WHEREAS, Article V of the United States Constitution provides the states with the authority to call a convention for the purpose of proposing an amendment to the Constitution on application by at least two-thirds of the states;WHEREAS, this power provides the states with the leverage needed to force Congress to act when it otherwise does not want to;WHEREAS, the citizens of Utah and 22 other states, having passed statutes or state constitutional amendments placing term limits on members of Congress, were overruled by the Supreme Court of the United States;WHEREAS, the Utah Legislature hereby joins with other states in instructing Congress to draft an amendment to the Constitution placing term limits on members of Congress for ratification by the states, the failure of which will result in the states taking action on their own; andWHEREAS, the Utah Legislature, a body of citizen legislators, desires to restore rotation in office for members serving in Congress:NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah hereby makes an application to Congress, as provided by Article V of the Constitution of the United States of America, to call a convention limited to proposing an amendment to the Constitution of the United States of America to set a limit on the number of terms that a person may be elected as a member of the United States House of Representatives and to set a limit to the number of terms that a person may be elected as a member of the United States Senate.BE IT FURTHER RESOLVED that this resolution shall be considered as covering the same subject matter as the applications from other states to Congress to call a convention to set a limit on the number of terms that a person may be elected as a member of the United States House of Representatives and the United States Senate and shall be aggregated with the same for the purpose of attaining the two-thirds of states necessary to require Congress to call a limited convention on this subject, but shall not be aggregated with any other applications on any other subject.BE IT FURTHER RESOLVED that this resolution constitutes a continuing application in accordance with Article V of the United States Constitution until the legislatures of at least two-thirds of the several states have made applications on the same subject.BE IT FURTHER RESOLVED that copies of this resolution be sent to the Majority Leader and Secretary of the United States Senate, the Speaker, Clerk, and Judiciary Chairman of the United States House of Representatives, the members of Utah's congressional delegation, and the presiding officers of each of the legislative houses in the several states, requesting their cooperation.
