<chapter number="4-25"><effdate>7/1/2017</effdate><catchline>Estrays</catchline><part number="4-25-1"><catchline>Organization</catchline><section number="4-25-102"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Definitions.</catchline><tab/>For the purpose of this chapter:<subsection number="4-25-102(1)"><subsection number="4-25-102(1)(a)">
"Estray" means:<subsection number="4-25-102(1)(a)(i)">
an unbranded sheep, cow, horse, mule, or ass found running at large;</subsection><subsection number="4-25-102(1)(a)(ii)">
a branded sheep, cow, horse, mule, or ass found running at large whose owner cannot be found after reasonable search; or</subsection><subsection number="4-25-102(1)(a)(iii)">
a swine found running at large whose owner cannot be found after reasonable search.</subsection></subsection><subsection number="4-25-102(1)(b)">
"Estray" does not mean any unweaned animal specified in this section that is running with its mother.</subsection></subsection><subsection number="4-25-102(2)">
"Feral swine" means any species, or hybrid species:
<subsection number="4-25-102(2)(a)">
of the family Suidae, including the European boar, the Eurasian boar, the Russian boar, a feral hog, or a domestic pig;</subsection><subsection number="4-25-102(2)(b)">
that is not conspicuously identified by an ear tag or other form of visual identification; and</subsection><subsection number="4-25-102(2)(c)">
that is roaming freely upon public land or private land.</subsection></subsection><subsection number="4-25-102(3)">
"Swine" means any domesticated species of the family Suidae that is conspicuously identified by an ear tag or other form of visible identification.</subsection></section><section number="4-25-103"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>County responsibility for estrays -- Contracts with other local governments authorized.</catchline><subsection number="4-25-103(1)">
Each county is responsible for the disposition of all estrays found within the county's boundaries.</subsection><subsection number="4-25-103(2)">
Each county in the discharge of the county's responsibility, however, may contract upon mutually agreeable terms with any city, town, or other county with an animal control office to perform any or all of the functions imposed by this chapter.</subsection></section><section number="4-25-104"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Department authorized to make and enforce rules.</catchline><tab/>The department is authorized, subject to <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, to make and enforce such rules as in the department's judgment are necessary to administer and enforce this chapter.</section></part><part number="4-25-2"><catchline>Management of Estrays</catchline><section number="4-25-201"><histories><history>Amended by Chapter <modchap sess="2023GS">435</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Possession of estrays -- Determination and location of owner -- Sale -- Disposition of proceeds -- Notice -- Title of purchaser -- Immunity from liability.</catchline><subsection number="4-25-201(1)"><subsection number="4-25-201(1)(a)">
Except as provided in Section <xref depth="3" refnumber="4-25-202" start="0">4-25-202</xref>, a county shall:<subsection number="4-25-201(1)(a)(i)">
take physical possession of an estray the county finds within county boundaries;</subsection><subsection number="4-25-201(1)(a)(ii)">
attempt to determine the name and location of the estray's owner; and</subsection><subsection number="4-25-201(1)(a)(iii)">
contact the local brand inspector.</subsection></subsection><subsection number="4-25-201(1)(b)">
The department shall assist a county that requests its help in determining the name and location of the owner or other person responsible for the estray.</subsection><subsection number="4-25-201(1)(c)"><subsection number="4-25-201(1)(c)(i)">
Notwithstanding the requirements of <xref depth="1" refnumber="67-4a" start="0">Title 67, Chapter 4a, Revised Uniform Unclaimed Property Act</xref>, if the county cannot determine the estray's owner, or, if having determined ownership, neither the county nor the department is able to locate the owner within a reasonable period of time, the estray shall be sold at a livestock or other appropriate market.</subsection><subsection number="4-25-201(1)(c)(ii)">
The proceeds of a sale under Subsection <xref depth="4" refnumber="4-25-201(1)(c)(i)" start="0">(1)(c)(i)</xref>, less the costs described in Subsection <xref depth="4" refnumber="4-25-201(1)(c)(iii)" start="0">(1)(c)(iii)</xref>, shall be paid to the county selling the estray.</subsection><subsection number="4-25-201(1)(c)(iii)">
