is ineligible for licensure under Subsection <xref depth="4" refnumber="53E-6-603(1)">(1)</xref> if the underlying <ln numlevel="1" lineno="89" slineno="1-56"/>conduct involved:</amend><subsection ssid="1-46" dnum="_-o:i-i" numlevel="1" lineno="90" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">administrative or documentation errors;</amend></subsection><subsection ssid="1-47" dnum="_-o:ii-i" numlevel="1" lineno="91" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">procedural or communication failures;</amend></subsection><subsection ssid="1-48" dnum="_-o:iii-i" numlevel="1" lineno="92" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">record keeping mistakes;</amend></subsection><subsection ssid="1-49" dnum="_-o:iv-i" numlevel="1" lineno="93" slineno="1-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">unintentional misstatements unrelated to student safety; or</amend></subsection><subsection ssid="1-50" dnum="_-o:v-i" numlevel="1" lineno="94" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">technical violations that lack evidence of actual harm or credible risk of harm to <ln numlevel="1" lineno="95" slineno="1-62"/>students.</amend></subsection></subsection></subsection><subsection ssid="1-null-25" dnum="4-o" numlevel="1" lineno="96" slineno="1-63" level="1" space="false"><display>(4)</display><subsection ssid="1-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the state board denies licensure under this section, the state board shall <ln numlevel="1" lineno="97" slineno="1-64"/>immediately notify the applicant of:<subsection ssid="1-null-27" dnum="i-o" numlevel="1" lineno="98" slineno="1-65" level="3" tab="1"><display>(i)</display>the denial; and</subsection><subsection ssid="1-null-28" dnum="ii-o" numlevel="1" lineno="99" slineno="1-66" level="3" tab="1"><display>(ii)</display>the applicant's right to request a hearing before UPPAC.</subsection></subsection><subsection ssid="1-null-29" dnum="b-o" numlevel="1" lineno="100" slineno="1-67" level="2"><display>(b)</display>Upon receipt of a notice described in Subsection <xref depth="4" refnumber="53E-6-603(4)(a)" start="0">(4)(a)</xref>, an applicant may, within 30 <ln numlevel="1" lineno="101" slineno="1-68"/>days after the day on which the applicant received the notice, request a hearing before <ln numlevel="1" lineno="102" slineno="1-69"/>UPPAC for the applicant to review and respond to all evidence upon which the state <ln numlevel="1" lineno="103" slineno="1-70"/>board based the denial.</subsection><subsection ssid="1-null-30" dnum="c-o" numlevel="1" lineno="104" slineno="1-71" level="2"><display>(c)</display>If the state board receives a request for a hearing described in Subsection <xref depth="4" refnumber="53E-6-603(4)(b)" start="0">(4)(b)</xref>, the <ln numlevel="1" lineno="105" slineno="1-72"/>state board shall direct UPPAC to hold a hearing.</subsection></subsection></section></bsec><bsec buid="2" num="53E-6-604" type="amend" src="code" uid="C53E-6-S604_2026050620260506" sort="53E06 06040020260506" numlevel="1" lineno="106" slineno="2-1" sn="2"><section number="53E-6-604" numlevel="1" lineno="107" slineno="2-2" type="amend"><secline lineno="106">Section 2. Section <bold>53E-6-604</bold> is amended to read:</secline><catline lineno="107"><bold>53E-6-604<parens/>. State board disciplinary action against an educator.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="108" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall direct UPPAC to investigate an allegation, administrative <ln numlevel="1" lineno="109" slineno="2-4"/>decision, or judicial decision that evidences an educator is unfit for duty because the <ln numlevel="1" lineno="110" slineno="2-5"/>educator exhibited behavior that:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="111" slineno="2-6" level="3" tab="1"><display>(i)</display>is immoral, unprofessional, or incompetent; or</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="112" slineno="2-7" level="3" tab="1"><display>(ii)</display>violates standards of ethical conduct, performance, or professional competence.</subsection></subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="113" slineno="2-8" level="2"><display>(b)</display>If the state board determines an allegation or decision described in Subsection <xref depth="4" refnumber="53E-6-604(1)(a)">(1)(a)</xref> <ln numlevel="1" lineno="114" slineno="2-9"/>does not evidence an educator's unfitness for duty, the state board may dismiss the <ln numlevel="1" lineno="115" slineno="2-10"/>allegation or decision without an investigation or hearing.