It is proposed to amend Utah Constitution, Article VI, Section 2 to read</secline><catline lineno="25"><bold>Article VI, Section 2<parens/>. [Time and location of annual general sessions -- Location <ln numlevel="1" lineno="26" slineno="1-3"/>of sessions convened by the Governor or Legislature -- Sessions convened by the <ln numlevel="1" lineno="27" slineno="1-4"/>Legislature.]</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-9" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Annual general sessions of the Legislature shall be held at the seat of government <ln numlevel="1" lineno="29" slineno="1-6"/>and shall begin on the day in January designated by statute.</subsection><subsection ssid="6-10" dnum="_-o:b-i" numlevel="1" lineno="30" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">An annual general session may occur on nonconsecutive days throughout the <ln numlevel="1" lineno="31" slineno="1-8"/>calendar year, provided the time period described in Article VI, Section 16, is not <ln numlevel="1" lineno="32" slineno="1-9"/>exceeded.</amend></subsection><subsection ssid="6-11" dnum="_-o:c-i" numlevel="1" lineno="33" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">Both houses shall meet in annual general session on the same days of the calendar <ln numlevel="1" lineno="34" slineno="1-11"/>year.</amend></subsection></subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="35" slineno="1-12" level="1"><display>(2)</display>A session convened by the Governor under Article VII, Section 6 and a session <ln numlevel="1" lineno="36" slineno="1-13"/>convened by the Legislature under Subsection <xref depth="4" refnumber="Article VI, Section 2(3)" start="0">(3)</xref> shall be held at the seat of <ln numlevel="1" lineno="37" slineno="1-14"/>government, unless convening at the seat of government is not feasible due to epidemic, <ln numlevel="1" lineno="38" slineno="1-15"/>natural or human-caused disaster, enemy attack, or other public catastrophe.</subsection><subsection ssid="6-null-3" dnum="3-o" numlevel="1" lineno="39" slineno="1-16" level="1" space="false"><display>(3)</display><subsection ssid="6-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The President of the Senate and Speaker of the House of Representatives shall by <ln numlevel="1" lineno="40" slineno="1-17"/>joint proclamation convene the Legislature into session if a poll conducted by the <ln numlevel="1" lineno="41" slineno="1-18"/>President and Speaker of their respective houses indicates that two-thirds of all <ln numlevel="1" lineno="42" slineno="1-19"/>members elected to each house are in favor of convening the Legislature into session <ln numlevel="1" lineno="43" slineno="1-20"/>because in their opinion a persistent fiscal crisis, war, natural disaster, or emergency <ln numlevel="1" lineno="44" slineno="1-21"/>in the affairs of the State necessitates convening the Legislature into session.</subsection><subsection ssid="6-null-5" dnum="b-o" numlevel="1" lineno="45" slineno="1-22" level="2"><display>(b)</display>The joint proclamation issued by the President and Speaker shall specify the business <ln numlevel="1" lineno="46" slineno="1-23"/>for which the Legislature is to be convened, and the Legislature may not transact any <ln numlevel="1" lineno="47" slineno="1-24"/>business other than that specified in the joint proclamation, except that the <ln numlevel="1" lineno="48" slineno="1-25"/>Legislature may provide for the expenses of the session and other matters incidental <ln numlevel="1" lineno="49" slineno="1-26"/>to the session.</subsection><subsection ssid="6-null-6" dnum="c-o" numlevel="1" lineno="50" slineno="1-27" level="2"><display>(c)</display>The Legislature may not be convened into session under this Subsection <xref depth="4" refnumber="Article VI, Section 2(3)" start="0">(3)</xref> during <ln numlevel="1" lineno="51" slineno="1-28"/>the 30 calendar days immediately following the adjournment sine die of an annual <ln numlevel="1" lineno="52" slineno="1-29"/>general session of the Legislature.</subsection><subsection ssid="6-null-7" dnum="d-o" numlevel="1" lineno="53" slineno="1-30" level="2"><display>(d)</display>In a session convened under this Subsection <xref depth="4" refnumber="Article VI, Section 2(3)" start="0">(3)</xref>, the cumulative amount of <ln numlevel="1" lineno="54" slineno="1-31"/>appropriations that the Legislature makes may not exceed an amount equal to 1% of <ln numlevel="1" lineno="55" slineno="1-32"/>the total amount appropriated by the Legislature for the immediately preceding <ln numlevel="1" lineno="56" slineno="1-33"/>completed fiscal year.</subsection><subsection ssid="6-null-8" dnum="e-o" numlevel="1" lineno="57" slineno="1-34" level="2"><display>(e)</display>Nothing in this Subsection <xref depth="4" refnumber="Article VI, Section 2(3)" start="0">(3)</xref> affects the Governor's authority to convene the <ln numlevel="1" lineno="58" slineno="1-35"/>Legislature under Article VII, Section 6.