The livestock or other market conducting the sale under Subsection <xref depth="4" refnumber="4-25-201(1)(c)(i)" start="0">(1)(c)(i)</xref> may deduct the cost of feed, transportation, and other market costs from the proceeds of the sale.</subsection></subsection></subsection><subsection number="4-25-201(2)">
A county shall publish notice of the sale of an estray within the county where the estray was taken into custody, as a class A notice under Section <xref depth="3" refnumber="63G-30-102" start="0">63G-30-102</xref>, for at least 10 days before the date of the sale.</subsection><subsection number="4-25-201(3)">
A purchaser of an estray sold under this section shall receive title to the estray free and clear of all claims of the estray's owner and a person claiming title through the owner.</subsection><subsection number="4-25-201(4)">
A county that complies with the provisions of this section is immune from liability for the sale of an estray sold at a livestock or other appropriate market.</subsection><subsection number="4-25-201(5)">
Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-25-201(1)(c)" start="0">(1)(c)</xref>, a county may employ a licensed veterinarian to euthanize an estray if the licensed veterinarian determines that the estray's physical condition prevents the estray from being sold.</subsection></section><section number="4-25-202"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Report of estrays -- Possession -- Relief from liability.</catchline><subsection number="4-25-202(1)">
As used in this section, "division" means the Division of Wildlife Resources.</subsection><subsection number="4-25-202(2)">
A person, other than an official of the county or of an animal control office under contract with the county, who finds an estray shall report the estray to the county or animal control office immediately.</subsection><subsection number="4-25-202(3)">
Upon receipt of notification under Subsection <xref depth="4" refnumber="4-25-202(2)" start="0">(2)</xref>, the county or the animal control office shall:
<subsection number="4-25-202(3)(a)">
take possession of the estray; or</subsection><subsection number="4-25-202(3)(b)">
if appropriate, authorize the person in possession of the estray to maintain and care for the estray pending determination and location of the estray's owner.</subsection></subsection><subsection number="4-25-202(4)">
A person who gives notice of an estray and delivers the estray to the county or animal control office is not liable to third parties on account of the estray to the extent of the value of the animal.</subsection><subsection number="4-25-202(5)"><subsection number="4-25-202(5)(a)">
If an employee of the department or the division, acting in the employee's official capacity, finds an estray, the employee shall:<subsection number="4-25-202(5)(a)(i)">
comply with the requirements of Subsection <xref depth="4" refnumber="4-25-202(2)" start="0">(2)</xref>; and</subsection><subsection number="4-25-202(5)(a)(ii)">
make a reasonable attempt to contact the estray's owner.</subsection></subsection><subsection number="4-25-202(5)(b)">
The county or animal control office receiving a report of an estray from an employee of the department or the division shall:<subsection number="4-25-202(5)(b)(i)">
take possession of the estray; or</subsection><subsection number="4-25-202(5)(b)(ii)">
authorize the department or the division in writing or through electronic means to take possession of the estray.</subsection></subsection><subsection number="4-25-202(5)(c)">
If the county or animal control office does not comply with Subsection <xref depth="4" refnumber="4-25-202(5)(b)" start="0">(5)(b)</xref> within 72 hours from the time the division reports an estray, the division may take possession of the estray.</subsection><subsection number="4-25-202(5)(d)">
If the division takes possession of the estray, the division shall:<subsection number="4-25-202(5)(d)(i)">
make a reasonable attempt to return the estray to the estray's owner; or</subsection><subsection number="4-25-202(5)(d)(ii)">
if unable to return the estray to the estray's owner, deliver the estray to the county or animal control office.</subsection></subsection><subsection number="4-25-202(5)(e)">
If the division is unable to take possession of the estray after a reasonable attempt, the division may cause the death of the estray if the division determines that the estray presents a material threat to wildlife by:<subsection number="4-25-202(5)(e)(i)">