</subsection></subsection><subsection ssid="2-null-6" dnum="2-o" numlevel="1" lineno="116" slineno="2-11" level="1"><display>(2)</display>The state board shall direct UPPAC to investigate and allow an educator to respond in a <ln numlevel="1" lineno="117" slineno="2-12"/>UPPAC hearing if the state board receives an allegation that the educator:<subsection ssid="2-null-7" dnum="a-o" numlevel="1" lineno="118" slineno="2-13" level="2"><display>(a)</display>was charged with a felony of a sexual nature;</subsection><subsection ssid="2-null-8" dnum="b-o" numlevel="1" lineno="119" slineno="2-14" level="2"><display>(b)</display>was convicted of a felony of a sexual nature;</subsection><subsection ssid="2-null-9" dnum="c-o" numlevel="1" lineno="120" slineno="2-15" level="2"><display>(c)</display>pled guilty to a felony of a sexual nature;</subsection><subsection ssid="2-null-10" dnum="d-o" numlevel="1" lineno="121" slineno="2-16" level="2"><display>(d)</display>entered a plea of no contest to a felony of a sexual nature;</subsection><subsection ssid="2-null-11" dnum="e-o" numlevel="1" lineno="122" slineno="2-17" level="2"><display>(e)</display>entered a plea in abeyance to a felony of a sexual nature;</subsection><subsection ssid="2-null-12" dnum="f-o" numlevel="1" lineno="123" slineno="2-18" level="2"><display>(f)</display>was convicted of a sexual offense under Title 76, Chapter 5, Part 4, Sexual Offenses, <ln numlevel="1" lineno="124" slineno="2-19"/>against a minor child;</subsection><subsection ssid="2-null-13" dnum="g-o" numlevel="1" lineno="125" slineno="2-20" level="2"><display>(g)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>, with a student <ln numlevel="1" lineno="126" slineno="2-21"/>who is a minor; or</subsection><subsection ssid="2-null-14" dnum="h-o" numlevel="1" lineno="127" slineno="2-22" level="2"><display>(h)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>, with a student <ln numlevel="1" lineno="128" slineno="2-23"/>who:<subsection ssid="2-null-15" dnum="i-o" numlevel="1" lineno="129" slineno="2-24" level="3"><display>(i)</display>is not enrolled in an adult education program in an LEA;</subsection><subsection ssid="2-null-16" dnum="ii-o" numlevel="1" lineno="130" slineno="2-25" level="3"><display>(ii)</display>is not a minor; and</subsection><subsection ssid="2-null-17" dnum="iii-o" numlevel="1" lineno="131" slineno="2-26" level="3" space="false"><display>(iii)</display><subsection ssid="2-null-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is enrolled in an LEA where the educator is employed; or</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="132" slineno="2-27" level="4"><display>(B)</display>is a participant in an extracurricular program in which the educator is involved.</subsection></subsection></subsection></subsection><subsection ssid="2-null-20" dnum="3-o" numlevel="1" lineno="133" slineno="2-28" level="1"><display>(3)</display>Upon notice that an educator allegedly violated Section <xref depth="3" refnumber="53E-6-701">53E-6-701</xref>, the state board shall <ln numlevel="1" lineno="134" slineno="2-29"/>direct UPPAC to:<subsection ssid="2-null-21" dnum="a-o" numlevel="1" lineno="135" slineno="2-30" level="2"><display>(a)</display>investigate the alleged violation; and</subsection><subsection ssid="2-null-22" dnum="b-o" numlevel="1" lineno="136" slineno="2-31" level="2"><display>(b)</display>hold a hearing to allow the educator to respond to the allegation.</subsection></subsection><subsection ssid="2-null-23" dnum="4-o" numlevel="1" lineno="137" slineno="2-32" level="1"><display>(4)</display>Upon completion of an investigation or hearing described in this section, UPPAC shall:<subsection ssid="2-null-24" dnum="a-o" numlevel="1" lineno="138" slineno="2-33" level="2"><display>(a)</display>provide findings to the state board; and</subsection><subsection ssid="2-null-25" dnum="b-o" numlevel="1" lineno="139" slineno="2-34" level="2"><display>(b)</display>make a recommendation for state board action.