Section <bold>10-20-504</bold> is amended to read:</secline><catline lineno="32"><bold>10-20-504<parens/>. Temporary land use regulations.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="10-9a-504(2)(b)" start="0">(2)(b)</xref>, a municipal legislative body may, <ln numlevel="1" lineno="34" slineno="1-4"/>without prior consideration of or recommendation from the planning commission, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="35" slineno="1-5"/>enact</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">adopt</amend> an ordinance establishing a temporary land use regulation for any part or <ln numlevel="1" lineno="36" slineno="1-6"/>all of the area within the municipality if:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="37" slineno="1-7" level="3" tab="1"><display>(i)</display>the legislative body makes a finding of compelling, countervailing public interest; <ln numlevel="1" lineno="38" slineno="1-8"/>or</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="39" slineno="1-9" level="3" tab="1"><display>(ii)</display>the area is unregulated.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="40" slineno="1-10" level="2"><display>(b)</display>A temporary land use regulation under Subsection <xref depth="4" refnumber="10-9a-504(1)(a)" start="0">(1)(a)</xref> may<amend anum="0" ea="amend" pairid="30" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both"> not:</amend> <subsection ssid="1-17" dnum="_-o:i-i" numlevel="1" lineno="41" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>prohibit or regulate the erection, construction, reconstruction, or alteration of any <ln numlevel="1" lineno="42" slineno="1-12"/>building or structure or any subdivision approval<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend><subsection ssid="1-null-6" dnum="c-o:_-i" numlevel="1" lineno="43" slineno="1-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="37" groupid="35" style="2" owner="jchristopherson" level="1" deltag="end">A temporary land use regulation under Subsection <xref depth="4" refnumber="10-9a-504(1)(a)" start="0">(1)(a)</xref> may not </amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-18" dnum="_-o:ii-i" numlevel="1" lineno="44" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>impose an impact fee or other financial requirement on building or development.</subsection></subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="45" slineno="1-15" level="1" space="false"><display>(2)</display><subsection ssid="1-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">The </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A </amend>municipal legislative body <amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">that adopts an ordinance establishing a <ln numlevel="1" lineno="46" slineno="1-16"/>temporary land use regulation </amend>shall establish a period of limited effect for the <ln numlevel="1" lineno="47" slineno="1-17"/>ordinance <amend anum="0" ea="amend" pairid="19" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both">that does </amend>not<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both"> to</amend><amendoutend style="2"/> exceed 180 days.</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="48" slineno="1-18" level="2"><display>(b)</display>A municipal legislative body may not apply the provisions of a temporary land use <ln numlevel="1" lineno="49" slineno="1-19"/>regulation to the review of a specific land use application if the land use application <ln numlevel="1" lineno="50" slineno="1-20"/>is impaired or prohibited by proceedings initiated under Subsection <xref depth="4" refnumber="10-20-902(1)(a)(ii)(b)"><ln numlevel="1" lineno="51" slineno="1-21"/>10-20-902(1)(a)(ii)(B)</xref>.</subsection></subsection><subsection ssid="1-null-10" dnum="3-o" numlevel="1" lineno="52" slineno="1-22" level="1" space="false"><display>(3)</display><subsection ssid="1-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipal legislative body may, without prior planning commission <ln numlevel="1" lineno="53" slineno="1-23"/>consideration or recommendation, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">enact</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">adopt</amend> an ordinance establishing a <ln numlevel="1" lineno="54" slineno="1-24"/>temporary land use regulation prohibiting construction, subdivision approval, and <ln numlevel="1" lineno="55" slineno="1-25"/>other development activities within an area that is the subject of an <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="106" groupid="80" style="2" owner="jchristopherson" level="1" deltag="both">Environmental <ln numlevel="1" lineno="56" slineno="1-26"/>Impact Statement</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="104" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">environmental impact statement</amend> or a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="107" groupid="81" style="2" owner="jchristopherson" level="1" deltag="both">Major Investment Study</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="105" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="57" slineno="1-27"/>major investment study</amend> examining the area as a proposed highway or transportation <ln numlevel="1" lineno="58" slineno="1-28"/>corridor.</subsection><subsection ssid="1-null-12" dnum="b-o" numlevel="1" lineno="59" slineno="1-29" level="2"><display>(b)</display>A regulation under Subsection <xref depth="4" refnumber="10-9a-504(3)(a)" start="0">(3)(a)</xref>:<subsection ssid="1-null-13" dnum="i-o" numlevel="1" lineno="60" slineno="1-30" level="3"><display>(i)</display>may not exceed 180 days in duration;</subsection><subsection ssid="1-null-14" dnum="ii-o" numlevel="1" lineno="61" slineno="1-31" level="3"><display>(ii)</display>may be renewed, if requested by the Transportation Commission created under <ln numlevel="1" lineno="62" slineno="1-32"/>Section <xref depth="3" refnumber="72-1-301" start="0">72-1-301</xref>, for up to two additional 180-day periods by <amend anum="0" ea="amend" pairid="83" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both">an </amend>ordinance <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="63" slineno="1-33"/>enacted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">adopted</amend> before the expiration of the previous regulation; and</subsection><subsection ssid="1-null-15" dnum="iii-o" numlevel="1" lineno="64" slineno="1-34" level="3"><display>(iii)</display>notwithstanding Subsections <xref depth="4" refnumber="10-9a-504(3)(b)(i)" start="0">(3)(b)(i)</xref> and <xref depth="4" refnumber="10-9a-504(3)(b)(ii)" start="0">(ii)</xref>, is effective only as long as the <ln numlevel="1" lineno="65" slineno="1-35"/>Environmental Impact Statement or Major Investment Study is in progress.