Consolidation; separate trials; venue transfer.</bold></catline><sectionText lineno="27"><tab/><bold>(a) Consolidation.</bold> <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="28" slineno="1-4" display="tab"/><para/>(1) </amend>When actions involving a common question of law or fact or arising from the same <ln numlevel="1" lineno="29" slineno="1-5"/>transaction or occurrence are pending before the court in one or more judicial districts, the <ln numlevel="1" lineno="30" slineno="1-6"/>court may, on motion of any party or on the court's own initiative: <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="31" slineno="1-7" display="tab"/><para/><tab/><tab/>(A) </amend>order that the actions are consolidated in whole or in part for any purpose, <ln numlevel="1" lineno="32" slineno="1-8"/>including for discovery, other pretrial matters, or a joint hearing or trial; <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="33" slineno="1-9" display="tab"/><para/><tab/><tab/>(B) </amend>stay any or all of the proceedings in any action subject to the order; <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="34" slineno="1-10" display="tab"/><para/><tab/><tab/>(C) </amend>transfer any or all further proceedings in the actions to a location in which any <ln numlevel="1" lineno="35" slineno="1-11"/>of the actions is pending after consulting with the presiding judge of the receiving court; and <amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="36" slineno="1-12" display="tab"/><para/><tab/><tab/>(D) </amend>make other such orders concerning proceedings therein as may tend to avoid <ln numlevel="1" lineno="37" slineno="1-13"/>unnecessary costs or delay.<eol numlevel="1" lineno="38" slineno="1-14" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend> In determining whether to order consolidation and the appropriate location for <ln numlevel="1" lineno="39" slineno="1-15"/>the consolidated proceedings, the court may consider, among other factors: <amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="40" slineno="1-16" display="tab"/><para/><tab/><tab/>(A) </amend>the complexity of the actions; <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="41" slineno="1-17" display="tab"/><para/><tab/><tab/>(B) </amend>the importance of any common question of fact or law to the determination of <ln numlevel="1" lineno="42" slineno="1-18"/>the actions; <amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="43" slineno="1-19" display="tab"/><para/><tab/><tab/>(C) </amend>the risk of duplicative or inconsistent rulings, orders, or judgments; <amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="44" slineno="1-20" display="tab"/><para/><tab/><tab/>(D) </amend>the case and records classification of each case as described in Rule 4-202.02 <ln numlevel="1" lineno="45" slineno="1-21"/>of the Utah Code of Judicial Administration; <amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="46" slineno="1-22" display="tab"/><para/><tab/><tab/>(E) </amend>the relative procedural postures of the actions; <amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="47" slineno="1-23" display="tab"/><para/><tab/><tab/>(F) </amend>the risk that consolidation may unreasonably delay the progress, increase the <ln numlevel="1" lineno="48" slineno="1-24"/>expense, or complicate the processing of any action; <amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="49" slineno="1-25" display="tab"/><para/><tab/><tab/>(G) </amend>prejudice to any party that far outweighs the overall benefits of consolidation; <amend anum="0" ea="amend" pairid="39" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="50" slineno="1-26" display="tab"/><para/><tab/><tab/>(H) </amend>the convenience of the parties, witnesses, and counsel; and <amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="51" slineno="1-27" display="tab"/><para/><tab/><tab/>(I) </amend>the efficient utilization of judicial resources and the facilities and personnel of <ln numlevel="1" lineno="52" slineno="1-28"/>the court.<eol numlevel="1" lineno="53" slineno="1-29" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)</amend> A motion to consolidate may be filed or opposed by any party to either action to <ln numlevel="1" lineno="54" slineno="1-30"/>be consolidated, without seeking permission to intervene. The motion must be filed in and <ln numlevel="1" lineno="55" slineno="1-31"/>heard by the judge assigned to the first action filed and must be served on all parties in each <ln numlevel="1" lineno="56" slineno="1-32"/>action pursuant to Rule 5. The movant must file in each action notice of the motion and notice <ln numlevel="1" lineno="57" slineno="1-33"/>of the order denying or granting the motion.