Adoption, amendment, or suspension of Senate rules.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="43" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Senate shall adopt Senate rules, by a constitutional two-thirds vote, at the <ln numlevel="1" lineno="44" slineno="1-4"/>beginning of each new Legislature convening in an odd-numbered year.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="45" slineno="1-5" level="2"><display>(b)</display>If a motion to adopt the rules under Subsection <xref depth="4" refnumber="SR1-1-101(1)(a)" start="0">(1)(a)</xref> meets or exceeds a majority <ln numlevel="1" lineno="46" slineno="1-6"/>vote but fails to reach a constitutional two-thirds vote:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="47" slineno="1-7" level="3"><display>(i)</display>rules adopted by the Senate during the immediately preceding annual general <ln numlevel="1" lineno="48" slineno="1-8"/>session, as amended during that general session and any intervening session, apply <ln numlevel="1" lineno="49" slineno="1-9"/>to the conduct of the Senate; and</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="50" slineno="1-10" level="3"><display>(ii)</display>the presiding officer shall announce to the Senate that the previously adopted <ln numlevel="1" lineno="51" slineno="1-11"/>rules apply to the newly convened Legislature.</subsection></subsection></subsection><subsection ssid="1-null-6" dnum="2-o" numlevel="1" lineno="52" slineno="1-12" level="1" space="false"><display>(2)</display><subsection ssid="1-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in this rule:<subsection ssid="1-null-8" dnum="i-o" numlevel="1" lineno="53" slineno="1-13" level="3" tab="1"><display>(i)</display>during an annual general session held in an even-numbered year, rules adopted by <ln numlevel="1" lineno="54" slineno="1-14"/>the Senate during the immediately preceding general session, as amended during <ln numlevel="1" lineno="55" slineno="1-15"/>that general session and any intervening session, apply to the conduct of the <ln numlevel="1" lineno="56" slineno="1-16"/>Senate; and</subsection><subsection ssid="1-null-9" dnum="ii-o" numlevel="1" lineno="57" slineno="1-17" level="3" tab="1"><display>(ii)</display>during any special session<amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both"> or extraordinary session</amend>, Senate rules apply as <ln numlevel="1" lineno="58" slineno="1-18"/>provided in <xref depth="3" refnumber="JR2-1-101" start="0">JR2-1-101</xref>.</subsection></subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="59" slineno="1-19" level="2"><display>(b)</display>For a session described in Subsection <xref depth="4" refnumber="SR1-1-101(2)(a)" start="0">(2)(a)</xref>, the presiding officer shall announce to <ln numlevel="1" lineno="60" slineno="1-20"/>the Senate that the previously adopted rules apply to the newly convened session.</subsection></subsection><subsection ssid="1-null-11" dnum="3-o" numlevel="1" lineno="61" slineno="1-21" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refnumber="SR1-1-101(4)" start="0">(4)</xref>, additional rules may be adopted and existing rules <ln numlevel="1" lineno="62" slineno="1-22"/>may be suspended, amended, or repealed by a majority vote, except for those rules that <ln numlevel="1" lineno="63" slineno="1-23"/>require a two-thirds vote to adopt, suspend, amend, or repeal, including:<subsection ssid="1-null-12" dnum="a-o" numlevel="1" lineno="64" slineno="1-24" level="2"><display>(a)</display>rules governing motions for lifting tabled legislation from committee under <xref depth="3" refnumber="SR4-3-104" start="0"><ln numlevel="1" lineno="65" slineno="1-25"/>SR4-3-104</xref>; and</subsection><subsection ssid="1-null-13" dnum="b-o" numlevel="1" lineno="66" slineno="1-26" level="2"><display>(b)</display>rules governing consideration of legislation during the last three days of a session.