</subsection></subsection><subsection ssid="2-null-26" dnum="5-o" numlevel="1" lineno="140" slineno="2-35" level="1" space="false"><display>(5)</display><subsection ssid="2-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-6-604(5)(b)">(5)(b)</xref>, upon review of UPPAC's findings and <ln numlevel="1" lineno="141" slineno="2-36"/>recommendation, the state board may:<subsection ssid="2-null-28" dnum="i-o" numlevel="1" lineno="142" slineno="2-37" level="3" tab="1"><display>(i)</display>revoke the educator's license;</subsection><subsection ssid="2-null-29" dnum="ii-o" numlevel="1" lineno="143" slineno="2-38" level="3" tab="1"><display>(ii)</display>suspend the educator's license;</subsection><subsection ssid="2-null-30" dnum="iii-o" numlevel="1" lineno="144" slineno="2-39" level="3" tab="1"><display>(iii)</display>restrict or prohibit the educator from renewing the educator's license;</subsection><subsection ssid="2-null-31" dnum="iv-o" numlevel="1" lineno="145" slineno="2-40" level="3" tab="1"><display>(iv)</display>warn or reprimand the educator;</subsection><subsection ssid="2-null-32" dnum="v-o" numlevel="1" lineno="146" slineno="2-41" level="3" tab="1"><display>(v)</display>enter into a written agreement with the educator that requires the educator to <ln numlevel="1" lineno="147" slineno="2-42"/>comply with certain conditions;</subsection><subsection ssid="2-null-33" dnum="vi-o" numlevel="1" lineno="148" slineno="2-43" level="3" tab="1"><display>(vi)</display>direct UPPAC to further investigate or gather information; or</subsection><subsection ssid="2-null-34" dnum="vii-o" numlevel="1" lineno="149" slineno="2-44" level="3" tab="1"><display>(vii)</display>take other action the state board finds to be appropriate for and consistent with <ln numlevel="1" lineno="150" slineno="2-45"/>the educator's behavior.</subsection></subsection><subsection ssid="2-null-35" dnum="b-o" numlevel="1" lineno="151" slineno="2-46" level="2"><display>(b)</display>Upon review of UPPAC's findings and recommendation, the state board shall revoke <ln numlevel="1" lineno="152" slineno="2-47"/>the license of an educator who:<subsection ssid="2-null-36" dnum="i-o" numlevel="1" lineno="153" slineno="2-48" level="3"><display>(i)</display>was convicted of a felony of a sexual nature;</subsection><subsection ssid="2-null-37" dnum="ii-o" numlevel="1" lineno="154" slineno="2-49" level="3"><display>(ii)</display>pled guilty to a felony of a sexual nature;</subsection><subsection ssid="2-null-38" dnum="iii-o" numlevel="1" lineno="155" slineno="2-50" level="3"><display>(iii)</display>entered a plea of no contest to a felony of a sexual nature;</subsection><subsection ssid="2-null-39" dnum="iv-o" numlevel="1" lineno="156" slineno="2-51" level="3"><display>(iv)</display>entered a plea in abeyance to a felony of a sexual nature;</subsection><subsection ssid="2-null-40" dnum="v-o" numlevel="1" lineno="157" slineno="2-52" level="3"><display>(v)</display>was convicted of a sexual offense under Title 76, Chapter 5, Part 4, Sexual <ln numlevel="1" lineno="158" slineno="2-53"/>Offenses, against a minor child;</subsection><subsection ssid="2-null-41" dnum="vi-o" numlevel="1" lineno="159" slineno="2-54" level="3"><display>(vi)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>, with a <ln numlevel="1" lineno="160" slineno="2-55"/>student who is a minor;</subsection><subsection ssid="2-null-42" dnum="vii-o" numlevel="1" lineno="161" slineno="2-56" level="3"><display>(vii)</display>engaged in sexually explicit conduct, as defined in Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>, with a <ln numlevel="1" lineno="162" slineno="2-57"/>student who:<subsection ssid="2-null-43" dnum="A-o" numlevel="1" lineno="163" slineno="2-58" level="4"><display>(A)</display>is not enrolled in an adult education program in an LEA;</subsection><subsection ssid="2-null-44" dnum="B-o" numlevel="1" lineno="164" slineno="2-59" level="4"><display>(B)</display>is not a minor; and</subsection><subsection ssid="2-null-45" dnum="C-o" numlevel="1" lineno="165" slineno="2-60" level="4"><display>(C)</display>is enrolled in an LEA where the educator is employed or is a participant in an <ln numlevel="1" lineno="166" slineno="2-61"/>extracurricular program in which the educator is involved; or</subsection></subsection><subsection ssid="2-null-46" dnum="viii-o" numlevel="1" lineno="167" slineno="2-62" level="3"><display>(viii)</display>admits to the state board or UPPAC that the applicant committed conduct that <ln numlevel="1" lineno="168" slineno="2-63"/>amounts to:<subsection ssid="2-null-47" dnum="A-o" numlevel="1" lineno="169" slineno="2-64" level="4"><display>(A)</display>a felony of a sexual nature; or</subsection><subsection ssid="2-null-48" dnum="B-o" numlevel="1" lineno="170" slineno="2-65" level="4"><display>(B)</display>a sexual offense or sexually explicit conduct described in Subsection <xref depth="4" refnumber="53E-6-604(5)(b)(v)">(5)(b)(v)</xref>, <ln numlevel="1" lineno="171" slineno="2-66"/>(vi), or (vii).