Character evidence, crimes or other acts.</bold></catline><sectionText lineno="29"><tab/><bold>(a) Character Evidence.</bold><eol numlevel="1" lineno="30" slineno="1-4" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(1) Prohibited <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="107" style="2" owner="jchristopherson" level="1" deltag="both">Uses.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="102" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">uses. </amend></bold>Evidence of a person's character or character trait is not <ln numlevel="1" lineno="31" slineno="1-5"/>admissible to prove that on a particular occasion the person acted in conformity with the <ln numlevel="1" lineno="32" slineno="1-6"/>character or trait.<eol numlevel="1" lineno="33" slineno="1-7" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1" groupid="1" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(2) Exceptions for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="113" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both">Defendant or Victim in a Criminal Case.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="103" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">defendant or victim <ln numlevel="1" lineno="34" slineno="1-8"/>in a criminal case. </amend></bold>The following exceptions apply in a criminal case:<eol numlevel="1" lineno="35" slineno="1-9" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">(a)(2)</amend><amendoutend style="2"/>(A)</bold> a defendant may offer evidence of the defendant's pertinent trait, and if <ln numlevel="1" lineno="36" slineno="1-10"/>the evidence is admitted, the prosecutor may offer evidence to rebut it;<eol numlevel="1" lineno="37" slineno="1-11" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">(a)(2)</amend><amendoutend style="2"/>(B)</bold> subject to the limitations in Rule 412, a defendant may offer evidence of <ln numlevel="1" lineno="38" slineno="1-12"/>an alleged victim's pertinent trait, and if the evidence is admitted, the prosecutor may:<eol numlevel="1" lineno="39" slineno="1-13" display="tab"/><para/><tab/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">(a)(2)(B)</amend><amendoutend style="2"/>(i)</bold> offer evidence to rebut it; and<eol numlevel="1" lineno="41" slineno="1-15" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">(a)(2)</amend><amendoutend style="2"/>(C)</bold> in a homicide case, the prosecutor may offer evidence of the alleged <ln numlevel="1" lineno="42" slineno="1-16"/>victim's trait of peacefulness to rebut evidence that the victim was the first aggressor.<eol numlevel="1" lineno="43" slineno="1-17" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(3) Exceptions for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="115" groupid="111" style="2" owner="jchristopherson" level="1" deltag="both">Witness</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="104" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">witness</amend>.</bold> Evidence of a witness's character may be <ln numlevel="1" lineno="44" slineno="1-18"/>admitted under Rules 607, 608, and 609.<eol numlevel="1" lineno="45" slineno="1-19" display="tab"/><para/><bold>(b) Crimes, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="116" groupid="112" style="2" owner="jchristopherson" level="1" deltag="both">Wrongs, or Other Acts</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="105" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">wrongs, or other acts</amend>.</bold><eol numlevel="1" lineno="46" slineno="1-20" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(1) Prohibited <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="118" style="2" owner="jchristopherson" level="1" deltag="both">Uses</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="121" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">uses</amend>.</bold> Evidence of a crime, wrong, or other act is not <ln numlevel="1" lineno="47" slineno="1-21"/>admissible to prove a person's character in order to show that on a particular occasion the <ln numlevel="1" lineno="48" slineno="1-22"/>person acted in conformity with the character.