Please oppose SB134: Game Fowl Fighting Amendment.
Every year this issue is brought to the legislature and defeated. When will this end?
The argument Utah is only one of three states that has not made cock fighting a felony is the same argument my children used, Johnnie or Sally are allowed to do this, does not make it correct thing to do. The argument used by the Humane Society is a cockroach equals a mouse, a mouse equals a boy, a chicken equals a man or woman is not valid!
Utah law already addresses cockfighting and applies appropriate penalties.
76-9-301. Cruelty to animals.
Murderers and repeat drunken drivers are treated with more compassion than this proposed law will treat individuals accused of cockfighting. No mater what your personal feelings are on cock fighting this offense is not worthy of felony status! This amendment proposes to elevate cock fighting to the same level as murder, rape, grand larceny, and many other crimes that are harmful and a threat to the well being of humans and threaten the security and safety of society in general. Cock fighting does not even threaten humans! Utah law allows women to obtain an abortion with no criminal repercussions. I ask which act is more reprehensible the murder of an innocent unborn baby or the killing of a chicken? While cock fighting is repugnant this offense should not be considered the same as other felonious crimes that are harmful and a threat to the well being and safety of humans. Increase the penalty that may be applied to individuals convicted of Cock Fighting if you feel something must be done to curb this disgusting sport but it should not be considered a felonious act! Cock fighting is already addressed Utah code 76-9-301. Cruelty to animals and 76-9-301.2 and 76-9-301.3. This amendment is trying to elevate a chicken to the same level as a human! Remember that when you are eating chicken nuggets for lunch. What is next a felony charge for preparing and eating a Sunday chicken dinner or stopping at Mc Donald’s for chicken nuggets?
Our laws should be just and fair and not make the penalty for cock fighting more severe than killing a fellow citizen!
Is the offense of cock fighting equal to these felonious acts
Aggravated assault and/or battery?
Obstruction of justice?
Threatening an official (police officer, judge)?
I do not think so do you?
Thank you, for your consideration