</subsection></subsection><subsection ssid="1-null-14" dnum="4-o" numlevel="1" lineno="67" slineno="1-27" level="1" space="false"><display>(4)</display><subsection ssid="1-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule that includes a voting requirement of more than a constitutional majority <ln numlevel="1" lineno="68" slineno="1-28"/>must be adopted and may only be amended, suspended, or repealed by a <ln numlevel="1" lineno="69" slineno="1-29"/>constitutional two-thirds vote.</subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="70" slineno="1-30" level="2"><display>(b)</display>If the suspension of any Senate Rule is governed by the Utah Constitution or Utah <ln numlevel="1" lineno="71" slineno="1-31"/>statutes, the Senate may suspend that rule only as provided by that constitutional or <ln numlevel="1" lineno="72" slineno="1-32"/>statutory provision.</subsection></subsection></section></bsec><bsec buid="18" num="SR1-3-102" type="amend" src="rule" uid="SR1-3-S102_1800010118000101" sort="S01 03 01020018000101" numlevel="1" lineno="73" slineno="2-1" sn="2"><section number="SR1-3-102" numlevel="1" lineno="74" slineno="2-2" type="amend"><secline lineno="73">Section 2. <bold>SR1-3-102</bold> is amended to read:</secline><catline lineno="74"><bold>SR1-3-102<parens/>. Duties of the president.</bold></catline><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="75" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The general duties of the president are to:<subsection ssid="18-null-2" dnum="a-o" numlevel="1" lineno="76" slineno="2-4" level="2"><display>(a)</display>assign responsibilities to and supervise the officers and employees of the Senate;</subsection><subsection ssid="18-null-3" dnum="b-o" numlevel="1" lineno="77" slineno="2-5" level="2"><display>(b)</display>assign places and determine access for news media representatives;</subsection><subsection ssid="18-null-4" dnum="c-o" numlevel="1" lineno="78" slineno="2-6" level="2"><display>(c)</display>call the Senate to order at the time scheduled for convening, and proceed with the <ln numlevel="1" lineno="79" slineno="2-7"/>daily order of business;</subsection><subsection ssid="18-null-5" dnum="d-o" numlevel="1" lineno="80" slineno="2-8" level="2"><display>(d)</display>announce the business before the Senate in the order that it is to be acted upon;</subsection><subsection ssid="18-null-6" dnum="e-o" numlevel="1" lineno="81" slineno="2-9" level="2"><display>(e)</display>receive and submit all motions and proposals presented by senators;</subsection><subsection ssid="18-null-7" dnum="f-o" numlevel="1" lineno="82" slineno="2-10" level="2"><display>(f)</display>put to a vote all questions that arise in the course of proceedings, and announce the <ln numlevel="1" lineno="83" slineno="2-11"/>results of the vote;</subsection><subsection ssid="18-null-8" dnum="g-o" numlevel="1" lineno="84" slineno="2-12" level="2"><display>(g)</display>enforce the Senate Rules governing debates;</subsection><subsection ssid="18-null-9" dnum="h-o" numlevel="1" lineno="85" slineno="2-13" level="2"><display>(h)</display>enforce observance of order and decorum;</subsection><subsection ssid="18-null-10" dnum="i-o" numlevel="1" lineno="86" slineno="2-14" level="2"><display>(i)</display>inform the Senate on any point of order or practice;</subsection><subsection ssid="18-null-11" dnum="j-o" numlevel="1" lineno="87" slineno="2-15" level="2"><display>(j)</display>receive and announce to the Senate any official messages and communications;</subsection><subsection ssid="18-null-12" dnum="k-o" numlevel="1" lineno="88" slineno="2-16" level="2"><display>(k)</display>sign all acts, orders, and proceedings of the Senate;</subsection><subsection ssid="18-null-13" dnum="l-o" numlevel="1" lineno="89" slineno="2-17" level="2"><display>(l)</display>appoint the members of committees; and</subsection><subsection ssid="18-null-14" dnum="m-o" numlevel="1" lineno="90" slineno="2-18" level="2"><display>(m)</display>represent the Senate, declaring its will and obeying its commands.