lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This resolution urges the Governor to review Utah's designation of the Disability Law <ln numlevel="1" lineno="6" slineno="0-6"/>Center as the state's Protection and Advocacy agency to ensure that all individuals with <ln numlevel="1" lineno="7" slineno="0-7"/>disabilities, regardless of type or functional capacity, receive equitable advocacy and <ln numlevel="1" lineno="8" slineno="0-8"/>representation.</gd><hphead lineno="9">Highlighted Provisions:</hphead><hp numlevel="1" lineno="10" slineno="0-10">This resolution:<hl numlevel="1" lineno="11" slineno="0-11" level="1">recognizes the federal framework establishing Protection and Advocacy (P<char set="6" char="6"/>A) systems <ln numlevel="1" lineno="12" slineno="0-12"/>to protect the rights of individuals with disabilities;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">encourages the Governor to initiate a formal review of the current P<char set="6" char="6"/>A designation and <ln numlevel="1" lineno="14" slineno="0-14"/>consider redesignation, if warranted;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">outlines steps for a transparent redesignation process consistent with federal <ln numlevel="1" lineno="16" slineno="0-16"/>requirements, including public notice, comment, and hearings; and</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">urges that any review or redesignation process ensure inclusive representation and <ln numlevel="1" lineno="18" slineno="0-18"/>advocacy slineno="0-24">Be it resolved by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="25" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="jchristopherson" level="1" amendtag="both">WHEREAS, in 1978, the Governor of Utah designated what is now known as the Disability <ln numlevel="1" lineno="26" slineno="1-2"/>Law Center (DLC) as Utah's official Protection and Advocacy (P<char set="6" char="6"/>A) agency, in accordance <ln numlevel="1" lineno="27" slineno="1-3"/>with the Developmental Disabilities Assistance and Bill of Rights Act (DD Act), to protect and <ln numlevel="1" lineno="28" slineno="1-4"/>advance the legal rights of persons with disabilities;<eol numlevel="1" lineno="29" slineno="1-5" display="tab"/>WHEREAS, the state's Protection and Advocacy system, established under federal law <ln numlevel="1" lineno="30" slineno="1-6"/>including the DD Act and the Protection and Advocacy for Individuals with Mental Illness Act <ln numlevel="1" lineno="31" slineno="1-7"/>(PAIMI), is mandated to protect and advocate for the rights of all individuals with disabilities, <ln numlevel="1" lineno="32" slineno="1-8"/>regardless of type or severity;<eol numlevel="1" lineno="33" slineno="1-9" display="tab"/>WHEREAS, individuals with disabilities encompass diverse categories, including physical <ln numlevel="1" lineno="34" slineno="1-10"/>(e.g., cerebral palsy, spinal cord injuries), sensory (e.g., blindness, deafness), intellectual and <ln numlevel="1" lineno="35" slineno="1-11"/>developmental (e.g., Down syndrome, autism spectrum disorder), mental health (e.g., <ln numlevel="1" lineno="36" slineno="1-12"/>schizophrenia, bipolar disorder), and invisible disabilities (e.g., chronic pain, epilepsy, <ln numlevel="1" lineno="37" slineno="1-13"/>dyslexia), each requiring tailored advocacy;<eol numlevel="1" lineno="38" slineno="1-14" display="tab"/>WHEREAS, within these categories, individuals vary widely in functional capacity, from <ln numlevel="1" lineno="39" slineno="1-15"/>high-functioning individuals living independently with minimal support to low-functioning <ln numlevel="1" lineno="40" slineno="1-16"/>individuals requiring substantial or constant support, all entitled to equitable advocacy services;<eol numlevel="1" lineno="41" slineno="1-17" display="tab"/>WHEREAS, federal funding conditions and oversight by the Administration for <ln numlevel="1" lineno="42" slineno="1-18"/>Community Living require P<char set="6" char="6"/>A systems to demonstrate a cross-disability approach, ensuring <ln numlevel="1" lineno="43" slineno="1-19"/>advocacy efforts address all disability types and functional levels, including underserved <ln numlevel="1" lineno="44" slineno="1-20"/>populations;<eol numlevel="1" lineno="45" slineno="1-21" display="tab"/>WHEREAS, Annual Program Performance Reports submitted to federal authorities shall <ln numlevel="1" lineno="46" slineno="1-22"/>reflect balanced case distribution proportional to state demographics, ensuring no disability <ln numlevel="1" lineno="47" slineno="1-23"/>group is systematically underserved;<eol numlevel="1" lineno="48" slineno="1-24" display="tab"/>WHEREAS, the P<char set="6" char="6"/>A prioritization process, incorporating public input, shall explicitly <ln numlevel="1" lineno="49" slineno="1-25"/>include outreach to and representation of both high-functioning individuals (e.g., seeking <ln numlevel="1" lineno="50" slineno="1-26"/>employment or educational accommodations) and low-functioning individuals (e.g., at risk in <ln numlevel="1" lineno="51" slineno="1-27"/>institutional settings) to meet federal equity standards;<eol numlevel="1" lineno="52" slineno="1-28" display="tab"/>WHEREAS, stakeholder feedback reveals the need for P<char set="6" char="6"/>A advocacy to address both overt <ln numlevel="1" lineno="53" slineno="1-29"/>violations affecting low-functioning persons and systemic barriers affecting