I am writing to request the House Rules Committee move House Bill 37 out of Rules and into Subcommittee. Reasonable public access to Utah’s waterways is important to prevent the “haves” from denying the “have nots” access to Utah’s beautiful streams and rivers.
Two weeks ago, the Montana Supreme Court recognized the need to stop out-of-state billionaires (e.g., James Cox Kennedy) from denying common citizens access to public waters by threatening trespass and putting up electric fences -- as if people were cattle.
I ask that the Legislature likewise recognize the importance and need to protect public access to water ways, while balancing the rights of property owners through reasonable limitations and enforcement of existing laws prohibiting littering and trespass beyond the high-water mark.