</subsection></subsection><subsection ssid="18-null-15" dnum="2-o" numlevel="1" lineno="91" slineno="2-19" level="1"><display>(2)</display>The president shall:<subsection ssid="18-null-16" dnum="a-o" numlevel="1" lineno="92" slineno="2-20" level="2"><display>(a)</display>sign, or authorize a designee to sign, all requisitions on the Division of Finance to <ln numlevel="1" lineno="93" slineno="2-21"/>pay Senate expenses; and</subsection><subsection ssid="18-null-17" dnum="b-o" numlevel="1" lineno="94" slineno="2-22" level="2"><display>(b)</display>give final approval of all expenditure requests as authorized by the majority<amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both"> leader</amend> <ln numlevel="1" lineno="95" slineno="2-23"/>and <amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both">the </amend>minority <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="ahaskell" level="1" deltag="both">leaders of the Senate</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both" space="true">leader</amend>,<amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both"> as that term is defined in <xref depth="3" refnumber="SR3-2-101">SR3-2-101</xref>,</amend> <ln numlevel="1" lineno="96" slineno="2-24"/>including compensation and reimbursement for expenses for in-state and out-of-state <ln numlevel="1" lineno="97" slineno="2-25"/>travel on legislative business.</subsection></subsection></section></bsec><bsec buid="24" num="SR1-5-101" type="amend" src="rule" uid="SR1-5-S101_1800010118000101" sort="S01 05 01010018000101" numlevel="1" lineno="98" slineno="3-1" sn="3"><section number="SR1-5-101" numlevel="1" lineno="99" slineno="3-2" type="amend"><secline lineno="98">Section 3. <bold>SR1-5-101</bold> is amended to read:</secline><catline lineno="99"><bold>SR1-5-101<parens/>. Admittance to the Senate chamber.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="106" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>While the Senate is convened in annual general session or special session and <ln numlevel="1" lineno="107" slineno="4-4"/>except as specifically provided elsewhere in this rule, only legislators, legislative <ln numlevel="1" lineno="108" slineno="4-5"/>officers and employees, professional staff, former legislators who are not registered <ln numlevel="1" lineno="109" slineno="4-6"/>as lobbyists, legal spouses of legislators, legislative interns, and individuals invited <ln numlevel="1" lineno="110" slineno="4-7"/>by senators are allowed in the Senate chamber, halls, and lounge.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="111" slineno="4-8" level="2"><display>(b)</display>The president of the Senate may deny access to the Senate chamber, halls, and <ln numlevel="1" lineno="112" slineno="4-9"/>lounge to any individual, other than a legislator, if the individual uses that access to <ln numlevel="1" lineno="113" slineno="4-10"/>influence legislative decisions.</subsection></subsection><subsection ssid="3-null-4" dnum="2-o" numlevel="1" lineno="114" slineno="4-11" level="1" space="false"><display>(2)</display><subsection ssid="3-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A senator or the senator's legislative intern shall accompany each visitor in the <ln numlevel="1" lineno="115" slineno="4-12"/>chamber, lounge, or hallways and is responsible for that visitor.</subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="116" slineno="4-13" level="2"><display>(b)</display>After the visit, the senator or the senator's legislative intern shall ensure that the <ln numlevel="1" lineno="117" slineno="4-14"/>visitor leaves the chamber, lounge, or hallway.</subsection></subsection><subsection ssid="3-null-7" dnum="3-o" numlevel="1" lineno="118" slineno="4-15" level="1" space="false"><display>(3)</display><subsection ssid="3-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A senator may invite a guest to accompany the senator on the Senate floor, <ln numlevel="1" lineno="119" slineno="4-16"/>provided that:<subsection ssid="3-null-9" dnum="i-o" numlevel="1" lineno="120" slineno="4-17" level="3" tab="1"><display>(i)</display>the senator ensures that the guest does not encroach on a neighboring senator's <ln numlevel="1" lineno="121" slineno="4-18"/>desk space, impede staff work, or distract from the work of the Senate, and no <ln numlevel="1" lineno="122" slineno="4-19"/>neighboring senator makes such an objection; and</subsection><subsection ssid="3-null-10" dnum="ii-o" numlevel="1" lineno="123" slineno="4-20" level="3" tab="1"><display>(ii)</display>the guest complies with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">the requirements of <xref depth="3" refnumber="SR2-4-102">SR2-4-102</xref> and <xref depth="3" refnumber="SR2-4-103">SR2-4-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Senate <ln numlevel="1" lineno="124" slineno="4-21"/>rules and practice.