5/3/2023Renumbered and Amended by Chapter 306, 2023 General Session2023Presumption of permanency.There is a rebuttable presumption that an individual who is an inpatient in a care facility cannot reasonably be expected to be discharged from a care facility and return to the individual's home, if the individual has been an inpatient in a care facility for a period of at least 180 consecutive days.