<eol numlevel="1" lineno="58" slineno="1-34" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)</amend> If the court orders consolidation, the consolidated case will be heard by the <ln numlevel="1" lineno="59" slineno="1-35"/>judge assigned to the first action filed, unless otherwise ordered by the presiding judge or <ln numlevel="1" lineno="60" slineno="1-36"/>agreed upon by the originally assigned judges. The court will order that a single case number <ln numlevel="1" lineno="61" slineno="1-37"/>be used for all subsequent filings in the consolidated case.<eol numlevel="1" lineno="62" slineno="1-38" display="tab"/><bold>(b) Consolidation or severance in whole or in part.</bold> For convenience or to avoid prejudice, <ln numlevel="1" lineno="63" slineno="1-39"/>the court may: <eol numlevel="1" lineno="64" slineno="1-40" display="tab"/><para/>(1) order that the consolidated matters be tried together or that a separate trial be held on <ln numlevel="1" lineno="65" slineno="1-41"/>any one or more claims, crossclaims, counterclaims, third-party claims, or separate issues; or<eol numlevel="1" lineno="66" slineno="1-42" display="tab"/><para/>(2) order that the consolidated matters be severed at any point and provide that the <ln numlevel="1" lineno="67" slineno="1-43"/>matters be treated as separate actions going forward, including that the severed matters be tried <ln numlevel="1" lineno="68" slineno="1-44"/>by either the judge in the consolidated matter or the originally assigned judge.<eol numlevel="1" lineno="69" slineno="1-45" display="tab"/><bold>(c) Reassignment. </bold>If the consolidation of actions would be otherwise appropriate but is not <ln numlevel="1" lineno="70" slineno="1-46"/>administratively possible, the judge assigned to the first action may order the court clerk to <ln numlevel="1" lineno="71" slineno="1-47"/>reassign the other actions to the judge assigned to the first action. Such actions will be treated <ln numlevel="1" lineno="72" slineno="1-48"/>for all purposes as if they were consolidated except that the actions will retain their separate <ln numlevel="1" lineno="73" slineno="1-49"/>case numbers, which must be included on all filings.<bold/><eol numlevel="1" lineno="74" slineno="1-50" display="tab"/><bold>(d) <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">Venue Transfer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Transfer of an action</amend>.</bold><eol numlevel="1" lineno="75" slineno="1-51" display="tab"/><para/><bold>(1)</bold><amend anum="0" ea="amend" pairid="30" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both"> <bold>Transfer to proper venue.</bold></amend> <amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="76" slineno="1-52" display="tab"/><para/><tab/>(A) </amend>On timely motion of any party, where transfer to a proper venue is available, the <ln numlevel="1" lineno="77" slineno="1-53"/>court must transfer any action filed in an improper venue.<eol numlevel="1" lineno="78" slineno="1-54" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">(2) </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(B) </amend>The court must give substantial deference to a plaintiff's choice of a proper <ln numlevel="1" lineno="79" slineno="1-55"/>venue. <amend anum="0" ea="amend" pairid="29" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="80" slineno="1-56" display="tab"/><para/><tab/>(C) </amend>On timely motion of any party, a court may: <amend anum="0" ea="amend" pairid="33" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="81" slineno="1-57" display="tab"/><para/><tab/><tab/><tab/>(i) </amend>transfer venue of any action, in whole or in part, to any other venue for any <ln numlevel="1" lineno="82" slineno="1-58"/>purpose, including for discovery, other pretrial matters, or a joint hearing or trial; <amend anum="0" ea="amend" pairid="34" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="83" slineno="1-59" display="tab"/><para/><tab/><tab/><tab/>(ii) </amend>stay any or all of the proceedings in the action; and <amend anum="0" ea="amend" pairid="35" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="84" slineno="1-60" display="tab"/><para/><tab/><tab/><tab/>(iii) </amend>make other such orders concerning proceedings therein to pursue the <ln numlevel="1" lineno="85" slineno="1-61"/>interests of justice and avoid unnecessary costs or delay. <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="37" style="2" owner="jchristopherson" level="1" deltag="start">In determining whether to transfer <ln numlevel="1" lineno="86" slineno="1-62"/>venue and the appropriate venue for the transferred