Eliason moved to open a committee bill file to remove Utah Code Section 62A-3-209 from the Legislative Oversight and Sunset Act, with the modifications recommended by DHHS, including amending Utah Code Section 62A-3-209 to require the long-term care ombudsman to conduct voluntary interviews with residents being discharged from nursing homes. |
SUBSTITUTE MOTION:Rep. Judkins moved that the committee approve the original motion, but with an amendment that Utah Code Section 62A-3-209 be amended to: 1) include stronger accountability for long-term care facilities, both assisted living facilities and skilled nursing facilities, to notify the long-term care ombudsman of a discharge to ensure adherence to state and federal regulations; and 2) clarify that long-term care facilities must notify the Long-Term Care Ombudsman Program of a pending discharge that is not strictly initiated by the resident or resident’s representative. |