</subsection></subsection></subsection><subsection ssid="2-null-49" dnum="c-o" numlevel="1" lineno="172" slineno="2-67" level="2"><display>(c)</display>The state board may not reinstate a revoked license.</subsection><subsection ssid="2-null-50" dnum="d-o" numlevel="1" lineno="173" slineno="2-68" level="2"><display>(d)</display>Before the state board takes adverse action against an educator under this section, the <ln numlevel="1" lineno="174" slineno="2-69"/>state board shall ensure that the educator had an opportunity for a UPPAC hearing.</subsection><subsection ssid="2-52" dnum="_-o:e-i" numlevel="1" lineno="175" slineno="2-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board suspends or revokes an educator's license under this section, the <ln numlevel="1" lineno="176" slineno="2-71"/>state board shall determine whether the restrictions described in Section <xref depth="3" refnumber="53E-6-604.5">53E-6-604.5</xref> <ln numlevel="1" lineno="177" slineno="2-72"/>apply to the educator.</amend></subsection></subsection><subsection ssid="2-null-51" dnum="6-o" numlevel="1" lineno="178" slineno="2-73" level="1"><display>(6)</display>Notwithstanding any other provision in this section, the state board shall make rules, in <ln numlevel="1" lineno="179" slineno="2-74"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, that <ln numlevel="1" lineno="180" slineno="2-75"/>require an LEA to notify the state board, UPPAC, and the educator of a complaint from <ln numlevel="1" lineno="181" slineno="2-76"/>a parent against an educator alleging a violation of educator licensing standards.</subsection></section></bsec><bsec buid="6" num="53E-6-604.5" type="enact" src="code" uid="C53E-6-S604.5_2026050620260506" sort="53E06 06040520260506" numlevel="1" lineno="182" slineno="3-1" sn="3"><section numlevel="1" lineno="183" slineno="3-2" number="53E-6-604.5" type="enact"><secline lineno="182">Section 3. Section <bold>53E-6-604.5</bold> is enacted to read:</secline><catline lineno="183"><bold>53E-6-604.5<parens/>. Restrictions on employment and volunteer service following license <ln numlevel="1" lineno="184" slineno="3-3"/>suspension or revocation.</bold></catline><subsection ssid="6-1" dnum="_-o:1-i" numlevel="1" lineno="185" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="6-2" dnum="_-o:a-i" numlevel="1" lineno="186" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Qualifying serious misconduct" means conduct that:</amend><subsection ssid="6-3" dnum="_-o:i-i" numlevel="1" lineno="187" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">caused actual physical, emotional, or psychological harm to a child;</amend></subsection><subsection ssid="6-4" dnum="_-o:ii-i" numlevel="1" lineno="188" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">created a credible risk of harm to a child;</amend></subsection><subsection ssid="6-5" dnum="_-o:iii-i" numlevel="1" lineno="189" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">involved sexual misconduct, grooming, or boundary violations;<marker pairid="256"/><marker pairid="257"/></amend></subsection><subsection ssid="6-6" dnum="_-o:iv-i" numlevel="1" lineno="190" slineno="3-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">involved abuse, exploitation, violence, or serious endangerment; <marker pairid="258">or </marker></amend></subsection><subsection ssid="6-56" dnum="_-o:v-i" numlevel="1" lineno="191" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="198" style="1" owner="jchristopherson" level="1" amendtag="end"><marker pairid="258">demonstrates an ongoing threat to student safety</marker>.