Section <bold>52-6-201</bold> is amended to read:</secline><catline lineno="33"><bold>52-6-201<parens/>. Indictment or information against officer or employee -- <ln numlevel="1" lineno="34" slineno="1-3"/>Reimbursement of attorney fees and court costs incurred in defense.</bold></catline><subsection ssid="1-null-1" dnum="1-o:_-i" numlevel="1" lineno="35" slineno="1-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" placement="noreturn"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1000" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">Except as provided in Subsection <xref depth="4" refnumber="52-6-201(3)" start="0">(3)</xref>, and subject to Subsection <xref depth="4" refnumber="52-6-201(2)" start="0">(2)</xref>, if a state grand <ln numlevel="1" lineno="36" slineno="1-5"/>jury indicts, or if an information is filed against, an officer or employee, in connection <ln numlevel="1" lineno="37" slineno="1-6"/>with or arising out of any act or omission of that officer or employee during the <ln numlevel="1" lineno="38" slineno="1-7"/>performance of the officer or employee's duties, within the scope of the officer or <ln numlevel="1" lineno="39" slineno="1-8"/>employee's employment, or under color of the officer or employee's authority, and that <ln numlevel="1" lineno="40" slineno="1-9"/>indictment or information is quashed or dismissed or results in a judgment of acquittal, <ln numlevel="1" lineno="41" slineno="1-10"/>unless the indictment or information is quashed or dismissed upon application or motion <ln numlevel="1" lineno="42" slineno="1-11"/>of the prosecuting attorney, that officer or employee is entitled to recover reasonable <ln numlevel="1" lineno="43" slineno="1-12"/>attorney fees and court costs necessarily incurred in the defense of that indictment or <ln numlevel="1" lineno="44" slineno="1-13"/>information from the public entity, unless the officer or employee is found guilty of <ln numlevel="1" lineno="45" slineno="1-14"/>substantially the same misconduct that formed the basis for the indictment or <ln numlevel="1" lineno="46" slineno="1-15"/>information.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-2" dnum="2-o:_-i" numlevel="1" lineno="47" slineno="1-16" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1001" style="2" owner="o" level="1" deltag="start">(2)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">Except as provided in Subsection <xref depth="4" refnumber="52-6-201(3)" start="0">(3)</xref>, if the officer or employee is acquitted of some of <ln numlevel="1" lineno="48" slineno="1-17"/>the charges or counts, or portions of the indictment or information are quashed or <ln numlevel="1" lineno="49" slineno="1-18"/>dismissed, that officer or employee is entitled to recover from the public entity <ln numlevel="1" lineno="50" slineno="1-19"/>reasonable attorney fees and court costs necessarily incurred in the defense of those <ln numlevel="1" lineno="51" slineno="1-20"/>charges, counts, or portions of the indictment or information that were quashed, <ln numlevel="1" lineno="52" slineno="1-21"/>dismissed, or resulted in a judgment of acquittal, unless the alleged misconduct covered <ln numlevel="1" lineno="53" slineno="1-22"/>by those charges, counts, or portions of the indictment or information that were quashed, <ln numlevel="1" lineno="54" slineno="1-23"/>dismissed, or resulted in a judgment of acquittal is substantially the same alleged <ln numlevel="1" lineno="55" slineno="1-24"/>misconduct that formed the basis for charges, counts, or portions of the indictment or <ln numlevel="1" lineno="56" slineno="1-25"/>information of which the officer or employee was found guilty.</amend><amendoutend style="2"/></subsection><subsection ssid="1-12" dnum="_-o:1-i" numlevel="1" lineno="57" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="52-6-201(2)">(2)</xref>, an officer or employee who is indicted, or against <ln numlevel="1" lineno="58" slineno="1-27"/>whom an information is filed, for violation of a state law is entitled to recover from the <ln numlevel="1" lineno="59" slineno="1-28"/>public entity described in Subsection <xref depth="4" refnumber="52-6-201(3)">(3)</xref> reasonable attorney fees and court costs <ln numlevel="1" lineno="60" slineno="1-29"/>necessarily incurred in defense of a charge in the indictment or information, if:</amend><subsection ssid="1-13" dnum="_-o:a-i" numlevel="1" lineno="61" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">the charge is brought in connection with, or arising out of, an alleged act or omission <ln numlevel="1" lineno="62" slineno="1-31"/>of the officer or employee:</amend><subsection ssid="1-14" dnum="_-o:i-i" numlevel="1" lineno="63" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">during the performance of the officer's or employee's duties;</amend></subsection><subsection ssid="1-15" dnum="_-o:ii-i" numlevel="1" lineno="64" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">within the scope of the officer's or employee's employment; or</amend></subsection><subsection ssid="1-16" dnum="_-o:iii-i" numlevel="1" lineno="65" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">under color of the officer's or employee's authority; <marker pairid="140"/>and</amend></subsection></subsection><subsection ssid="1-17" dnum="_-o:b-i" numlevel="1" lineno="66" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">the charge, or the entire indictment or information, is quashed, dismissed, or results <ln numlevel="1" lineno="67" slineno="1-36"/>in a judgment of acquittal.