MOTION:Rep. Eliason moved to open a committee bill file titled, "Behavioral Health Crisis Response Amendments," to clarify funding for receiving centers, enact recommendations by the Behavioral Health Crisis Response Commission, and allow the Behavioral Health Receiving Center Grant Program to sunset.The motion passed with a vote of 13-0-5.

Seth Anderson presented information on the scheduled sunset of the Behavioral Health Crisis Response Commission.
MOTION:Rep. Nelson moved that in accordance with a recommendation by DHHS the Behavioral Health Crisis Response Commission statute be extended for 10 years, with a sunset review in five years.
SUBSTITUTE MOTION:Rep. Judkins moved that the Behavioral Health Crisis Response Commission statute be extended for 10 years, with a sunset review in two years.
Rep. Judkins withdrew the motion.
SUBSTITUTE MOTION:Sen. Vickers moved that the Behavioral Health Crisis Response Commission statute be extended for five years.The substitute motion passed with a vote of 13-0-5.

Rep. Dailey-Provost made a point of order. She clarified that draft legislation "Postpartum Medicaid Coverage Amendments" (2023FL-017/006) extends Medicaid postpartum coverage to one year but does not expand eligibility for the coverage to include individuals with up to 200% of the federal poverty level.
MOTION:Rep. Harrison moved to favorably recommend draft legislation "Postpartum Medicaid Coverage Amendments" (2023FL-0171/006).
SUBSTITUTE MOTION:Sen. Vickers moved that the committee move to the next item on the agenda.The substitute motion failed with a vote of 6-7-5.

Christopher Williams presented information about the scheduled sunset of Utah Code Section 62A-3-209, Assisted living facility transfers, and answered questions from the committee.
Alianne Sipes, Long-term Care Ombudsman, DHHS, provided clarifying comments and responded to questions.
MOTION:Rep. Eliason moved to open a committee bill file to remove Utah Code Section 62A-3-209 from the Legislative Oversight and Sunset Act, with the modifications recommended by DHHS, including amending Utah Code Section 62A-3-209 to require the long-term care ombudsman to conduct voluntary interviews with residents being discharged from nursing homes.
SUBSTITUTE MOTION:Rep. Judkins moved that the committee approve the original motion, but with an amendment that Utah Code Section 62A-3-209 be amended to: 1) include stronger accountability for long-term care facilities, both assisted living facilities and skilled nursing facilities, to notify the long-term care ombudsman of a discharge to ensure adherence to state and federal regulations; and 2) clarify that long-term care facilities must notify the Long-Term Care Ombudsman Program of a pending discharge that is not strictly initiated by the resident or resident’s representative.
Rep. Judkins withdrew the motion.
The original motion passed with a vote 10-0-8.