</amend></subsection></subsection><subsection ssid="6-7" dnum="_-o:b-i" numlevel="1" lineno="192" slineno="3-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">"Technical violation" means conduct that:</amend><subsection ssid="6-8" dnum="_-o:i-i" numlevel="1" lineno="193" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">involved administrative or documentation errors;</amend></subsection><subsection ssid="6-9" dnum="_-o:ii-i" numlevel="1" lineno="194" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">involved procedural or communication failures;</amend></subsection><subsection ssid="6-10" dnum="_-o:iii-i" numlevel="1" lineno="195" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">involved recordkeeping mistakes;</amend></subsection><subsection ssid="6-11" dnum="_-o:iv-i" numlevel="1" lineno="196" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">involved unintentional misstatements unrelated to student safety; or</amend></subsection><subsection ssid="6-12" dnum="_-o:v-i" numlevel="1" lineno="197" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">constituted a technical violation of licensing standards that lacks evidence of <ln numlevel="1" lineno="198" slineno="3-17"/>actual harm or credible risk of harm to students.</amend></subsection></subsection></subsection><subsection ssid="6-13" dnum="_-o:2-i" numlevel="1" lineno="199" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="6-17" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board revokes an educator's license under Subsection <xref depth="4" refnumber="53E-6-604(5)(b)">53E-6-604(5)(b)</xref> <ln numlevel="1" lineno="200" slineno="3-19"/>or for qualifying serious misconduct, a public school may not:</amend><subsection ssid="6-16" dnum="_-o:i-i" numlevel="1" lineno="201" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">employ the educator in the public school in a paid or unpaid capacity; or</amend></subsection><subsection ssid="6-29" dnum="_-o:ii-i" numlevel="1" lineno="219" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">allow the educator to volunteer in the public school.</amend></subsection></subsection><subsection ssid="6-30" dnum="_-o:b-i" numlevel="1" lineno="220" slineno="3-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">The restriction described in Subsection <xref depth="4" refnumber="53E-6-604.5(4)(a)">(4)(a)</xref> applies automatically upon the <ln numlevel="1" lineno="221" slineno="3-40"/>effective date of the license suspension.</amend></subsection></subsection><subsection ssid="6-31" dnum="_-o:5-i" numlevel="1" lineno="222" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="6-32" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board suspends an educator's license for conduct that does not <ln numlevel="1" lineno="223" slineno="3-42"/>constitute qualifying serious misconduct under Subsection <xref depth="4" refnumber="53E-6-604.5(4)">(4)</xref>, the restriction <ln numlevel="1" lineno="224" slineno="3-43"/>described in Subsection <xref depth="4" refnumber="53E-6-604.5(4)(a)">(4)(a)</xref> applies during the period of suspension only if the <ln numlevel="1" lineno="225" slineno="3-44"/>state board issues written findings that:</amend><subsection ssid="6-33" dnum="_-o:i-i" numlevel="1" lineno="226" slineno="3-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">identify a specific, articulable risk to students or the school environment based on <ln numlevel="1" lineno="227" slineno="3-46"/>the educator's conduct; and</amend></subsection><subsection ssid="6-34" dnum="_-o:ii-i" numlevel="1" lineno="228" slineno="3-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="end">explain why allowing the educator to work or volunteer in a public school during <ln numlevel="1" lineno="229" slineno="3-48"/>the suspension period, even in a capacity not requiring a license, would be <ln numlevel="1" lineno="230" slineno="3-49"/>insufficient to protect student safety.</amend></subsection></subsection><subsection ssid="6-35" dnum="_-o:b-i" numlevel="1" lineno="231" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board does not issue the written findings described in Subsection <xref depth="4" refnumber="53E-6-604.5(5)(a)">(5)(a)</xref>, <ln numlevel="1" lineno="232" slineno="3-51"/>the educator may, during the period of suspension:</amend><subsection ssid="6-36" dnum="_-o:i-i" numlevel="1" lineno="233" slineno="3-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">work in a public school in a capacity that does not require a license; or</amend></subsection><subsection ssid="6-37" dnum="_-o:ii-i" numlevel="1" lineno="234" slineno="3-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">volunteer in a public school, subject to any other applicable employment or <ln numlevel="1" lineno="235" slineno="3-54"/>volunteer screening<marker pairid="259"> </marker>requirements.