<eol numlevel="1" lineno="49" slineno="1-23" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(2) Permitted <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="117" groupid="113" style="2" owner="jchristopherson" level="1" deltag="both">Uses; Notice in a Criminal Case</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="106" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">uses; Notice in a criminal case</amend>.</bold> <ln numlevel="1" lineno="50" slineno="1-24"/>This evidence may be admissible for another purpose, such as proving motive, opportunity, <ln numlevel="1" lineno="51" slineno="1-25"/>intent, preparation, plan, knowledge, identity, absence of mistake, or lack of accident. On <ln numlevel="1" lineno="52" slineno="1-26"/>request by a defendant in a criminal case, the prosecutor must:<eol numlevel="1" lineno="53" slineno="1-27" display="tab"/><para/><tab/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend style="2"/>(A)</bold> provide reasonable notice of the general nature of any such evidence <ln numlevel="1" lineno="54" slineno="1-28"/>that the prosecutor intends to offer at trial; and<eol numlevel="1" lineno="55" slineno="1-29" display="tab"/><para/><tab/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend style="2"/>(B)</bold> do so before trial, or during trial if the court excuses lack of pretrial <ln numlevel="1" lineno="56" slineno="1-30"/>notice on good cause shown.<eol numlevel="1" lineno="57" slineno="1-31" display="tab"/><para/><bold>(c) Evidence of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="119" style="2" owner="jchristopherson" level="1" deltag="both">Similar Crimes in Child-Molestation Cases</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">similar crimes in <ln numlevel="1" lineno="58" slineno="1-32"/>child-molestation cases</amend>.</bold><amend anum="0" ea="amend" pairid="36" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="59" slineno="1-33" display="tab"/><bold><tab/><tab/>(1) Definition of "child molestation." </bold>As used in this paragraph (c), "child <ln numlevel="1" lineno="60" slineno="1-34"/>molestation" means an act committed in relation to a child who is younger than 14 years old <ln numlevel="1" lineno="61" slineno="1-35"/>that would, if committed in this state, be a sexual offense or an attempt to commit a sexual <ln numlevel="1" lineno="62" slineno="1-36"/>offense.</amend><eol numlevel="1" lineno="63" slineno="1-37" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">(c)(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend> Permitted <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="125" groupid="120" style="2" owner="jchristopherson" level="1" deltag="both">Uses.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">uses. </amend></bold>In a criminal case in which a defendant is accused <ln numlevel="1" lineno="64" slineno="1-38"/>of child molestation, the court may admit <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="78" groupid="75" style="2" owner="jchristopherson" level="1" deltag="both">evidence that the defendant committed any other <ln numlevel="1" lineno="65" slineno="1-39"/>acts of child molestation to prove a propensity to commit the crime charged.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="76" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the following <ln numlevel="1" lineno="66" slineno="1-40"/>evidence to prove propensity to commit the crime charged:<eol numlevel="1" lineno="67" slineno="1-41" display="tab"/><para/><tab/><tab/><bold>(A)</bold> evidence that the defendant committed any other acts of child molestation; or<eol numlevel="1" lineno="68" slineno="1-42" display="tab"/><para/><tab/><tab/><bold>(B)</bold> evidence that the defendant committed sexual exploitation of a minor, as <ln numlevel="1" lineno="69" slineno="1-43"/>described in Utah Code Section 76-5b-201, or aggravated sexual exploitation of a minor, as <ln numlevel="1" lineno="70" slineno="1-44"/>described in Utah Code Section 76-5b-201.1.</amend><eol numlevel="1" lineno="71" slineno="1-45" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both">(c)(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)</amend> Disclosure<amend anum="0" ea="amend" pairid="89" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="both"> to the defendant</amend>.