</subsection></subsection></section></bsec><bsec buid="4" num="Article VI, Section 15" type="amend" src="const" uid="UC_AVI_S15_2028010120280101" sort="00I06 00150020280101" numlevel="1" lineno="59" slineno="2-1" sn="2"><section number="Article VI, Section 15" numlevel="1" lineno="60" slineno="2-2" type="amend"><secline lineno="59">Section 2. It is proposed to amend Utah Constitution, Article VI, Section 15 to read</secline><catline lineno="60"><bold>Article VI, Section 15<parens/>. [Sessions to be public.]</bold></catline><sectionText lineno="61"><tab/>All sessions of the Legislature, except those of the Senate while sitting in executive <ln numlevel="1" lineno="62" slineno="2-4"/>session, shall be public<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">; and neither house, without the consent of the other, shall adjourn for <ln numlevel="1" lineno="63" slineno="2-5"/>more than three days, nor to any other place than that in which it may be holding session</amend><amendoutend style="2"/>.</sectionText></section></bsec><bsec buid="10" num="Article VI, Section 16" type="amend" src="const" uid="UC_AVI_S16_2026050620260506" sort="00I06 00160020260506" numlevel="1" lineno="64" slineno="3-1" sn="3"><section number="Article VI, Section 16" numlevel="1" lineno="65" slineno="3-2" type="amend"><secline lineno="64">Section 3. It is proposed to amend Utah Constitution, Article VI, Section 16 to read</secline><catline lineno="65"><bold>Article VI, Section 16<parens/>. [Duration of sessions.]</bold></catline><sectionText lineno="66"><tab/>Except in cases of impeachment:</sectionText><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="67" slineno="3-4" level="1"><display>(1)</display>no annual general session of the Legislature may exceed 45 calendar days, excluding <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="68" slineno="3-5"/>state holidays and federal holidays</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">days provided by statute</amend>;</subsection><subsection ssid="10-null-2" dnum="2-o" numlevel="1" lineno="69" slineno="3-6" level="1"><display>(2)</display>no session of the Legislature convened by the Governor under Article VII, Section 6 <ln numlevel="1" lineno="70" slineno="3-7"/>may exceed 30 calendar days; and</subsection><subsection ssid="10-null-3" dnum="3-o" numlevel="1" lineno="71" slineno="3-8" level="1"><display>(3)</display>no session of the Legislature convened by the Legislature under Article VI, Section 2, <ln numlevel="1" lineno="72" slineno="3-9"/>Subsection <xref depth="4" refnumber="Article VI, Section 16(3)" start="0">(3)</xref> may exceed 10 calendar days.</subsection></section></bsec><bsec buid="9" num="Article IX, Section 1" type="amend" src="const" uid="UC_AIX_S1_2026050620260506" sort="00I09 00010020260506" numlevel="1" lineno="73" slineno="4-1" sn="4"><section number="Article IX, Section 1" numlevel="1" lineno="74" slineno="4-2" type="amend"><secline lineno="73">Section 4. It is proposed to amend Utah Constitution, Article IX, Section 1 to read</secline><catline lineno="74"><bold>Article IX, Section 1<parens/>. [Dividing the state into districts.]</bold></catline><sectionText lineno="75"><tab/>No later than the <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">start of the </amend>annual general session next following the Legislature's <ln numlevel="1" lineno="76" slineno="4-4"/>receipt of the results of an enumeration made by the authority of the United States, the <ln numlevel="1" lineno="77" slineno="4-5"/>Legislature shall divide the state into congressional, legislative, and other districts accordingly.</sectionText></section></bsec><bsec buid="2" type="uncod" untype="votesub" src="uncod" uid="VS0000" sort="UB" langlock="false" numlevel="1" lineno="78" slineno="5-1" sn="5"><section type="uncod" untype="votesub" display="false" src="uncod"><secline lineno="78">Section 5.  <bold>Submittal to voters.</bold></secline><sectionText lineno="79"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">The lieutenant governor is directed to submit this proposed amendment to the voters of <ln numlevel="1" lineno="80" slineno="5-3"/>the state at the next regular general election in the manner provided by law.</amend></sectionText></section></bsec><bsec buid="1" type="uncod" untype="contingent" src="uncod" uid="CT0000" sort="UC" langlock="false" numlevel="1" lineno="81" slineno="6-1" sn="6"><section type="uncod" untype="contingent" display="false" src="uncod"><secline lineno="81">Section 6.  <bold>Contingent effective date.</bold></secline><sectionText lineno="82"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">If the amendment proposed by this joint resolution is approved by a majority of those <ln numlevel="1" lineno="83" slineno="6-3"/>voting on it at the next regular general election, the amendment shall take effect on January 1, <ln numlevel="1" lineno="84" slineno="6-4"/>2028.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-26-26 9:04 AM</tm></rev></foot></leg>