</subsection></subsection></subsection><subsection ssid="1-16" dnum="_-o:4-i" numlevel="1" lineno="66" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">A municipal legislative body may not adopt an ordinance establishing a temporary land <ln numlevel="1" lineno="67" slineno="1-37"/>use regulation that limits or impairs the rights of a property owner under a recorded <ln numlevel="1" lineno="68" slineno="1-38"/>development agreement that a county approved before the municipality:</amend><subsection ssid="1-23" dnum="_-o:a-i" numlevel="1" lineno="69" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">incorporated; or</amend></subsection><subsection ssid="1-24" dnum="_-o:b-i" numlevel="1" lineno="70" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">annexed the real property that is the subject of the development agreement.</amend></subsection></subsection></section></bsec><bsec buid="2" num="10-20-508" type="amend" src="code" uid="C10-20-S508_2026050620260506" sort="10 20 05080020260506" numlevel="1" lineno="71" slineno="2-1" sn="2"><section number="10-20-508" numlevel="1" lineno="72" slineno="2-2" type="amend"><secline lineno="71">Section 2. Section <bold>10-20-508</bold> is amended to read:</secline><catline lineno="72"><bold>10-20-508<parens/>. Development agreements.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="73" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsection <xref depth="4" refnumber="10-9a-532(2)">(2)</xref>, a municipality may enter into a development agreement <ln numlevel="1" lineno="74" slineno="2-4"/>containing any term that the municipality considers necessary or appropriate to <ln numlevel="1" lineno="75" slineno="2-5"/>accomplish the purposes of this chapter, including a term relating to:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="76" slineno="2-6" level="2"><display>(a)</display>a master planned development;</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="77" slineno="2-7" level="2"><display>(b)</display>a planned unit development;</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="78" slineno="2-8" level="2"><display>(c)</display>an annexation;</subsection><subsection ssid="2-null-5" dnum="d-o" numlevel="1" lineno="79" slineno="2-9" level="2"><display>(d)</display>affordable or moderate income housing with development incentives;</subsection><subsection ssid="2-null-6" dnum="e-o" numlevel="1" lineno="80" slineno="2-10" level="2"><display>(e)</display>a public-private partnership; or</subsection><subsection ssid="2-null-7" dnum="f-o" numlevel="1" lineno="81" slineno="2-11" level="2"><display>(f)</display>a density transfer or bonus within a development project or between development <ln numlevel="1" lineno="82" slineno="2-12"/>projects.</subsection></subsection><subsection ssid="2-null-8" dnum="2-o" numlevel="1" lineno="83" slineno="2-13" level="1" space="false"><display>(2)</display><subsection ssid="2-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="10-20-508(2)(g)">(2)(g)</xref> or <xref depth="4" refnumber="10-20-508(2)(h)">(2)(h)</xref>, a</amend> development agreement <ln numlevel="1" lineno="84" slineno="2-14"/>may not:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="85" slineno="2-15" level="3" tab="1"><display>(i)</display>limit a municipality's authority in the future to:<subsection ssid="2-null-11" dnum="A-o" numlevel="1" lineno="86" slineno="2-16" level="4"><display>(A)</display>enact a land use regulation; or</subsection><subsection ssid="2-null-12" dnum="B-o" numlevel="1" lineno="87" slineno="2-17" level="4"><display>(B)</display>take any action allowed under Section <xref depth="3" refnumber="10-8-84">10-8-84</xref>;</subsection></subsection><subsection ssid="2-null-13" dnum="ii-o" numlevel="1" lineno="88" slineno="2-18" level="3" tab="1"><display>(ii)</display>require a municipality to change the zoning designation of an area of land within <ln numlevel="1" lineno="89" slineno="2-19"/>the municipality in the future; or</subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="90" slineno="2-20" level="3" tab="1"><display>(iii)</display>allow a use or development of land that applicable land use regulations <ln numlevel="1" lineno="91" slineno="2-21"/>governing the area subject to the development agreement would otherwise <ln numlevel="1" lineno="92" slineno="2-22"/>prohibit, unless the legislative body approves the development agreement in <ln numlevel="1" lineno="93" slineno="2-23"/>accordance with the same procedures for enacting a land use regulation under <ln numlevel="1" lineno="94" slineno="2-24"/>Section <xref depth="3" refnumber="10-20-502">10-20-502</xref>, including a review and recommendation from the planning <ln numlevel="1" lineno="95" slineno="2-25"/>commission and a public hearing.</subsection></subsection><subsection ssid="2-null-15" dnum="b-o" numlevel="1" lineno="96" slineno="2-26" level="2"><display>(b)</display>A development agreement that requires the implementation of an existing land use <ln numlevel="1" lineno="97" slineno="2-27"/>regulation as an administrative act does not require a legislative body's approval <ln numlevel="1" lineno="98" slineno="2-28"/>under Section <xref depth="3" refnumber="10-20-502">10-20-502</xref>.