Shallenberger</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This resolution addresses Utah's critical minerals industry.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This resolution:<hl numlevel="1" lineno="8" slineno="0-8" level="1">highlights the urgency to develop domestic supplies of critical minerals;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">describes Utah's position as a top mining jurisdiction;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">outlines the role of the proposed Minerals for Industrial, National, and Economic Security <ln numlevel="1" lineno="11" slineno="0-11"/>Center (MINES Center) in establishing Utah as a critical minerals hub;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">expresses support for the creation of the MINES Center;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">encourages the federal government to distribute federal money for critical minerals <ln numlevel="1" lineno="14" slineno="0-14"/>development through block grants; and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">calls on the state's congressional delegation to support the state's efforts to create a <ln numlevel="1" lineno="16" slineno="0-16"/>MINES Center and to achieve a designation and funding for a critical minerals national <ln numlevel="1" lineno="17" slineno="0-17"/>lab in the state.</hl></hp><moni numlevel="1" lineno="18" slineno="0-18" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="19">None</moniNone><oc numlevel="1" lineno="20" slineno="0-20">Other Special Clauses:</oc><ocNone lineno="21">None</ocNone></lt><enacthead lineno="22"/><enact numlevel="1" lineno="23" slineno="0-23">Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="24" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="ahaskell" level="1" amendtag="both">WHEREAS, in 2024, the United States was 100% net import reliant for 12 critical minerals <ln numlevel="1" lineno="25" slineno="1-2"/>and greater than 50% net import reliant for an additional 29 critical minerals, according to the <ln numlevel="1" lineno="26" slineno="1-3"/>United States Geological Survey;<eol numlevel="1" lineno="27" slineno="1-4" display="tab"/>WHEREAS, the United States faces an urgent national security and economic need to <ln numlevel="1" lineno="28" slineno="1-5"/>secure access to critical minerals through development of domestic supplies;<eol numlevel="1" lineno="29" slineno="1-6" display="tab"/>WHEREAS, access to a domestic supply of critical minerals is essential for development, <ln numlevel="1" lineno="30" slineno="1-7"/>deployment, and scaling of advanced energy technologies, strengthening the United States' <ln numlevel="1" lineno="31" slineno="1-8"/>energy reliability, resilience, and global competitiveness;<eol numlevel="1" lineno="32" slineno="1-9" display="tab"/>WHEREAS, the United States can mitigate supply-chain risks by leveraging international <ln numlevel="1" lineno="33" slineno="1-10"/>partnerships with allies to develop diversified supply chains;<eol numlevel="1" lineno="34" slineno="1-11" display="tab"/>WHEREAS, Utah has the most diverse mineral estate of any state, hosting 50 of the 60 <ln numlevel="1" lineno="35" slineno="1-12"/>minerals listed as critical by the United States Geological Survey;<eol numlevel="1" lineno="36" slineno="1-13" display="tab"/>WHEREAS, Utah was recently named the number one global mining jurisdiction in a <ln numlevel="1" lineno="37" slineno="1-14"/>survey of mining executives conducted by the Fraser Institute, a prestigious Canadian policy <ln numlevel="1" lineno="38" slineno="1-15"/>institute;<eol numlevel="1" lineno="39" slineno="1-16" display="tab"/>WHEREAS, the University of Utah has one of only 14 accredited mining engineering <ln numlevel="1" lineno="40" slineno="1-17"/>programs in the nation;<eol numlevel="1" lineno="41" slineno="1-18" display="tab"/>WHEREAS, Utah, as the crossroads of the West, is geographically positioned to serve as a <ln numlevel="1" lineno="42" slineno="1-19"/>hub for mining exploration and development, mining services, logistics, and infrastructure for <ln numlevel="1" lineno="43" slineno="1-20"/>the mining industry;<eol numlevel="1" lineno="44" slineno="1-21" display="tab"/>WHEREAS, in the 2025 General Session, the Legislature passed S.J.R. 11, Joint Resolution <ln numlevel="1" lineno="45" slineno="1-22"/>Regarding Critical Minerals, which called on private industry to form a technical working <ln numlevel="1" lineno="46" slineno="1-23"/>group to develop a strategy to position Utah as a national leader in critical minerals;<eol numlevel="1" lineno="47" slineno="1-24" display="tab"/>WHEREAS, the working group recommended the creation of an open-access user research <ln numlevel="1" lineno="48" slineno="1-25"/>facility, provisionally called the Minerals for Industrial, National, and Economic Security <ln numlevel="1" lineno="49" slineno="1-26"/>Center (MINES Center);<eol numlevel="1" lineno="50" slineno="1-27" display="tab"/>WHEREAS, the MINES Center would provide shared laboratory facilities to de-risk and <ln numlevel="1" lineno="51" slineno="1-28"/>accelerate the commercialization of new mineral extraction and processing technologies;<eol numlevel="1" lineno="52" slineno="1-29" display="tab"/>WHEREAS, the MINES Center would partner with industry and academia to advance <ln numlevel="1" lineno="53" slineno="1-30"/>extraction and processing technologies, including by providing for pilot-scale demonstrations <ln