high-functioning <ln numlevel="1" lineno="54" slineno="1-30"/>individuals;<eol numlevel="1" lineno="55" slineno="1-31" display="tab"/>WHEREAS, the social model of disability emphasizes barriers rooted in societal and <ln numlevel="1" lineno="56" slineno="1-32"/>environmental factors, necessitating P<char set="6" char="6"/>A advocacy that encompasses access, inclusion, and <ln numlevel="1" lineno="57" slineno="1-33"/>rights enforcement across all functional levels;<eol numlevel="1" lineno="58" slineno="1-34" display="tab"/>WHEREAS, failure to advocate for all disabled persons risks perpetuating disparities and <ln numlevel="1" lineno="59" slineno="1-35"/>undermines the P<char set="6" char="6"/>A's mission;<eol numlevel="1" lineno="60" slineno="1-36" display="tab"/>WHEREAS, a comprehensive advocacy strategy shall include facility monitoring for <ln numlevel="1" lineno="61" slineno="1-37"/>institutionalized individuals as well as community-based advocacy promoting Americans with <ln numlevel="1" lineno="62" slineno="1-38"/>Disabilities Act compliance for high-functioning individuals;<eol numlevel="1" lineno="63" slineno="1-39" display="tab"/>WHEREAS, since the original 1978 designation, the DLC has not regularly provided <ln numlevel="1" lineno="64" slineno="1-40"/>formal performance or fiscal reports to the Governor or Utah Legislature beyond federal <ln numlevel="1" lineno="65" slineno="1-41"/>submissions, limiting state oversight and review of activities; and<eol numlevel="1" lineno="66" slineno="1-42" display="tab"/>WHEREAS,  federal law under 45 C.F.R. Sec. 1326.20 gives the Governor discretion to <ln numlevel="1" lineno="67" slineno="1-43"/>review and redesignate the state's P<char set="6" char="6"/>A agency for good cause, requiring adherence to <ln numlevel="1" lineno="68" slineno="1-44"/>federally prescribed steps ensuring transparency, public participation, and continuity of <ln numlevel="1" lineno="69" slineno="1-45"/>services:<eol numlevel="1" lineno="70" slineno="1-46" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah <ln numlevel="1" lineno="71" slineno="1-47"/>respectfully urges the Governor to initiate a formal review of the designation of the Disability <ln numlevel="1" lineno="72" slineno="1-48"/>Law Center as Utah's P<char set="6" char="6"/>A agency and, if warranted, undertake redesignation consistent with <ln numlevel="1" lineno="73" slineno="1-49"/>federal guidelines.<eol numlevel="1" lineno="74" slineno="1-50" display="tab"/>BE IT FURTHER RESOLVED that the formal review should evaluate whether the current <ln numlevel="1" lineno="75" slineno="1-51"/>P<char set="6" char="6"/>A provider is respectful of families caring for disabled members, is appropriately <ln numlevel="1" lineno="76" slineno="1-52"/>advocating for all eligible individuals, and prioritizing those with the greatest needs.<eol numlevel="1" lineno="77" slineno="1-53" display="tab"/>BE IT FURTHER RESOLVED that the Governor, if commencing redesignation, shall:<eol numlevel="1" lineno="78" slineno="1-54" display="tab"/><char set="6" char="34"/>Provide written notice of intent to the current agency citing good cause and informing of <ln numlevel="1" lineno="79" slineno="1-55"/>appeal rights;<eol numlevel="1" lineno="80" slineno="1-56" display="tab"/><char set="6" char="34"/> Issue a broadly disseminated public notice with accessible details on the review purpose, <ln numlevel="1" lineno="81" slineno="1-57"/>process, and assurances of service continuation;<eol numlevel="1" lineno="82" slineno="1-58" display="tab"/><char set="6" char="34"/> Provide a minimum 45-day public comment period inviting feedback from stakeholders;<eol numlevel="1" lineno="83" slineno="1-59" display="tab"/><char set="6" char="34"/> Hold a public hearing to review comments and testimony;<eol numlevel="1" lineno="84" slineno="1-60" display="tab"/><char set="6" char="34"/> Solicit proposals<badspell spid="3743" suggestions="DPs,RVs,RAMs,RAP,RBIs"/> from qualified public or private nonprofit entities demonstrating <ln numlevel="1" lineno="85" slineno="1-61"/>independence and capacity to serve all disability populations inclusively and with <ln numlevel="1" lineno="86" slineno="1-62"/>family-centered advocacy;<eol numlevel="1" lineno="87" slineno="1-63" display="tab"/><char set="6" char="34"/> Evaluate comments and proposals to determine whether to retain or redesignate the <ln numlevel="1" lineno="88" slineno="1-64"/>agency; and<eol numlevel="1" lineno="89" slineno="1-65" display="tab"/><char set="6" char="34"/> Publish a final decision with justifications and submit required assurances to federal <ln numlevel="1" lineno="90" slineno="1-66"/>authorities within 30 days post-decision.<eol numlevel="1" lineno="91" slineno="1-67" display="tab"/>BE IT FURTHER RESOLVED that the Legislature of the state of Utah encourages the <ln numlevel="1" lineno="92" slineno="1-68"/>Governor to ensure this process is conducted with transparency, inclusivity, and a commitment <ln numlevel="1" lineno="93" slineno="1-69"/>to representing the full breadth of Utah's disabled community.<eol numlevel="1" lineno="94" slineno="1-70" display="tab"/>BE IT FURTHER RESOLVED that the Governor's findings and any actions taken be <ln numlevel="1" lineno="95" slineno="1-71"/>reported to the Legislature for oversight and future guidance.</amend><sectionText/></section></bsec></bdy><foot><rev><tm>1-19-26 12:44 PM</tm></rev></foot></leg>
