Section <bold>52-6-201</bold> is repealed and reenacted to read:</secline><catline lineno="25"><bold>52-6-201<parens/>. Indictment or information against officer or employee -- <ln numlevel="1" lineno="26" slineno="1-3"/>Reimbursement of attorney fees and court costs incurred in defense.</bold></catline><subsection ssid="6-2" dnum="_-o:1-i" numlevel="1" lineno="27" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection (2), a court in which a criminal charge is, by <ln numlevel="1" lineno="28" slineno="1-5"/>indictment or information, brought against an officer or employee for violation of a state <ln numlevel="1" lineno="29" slineno="1-6"/>law may order a public entity described in Subsection (3) to pay the reasonable attorney <ln numlevel="1" lineno="30" slineno="1-7"/>fees and court costs necessarily incurred by the officer or employee in defense of the <ln numlevel="1" lineno="31" slineno="1-8"/>charge, if:</amend><subsection ssid="6-3" dnum="_-o:a-i" numlevel="1" lineno="32" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the charge is brought in connection with, or arising out of, an alleged act or omission <ln numlevel="1" lineno="33" slineno="1-10"/>of the officer or employee:</amend><subsection ssid="6-4" dnum="_-o:i-i" numlevel="1" lineno="34" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">during the performance of the officer's or employee's duties;</amend></subsection><subsection ssid="6-5" dnum="_-o:ii-i" numlevel="1" lineno="35" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">within the scope of the officer's or employee's employment; or</amend></subsection><subsection ssid="6-6" dnum="_-o:iii-i" numlevel="1" lineno="36" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">under color of the officer's or employee's authority;<marker pairid="140"/></amend></subsection></subsection><subsection ssid="6-7" dnum="_-o:b-i" numlevel="1" lineno="37" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the charge, or the entire indictment or information, is quashed, dismissed, or results <ln numlevel="1" lineno="38" slineno="1-15"/>in a judgment of acquittal; and</amend></subsection><subsection ssid="6-8" dnum="_-o:c-i" numlevel="1" lineno="39" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the court finds that the public entity acted in bad faith in relation to the charge.</amend></subsection></subsection><subsection ssid="6-9" dnum="_-o:2-i" numlevel="1" lineno="40" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">An officer or employee is not entitled to recover attorney fees or court costs under <ln numlevel="1" lineno="41" slineno="1-18"/>Subsection (1) if the officer or employee is found guilty of another violation of law for <ln numlevel="1" lineno="42" slineno="1-19"/>substantially the same act or omission that formed the basis for the charge described in <ln numlevel="1" lineno="43" slineno="1-20"/>Subsection (1).</amend></subsection><subsection ssid="6-10" dnum="_-o:3-i" numlevel="1" lineno="44" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">The court may order the following public entities to pay the reasonable attorney fees <ln numlevel="1" lineno="45" slineno="1-22"/>and court costs described in Subsection (1) if the court finds, under Subsection (1)(c), <ln numlevel="1" lineno="46" slineno="1-23"/>that the public entity acted in bad faith in relation to the charge:</amend><subsection ssid="6-11" dnum="_-o:a-i" numlevel="1" lineno="47" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end"><marker pairid="152"/>the public entity for which the officer or employee, in relation to the alleged <ln numlevel="1" lineno="48" slineno="1-25"/>violation:</amend><subsection ssid="6-12" dnum="_-o:i-i" numlevel="1" lineno="49" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">was engaged in performing a duty described in Subsection (1)(a)(i);</amend></subsection><subsection ssid="6-13" dnum="_-o:ii-i" numlevel="1" lineno="50" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">acted, or failed to act, within the scope of the officer's or employee's employment; <ln numlevel="1" lineno="51" slineno="1-28"/>or</amend></subsection><subsection ssid="6-14" dnum="_-o:iii-i" numlevel="1" lineno="52" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">acted, or failed to act, under color of the officer's or employee's authority; or</amend></subsection></subsection><subsection ssid="6-15" dnum="_-o:b-i" numlevel="1" lineno="53" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the municipal prosecutor's office, the county attorney's office, the district attorney's <ln numlevel="1" lineno="54" slineno="1-31"/>office, or the attorney general's office that pursued the charges.</amend></subsection></subsection><subsection ssid="6-16" dnum="_-o:4-i" numlevel="1" lineno="55" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">If the court finds that the entity described in Subsection (3)(a) and the entity described <ln numlevel="1" lineno="56" slineno="1-33"/>in Subsection (3)(b) both acted in bad faith, the court may order each public entity to <ln numlevel="1" lineno="57" slineno="1-34"/>pay half of the reasonable court costs and attorney fees.</amend></subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="58" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="58">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="59"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-6-26 11:47 PM</tm></rev></foot></leg>