</subsection><subsection ssid="2-null-16" dnum="c-o" numlevel="1" lineno="99" slineno="2-29" level="2"><display>(c)</display>Subject to Subsection <xref depth="4" refnumber="10-9a-532(2)(d)">(2)(d)</xref>, a municipality may require a development agreement <ln numlevel="1" lineno="100" slineno="2-30"/>for developing land within the municipality if the applicant has applied for a <ln numlevel="1" lineno="101" slineno="2-31"/>legislative or discretionary approval, including an approval relating to:<subsection ssid="2-null-17" dnum="i-o" numlevel="1" lineno="102" slineno="2-32" level="3"><display>(i)</display>the height of a structure;</subsection><subsection ssid="2-null-18" dnum="ii-o" numlevel="1" lineno="103" slineno="2-33" level="3"><display>(ii)</display>a parking or setback exception;</subsection><subsection ssid="2-null-19" dnum="iii-o" numlevel="1" lineno="104" slineno="2-34" level="3"><display>(iii)</display>a density transfer or bonus;</subsection><subsection ssid="2-null-20" dnum="iv-o" numlevel="1" lineno="105" slineno="2-35" level="3"><display>(iv)</display>a development incentive;</subsection><subsection ssid="2-null-21" dnum="v-o" numlevel="1" lineno="106" slineno="2-36" level="3"><display>(v)</display>a zone change; or</subsection><subsection ssid="2-null-22" dnum="vi-o" numlevel="1" lineno="107" slineno="2-37" level="3"><display>(vi)</display>an amendment to a prior development agreement.</subsection></subsection><subsection ssid="2-null-23" dnum="d-o" numlevel="1" lineno="108" slineno="2-38" level="2"><display>(d)</display>A municipality may not require a development agreement as a condition for <ln numlevel="1" lineno="109" slineno="2-39"/>developing land within the municipality if:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="110" slineno="2-40" level="3"><display>(i)</display>the development otherwise complies with applicable statute and municipal <ln numlevel="1" lineno="111" slineno="2-41"/>ordinances;</subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="112" slineno="2-42" level="3"><display>(ii)</display>the development is an allowed or permitted use; or</subsection><subsection ssid="2-null-26" dnum="iii-o" numlevel="1" lineno="113" slineno="2-43" level="3"><display>(iii)</display>the municipality's land use regulations otherwise establish all applicable <ln numlevel="1" lineno="114" slineno="2-44"/>standards for development on the land.</subsection></subsection><subsection ssid="2-null-27" dnum="e-o" numlevel="1" lineno="115" slineno="2-45" level="2"><display>(e)</display>A municipality may submit to a county recorder's office for recording:<subsection ssid="2-null-28" dnum="i-o" numlevel="1" lineno="116" slineno="2-46" level="3"><display>(i)</display>a fully executed<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> development</amend> agreement; or</subsection><subsection ssid="2-null-29" dnum="ii-o" numlevel="1" lineno="117" slineno="2-47" level="3"><display>(ii)</display>a document related to:<subsection ssid="2-null-30" dnum="A-o" numlevel="1" lineno="118" slineno="2-48" level="4"><display>(A)</display>code enforcement;</subsection><subsection ssid="2-null-31" dnum="B-o" numlevel="1" lineno="119" slineno="2-49" level="4"><display>(B)</display>a special assessment area;</subsection><subsection ssid="2-null-32" dnum="C-o" numlevel="1" lineno="120" slineno="2-50" level="4"><display>(C)</display>a local historic district boundary; or</subsection><subsection ssid="2-null-33" dnum="D-o" numlevel="1" lineno="121" slineno="2-51" level="4"><display>(D)</display>the memorializing or enforcement of an agreed upon restriction, incentive, or <ln numlevel="1" lineno="122" slineno="2-52"/>covenant.</subsection></subsection></subsection><subsection ssid="2-null-34" dnum="f-o" numlevel="1" lineno="123" slineno="2-53" level="2"><display>(f)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="90" groupid="71" style="2" owner="jchristopherson" level="1" deltag="both">Subject to Subsection <xref depth="4" refnumber="10-9a-532(2)(e)">(2)(e)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except for a development agreement approved in <ln numlevel="1" lineno="124" slineno="2-54"/>accordance with this section or a document described in Subsection <xref depth="4" refnumber="10-20-508(2)(e)(ii)">(2)(e)(ii)</xref></amend>, a <ln numlevel="1" lineno="125" slineno="2-55"/>municipality may not cause to be recorded against private real property a document <ln numlevel="1" lineno="126" slineno="2-56"/>that imposes development requirements, development regulations, or development <ln numlevel="1" lineno="127" slineno="2-57"/>controls on the property.</subsection><subsection ssid="2-null-35" dnum="g-o" numlevel="1" lineno="128" slineno="2-58" level="2"><display>(g)</display>To the extent that a development agreement<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="2-52" dnum="_-o:i-i" numlevel="1" lineno="129" slineno="2-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>does not specifically address a matter or concern related to land use or <ln numlevel="1" lineno="130" slineno="2-60"/>development, the matter or concern is governed by:<subsection ssid="2-null-36" dnum="i-o:A-i" numlevel="1" lineno="131" slineno="2-61" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>this chapter; and</subsection><subsection ssid="2-null-37" dnum="ii-o:B-i" numlevel="1" lineno="132" slineno="2-62" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>any applicable land use regulations<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection></subsection><subsection ssid="2-44" dnum="_-o:ii-i" numlevel="1" lineno="133" slineno="2-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">conflicts with a land use regulation, the development agreement governs with <ln numlevel="1" lineno="134" slineno="2-64"/>respect to the development and use of the real property that is the subject of the <ln numlevel="1" lineno="135" slineno="2-65"/>development agreement.