Regulating the practice of law.</bold></catline><sectionText lineno="23"><para/> (a)<bold> Vested authority.</bold><eol numlevel="1" lineno="24" slineno="1-4" display="tab"/><para/>(1) The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="ahaskell" level="1" deltag="both">Supreme Court-by</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Supreme Court, by</amend> its constitutional <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="ahaskell" level="1" deltag="both">power-authorizes</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="25" slineno="1-5"/>power, authorizes</amend> and designates the Bar to administer rules and regulations that govern the <ln numlevel="1" lineno="26" slineno="1-6"/>practice of law in Utah, including regulating licensed paralegal practitioners. All persons <ln numlevel="1" lineno="27" slineno="1-7"/>authorized to practice law in Utah must be licensed by the Bar in accordance with this chapter <ln numlevel="1" lineno="28" slineno="1-8"/>and Chapter 15 of the Supreme Court Rules of Professional Practice.  <eol numlevel="1" lineno="29" slineno="1-9" display="tab"/><para/>(2) The Supreme Court recognizes a compelling state interest in using the Bar to assist <ln numlevel="1" lineno="30" slineno="1-10"/>the Court in governing admission to the practice of law and improving the quality of legal <ln numlevel="1" lineno="31" slineno="1-11"/>services in the state. The requirements imposed, the delegations made, and the authority <ln numlevel="1" lineno="32" slineno="1-12"/>granted to the Bar provide the best ways to promote these compelling state interests and there <ln numlevel="1" lineno="33" slineno="1-13"/>are no less restrictive alternatives available to achieve those results.  <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="34" slineno="1-14" display="tab"/><para/>(3) The Supreme Court may only approve or impose a licensing fee on persons <ln numlevel="1" lineno="35" slineno="1-15"/>authorized to practice law that is proportional to the costs and expenses incurred to admit and <ln numlevel="1" lineno="36" slineno="1-16"/>license persons authorized to practice law, to discipline and disbar persons licensed to practice <ln numlevel="1" lineno="37" slineno="1-17"/>law, and to propose rules related to the practice of law.<eol numlevel="1" lineno="38" slineno="1-18" display="tab"/><para/>(4) Except as provided in paragraph (a)(5), the Supreme Court may not approve or <ln numlevel="1" lineno="39" slineno="1-19"/>impose a fee on persons authorized to practice law, or use any amount of a licensing fee <ln numlevel="1" lineno="40" slineno="1-20"/>described in paragraph (a)(3), to fund a service for persons licensed to practice law or a service <ln numlevel="1" lineno="41" slineno="1-21"/>provided to the public.<eol numlevel="1" lineno="42" slineno="1-22" display="tab"/><para/>(5) The Supreme Court may approve or impose a voluntary fee from persons authorized <ln numlevel="1" lineno="43" slineno="1-23"/>to practice law to fund a service described in paragraph (a)(4).<eol numlevel="1" lineno="44" slineno="1-24" display="tab"/><para/>(6) Any fee that is charged or collected under this rule shall:<eol numlevel="1" lineno="45" slineno="1-25" display="tab"/><para/><tab/>(A) be reasonable and fair; and<eol numlevel="1" lineno="46" slineno="1-26" display="tab"/><para/><tab/>(B) reflect and be based on all of the direct and indirect costs and expenses for:<eol numlevel="1" lineno="47" slineno="1-27" display="tab"/><para/><tab/><tab/>(i) if the fee is a licensing fee, admitting and licensing persons authorized to <ln numlevel="1" lineno="48" slineno="1-28"/>practice law, disciplining and disbarring persons licensed to practice law, and proposing rules <ln numlevel="1" lineno="49" slineno="1-29"/>related to the practice of law; and<eol numlevel="1" lineno="50" slineno="1-30" display="tab"/><para/><tab/><tab/>(ii) if the fee is for a service described in paragraph (a)(4), providing the service <ln numlevel="1" lineno="51" slineno="1-31"/>for which the fee is charged.