Although the fiscal impact cannot be accurately quantified, passage of this bill could increase the cost of completing state construction projects as the state may lose leverage for compelling contractors to complete work. Additional funds may be required for increased litigation and for hiring contractors to complete work not fully completed by the original contractor. It is also possible that claims will be paid by the state for not meeting the 30-day release of retention requirements in dispute situations. The provisions of the bill could impact local governments in the same way.
