<section number="13-76-401"><effdate>3/18/2026</effdate><histories><history>Amended by Chapter <modchap sess="2026GS">157</modchap>, 2026 General Session</history><modyear>2026</modyear></histories><catchline>Enforcement.</catchline><subsection number="13-76-401(1)"><subsection number="13-76-401(1)(a)">Beginning May 6, 2027, only a minor, or the parent of that minor, who has been harmed by a violation of Subsection <xref depth="4" refnumber="13-76-201(2)">13-76-201(2)</xref> may bring a civil action against an app store provider.</subsection><subsection number="13-76-401(1)(b)">Beginning May 6, 2027, only a minor, or the parent of that minor, who has been harmed by a violation of Subsection <xref depth="4" refnumber="13-76-202(4)">13-76-202(4)</xref> may bring a civil action against a developer.</subsection></subsection><subsection number="13-76-401(2)">In an action described in Subsection (1), the court shall award a prevailing parent:<subsection number="13-76-401(2)(a)">the greater of:<subsection number="13-76-401(2)(a)(i)">actual damages; or</subsection><subsection number="13-76-401(2)(a)(ii)">$1,000 for each violation;</subsection></subsection><subsection number="13-76-401(2)(b)">reasonable attorney fees; and</subsection><subsection number="13-76-401(2)(c)">litigation costs.</subsection></subsection></section>