</amend></subsection></subsection><subsection ssid="3-null-11" dnum="b-o" numlevel="1" lineno="125" slineno="4-22" level="2"><display>(b)</display>A senator who believes that a guest is intruding on desk space, is impeding staff <ln numlevel="1" lineno="126" slineno="4-23"/>work, or is distracting from the work of the Senate may communicate the senator's <ln numlevel="1" lineno="127" slineno="4-24"/>objection to the senator who has invited the guest, or through the majority leader, the <ln numlevel="1" lineno="128" slineno="4-25"/>minority leader<amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both"> as defined in <xref depth="3" refnumber="SR3-2-101">SR3-2-101</xref></amend>, or the president of the Senate.</subsection></subsection></section></bsec><bsec buid="19" num="SR3-2-101" type="amend" src="rule" uid="SR3-2-S101_1800010118000101" sort="S03 02 01010018000101" numlevel="1" lineno="129" slineno="5-1" sn="5"><section number="SR3-2-101" numlevel="1" lineno="130" slineno="5-2" type="amend"><secline lineno="129">Section 5. <bold>SR3-2-101</bold> is amended to read:</secline><catline lineno="130"><bold>SR3-2-101<parens/>. Definitions.</bold></catline><sectionText lineno="131"><tab/>As used in this chapter:</sectionText><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="132" slineno="5-4" slineno="5-12"/>legislation to the Senate second reading calendar.</subsection><subsection ssid="19-null-7" dnum="5-o" numlevel="1" lineno="141" slineno="5-13" level="1"><display>(5)</display>"Legislation" means a Senate bill, House bill, Senate resolution, House resolution, joint <ln numlevel="1" lineno="142" slineno="5-14"/>resolution, or concurrent resolution.</subsection><subsection ssid="19-null-8" dnum="6-o" numlevel="1" lineno="143" slineno="5-15" level="1"><display>(6)</display>"Majority vote" means a majority of a quorum as described in <xref depth="3" refnumber="SR3-2-203" start="0">SR3-2-203</xref>.</subsection><subsection ssid="19-16" dnum="_-o:7-i" numlevel="1" lineno="144" slineno="5-16" ea="amend" anum="0" owner="ahaskell" Point of order.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="203" slineno="8-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="22-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a senator believes that there has been a breach of order, a breach of rules, or a <ln numlevel="1" lineno="204" slineno="8-4"/>breach of established parliamentary practice, the senator may rise and, without being <ln numlevel="1" lineno="205" slineno="8-5"/>recognized, state: "point of order."</subsection><subsection ssid="22-null-3" dnum="b-o" numlevel="1" lineno="206" slineno="8-6" level="2"><display>(b)</display>When a senator raises a point of order:<subsection ssid="22-null-4" dnum="i-o" numlevel="1" lineno="207" slineno="8-7" level="3"><display>(i)</display>the presiding officer shall interrupt the proceedings;</subsection><subsection ssid="22-null-5" dnum="ii-o" numlevel="1" lineno="208" slineno="8-8" level="3"><display>(ii)</display>the senator who has the floor shall yield the floor; and</subsection><subsection ssid="22-null-6" dnum="iii-o" numlevel="1" lineno="209" slineno="8-9" level="3"><display>(iii)</display>the presiding officer shall ask the senator raising the point of order to "state your <ln numlevel="1" lineno="210" slineno="8-10"/>point."</subsection></subsection><subsection ssid="22-null-7" dnum="c-o" numlevel="1" lineno="211" slineno="8-11" level="2"><display>(c)</display>When the presiding officer responds "state your point," the senator shall briefly <ln numlevel="1" lineno="212" slineno="8-12"/>explain the alleged breach to the body, citing to appropriate authority if possible.