<amend anum="0" ea="amend" pairid="64" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend></bold>If the prosecution intends to offer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="85" groupid="81" style="2" owner="jchristopherson" level="1" deltag="both">this <ln numlevel="1" lineno="72" slineno="1-46"/>evidence it shall</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="98" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">evidence described in paragraph (c)(2), the prosecution must</amend> provide <ln numlevel="1" lineno="73" slineno="1-47"/>reasonable notice in advance of trial, or during trial if the court excuses pretrial notice on good <ln numlevel="1" lineno="74" slineno="1-48"/>cause shown.<eol numlevel="1" lineno="75" slineno="1-49" display="tab"/><para/><tab/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="68" style="2" owner="jchristopherson" level="1" deltag="start">(c)(3)</amend></bold><amend anum="0" ea="erase" pairid="70" groupid="69" style="2" owner="jchristopherson" level="1"> For purposes of this rule "child molestation" means an act committed in <ln numlevel="1" lineno="76" slineno="1-50"/>relation to a child under the age of 14 which would, if committed in this state, be a sexual <ln numlevel="1" lineno="77" slineno="1-51"/>offense or an attempt to commit a sexual offense.</amend><eol numlevel="1" lineno="78" slineno="1-52" display="tab"/><para/><tab/><bold><amend anum="0" ea="erase" pairid="71" groupid="70" style="2" owner="jchristopherson" level="1">(c)(4)</amend></bold><amend anum="0" ea="erase" pairid="72" groupid="71" style="2" owner="jchristopherson" level="1" deltag="end"> Rule 404(c) does not limit the admissibility of evidence otherwise <ln numlevel="1" lineno="79" slineno="1-53"/>admissible under Rule 404(a), 404(b), or any other rule of evidence.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="61" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="80" slineno="1-54" display="tab"/><para/><tab/><bold>(4) Effect on Other Rules.</bold> This paragraph (c) does not limit the admissibility of <ln numlevel="1" lineno="81" slineno="1-55"/>evidence otherwise admissible under paragraph (a), paragraph (b), paragraph (d), or any other <ln numlevel="1" lineno="82" slineno="1-56"/>rule of evidence.<eol numlevel="1" lineno="83" slineno="1-57" display="tab"/><bold>(d) Evidence of Similar Crimes in Sexual Assault Cases.</bold><eol numlevel="1" lineno="84" slineno="1-58" display="tab"/><para/><bold>(1) Definition of "Sexual Assault."</bold> As used in this paragraph (d), "sexual assault" means:<eol numlevel="1" lineno="85" slineno="1-59" display="tab"/><para/><tab/><bold>(A)</bold> a sexual offense described in Utah Code Title 76, Chapter 5, Part 4, Sexual <ln numlevel="1" lineno="86" slineno="1-60"/>Offenses;<eol numlevel="1" lineno="87" slineno="1-61" display="tab"/><para/><tab/><bold>(B)</bold> an attempt to commit a sexual offense described in Utah Code Title 76, Chapter <ln numlevel="1" lineno="88" slineno="1-62"/>5, Part 4, Sexual Offenses; or<eol numlevel="1" lineno="89" slineno="1-63" display="tab"/><para/><tab/><bold>(C)</bold> an offense in another jurisdiction that is substantially similar to an offense <ln numlevel="1" lineno="90" slineno="1-64"/>described in paragraph (d)(1)(A) or (d)(1)(B).<eol numlevel="1" lineno="91" slineno="1-65" display="tab"/><para/><bold>(2) Permitted Uses.</bold> In a criminal case in which a defendant is accused of sexual assault, <ln numlevel="1" lineno="92" slineno="1-66"/>the court may admit evidence that the defendant committed any other acts of sexual assault. <ln numlevel="1" lineno="93" slineno="1-67"/>This evidence may be considered on any matter to which the evidence is relevant, including to <ln numlevel="1" lineno="94" slineno="1-68"/>prove a propensity to commit the crime charged.<eol numlevel="1" lineno="95" slineno="1-69" display="tab"/><para/><bold>(3) Disclosure to the Defendant.</bold> If the prosecution intends to offer evidence that the <ln numlevel="1" lineno="96" slineno="1-70"/>defendant committed any other acts of sexual assault, the prosecution must disclose the <ln numlevel="1" lineno="97" slineno="1-71"/>evidence to the defendant in accordance with Rule 16(a)(5) of the Utah Rules of Criminal <ln numlevel="1" lineno="98" slineno="1-72"/>Procedure, including disclosure of a witness's statement or a summary of the witness's <ln numlevel="1" lineno="99" slineno="1-73"/>expected testimony.