</amend></subsection></subsection><subsection ssid="2-38" dnum="_-o:h-i" numlevel="1" lineno="136" slineno="2-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">For a real property in a municipality that is the subject of a recorded development <ln numlevel="1" lineno="137" slineno="2-67"/>agreement that a county approved before the municipality incorporated or before the <ln numlevel="1" lineno="138" slineno="2-68"/>municipality annexed the property, the municipality may not:</amend><subsection ssid="2-49" dnum="_-o:i-i" numlevel="1" lineno="139" slineno="2-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">limit or impair the development or use of the property as specified in the <ln numlevel="1" lineno="140" slineno="2-70"/>development agreement; or</amend></subsection><subsection ssid="2-47" dnum="_-o:ii-i" numlevel="1" lineno="141" slineno="2-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">refuse to provide municipal services to the property:</amend><subsection ssid="2-50" dnum="_-o:A-i" numlevel="1" lineno="142" slineno="2-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">that the municipality provides to other real property within the municipality's <ln numlevel="1" lineno="143" slineno="2-73"/>boundaries; or</amend></subsection><subsection ssid="2-51" dnum="_-o:B-i" numlevel="1" lineno="144" slineno="2-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">that the development agreement specifies that a county or municipality will <ln numlevel="1" lineno="145" slineno="2-75"/>provide to the property.</amend></subsection></subsection></subsection></subsection></section></bsec><bsec buid="3" num="10-20-902" type="amend" src="code" uid="C10-20-S902_2026050620260506" sort="10 20 09020020260506" numlevel="1" lineno="146" slineno="3-1" sn="3"><section number="10-20-902" numlevel="1" lineno="147" slineno="3-2" type="amend"><secline lineno="146">Section 3. Section <bold>10-20-902</bold> is amended to read:</secline><catline lineno="147"><bold>10-20-902<parens/>. Applicant's entitlement to land use application approval -- <ln numlevel="1" lineno="148" slineno="3-3"/>Municipality's requirements and limitations -- Vesting upon submission of development <ln numlevel="1" lineno="149" slineno="3-4"/>plan and schedule.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="150" slineno="3-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-null-3" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>An applicant who has submitted a complete land use application as <ln numlevel="1" lineno="151" slineno="3-6"/>described in Subsection <xref depth="4" refnumber="10-9a-509(1)(c)">(1)(c)</xref>, including the payment of all application fees, is <ln numlevel="1" lineno="152" slineno="3-7"/>entitled to substantive review of the application under the land use regulations:<subsection ssid="3-null-4" dnum="A-o" numlevel="1" lineno="153" slineno="3-8" level="4" tab="2"><display>(A)</display>in effect on the date that the application is complete; and</subsection><subsection ssid="3-null-5" dnum="B-o" numlevel="1" lineno="154" slineno="3-9" level="4" tab="2"><display>(B)</display>applicable to the application or to the information shown on the application.</subsection></subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="155" slineno="3-10" level="3" tab="1"><display>(ii)</display>An applicant is entitled to approval of a land use application if the application <ln numlevel="1" lineno="156" slineno="3-11"/>conforms to the requirements of the applicable land use regulations, land use <ln numlevel="1" lineno="157" slineno="3-12"/>decisions, and development standards in effect when the applicant submits a <ln numlevel="1" lineno="158" slineno="3-13"/>complete application and pays application fees, unless:<subsection ssid="3-null-7" dnum="A-o" numlevel="1" lineno="159" slineno="3-14" level="4"><display>(A)</display>the land use authority, on the record, formally finds that a compelling, <ln numlevel="1" lineno="160" slineno="3-15"/>countervailing public interest would be jeopardized by approving the <ln numlevel="1" lineno="161" slineno="3-16"/>application and specifies the compelling, countervailing public interest in <ln numlevel="1" lineno="162" slineno="3-17"/>writing; or</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="163" slineno="3-18" level="4"><display>(B)</display>in the manner provided by local ordinance and before the applicant submits <ln numlevel="1" lineno="164" slineno="3-19"/>the application, the municipality formally initiates proceedings to amend the <ln numlevel="1" lineno="165" slineno="3-20"/>municipality's land use regulations in a manner that would prohibit approval of <ln numlevel="1" lineno="166" slineno="3-21"/>the application as submitted.</subsection></subsection></subsection><subsection ssid="3-null-9" dnum="b-o" numlevel="1" lineno="167" slineno="3-22" level="2"><display>(b)</display>The municipality shall process an application without regard to proceedings the <ln numlevel="1" lineno="168" slineno="3-23"/>municipality initiated to amend the municipality's ordinances as described in <ln numlevel="1" lineno="169" slineno="3-24"/>Subsection <xref depth="4" refnumber="10-9a-509(1)(a)(ii)(b)">(1)(a)(ii)(B)</xref> if:<subsection ssid="3-null-10" dnum="i-o" numlevel="1" lineno="170" slineno="3-25" level="3"><display>(i)</display>180 days have passed since the municipality initiated the proceedings; and</subsection><subsection ssid="3-null-11" dnum="ii-o" numlevel="1" lineno="171" slineno="3-26" level="3" space="false"><display>(ii)</display><subsection ssid="3-null-12" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the proceedings have not resulted in an enactment that prohibits approval <ln numlevel="1" lineno="172" slineno="3-27"/>of the application as submitted; or</subsection><subsection ssid="3-null-13" dnum="B-o" numlevel="1" lineno="173" slineno="3-28" level="4"><display>(B)</display>during the 12 months before the municipality processing the application, or <ln numlevel="1" lineno="174" slineno="3-29"/>multiple applications of the same type, are impaired or prohibited under the <ln numlevel="1" lineno="175" slineno="3-30"/>terms of a temporary land use regulation adopted under Section <xref depth="3" refnumber="10-20-504">10-20-504</xref>.</subsection></subsection></subsection><subsection ssid="3-null-14" dnum="c-o" numlevel="1" lineno="176" slineno="3-31" level="2"><display>(c)</display>A land use application is considered submitted and complete when the applicant <ln numlevel="1" lineno="177" slineno="3-32"/>provides the application in a form that complies with the requirements of applicable <ln numlevel="1" lineno="178" slineno="3-33"/>ordinances and pays all applicable fees.