</subsection></subsection><subsection ssid="22-null-8" dnum="2-o" numlevel="1" lineno="213" slineno="8-13" level="1" space="false"><display>(2)</display><subsection ssid="22-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The presiding officer may speak to points of order <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">in preference to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> other <ln numlevel="1" lineno="214" slineno="8-14"/>senators rising for that purpose.</subsection><subsection ssid="22-null-10" dnum="b-o" numlevel="1" lineno="215" slineno="8-15" level="2"><display>(b)</display>The presiding officer may:<subsection ssid="22-null-11" dnum="i-o" numlevel="1" lineno="216" slineno="8-16" level="3"><display>(i)</display>rule on the point of order immediately;</subsection><subsection ssid="22-null-12" dnum="ii-o" numlevel="1" lineno="217" slineno="8-17" level="3"><display>(ii)</display>consult with the secretary of the Senate, other staff, or another senator before <ln numlevel="1" lineno="218" slineno="8-18"/>ruling on the point of order; or</subsection><subsection ssid="22-null-13" dnum="iii-o" numlevel="1" lineno="219" slineno="8-19" level="3"><display>(iii)</display>defer the point of order until the presiding officer can research and rule on the <ln numlevel="1" lineno="220" slineno="8-20"/>point of order.</subsection></subsection><subsection ssid="22-null-14" dnum="c-o" numlevel="1" lineno="221" slineno="8-21" level="2" space="false"><display>(c)</display><subsection ssid="22-null-15" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Although points of order are generally decided without debate, the presiding <ln numlevel="1" lineno="222" slineno="8-22"/>officer may submit the point of order to the Senate for decision in doubtful cases.</subsection><subsection ssid="22-null-16" dnum="ii-o" numlevel="1" lineno="223" slineno="8-23" level="3"><display>(ii)</display>If submitted to the Senate for decision, a presiding officer shall allow debate or <ln numlevel="1" lineno="224" slineno="8-24"/>discussion on the point of order by recognizing members of the Senate who wish <ln numlevel="1" lineno="225" slineno="8-25"/>to speak to the point of order.</subsection><subsection ssid="22-null-17" dnum="iii-o" numlevel="1" lineno="226" slineno="8-26" level="3"><display>(iii)</display>A decision by the Senate deciding a point of order is not subject to appeal.</subsection></subsection></subsection><subsection ssid="22-null-18" dnum="3-o" numlevel="1" lineno="227" slineno="8-27" level="1"><display>(3)</display>When the presiding officer rules on the point of order, any senator who disagrees with <ln numlevel="1" lineno="228" slineno="8-28"/>the presiding officer's decision may appeal that decision to the Senate by following the <ln numlevel="1" lineno="229" slineno="8-29"/>procedures and requirements of <xref depth="3" refnumber="SR4-2-202" start="0">SR4-2-202</xref>.</subsection></section></bsec><bsec buid="11" num="SR4-3-102" type="amend" src="rule" uid="SR4-3-S102_1800010118000101" sort="S04 03 01020018000101" numlevel="1" lineno="230" slineno="9-1" sn="9"><section number="SR4-3-102" numlevel="1" lineno="231" slineno="9-2" type="amend"><secline lineno="230">Section 9. <bold>SR4-3-102</bold> is amended to read:</secline><catline lineno="231"><bold>SR4-3-102<parens/>. Consideration of bills.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="232" slineno="9-3" level="1" placement="noreturn"><display>(1)</display>Except for the 1st, 43rd, 44th, and 45th day of the annual general session, or any day <ln numlevel="1" lineno="233" slineno="9-4"/>during a special<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both"> or an extraordinary</amend> session, legislation may not be read for the third <ln numlevel="1" lineno="234" slineno="9-5"/>time until at least the day after it is placed on the third reading calendar.</subsection><subsection ssid="11-null-2" dnum="2-o" numlevel="1" lineno="235" slineno="9-6" level="1"><display>(2)</display>Legislation on the third reading calendar shall be considered in the order that it appears <ln numlevel="1" lineno="236" slineno="9-7"/>on the calendar unless a constitutional majority vote of the members of the Senate <ln numlevel="1" lineno="237" slineno="9-8"/>directs other action.