and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">limits the scope of the convention to establishing a limit on the number of terms that a <ln numlevel="1" lineno="12" slineno="0-12"/>person may be elected as a member of Congress.</hl></hp><moni numlevel="1" lineno="13" slineno="0-13" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="14">None</moniNone><oc numlevel="1" lineno="15" slineno="0-15">Other Special Clauses:</oc><ocNone lineno="16">None</ocNone></lt><enacthead lineno="17"/><enact numlevel="1" lineno="18" slineno="0-18">Be it resolved by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="19" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="jchristopherson" level="1" amendtag="both">WHEREAS, Article V of the United States Constitution provides the states with the <ln numlevel="1" lineno="20" slineno="1-2"/>authority to call a convention for the purpose of proposing an amendment to the Constitution <ln numlevel="1" lineno="21" slineno="1-3"/>on application by at least two-thirds of the states;<eol numlevel="1" lineno="22" slineno="1-4" display="tab"/>WHEREAS, this power provides the states with the leverage needed to force Congress to <ln numlevel="1" lineno="23" slineno="1-5"/>act when it otherwise does not want to;<eol numlevel="1" lineno="24" slineno="1-6" display="tab"/>WHEREAS, the citizens of Utah and 22 other states, having passed statutes or state <ln numlevel="1" lineno="25" slineno="1-7"/>constitutional amendments placing term limits on members of Congress, were overruled by the <ln numlevel="1" lineno="26" slineno="1-8"/>Supreme Court of the United States;<eol numlevel="1" lineno="27" slineno="1-9" display="tab"/>WHEREAS, the Utah Legislature hereby joins with other states in instructing Congress to <ln numlevel="1" lineno="28" slineno="1-10"/>draft an amendment to the Constitution placing term limits on members of Congress for <ln numlevel="1" lineno="29" slineno="1-11"/>ratification by the states, the failure of which will result in the states taking action on their <ln numlevel="1" lineno="30" slineno="1-12"/>own; and<eol numlevel="1" lineno="31" slineno="1-13" display="tab"/>WHEREAS, the Utah Legislature, a body of citizen legislators, desires to restore rotation in <ln numlevel="1" lineno="32" slineno="1-14"/>office for members serving in Congress:<eol numlevel="1" lineno="33" slineno="1-15" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah hereby <ln numlevel="1" lineno="34" slineno="1-16"/>makes an application to Congress, as provided by Article V of the Constitution of the United <ln numlevel="1" lineno="35" slineno="1-17"/>States of America, to call a convention limited to proposing an amendment to the Constitution <ln numlevel="1" lineno="36" slineno="1-18"/>of the United States of America to set a limit on the number of terms that a person may be <ln numlevel="1" lineno="37" slineno="1-19"/>elected as a member of the United States House of Representatives and to set a limit to the <ln numlevel="1" lineno="38" slineno="1-20"/>number of terms that a person may be elected as a member of the United States Senate.<eol numlevel="1" lineno="39" slineno="1-21" display="tab"/>BE IT FURTHER RESOLVED that this resolution shall be considered as covering the <ln numlevel="1" lineno="40" slineno="1-22"/>same subject matter as the applications from other states to Congress to call a convention to set <ln numlevel="1" lineno="41" slineno="1-23"/>a limit on the number of terms that a person may be elected as a member of the United States <ln numlevel="1" lineno="42" slineno="1-24"/>House of Representatives and the United States Senate and shall be aggregated with the same <ln numlevel="1" lineno="43" slineno="1-25"/>for the purpose of attaining the two-thirds of states necessary to require Congress to call a <ln numlevel="1" lineno="44" slineno="1-26"/>limited convention on this subject, but shall not be aggregated with any other applications on <ln numlevel="1" lineno="45" slineno="1-27"/>any other subject.<eol numlevel="1" lineno="46" slineno="1-28" display="tab"/>BE IT FURTHER RESOLVED that this resolution constitutes a continuing application in <ln numlevel="1" lineno="47" slineno="1-29"/>accordance with Article V of the United States Constitution until the legislatures of at least <ln numlevel="1" lineno="48" slineno="1-30"/>two-thirds of the several states have made applications on the same subject.<eol numlevel="1" lineno="49" slineno="1-31" display="tab"/>BE IT FURTHER RESOLVED that copies of this resolution be sent to the Majority Leader <ln numlevel="1" lineno="50" slineno="1-32"/>and Secretary of the United States Senate, the Speaker, Clerk, and Judiciary Chairman of the <ln numlevel="1" lineno="51" slineno="1-33"/>United States House of Representatives, the members of Utah's congressional delegation, and <ln numlevel="1" lineno="52" slineno="1-34"/>the presiding officers of each of the legislative houses in the several states, requesting their <ln numlevel="1" lineno="53" slineno="1-35"/>cooperation.</amend><sectionText/></section></bsec></bdy><foot><rev><tm>1-6-26 12:46 PM</tm></rev></foot></leg>