numlevel="1" lineno="54" slineno="1-31"/>and scale up, technology benchmarking and performance validation, and autonomous sampling <ln numlevel="1" lineno="55" slineno="1-32"/>and real-time analysis;<eol numlevel="1" lineno="56" slineno="1-33" display="tab"/>WHEREAS, the MINES Center would serve as the state's primary partner in moving <ln numlevel="1" lineno="57" slineno="1-34"/>extraction and processing technologies from research to commercialization, including through <ln numlevel="1" lineno="58" slineno="1-35"/>workforce training, testing and piloting of technology, federal grant coordination, and <ln numlevel="1" lineno="59" slineno="1-36"/>development of processing capacity;<eol numlevel="1" lineno="60" slineno="1-37" display="tab"/>WHEREAS, the MINES Center would facilitate coordinated statewide critical minerals <ln numlevel="1" lineno="61" slineno="1-38"/>development and maximize Utah's leadership in the domestic critical minerals supply chain;<eol numlevel="1" lineno="62" slineno="1-39" display="tab"/>WHEREAS, the MINES Center would further establish Utah as the nation's critical <ln numlevel="1" lineno="63" slineno="1-40"/>minerals mining, refining, recycling, and research capital;<eol numlevel="1" lineno="64" slineno="1-41" display="tab"/>WHEREAS, the MINES Center would lay the foundation for the establishment of a critical <ln numlevel="1" lineno="65" slineno="1-42"/>minerals national lab in the state;<eol numlevel="1" lineno="66" slineno="1-43" display="tab"/>WHEREAS, funding from the federal government is an essential component of successful <ln numlevel="1" lineno="67" slineno="1-44"/>and timely development of domestic critical minerals supplies and the MINES Center's efforts <ln numlevel="1" lineno="68" slineno="1-45"/>to accelerate critical minerals research and development;<eol numlevel="1" lineno="69" slineno="1-46" display="tab"/>WHEREAS, block grants to the states, a funding mechanism the federal government has <ln numlevel="1" lineno="70" slineno="1-47"/>used since the 1960s, would be the most efficient way to distribute federal money to the states <ln numlevel="1" lineno="71" slineno="1-48"/>for critical minerals development;<eol numlevel="1" lineno="72" slineno="1-49" display="tab"/>WHEREAS, a block grant would give the state the flexibility required for coordinated and <ln numlevel="1" lineno="73" slineno="1-50"/>strategic critical minerals development; and<eol numlevel="1" lineno="74" slineno="1-51" display="tab"/>WHEREAS, a block grant would also allow the state to quickly identify and fund shovel <ln numlevel="1" lineno="75" slineno="1-52"/>ready projects, immediately accelerating the extraction and processing of critical minerals in <ln numlevel="1" lineno="76" slineno="1-53"/>the state:<eol numlevel="1" lineno="77" slineno="1-54" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the <ln numlevel="1" lineno="78" slineno="1-55"/>Governor concurring therein, supports the creation of a MINES Center within the state.<eol numlevel="1" lineno="79" slineno="1-56" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor support efforts by the <ln numlevel="1" lineno="80" slineno="1-57"/>following to provide resources, information, and assistance to the MINES Center:<eol numlevel="1" lineno="81" slineno="1-58" display="tab"/><char set="6" char="34"/> Division of Oil, Gas, and Mining;<eol numlevel="1" lineno="82" slineno="1-59" display="tab"/><char set="6" char="34"/> Office of Energy Development;<eol numlevel="1" lineno="83" slineno="1-60" display="tab"/><char set="6" char="34"/> Department of Environmental Quality;<eol numlevel="1" lineno="84" slineno="1-61" display="tab"/><char set="6" char="34"/> Governor's Office of Economic Opportunity;<eol numlevel="1" lineno="85" slineno="1-62" display="tab"/><char set="6" char="34"/> University of Utah; and<eol numlevel="1" lineno="86" slineno="1-63" display="tab"/><char set="6" char="34"/> other relevant agencies and institutions of higher education.<eol numlevel="1" lineno="87" slineno="1-64" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor support the MINES <ln numlevel="1" lineno="88" slineno="1-65"/>Center's work laying the foundation for the establishment of a critical minerals national lab <ln numlevel="1" lineno="89" slineno="1-66"/>within the state.<eol numlevel="1" lineno="90" slineno="1-67" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the federal <ln numlevel="1" lineno="91" slineno="1-68"/>government to utilize block grants for the distribution of critical minerals funding.<eol numlevel="1" lineno="92" slineno="1-69" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the state's <ln numlevel="1" lineno="93" slineno="1-70"/>congressional delegation to support the state's efforts to create a MINES Center and to position <ln numlevel="1" lineno="94" slineno="1-71"/>Utah as a national leader in critical minerals research and development.<eol numlevel="1" lineno="95" slineno="1-72" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor also call on the <ln numlevel="1" lineno="96" slineno="1-73"/>state's congressional delegation to work with the state to achieve a designation and funding for <ln numlevel="1" lineno="97" slineno="1-74"/>a critical minerals national lab in the state.<eol numlevel="1" lineno="98" slineno="1-75" display="tab"/>BE IT FURTHER RESOLVED that a copy of this resolution be prepared and submitted to <ln numlevel="1" lineno="99" slineno="1-76"/>the six members representing Utah in the United States