</amend><eol numlevel="1" lineno="52" slineno="1-32" display="tab"/>(b) <bold>Responsibilities of the Bar.</bold> The Bar's purposes, duties, and responsibilities include:  <eol numlevel="1" lineno="53" slineno="1-33" display="tab"/><para/>(1) advancing the administration of justice according to law;  <eol numlevel="1" lineno="54" slineno="1-34" display="tab"/><para/>(2) aiding the courts in the administration of justice;  <eol numlevel="1" lineno="55" slineno="1-35" display="tab"/><para/>(3) regulating the admission of persons seeking to practice law;  <eol numlevel="1" lineno="56" slineno="1-36" display="tab"/><para/>(4) fostering and maintaining integrity, learning competence, public service, and high <ln numlevel="1" lineno="57" slineno="1-37"/>standards of conduct among those practicing law;  <eol numlevel="1" lineno="58" slineno="1-38" display="tab"/><para/>(5) representing the Bar before legislative, administrative, and judicial bodies;  <eol numlevel="1" lineno="59" slineno="1-39" display="tab"/><para/>(6) preventing the unauthorized practice of law;  <eol numlevel="1" lineno="60" slineno="1-40" display="tab"/><para/>(7) promoting professionalism, competence, and excellence through continuing legal <ln numlevel="1" lineno="61" slineno="1-41"/>education and other means;  <eol numlevel="1" lineno="62" slineno="1-42" display="tab"/><para/>(8) providing a service to the public, the judicial system, and Bar members;  <eol numlevel="1" lineno="63" slineno="1-43" display="tab"/><para/>(9) educating the public about the rule of law and responsibilities under the law; and  <eol numlevel="1" lineno="64" slineno="1-44" display="tab"/><para/>(10) assisting Bar members in improving the quality and efficiency of their practice.  <eol numlevel="1" lineno="65" slineno="1-45" display="tab"/>(c) <bold>Qualifications.</bold> This chapter prescribes the qualifications, duties, and obligations of <ln numlevel="1" lineno="66" slineno="1-46"/>lawyers, foreign legal consultants, and licensed paralegal practitioners licensed to practice law <ln numlevel="1" lineno="67" slineno="1-47"/>in Utah. The Supreme Court is responsible for disciplining a Bar member or licensed paralegal <ln numlevel="1" lineno="68" slineno="1-48"/>practitioner.<eol numlevel="1" lineno="69" slineno="1-49" display="tab"/>(d) <bold>Licensure required.</bold> Suspended or disbarred persons may not practice law in Utah or <ln numlevel="1" lineno="70" slineno="1-50"/>hold themselves out as able to practice law in Utah. A person may only practice law in Utah if <ln numlevel="1" lineno="71" slineno="1-51"/>that person is:<eol numlevel="1" lineno="72" slineno="1-52" display="tab"/><para/>(1) a licensed lawyer and an active Bar member in good standing;  <eol numlevel="1" lineno="73" slineno="1-53" display="tab"/><para/>(2) an inactive member in good standing providing pro bono legal services for or on <ln numlevel="1" lineno="74" slineno="1-54"/>behalf of a legal services organization approved by the Bar upon meeting certification and <ln numlevel="1" lineno="75" slineno="1-55"/>performance standards, conditions, and rules established by the Board;  <eol numlevel="1" lineno="76" slineno="1-56" display="tab"/><para/>(3) a foreign legal consultant licensed by the Bar; or  <eol numlevel="1" lineno="77" slineno="1-57" display="tab"/><para/>(4) a licensed paralegal practitioner and an active licensee of the Bar in good standing.</sectionText></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="78" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="78">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="79"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">As provided in Utah Constitution, Article VIII, Section 4, this resolution takes effect <ln numlevel="1" lineno="80" slineno="2-3"/>upon a two-thirds vote of all members elected to each house.</amend></sectionText></section></bsec></bdy><foot><rev/></foot></leg>