</subsection></section></bsec><bsec buid="13" num="SR4-4-101" type="amend" src="rule" uid="SR4-4-S101_1800010118000101" sort="S04 04 01010018000101" numlevel="1" lineno="238" slineno="10-1" sn="10"><section number="SR4-4-101" numlevel="1" lineno="239" slineno="10-2" type="amend"><secline lineno="238">Section 10. <bold>SR4-4-101</bold> is amended to read:</secline><catline lineno="239"><bold>SR4-4-101<parens/>. Standing committee reports.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="240" slineno="10-3" level="1" placement="noreturn"><display>(1)</display>As used in this rule, "favorable committee report" means a report produced by a Senate <ln numlevel="1" lineno="241" slineno="10-4"/>standing committee for legislation that the committee voted to favorably recommend.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="242" slineno="10-5" level="1"><display>(2)</display>The secretary of the Senate<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both"> or the secretary's designee</amend> shall read each standing <ln numlevel="1" lineno="243" slineno="10-6"/>committee report.</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="244" slineno="10-7" level="1"><display>(3)</display>If the Senate adopts a favorable committee report, the secretary of the Senate or the <ln numlevel="1" lineno="245" slineno="10-8"/>secretary's designee shall:<subsection ssid="13-null-4" dnum="a-o" numlevel="1" lineno="246" slineno="10-9" level="2"><display>(a)</display>place the legislation, including any substitute or amendment recommended by the <ln numlevel="1" lineno="247" slineno="10-10"/>standing committee, on the second reading calendar; or</subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="248" slineno="10-11" level="2"><display>(b)</display>if the favorable committee report recommends that the legislation be placed on the <ln numlevel="1" lineno="249" slineno="10-12"/>consent calendar:<subsection ssid="13-null-6" dnum="i-o" numlevel="1" lineno="250" slineno="10-13" level="3"><display>(i)</display>read the legislation for the second time; and</subsection><subsection ssid="13-null-7" dnum="ii-o" numlevel="1" lineno="251" slineno="10-14" level="3"><display>(ii)</display>place the legislation on the consent calendar.</subsection></subsection></subsection><subsection ssid="13-null-8" dnum="4-o" numlevel="1" lineno="252" slineno="10-15" level="1"><display>(4)</display>If the Senate adopts a standing committee report that is not a favorable committee <ln numlevel="1" lineno="253" slineno="10-16"/>report, the legislation is placed in accordance with the standing committee report's <ln numlevel="1" lineno="254" slineno="10-17"/>recommendation.</subsection><subsection ssid="13-null-9" dnum="5-o" numlevel="1" lineno="255" slineno="10-18" level="1"><display>(5)</display>If the Senate fails to adopt a standing committee report, the legislation is returned to the <ln numlevel="1" lineno="256" slineno="10-19"/>Senate Rules Committee.</subsection></section></bsec><bsec buid="15" num="SR4-4-401" type="amend" src="rule" uid="SR4-4-S401_1800010118000101" sort="S04 04 04010018000101" numlevel="1" lineno="257" slineno="11-1" sn="11"><section number="SR4-4-401" numlevel="1" lineno="258" slineno="11-2" type="amend"><secline lineno="257">Section 11. <bold>SR4-4-401</bold> is amended to read:</secline><catline lineno="258"><bold>SR4-4-401<parens/>. Consent calendar.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="259" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>As used in this rule, "legislative day" means the same as that term is defined in <xref depth="3" refnumber="SR4-9-101"><ln numlevel="1" lineno="260" slineno="11-4"/>SR4-9-101</xref>.</subsection><subsection ssid="15-null-2" dnum="2-o" numlevel="1" lineno="261" slineno="11-5" level="1"><display>(2)</display>Subject to Subsection <xref tempid="286" depth="4" refnumber="SR4-4-301(3)(b)">(3)(b)</xref>, legislation shall remain on the consent calendar for two <ln numlevel="1" lineno="262" slineno="11-6"/>legislative days after the day on which the legislation is placed on the consent calendar <ln numlevel="1" lineno="263" slineno="11-7"/>under <xref depth="3" refnumber="SR4-4-201">SR4-4-201</xref>.