</amend></subsection></subsection><subsection ssid="1-11" dnum="_-o:2-i" numlevel="1" lineno="68" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">An officer or employee is not entitled to recover attorney fees or court costs under <ln numlevel="1" lineno="69" slineno="1-38"/>Subsection <xref depth="4" refnumber="52-6-201(1)">(1)</xref>:</amend><subsection ssid="1-18" dnum="_-o:a-i" numlevel="1" lineno="70" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">if the officer or employee is found guilty of another violation of law for substantially <ln numlevel="1" lineno="71" slineno="1-40"/>the same act or omission that formed the basis for the charge described in Subsection <xref depth="4" refnumber="52-6-201(1)"><ln numlevel="1" lineno="72" slineno="1-41"/>(1)</xref>;</amend></subsection><subsection ssid="1-19" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">in relation to a charge in an indictment, if the charge, or the entire indictment, is <ln numlevel="1" lineno="74" slineno="1-43"/>quashed or dismissed upon application or motion of the prosecuting attorney; or</amend></subsection><subsection ssid="1-20" dnum="_-o:c-i" numlevel="1" lineno="75" slineno="1-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">in relation to a charge in an information, if the charge, or the entire information, is, <ln numlevel="1" lineno="76" slineno="1-45"/>no later than 45 days after the day on which the charge is bound over for trial as a <ln numlevel="1" lineno="77" slineno="1-46"/>result of a preliminary hearing, quashed or dismissed upon application or motion of <ln numlevel="1" lineno="78" slineno="1-47"/>the prosecuting attorney.</amend></subsection></subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="79" slineno="1-48" level="1"><display>(3)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="53" style="2" owner="jchristopherson" level="1" deltag="both">An</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The following public entity shall pay the reasonable attorney fees and court costs <ln numlevel="1" lineno="80" slineno="1-49"/>that an</amend> officer or employee <amend anum="0" ea="amend" pairid="82" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both">is </amend>entitled to recover<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both"> reasonable attorney fees and court costs</amend><amendoutend style="2"/><ln numlevel="1" lineno="81" slineno="1-50"/> under Subsection <xref depth="4" refnumber="52-6-201(1)" start="0">(1)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both"> or <xref depth="4" refnumber="52-6-201(2)" start="0">(2)</xref> in connection with the officer's or employee's position <ln numlevel="1" lineno="82" slineno="1-51"/>within a political subdivision, is entitled to recover all fees and costs from the state <ln numlevel="1" lineno="83" slineno="1-52"/>rather than the political subdivision, if</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="155" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="150"/></amend>:<subsection ssid="1-21" dnum="_-o:a-i" numlevel="1" lineno="84" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection <xref depth="4" refnumber="52-6-201(3)(b)">(3)(b)</xref>, <marker pairid="152"/>the public entity for which the officer or <ln numlevel="1" lineno="85" slineno="1-54"/>employee, in relation to the alleged violation:</amend><subsection ssid="1-23" dnum="_-o:i-i" numlevel="1" lineno="86" slineno="1-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">was engaged in performing a duty described in Subsection <xref depth="4" refnumber="52-6-201(1)(a)(i)">(1)(a)(i)</xref>;</amend></subsection><subsection ssid="1-24" dnum="_-o:ii-i" numlevel="1" lineno="87" slineno="1-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">acted, or failed to act, within the scope of the officer's or employee's employment; <ln numlevel="1" lineno="88" slineno="1-57"/>or</amend></subsection><subsection ssid="1-25" dnum="_-o:iii-i" numlevel="1" lineno="89" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">acted, or failed to act, under color of the officer's or employee's authority; or</amend></subsection></subsection><subsection ssid="1-26" dnum="_-o:b-i" numlevel="1" lineno="90" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">the state, if:</amend><subsection ssid="1-27" dnum="_-o:i-i" numlevel="1" lineno="91" slineno="1-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">the public entity described in Subsection <xref depth="4" refnumber="52-6-201(3)(a)">(3)(a)</xref> is