</amend></subsection></subsection></subsection><subsection ssid="6-38" dnum="_-o:6-i" numlevel="1" lineno="236" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may not issue a restriction described in Subsection <xref depth="4" refnumber="53E-6-604.5(2)(a)">(2)(a)</xref> or <xref depth="4" refnumber="53E-6-604.5(4)(a)">(4)(a)</xref> for a <ln numlevel="1" lineno="237" slineno="3-56"/>technical violation unless:</amend><subsection ssid="6-39" dnum="_-o:a-i" numlevel="1" lineno="238" slineno="3-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">the educator engaged in a pattern of repeated technical violations that demonstrates <ln numlevel="1" lineno="239" slineno="3-58"/>disregard for licensing standards; and</amend></subsection><subsection ssid="6-40" dnum="_-o:b-i" numlevel="1" lineno="240" slineno="3-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="186" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">the state board issues written findings that:</amend><subsection ssid="6-41" dnum="_-o:i-i" numlevel="1" lineno="241" slineno="3-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="191" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">document the pattern of repeated violations;</amend></subsection><subsection ssid="6-42" dnum="_-o:ii-i" numlevel="1" lineno="242" slineno="3-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="196" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">identify a specific, articulable risk to students or the school environment; and</amend></subsection><subsection ssid="6-43" dnum="_-o:iii-i" numlevel="1" lineno="243" slineno="3-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="201" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">explain why a lesser sanction is insufficient.</amend></subsection></subsection></subsection><subsection ssid="6-44" dnum="_-o:7-i" numlevel="1" lineno="244" slineno="3-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="6-47" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">The written findings required under Subsections <xref depth="4" refnumber="53E-6-604.5(3)(a)">(3)(a)</xref>, (5)(a), and (6)(b) shall:</amend><subsection ssid="6-45" dnum="_-o:i-i" numlevel="1" lineno="245" slineno="3-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="159" style="1" owner="jchristopherson" level="1" amendtag="end">be based on evidence presented during the UPPAC hearing or investigation;</amend></subsection><subsection ssid="6-46" dnum="_-o:ii-i" numlevel="1" lineno="246" slineno="3-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">address the specific circumstances of the educator's conduct;</amend></subsection><subsection ssid="6-48" dnum="_-o:iii-i" numlevel="1" lineno="247" slineno="3-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="222" groupid="168" style="1" owner="jchristopherson" level="1" amendtag="end">consider any mitigating factors; and</amend></subsection><subsection ssid="6-49" dnum="_-o:iv-i" numlevel="1" lineno="248" slineno="3-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="227" groupid="172" style="1" owner="jchristopherson" level="1" amendtag="end">explain the basis for the determination that the restriction is necessary and <ln numlevel="1" lineno="249" slineno="3-68"/>proportional.</amend></subsection></subsection><subsection ssid="6-50" dnum="_-o:b-i" numlevel="1" lineno="250" slineno="3-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="232" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall provide the educator with a copy of the written findings <ln numlevel="1" lineno="251" slineno="3-70"/>required under this section.</amend></subsection></subsection><subsection ssid="6-51" dnum="_-o:8-i" numlevel="1" lineno="252" slineno="3-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="236" groupid="179" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not limit:</amend><subsection ssid="6-52" dnum="_-o:a-i" numlevel="1" lineno="253" slineno="3-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="241" groupid="183" style="1" owner="jchristopherson" level="1" amendtag="end">the authority of a public school to establish and enforce employment and volunteer <ln numlevel="1" lineno="254" slineno="3-73"/>policies that are more restrictive than the requirements of this section;</amend></subsection><subsection ssid="6-53" dnum="_-o:b-i" numlevel="1" lineno="255" slineno="3-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="246" groupid="187" style="1" owner="jchristopherson" level="1" amendtag="end">the authority of the state board to impose conditions or restrictions on an educator's <ln numlevel="1" lineno="256" slineno="3-75"/>license under Subsection <xref depth="4" refnumber="53E-6-604(5)(a)(v)">53E-6-604(5)(a)(v)</xref> or <xref depth="4" refnumber="53E-6-604.5(vii)">(vii)</xref>; or</amend></subsection><subsection ssid="6-54" dnum="_-o:c-i" numlevel="1" lineno="257" slineno="3-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="251" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="end">the requirement under Section <xref depth="3" refnumber="53E-6-201">53E-6-201</xref> that an individual employed in a position <ln numlevel="1" lineno="258" slineno="3-77"/>requiring licensure hold an appropriate license.