proceedings, the court may consider, <ln numlevel="1" lineno="87" slineno="1-63"/>among other factors, whether transfer will: increase the likelihood of a fair and impartial <ln numlevel="1" lineno="88" slineno="1-64"/>determination in the action; minimize expense or inconvenience to parties, witnesses, or the <ln numlevel="1" lineno="89" slineno="1-65"/>court; decrease delay; avoid hardship or injustice otherwise caused by venue requirements; and <ln numlevel="1" lineno="90" slineno="1-66"/>advance the interests of justice. </amend><eol numlevel="1" lineno="91" slineno="1-67" display="tab"/><para/><amend anum="0" ea="erase" pairid="38" groupid="38" style="2" owner="jchristopherson" level="1" deltag="end">(3) The court may direct that specified parties pay the expenses, if any, of transfer.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="92" slineno="1-68" display="tab"/><para/><bold>(2)</bold> <bold>Transfer to business and chancery court.</bold><eol numlevel="1" lineno="93" slineno="1-69" display="tab"/><para/><tab/>(A) If a plaintiff filed the complaint in the district court and the action meets the <ln numlevel="1" lineno="94" slineno="1-70"/>jurisdictional requirements of the business and chancery court, a party may file a separate <ln numlevel="1" lineno="95" slineno="1-71"/>notice requesting transfer of the action to the business and chancery court.<eol numlevel="1" lineno="96" slineno="1-72" display="tab"/><para/><tab/>(B) If a party makes a request to transfer an action to the business and chancery court <ln numlevel="1" lineno="97" slineno="1-73"/>within 21 days after the appearance of the party:<eol numlevel="1" lineno="98" slineno="1-74" display="tab"/><para/><tab/><tab/>(i) the district court must transfer the action to the business and chancery court <ln numlevel="1" lineno="99" slineno="1-75"/>unless the district court determines that the transfer will prejudice the interests of justice; and<eol numlevel="1" lineno="100" slineno="1-76" display="tab"/><para/><tab/><tab/>(ii) the district court may not give any deference to the plaintiff's choice to file the <ln numlevel="1" lineno="101" slineno="1-77"/>complaint in the district court.<eol numlevel="1" lineno="102" slineno="1-78" display="tab"/><para/><tab/>(C) If a party makes a request to transfer an action to the business and chancery court <ln numlevel="1" lineno="103" slineno="1-79"/>more than 21 days after the appearance of the party, the district court may:<eol numlevel="1" lineno="104" slineno="1-80" display="tab"/><para/><tab/><tab/>(i) give deference to the plaintiff's choice to file the complaint in the district court; <ln numlevel="1" lineno="105" slineno="1-81"/>or<eol numlevel="1" lineno="106" slineno="1-82" display="tab"/><para/><tab/><tab/>(ii) transfer the action to the business and chancery court if the factors described in <ln numlevel="1" lineno="107" slineno="1-83"/>paragraph (d)(3) weigh in favor of transfer.<eol numlevel="1" lineno="108" slineno="1-84" display="tab"/><para/><tab/>(D) A district court may not transfer the action to the business and chancery court <ln numlevel="1" lineno="109" slineno="1-85"/>under this rule if the action does not meet the jurisdictional requirements of the business and <ln numlevel="1" lineno="110" slineno="1-86"/>chancery court.<eol numlevel="1" lineno="111" slineno="1-87" display="tab"/><para/><bold>(3)</bold> <bold>Factors in determining whether to transfer an action.</bold> On a motion under paragraph <ln numlevel="1" lineno="112" slineno="1-88"/>(d)(1) or (2), a court may consider, among other factors, whether the transfer will:<eol numlevel="1" lineno="113" slineno="1-89" display="tab"/><para/><tab/>(A) increase the likelihood of a fair and impartial determination in the action;<eol numlevel="1" lineno="114" slineno="1-90" display="tab"/><para/><tab/>(B) minimize expense or inconvenience to parties, witnesses, or the court;<eol numlevel="1" lineno="115" slineno="1-91" display="tab"/><para/><tab/>(C) decrease delay;<eol numlevel="1" lineno="116" slineno="1-92" display="tab"/><para/><tab/>(D) avoid hardship or injustice otherwise caused by:<eol numlevel="1" lineno="117" slineno="1-93" display="tab"/><para/><tab/><tab/>(i) the venue requirements if the court is determining whether to transfer the <ln numlevel="1" lineno="118" slineno="1-94"/>action to the appropriate venue under paragraph (d)(1); or<eol numlevel="1" lineno="119" slineno="1-95" display="tab"/><para/><tab/><tab/>(ii) keeping the action in the district court if the court is determining whether to <ln numlevel="1" lineno="120" slineno="1-96"/>transfer the action to the business and chancery court under paragraph (d)(2);