</subsection><subsection ssid="15-null-3" dnum="3-o" numlevel="1" lineno="264" slineno="11-8" level="1" space="false"><display>(3)</display><subsection ssid="15-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Whenever the consent calendar contains legislation, the presiding officer shall <ln numlevel="1" lineno="265" slineno="11-9"/>inform the Senate each day that:<subsection ssid="15-null-5" dnum="i-o" numlevel="1" lineno="266" slineno="11-10" level="3" tab="1"><display>(i)</display>there are items on the consent calendar; and</subsection><subsection ssid="15-null-6" dnum="ii-o" numlevel="1" lineno="267" slineno="11-11" level="3" tab="1"><display>(ii)</display>if any senator objects to any legislation on the consent calendar, three or more <ln numlevel="1" lineno="268" slineno="11-12"/>senators may move the legislation to the second reading calendar by notifying the <ln numlevel="1" lineno="269" slineno="11-13"/>presiding officer verbally or in writing.</subsection></subsection><subsection ssid="15-null-7" dnum="b-o" numlevel="1" lineno="270" slineno="11-14" level="2"><display>(b)</display>If the presiding officer receives requests to move legislation from the consent <ln numlevel="1" lineno="271" slineno="11-15"/>calendar to the second reading calendar from three or more senators, the secretary <ln numlevel="1" lineno="272" slineno="11-16"/>shall:<subsection ssid="15-null-8" dnum="i-o" numlevel="1" lineno="273" slineno="11-17" level="3"><display>(i)</display>remove the legislation from the consent calendar; and</subsection><subsection ssid="15-null-9" dnum="ii-o" numlevel="1" lineno="274" slineno="11-18" level="3"><display>(ii)</display>place the legislation at the bottom of the second reading calendar.</subsection></subsection></subsection><subsection ssid="15-null-10" dnum="4-o" numlevel="1" lineno="275" slineno="11-19" level="1"><display>(4)</display>If no more than two members have registered objections to the legislation during the <ln numlevel="1" lineno="276" slineno="11-20"/>time period described in Subsection <xref tempid="228" depth="4" refnumber="SR4-4-301(2)">(2)</xref>, the<amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="ahaskell" level="1" amendtag="both"> secretary of the Senate or the secretary's <ln numlevel="1" lineno="277" slineno="11-21"/>designee shall read the legislation by title.</amend></subsection><subsection ssid="15-26" dnum="_-o:5-i" numlevel="1" lineno="278" slineno="11-22" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">When the secretary of the Senate or the secretary's designee has completed the third <ln numlevel="1" lineno="279" slineno="11-23"/>reading of the legislation:</amend><subsection ssid="15-27" dnum="_-o:a-i" numlevel="1" lineno="280" slineno="11-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">the legislation is before the Senate; and</amend></subsection><subsection ssid="15-28" dnum="_-o:b-i" numlevel="1" lineno="281" slineno="11-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="SR4-4-401(6)">(6)</xref>, the presiding officer shall:</amend><subsection ssid="15-29" dnum="_-o:i-i" numlevel="1" lineno="282" slineno="11-26" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">pose the final question: "This bill (resolution) has been read three times. The <ln numlevel="1" lineno="283" slineno="11-27"/>question is, shall this bill (resolution) pass?"; and</amend></subsection><subsection ssid="15-32" dnum="_-o:ii-i" numlevel="1" lineno="284" slineno="11-28" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="ahaskell" level="1" amendtag="end">place the question as a roll call vote.</amend></subsection></subsection></subsection><subsection ssid="15-33" dnum="_-o:6-i" numlevel="1" lineno="285" slineno="11-29" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">For legislation on the consent calendar, the presiding officer may not:</amend><subsection ssid="15-34" dnum="_-o:a-i" numlevel="1" lineno="286" slineno="11-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">accept a motion to amend or substitute the legislation;