</subsection><subsection ssid="3-null-15" dnum="d-o" numlevel="1" lineno="179" slineno="3-34" level="2"><display>(d)</display>A subsequent incorporation of a municipality or a petition that proposes the <ln numlevel="1" lineno="180" slineno="3-35"/>incorporation of a municipality does not affect<amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="3-57" dnum="_-o:i-i" numlevel="1" lineno="181" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>a land use application approved by a county in accordance with Section <xref depth="3" refnumber="17-79-803">17-79-803</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="182" slineno="3-37"/>or</amend></subsection><subsection ssid="3-58" dnum="_-o:ii-i" numlevel="1" lineno="183" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">a development agreement approved by a county in accordance with Section <xref depth="3" refnumber="17-79-508"><ln numlevel="1" lineno="184" slineno="3-39"/>17-79-508</xref>.</amend></subsection></subsection><subsection ssid="3-null-16" dnum="e-o" numlevel="1" lineno="185" slineno="3-40" level="2"><display>(e)</display>Unless a phasing sequence is required in an executed development agreement, a <ln numlevel="1" lineno="186" slineno="3-41"/>municipality shall, without regard to any other separate and distinct land use <ln numlevel="1" lineno="187" slineno="3-42"/>application, accept and process a complete land use application.</subsection><subsection ssid="3-null-17" dnum="f-o" numlevel="1" lineno="188" slineno="3-43" level="2"><display>(f)</display>The continuing validity of an approval of a land use application is conditioned upon <ln numlevel="1" lineno="189" slineno="3-44"/>the applicant proceeding after approval to implement the approval with reasonable <ln numlevel="1" lineno="190" slineno="3-45"/>diligence.</subsection><subsection ssid="3-null-18" dnum="g-o" numlevel="1" lineno="191" slineno="3-46" level="2"><display>(g)</display>A municipality may not impose on an applicant who has submitted a complete <ln numlevel="1" lineno="192" slineno="3-47"/>application a requirement that is not expressed in:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="193" slineno="3-48" level="3"><display>(i)</display>this chapter;</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="194" slineno="3-49" level="3"><display>(ii)</display>a municipal ordinance in effect on the date that the applicant submits a complete <ln numlevel="1" lineno="195" slineno="3-50"/>application, subject to Subsection <xref depth="4" refnumber="10-20-902(1)(a)(ii)">10-20-902(1)(a)(ii)</xref>; or</subsection><subsection ssid="3-null-21" dnum="iii-o" numlevel="1" lineno="196" slineno="3-51" level="3"><display>(iii)</display>a municipal specification for public improvements applicable to a subdivision or <ln numlevel="1" lineno="197" slineno="3-52"/>development that is in effect on the date that the applicant submits an application.</subsection></subsection><subsection ssid="3-null-22" dnum="h-o" numlevel="1" lineno="198" slineno="3-53" level="2"><display>(h)</display>A municipality may not impose on a holder of an issued land use permit or a final, <ln numlevel="1" lineno="199" slineno="3-54"/>unexpired subdivision plat a requirement that is not expressed:<subsection ssid="3-null-23" dnum="i-o" numlevel="1" lineno="200" slineno="3-55" level="3"><display>(i)</display>in a land use permit;</subsection><subsection ssid="3-null-24" dnum="ii-o" numlevel="1" lineno="201" slineno="3-56" level="3"><display>(ii)</display>on the subdivision plat;</subsection><subsection ssid="3-null-25" dnum="iii-o" numlevel="1" lineno="202" slineno="3-57" level="3"><display>(iii)</display>in a document on which the land use permit or subdivision plat is based;</subsection><subsection ssid="3-null-26" dnum="iv-o" numlevel="1" lineno="203" slineno="3-58" level="3"><display>(iv)</display>in the written record evidencing approval of the land use permit or subdivision <ln numlevel="1" lineno="204" slineno="3-59"/>plat;</subsection><subsection ssid="3-null-27" dnum="v-o" numlevel="1" lineno="205" slineno="3-60" level="3"><display>(v)</display>in this chapter;</subsection><subsection ssid="3-null-28" dnum="vi-o" numlevel="1" lineno="206" slineno="3-61" level="3"><display>(vi)</display>in a municipal ordinance; or</subsection><subsection ssid="3-null-29" dnum="vii-o" numlevel="1" lineno="207" slineno="3-62" level="3"><display>(vii)</display>in a municipal specification for residential roadways in effect at the time a <ln numlevel="1" lineno="208" slineno="3-63"/>residential subdivision was approved.</subsection></subsection><subsection ssid="3-null-30" dnum="i-o" numlevel="1" lineno="209" slineno="3-64" level="2"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="10-9a-509(1)(j)">(1)(j)</xref> or <xref depth="4" refnumber="10-9a-509(k)">(k)</xref>, a municipality may not withhold <ln numlevel="1" lineno="210" slineno="3-65"/>issuance of a certificate of occupancy or acceptance of subdivision improvements <ln numlevel="1" lineno="211" slineno="3-66"/>because of an applicant's failure to comply with a requirement that is not expressed:<subsection ssid="3-null-31" dnum="i-o" numlevel="1" lineno="212" slineno="3-67" level="3"><display>(i)</display>in the building permit or subdivision plat, documents on which the building permit <ln numlevel="1" lineno="213" slineno="3-68"/>or subdivision plat is based, or the written record evidencing approval of the land <ln numlevel="1" lineno="214" slineno="3-69"/>use permit or subdivision plat; or</subsection><subsection ssid="3-null-32" dnum="ii-o" numlevel="1" lineno="215" slineno="3-70" level="3"><display>(ii)</display>in this chapter or the municipality's ordinances.