</amend></subsection></subsection><subsection ssid="6-55" dnum="_-o:9-i" numlevel="1" lineno="259" slineno="3-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="255" groupid="194" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section permits an individual to work in a position requiring licensure <ln numlevel="1" lineno="260" slineno="3-79"/>without holding the appropriate license as required by Section <xref depth="3" refnumber="53E-6-201">53E-6-201</xref>.</amend></subsection></section></bsec><bsec buid="4" num="53E-6-607" type="amend" src="code" uid="C53E-6-S607_2026050620260506" sort="53E06 06070020260506" numlevel="1" lineno="261" slineno="4-1" sn="4"><section number="53E-6-607" numlevel="1" lineno="262" slineno="4-2" type="amend"><secline lineno="261">Section 4. Section <bold>53E-6-607</bold> is amended to read:</secline><catline lineno="262"><bold>53E-6-607<parens/>. Policies for conducting hearings -- Standard of proof.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="263" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>The state board and each local school board shall adopt policies for the conduct of <ln numlevel="1" lineno="264" slineno="4-4"/>hearings to ensure that requirements of due process are met.</subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="265" slineno="4-5" level="1"><display>(2)</display>An accused party shall be provided not less than 15 days before a hearing with:<subsection ssid="4-null-3" dnum="a-o" numlevel="1" lineno="266" slineno="4-6" level="2"><display>(a)</display>notice of the hearing;</subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="267" slineno="4-7" level="2"><display>(b)</display>the law, rule, or policy alleged to have been violated;</subsection><subsection ssid="4-null-5" dnum="c-o" numlevel="1" lineno="268" slineno="4-8" level="2"><display>(c)</display>sufficient information about the allegations and the evidence to be presented in <ln numlevel="1" lineno="269" slineno="4-9"/>support of the allegations to permit the accused party to prepare a meaningful <ln numlevel="1" lineno="270" slineno="4-10"/>defense; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-6" dnum="d-o" numlevel="1" lineno="271" slineno="4-11" level="2"><display>(d)</display>a copy of the policies under which the hearing will be conducted<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="4-10" dnum="_-o:e-i" numlevel="1" lineno="272" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">if the proceeding may result in suspension or revocation of a license:</amend><subsection ssid="4-11" dnum="_-o:i-i" numlevel="1" lineno="273" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a statement explaining the potential restrictions on employment and volunteer <ln numlevel="1" lineno="274" slineno="4-14"/>service under Section <xref depth="3" refnumber="53E-6-604.5">53E-6-604.5</xref>;</amend></subsection><subsection ssid="4-12" dnum="_-o:ii-i" numlevel="1" lineno="275" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">a statement of the circumstances under which the restrictions apply automatically; <ln numlevel="1" lineno="276" slineno="4-16"/>and</amend></subsection><subsection ssid="4-13" dnum="_-o:iii-i" numlevel="1" lineno="277" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">a statement of the circumstances under which the restrictions require written <ln numlevel="1" lineno="278" slineno="4-18"/>findings by the state board.