a political subdivision of the <ln numlevel="1" lineno="92" slineno="1-61"/>state;</amend></subsection><subsection ssid="1-22" dnum="_-o:ii-i" numlevel="1" lineno="93" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display><subsection ssid="1-null-4" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>after the local attorney declines to pursue an indictment, or file an information, <ln numlevel="1" lineno="94" slineno="1-63"/>against the officer or employee, the attorney general obtains an indictment, or files an <ln numlevel="1" lineno="95" slineno="1-64"/>information, against the officer or employee;</subsection></subsection><subsection ssid="1-null-5" dnum="b-o:iii-i" numlevel="1" lineno="96" slineno="1-65" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the alleged misconduct forming the basis of the indictment or information <ln numlevel="1" lineno="97" slineno="1-66"/>against the officer or employee is substantially similar to the facts or investigation <ln numlevel="1" lineno="98" slineno="1-67"/>results upon which the local attorney relied in deciding not to pursue an <ln numlevel="1" lineno="99" slineno="1-68"/>indictment, or file an information, against the officer or employee; and</subsection><subsection ssid="1-null-6" dnum="c-o:iv-i" numlevel="1" lineno="100" slineno="1-69" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>the attorney general pursued the indictment, or filed the information, against <ln numlevel="1" lineno="101" slineno="1-70"/>the officer or employee, for a reason other than that:<subsection ssid="1-null-7" dnum="i-o:A-i" numlevel="1" lineno="102" slineno="1-71" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>the local attorney requested the attorney general's involvement in the <ln numlevel="1" lineno="103" slineno="1-72"/>prosecution of the officer or employee due to a conflict of interest; or</subsection><subsection ssid="1-null-8" dnum="ii-o:B-i" numlevel="1" lineno="104" slineno="1-73" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>the local attorney lacked the resources or subject matter expertise to <ln numlevel="1" lineno="105" slineno="1-74"/>initiate or proceed with the prosecution of the officer or employee.</subsection></subsection></subsection></subsection><subsection ssid="1-null-9" dnum="4-o" numlevel="1" lineno="106" slineno="1-75" level="1"><display>(4)</display>An officer or employee who <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="127" groupid="96" style="2" owner="jchristopherson" level="1" deltag="both">recovers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="124" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is entitled to recover reasonable attorney fees and <ln numlevel="1" lineno="107" slineno="1-76"/>court costs</amend> under <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="133" groupid="102" style="2" owner="jchristopherson" level="1" deltag="both">this section shall also be</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="125" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="52-6-201(1)">(1)</xref> from a public entity described <ln numlevel="1" lineno="108" slineno="1-77"/>in Subsection <xref depth="4" refnumber="52-6-201(3)">(3)</xref> is also</amend> entitled to recover <amend anum="0" ea="amend" pairid="126" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both">from that public entity </amend>reasonable attorney <ln numlevel="1" lineno="109" slineno="1-78"/>fees and costs necessarily incurred by the officer or employee in recovering the attorney <ln numlevel="1" lineno="110" slineno="1-79"/>fees and <amend anum="0" ea="amend" pairid="137" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="both">court </amend>costs <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="134" groupid="103" style="2" owner="jchristopherson" level="1" deltag="both">allowed under this section</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="132" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">to which the officer or employee is <ln numlevel="1" lineno="111" slineno="1-80"/>entitled under Subsection <xref depth="4" refnumber="52-6-201(1)">(1)</xref></amend>, including attorney fees and <amend anum="0" ea="amend" pairid="138" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="both">court </amend>costs incurred on appeal.</subsection><subsection ssid="1-null-10" dnum="5-o:_-i" numlevel="1" lineno="112" slineno="1-81" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(5)</amend></display><amend anum="0" ea="erase" pairid="72" groupid="50" style="2" owner="jchristopherson" level="1" deltag="end">Notwithstanding any other provision of this section, an officer or employee may not <ln numlevel="1" lineno="113" slineno="1-82"/>recover for the costs incurred in defense of any charge, count, or portion of the <ln numlevel="1" lineno="114" slineno="1-83"/>indictment or information that is quashed or dismissed upon application or motion of the <ln numlevel="1" lineno="115" slineno="1-84"/>prosecuting attorney.</amend><amendoutend