</subsection></subsection><subsection ssid="3-null-33" dnum="j-o" numlevel="1" lineno="216" slineno="3-71" level="2"><display>(j)</display>A municipality may not unreasonably withhold issuance of a certificate of occupancy <ln numlevel="1" lineno="217" slineno="3-72"/>where an applicant has met all requirements essential for the public health, public <ln numlevel="1" lineno="218" slineno="3-73"/>safety, and general welfare of the occupants, in accordance with this chapter, unless:<subsection ssid="3-null-34" dnum="i-o" numlevel="1" lineno="219" slineno="3-74" level="3"><display>(i)</display>the applicant and the municipality have agreed in a written document to the <ln numlevel="1" lineno="220" slineno="3-75"/>withholding of a certificate of occupancy; or</subsection><subsection ssid="3-null-35" dnum="ii-o" numlevel="1" lineno="221" slineno="3-76" level="3"><display>(ii)</display>the applicant has not provided a financial assurance for required and uncompleted <ln numlevel="1" lineno="222" slineno="3-77"/>public landscaping improvements or infrastructure improvements in accordance <ln numlevel="1" lineno="223" slineno="3-78"/>with an applicable local ordinance.</subsection></subsection><subsection ssid="3-null-36" dnum="k-o" numlevel="1" lineno="224" slineno="3-79" level="2"><display>(k)</display>A municipality may not conduct a final inspection required before issuing a <ln numlevel="1" lineno="225" slineno="3-80"/>certificate of occupancy for a residential unit that is within the boundary of an <ln numlevel="1" lineno="226" slineno="3-81"/>infrastructure financing district, as defined in Section <xref depth="3" refnumber="17B-1-102">17B-1-102</xref>, until the applicant <ln numlevel="1" lineno="227" slineno="3-82"/>for the certificate of occupancy provides adequate proof to the municipality that any <ln numlevel="1" lineno="228" slineno="3-83"/>lien on the unit arising from the infrastructure financing district's assessment against <ln numlevel="1" lineno="229" slineno="3-84"/>the unit under Title 11, Chapter 42, Assessment Area Act, has been released after <ln numlevel="1" lineno="230" slineno="3-85"/>payment in full of the infrastructure financing district's assessment against that unit.</subsection><subsection ssid="3-null-37" dnum="l-o" numlevel="1" lineno="231" slineno="3-86" level="2"><display>(l)</display>A municipality:<subsection ssid="3-null-38" dnum="i-o" numlevel="1" lineno="232" slineno="3-87" level="3"><display>(i)</display>may require the submission of a private landscaping plan, as defined in Section <xref depth="3" refnumber="10-20-807"><ln numlevel="1" lineno="233" slineno="3-88"/>10-20-807</xref>, before landscaping is installed; and</subsection><subsection ssid="3-null-39" dnum="ii-o" numlevel="1" lineno="234" slineno="3-89" level="3"><display>(ii)</display>may not withhold an applicant's building permit or certificate of occupancy <ln numlevel="1" lineno="235" slineno="3-90"/>because the applicant has not submitted a private landscaping plan.</subsection></subsection></subsection><subsection ssid="3-null-40" dnum="2-o" numlevel="1" lineno="236" slineno="3-91" level="1"><display>(2)</display>A municipality is bound by the terms and standards of applicable land use regulations <ln numlevel="1" lineno="237" slineno="3-92"/>and shall comply with mandatory provisions of those regulations.</subsection><subsection ssid="3-null-41" dnum="3-o" numlevel="1" lineno="238" slineno="3-93" level="1"><display>(3)</display>A municipality may not, as a condition of land use application approval, require a <ln numlevel="1" lineno="239" slineno="3-94"/>person filing a land use application to obtain documentation regarding a school district's <ln numlevel="1" lineno="240" slineno="3-95"/>willingness, capacity, or ability to serve the development proposed in the land use <ln numlevel="1" lineno="241" slineno="3-96"/>application.</subsection><subsection ssid="3-null-42" dnum="4-o" numlevel="1" lineno="242" slineno="3-97" level="1"><display>(4)</display>Upon a specified public agency's submission of a development plan and schedule as <ln numlevel="1" lineno="243" slineno="3-98"/>required in Subsection <xref depth="4" refnumber="10-20-304(8)">10-20-304(8)</xref> that complies with the requirements of that <ln numlevel="1" lineno="244" slineno="3-99"/>subsection, the specified public agency vests in the municipality's applicable land use <ln numlevel="1" lineno="245" slineno="3-100"/>maps, zoning map, hookup fees, impact fees, other applicable development fees, and <ln numlevel="1" lineno="246" slineno="3-101"/>land use regulations in effect on the date of submission.</subsection><subsection ssid="3-null-43" dnum="5-o" numlevel="1" lineno="247" slineno="3-102" level="1" space="false"><display>(5)</display><subsection ssid="3-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If sponsors of a referendum timely challenge a project in accordance with <ln numlevel="1" lineno="248" slineno="3-103"/>Subsection <xref depth="4" refnumber="20A-7-601(6)">20A-7-601(6)</xref>, the project's affected owner may rescind the project's land <ln numlevel="1" lineno="249" slineno="3-104"/>use approval by delivering a written notice:<subsection ssid="3-null-45" dnum="i-o" numlevel="1" lineno="250" slineno="3-105" level="3" tab="1"><display>(i)</display>to the local clerk as defined in Section <xref depth="3" refnumber="20A-7-101">20A-7-101</xref>; and</subsection><subsection ssid="3-null-46" dnum="ii-o" numlevel="1" lineno="251" slineno="3-106" level="3" tab="1"><display>(ii)</display>no later than seven days after the day on which a petition for a referendum is <ln numlevel="1" lineno="252" slineno="3-107"/>determined sufficient under Subsection <xref depth="4" refnumber="20A-7-607(5)">20A-7-607(5)</xref>.</subsection></subsection><subsection ssid="3-null-47" dnum="b-o" numlevel="1" lineno="253" slineno="3-108" level="2"><display>(b)</display>Upon delivery of a written notice described in Subsection <xref depth="4" refnumber="10-9a-509(5)(a)">(5)(a)</xref> the following are <ln numlevel="1" lineno="254" slineno="3-109"/>rescinded and are of no further force or effect:<subsection ssid="3-null-48" dnum="i-o" numlevel="1" lineno="255" slineno="3-110" level="3"><display>(i)</display>the relevant land use approval; and</subsection><subsection ssid="3-null-49" dnum="ii-o" numlevel="1" lineno="256" slineno="3-111" level="3"><display>(ii)</display>any land use regulation enacted specifically in relation to the land use approval.