</amend></subsection></subsection></subsection><subsection ssid="4-null-7" dnum="3-o" numlevel="1" lineno="279" slineno="4-19" level="1"><display>(3)</display>If an accused party fails to request a hearing within 30 days after written notice is sent <ln numlevel="1" lineno="280" slineno="4-20"/>to the party's address as shown on the records of the local school board, for actions taken <ln numlevel="1" lineno="281" slineno="4-21"/>under the auspices of a local school board, or on the records of the state board, for <ln numlevel="1" lineno="282" slineno="4-22"/>actions taken under the auspices of the state board, then the accused party shall be <ln numlevel="1" lineno="283" slineno="4-23"/>considered to have waived the right to a hearing and the action may proceed without <ln numlevel="1" lineno="284" slineno="4-24"/>further delay.</subsection><subsection ssid="4-null-8" dnum="4-o" numlevel="1" lineno="285" slineno="4-25" level="1"><display>(4)</display>Hearing fact finders shall use the preponderance of evidence standard in deciding all <ln numlevel="1" lineno="286" slineno="4-26"/>questions unless a higher standard is required by law.</subsection><subsection ssid="4-null-9" dnum="5-o" numlevel="1" lineno="287" slineno="4-27" level="1"><display>(5)</display>Unless otherwise provided in this public education code, the decisions of state and local <ln numlevel="1" lineno="288" slineno="4-28"/>school boards are final determinations under this section, appealable to the appropriate <ln numlevel="1" lineno="289" slineno="4-29"/>court for review.</subsection></section></bsec><bsec buid="8" num="53E-6-901" type="amend" src="code" uid="C53E-6-S901_2026050620260506" sort="53E06 09010020260506" numlevel="1" lineno="290" slineno="5-1" sn="5"><section number="53E-6-901" numlevel="1" lineno="291" slineno="5-2" type="amend"><secline lineno="290">Section 5. Section <bold>53E-6-901</bold> is amended to read:</secline><catline lineno="291"><bold>53E-6-901<parens/>. Substitute teachers.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="292" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "substitute teacher" means a licensed or non-licensed individual <ln numlevel="1" lineno="293" slineno="5-4"/>who is employed by a school district to fill in for a regular classroom teacher during the <ln numlevel="1" lineno="294" slineno="5-5"/>teacher's temporary absence from the classroom.</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="295" slineno="5-6" level="1"><display>(2)</display>When hiring substitute teachers, school districts shall prioritize licensed educators as <ln numlevel="1" lineno="296" slineno="5-7"/>substitutes when available.</subsection><subsection ssid="8-null-3" dnum="3-o" numlevel="1" lineno="297" slineno="5-8" level="1"><display>(3)</display>An individual shall submit to a background check in accordance with Section <xref depth="3" refnumber="53G-11-402"><ln numlevel="1" lineno="298" slineno="5-9"/>53G-11-402</xref> prior to employment as a substitute teacher.</subsection><subsection ssid="8-null-4" dnum="4-o" numlevel="1" lineno="299" slineno="5-10" level="1"><display>(4)</display>A teacher's position in the classroom may not be filled by a non-licensed substitute <ln numlevel="1" lineno="300" slineno="5-11"/>teacher for more than a total of 20 days during any school year unless a licensed <ln numlevel="1" lineno="301" slineno="5-12"/>educator is not available.</subsection><subsection ssid="8-null-5" dnum="5-o" numlevel="1" lineno="302" slineno="5-13" level="1"><display>(5)</display>An individual <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">who is ineligible to hold a license for reasons described in Title 53E, <ln numlevel="1" lineno="303" slineno="5-14"/>Chapter 6, Part 6, License Denial and Discipline, </amend><amendoutend style="2"/>may not serve as a substitute teacher<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> <ln numlevel="1" lineno="304" slineno="5-15"/>if:</amend><subsection ssid="8-6" dnum="_-o:a-i" numlevel="1" lineno="305" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">the individual is ineligible to hold a license under Section <xref depth="3" refnumber="53E-6-603">53E-6-603</xref>; or</amend></subsection><subsection ssid="8-7" dnum="_-o:b-i" numlevel="1" lineno="306" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's license has been suspended or revoked and the restrictions described <ln numlevel="1" lineno="307" slineno="5-18"/>in Section <xref depth="3" refnumber="53E-6-604.5">53E-6-604.5</xref> apply to the individual.</amend></subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="308" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="308">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="309"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-19-26 12:26 PM</tm></rev></foot></leg>
