<section number="13-76-202"><effdate>3/18/2026</effdate><histories><history>Amended by Chapter <modchap sess="2026GS">157</modchap>, 2026 General Session</history><modyear>2026</modyear></histories><catchline>Developer requirements.</catchline><subsection number="13-76-202(1)">Beginning May 6, 2027, a developer shall:<subsection number="13-76-202(1)(a)">verify through the app store's data sharing methods:<subsection number="13-76-202(1)(a)(i)">the age category data of account holders located in the state; and</subsection><subsection number="13-76-202(1)(a)(ii)">for a minor account, whether verifiable parental consent has been obtained;</subsection></subsection><subsection number="13-76-202(1)(b)">notify app store providers of a significant change to the app; and</subsection><subsection number="13-76-202(1)(c)">request age category data or parental consent:<subsection number="13-76-202(1)(c)(i)">at the time an account holder:<subsection number="13-76-202(1)(c)(i)(A)">downloads an app; </subsection><subsection number="13-76-202(1)(c)(i)(B)">purchases an app; or</subsection><subsection number="13-76-202(1)(c)(i)(C)">launches a pre-installed application for the first time;</subsection></subsection><subsection number="13-76-202(1)(c)(ii)">when implementing a significant change to the app; or</subsection><subsection number="13-76-202(1)(c)(iii)">to comply with applicable laws or regulations.</subsection></subsection></subsection><subsection number="13-76-202(2)">Beginning May 6, 2027, a developer may request age category data:<subsection number="13-76-202(2)(a)">no more than once during each 12-month period to verify:<subsection number="13-76-202(2)(a)(i)">accuracy of age category data associated with an account holder; or</subsection><subsection number="13-76-202(2)(a)(ii)">continued account use within the verified age category;</subsection></subsection><subsection number="13-76-202(2)(b)">when there is reasonable suspicion of:<subsection number="13-76-202(2)(b)(i)">account transfer; or</subsection><subsection number="13-76-202(2)(b)(ii)">misuse outside the verified age category; or</subsection></subsection><subsection number="13-76-202(2)(c)">at the time an account holder creates a new account with the developer.</subsection></subsection><subsection number="13-76-202(3)"><subsection number="13-76-202(3)(a)">Beginning May 6, 2027, when initially implementing any developer-created safety-related features or defaults, a developer shall use the lowest age category indicated by:<subsection number="13-76-202(3)(a)(i)">age verification data provided by an app store provider; or</subsection><subsection number="13-76-202(3)(a)(ii)">age data independently collected by the developer.</subsection></subsection><subsection number="13-76-202(3)(b)">Subsection <xref depth="4" refnumber="13-76-202(3)(a)">(3)(a)</xref> does not prohibit a developer from allowing a parent to customize age-related restrictions, safety-related features, or content settings for individual users within a minor account after the initial defaults described in Subsection <xref depth="4" refnumber="13-76-202(3)(a)">(3)(a)</xref> are set.</subsection></subsection><subsection number="13-76-202(4)">Beginning May 6, 2027, a developer may not:<subsection number="13-76-202(4)(a)">enforce a contract or terms of service against a minor unless the developer has verified through the app store's data sharing methods that verifiable parental consent has been obtained;</subsection><subsection number="13-76-202(4)(b)">knowingly misrepresent any information in the parental consent disclosure; or</subsection><subsection number="13-76-202(4)(c)">share age category data with any person.</subsection></subsection><subsection number="13-76-202(5)">Beginning May 6, 2027, a developer may only use age category data received through the app store's data sharing methods to:<subsection number="13-76-202(5)(a)">enforce any developer-created age-related restrictions;</subsection><subsection number="13-76-202(5)(b)">ensure compliance with applicable laws and regulations; or</subsection><subsection number="13-76-202(5)(c)">implement any developer-created safety-related features or defaults.</subsection></subsection><subsection number="13-76-202(6)">Beginning May 6, 2027, a developer may request that an app store provider prevent minor accounts from downloading or purchasing the developer's app.</subsection></section>