</subsection></subsection></subsection><subsection ssid="3-null-50" dnum="6-o" numlevel="1" lineno="257" slineno="3-112" level="1" space="false"><display>(6)</display><subsection ssid="3-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After issuance of a building permit, a municipality may not:<subsection ssid="3-null-52" dnum="i-o" numlevel="1" lineno="258" slineno="3-113" level="3" tab="1"><display>(i)</display>change or add to the requirements expressed in the building permit, unless the <ln numlevel="1" lineno="259" slineno="3-114"/>change or addition is:<subsection ssid="3-null-53" dnum="A-o" numlevel="1" lineno="260" slineno="3-115" level="4"><display>(A)</display>requested by the building permit holder; or</subsection><subsection ssid="3-null-54" dnum="B-o" numlevel="1" lineno="261" slineno="3-116" level="4"><display>(B)</display>necessary to comply with an applicable state building code; or</subsection></subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="262" slineno="3-117" level="3" tab="1"><display>(ii)</display>revoke the building permit or take action that has the effect of revoking the <ln numlevel="1" lineno="263" slineno="3-118"/>building permit.</subsection></subsection><subsection ssid="3-null-56" dnum="b-o" numlevel="1" lineno="264" slineno="3-119" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="10-9a-509(6)(a)">(6)(a)</xref> does not prevent a municipality from issuing a building permit that <ln numlevel="1" lineno="265" slineno="3-120"/>contains an expiration date defined in the building permit.</subsection></subsection></section></bsec><bsec buid="5" num="17-79-508" type="amend" src="code" uid="C17-79-S508_2026050620260506" sort="17 79 05080020260506" numlevel="1" lineno="266" slineno="4-1" sn="4"><section number="17-79-508" numlevel="1" lineno="267" slineno="4-2" type="amend"><secline lineno="266">Section 4. Section <bold>17-79-508</bold> is amended to read:</secline><catline lineno="267"><bold>17-79-508<parens/>. Development agreements.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="268" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsection <xref depth="4" refnumber="17-27a-528(2)">(2)</xref>, a county may enter into a development agreement containing <ln numlevel="1" lineno="269" slineno="4-4"/>any term that the county considers necessary or appropriate to accomplish the purposes <ln numlevel="1" lineno="270" slineno="4-5"/>of this chapter, including a term relating to:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="271" slineno="4-6" level="2"><display>(a)</display>a master planned development;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="272" slineno="4-7" level="2"><display>(b)</display>a planned unit development;</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="273" slineno="4-8" level="2"><display>(c)</display>an annexation;</subsection><subsection ssid="5-null-5" dnum="d-o" numlevel="1" lineno="274" slineno="4-9" level="2"><display>(d)</display>affordable or moderate income housing with development incentives;</subsection><subsection ssid="5-null-6" dnum="e-o" numlevel="1" lineno="275" slineno="4-10" level="2"><display>(e)</display>a public-private partnership; or</subsection><subsection ssid="5-null-7" dnum="f-o" numlevel="1" lineno="276" slineno="4-11" level="2"><display>(f)</display>a density transfer or bonus within a development project or between development <ln numlevel="1" lineno="277" slineno="4-12"/>projects.</subsection></subsection><subsection ssid="5-null-8" dnum="2-o" numlevel="1" lineno="278" slineno="4-13" level="1" space="false"><display>(2)</display><subsection ssid="5-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="17-79-508(2)(g)">(2)(g)</xref>, a</amend> development agreement may not:<subsection ssid="5-null-10" dnum="i-o" numlevel="1" lineno="279" slineno="4-14" level="3" tab="1"><display>(i)</display>limit a county's authority in the future to:<subsection ssid="5-null-11" dnum="A-o" numlevel="1" lineno="280" slineno="4-15" level="4"><display>(A)</display>enact a land use regulation; or</subsection><subsection ssid="5-null-12" dnum="B-o" numlevel="1" lineno="281" slineno="4-16" level="4"><display>(B)</display>take any action allowed under Section <xref depth="3" refnumber="17-64-501">17-64-501</xref>;</subsection></subsection><subsection ssid="5-null-13" dnum="ii-o" numlevel="1" lineno="282" slineno="4-17" level="3" tab="1"><display>(ii)</display>require a county to change the zoning designation of an area of land within the <ln numlevel="1" lineno="283" slineno="4-18"/>county in the future; or</subsection><subsection ssid="5-null-14" dnum="iii-o" numlevel="1" lineno="284" slineno="4-19" level="3" tab="1"><display>(iii)</display>allow a use or development of land that applicable land use regulations <ln numlevel="1" lineno="285" slineno="4-20"/>governing the area subject to the development agreement would otherwise <ln numlevel="1" lineno="286" slineno="4-21"/>prohibit, unless the legislative body approves the development agreement in <ln numlevel="1" lineno="287" slineno="4-22"/>accordance with the same procedures for enacting a land use regulation under <ln numlevel="1" lineno="288" slineno="4-23"/>Section <xref depth="3" refnumber="17-79-502">17-79-502</xref>, including a review and recommendation from the planning <ln numlevel="1" lineno="289" slineno="4-24"/>commission and a public hearing.</subsection></subsection><subsection ssid="5-null-15" dnum="b-o" numlevel="1" lineno="290" slineno="4-25" level="2"><display>(b)</display>A development agreement that requires the implementation of an existing land use <ln numlevel="1" lineno="291" slineno="4-26"/>regulation as an administrative act does not require a legislative body's approval <ln numlevel="1" lineno="292" slineno="4-27"/>under Section <xref depth="3" refnumber="17-79-502">17-79-502</xref>.</subsection><subsection ssid="5-null-16" dnum="c-o" numlevel="1" lineno="293" slineno="4-28" level="2"><display>(c)</display>Subject to Subsection <xref depth="4" refnumber="17-27a-528(2)(d)">(2)(d)</xref>, a county may require a development agreement for <ln numlevel="1" lineno="294" slineno="4-29"/>developing land within the unincorporated area of the county if the applicant has <ln numlevel="1" lineno="295" slineno="4-30"/>applied for a legislative or discretionary approval, including an approval relating to:<subsection ssid="5-null-17" dnum="i-o" numlevel="1" lineno="296" slineno="4-31" level="3"><display>(i)</display>the height of a structure;</subsection><subsection ssid="5-null-18" dnum="ii-o" numlevel="1" lineno="297" slineno="4-32" level="3"><display>(ii)</display>a parking or setback exception;</subsection><subsection ssid="5-null-19" dnum="iii-o" numlevel="1" lineno="298" slineno="4-33" level="3"><display>(iii)</display>a density transfer or bonus;</subsection><subsection ssid="5-null-20" dnum="iv-o" numlevel="1" lineno="299" slineno="4-34" level="3"><display>(iv)</display>a development incentive;</subsection><subsection ssid="5-null-21" dnum="v-o" numlevel="1" lineno="300" slineno="4-35" level="3"><display>(v)</display>a zone change; or</subsection><subsection ssid="5-null-22" dnum="vi-o" numlevel="1" lineno="301" slineno="4-36" level="3"><display>(vi)</display>an amendment to a prior development agreement.</subsection></subsection><subsection ssid="5-null-23" dnum="d-o" numlevel="1" lineno="302" slineno="4-37" level="2"><display>(d)</display>A county may not require a development agreement as a condition for developing <ln numlevel="1" lineno="303" slineno="4-38"/>land within the unincorporated area of the county if:<subsection ssid="5-null-24" dnum="i-o" numlevel="1" lineno="304" slineno="4-39" level="3"><display>(i)</display>the development otherwise complies with applicable statute and county ordinances;</subsection><subsection ssid="5-null-25" dnum="ii-o" numlevel="1" lineno="305" slineno="4-40" level="3"><display>(ii)</display>the development is an allowed or permitted use; or</subsection><subsection ssid="5-null-26" dnum="iii-o" numlevel="1" lineno="306" slineno="4-41" level="3"><display>(iii)</display>the county's land use regulations otherwise establish all applicable standards for <ln numlevel="1" lineno="307" slineno="4-42"/>development on the land.</subsection></subsection><subsection ssid="5-null-27" dnum="e-o" numlevel="1" lineno="308" slineno="4-43" level="2"><display>(e)</display>A county may submit to a county recorder's office for recording:<subsection ssid="5-null-28" dnum="i-o" numlevel="1" lineno="309" slineno="4-44" level="3"><display>(i)</display>a fully executed agreement; or</subsection><subsection ssid="5-null-29" dnum="ii-o" numlevel="1" lineno="310" slineno="4-45" level="3"><display>(ii)</display>a document related to:<subsection ssid="5-null-30" dnum="A-o" numlevel="1" lineno="311" slineno="4-46" level="4"><display>(A)</display>code enforcement;</subsection><subsection ssid="5-null-31" dnum="B-o" numlevel="1" lineno="312" slineno="4-47" level="4"><display>(B)</display>a special assessment area;</subsection><subsection ssid="5-null-32" dnum="C-o" numlevel="1" lineno="313" slineno="4-48" level="4"><display>(C)</display>a local historic district boundary; or</subsection><subsection ssid="5-null-33" dnum="D-o" numlevel="1" lineno="314" slineno="4-49" level="4"><display>(D)</display>the memorializing or enforcement of an agreed upon restriction, incentive, or <ln numlevel="1" lineno="315" slineno="4-50"/>covenant.</subsection></subsection></subsection><subsection ssid="5-null-34" dnum="f-o" numlevel="1" lineno="316" slineno="4-51" level="2"><display>(f)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">Subject to Subsection <xref depth="4" refnumber="17-27a-528(2)(e)">(2)(e)</xref>,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except for a development agreement approved in <ln numlevel="1" lineno="317" slineno="4-52"/>accordance with this section or a document described in Subsection <xref depth="4" refnumber="17-79-508(2)(e)(ii)">(2)(e)(ii)</xref>,</amend> a <ln numlevel="1" lineno="318" slineno="4-53"/>county may not cause to be recorded against private real property a document that <ln numlevel="1" lineno="319" slineno="4-54"/>imposes development requirements, development regulations, or development <ln numlevel="1" lineno="320" slineno="4-55"/>controls on the property.</subsection><subsection ssid="5-null-35" dnum="g-o" numlevel="1" lineno="321" slineno="4-56" level="2"><display>(g)</display>To the extent that a development agreement<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="5-49" dnum="_-o:i-i" numlevel="1" lineno="322" slineno="4-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>does not specifically address a matter or concern related to land use or <ln numlevel="1" lineno="323" slineno="4-58"/>development, the matter or concern is governed by:<subsection ssid="5-null-36" dnum="i-o:A-i" numlevel="1" lineno="324" slineno="4-59" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1158" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>this chapter; and</subsection><subsection ssid="5-null-37" dnum="ii-o:B-i" numlevel="1" lineno="325" slineno="4-60" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1159" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>any applicable land use regulations<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection></subsection><subsection ssid="5-43" dnum="_-o:ii-i" numlevel="1" lineno="326" slineno="4-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">conflicts with a land use regulation, the development agreement governs with <ln numlevel="1" lineno="327" slineno="4-62"/>respect to the development and use of the real property that is the subject of the <ln numlevel="1" lineno="328" slineno="4-63"/>development agreement.</amend></subsection></subsection></subsection></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="329" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="329">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="330"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-2-26 4:12 PM</tm></rev></foot></leg>