predation;</subsection><subsection number="4-25-202(5)(e)(ii)">
pathogen transmission; or</subsection><subsection number="4-25-202(5)(e)(iii)">
genetic introgression.</subsection></subsection><subsection number="4-25-202(5)(f)">
If the division causes the death of an estray under Subsection <xref depth="4" refnumber="4-25-202(5)(e)" start="0">(5)(e)</xref>, the division shall:<subsection number="4-25-202(5)(f)(i)">
compensate the owner of the estray at full market value of the estray; or</subsection><subsection number="4-25-202(5)(f)(ii)">
if the owner of the estray cannot be determined, deposit an amount equal to the full market value of the estray into the Agricultural and Wildlife Damage Prevention Account created in Section <xref depth="3" refnumber="4-23-108" start="0">4-23-108</xref>.</subsection></subsection></subsection><subsection number="4-25-202(6)">
Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-25-202(5)" start="0">(5)</xref>, the division may immediately take possession of an estray or cause an estray to move away from wildlife if the estray presents an imminent material threat to wildlife by:
<subsection number="4-25-202(6)(a)">
predation;</subsection><subsection number="4-25-202(6)(b)">
pathogen transmission; or</subsection><subsection number="4-25-202(6)(c)">
genetic introgression.</subsection></subsection></section><section number="4-25-203"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Compensation for care of estrays -- Liability of county -- Notice required.</catchline><subsection number="4-25-203(1)">
A person who finds an estray and who, after giving notice is authorized by the county to maintain and care for the estray, is entitled to compensation from the owner, or from the county, as the case may be, for the reasonable costs of feeding and maintaining the estray; provided, that the county is liable for such cost only if the owner is not located after diligent search.</subsection><subsection number="4-25-203(2)">
No person who finds an estray, however, is entitled to reimbursement for feed and maintenance or for any other cost incurred on behalf of the estray before such time as notice of the estray is given to the county or to the appropriate animal control office.</subsection></section><section number="4-25-204"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>County legislative body authorized to adopt fence ordinance  -- Lawful fence to be specified by ordinance -- Dividing the county into divisions for different fencing regulations.</catchline><subsection number="4-25-204(1)">
A county legislative body may, by ordinance, declare and enforce a general policy within the county for the fencing of farms, subdivisions, or other private property to allow domestic animals to graze without trespassing on farms, subdivisions, or other private property.</subsection><subsection number="4-25-204(2)">
If an ordinance is adopted under Subsection <xref depth="4" refnumber="4-25-204(1)" start="0">(1)</xref>, the county legislative body:
<subsection number="4-25-204(2)(a)">
shall through ordinance declare and specify what constitutes a lawful fence; and</subsection><subsection number="4-25-204(2)(b)">
may divide the county into divisions and prescribe different fencing regulations for each division.</subsection></subsection></section><section number="4-25-205"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Owner liable for trespass of animals -- Exception -- Intervention by county representative.</catchline><subsection number="4-25-205(1)">
The owner of any cattle, horse, ass, mule, sheep, goat, or swine that trespasses upon the premises of another person, except in cases where the premises are not enclosed by a lawful fence in a county or municipality that has adopted a fence ordinance, is liable in a civil action to the owner or occupant of the premises for any damage inflicted by the trespass.</subsection><subsection number="4-25-205(2)">
A county representative may intervene to remove the animal and the county is entitled to fair compensation for costs incurred.  If the animal is not claimed within 10 days after written notification is sent to the animal's owner, a county representative may sell the animal to cover costs incurred.</subsection><subsection number="4-25-205(3)">
Notwithstanding Subsections <xref depth="4" refnumber="4-25-205(1)" start="0">(1)</xref> and <xref depth="4" refnumber="4-25-205(2)" start="0">(2)</xref>, the owner of any cattle, horse, ass, mule, sheep, goat, or swine that trespasses upon the premises of another person is not liable in a civil action to the owner or occupant of the premises for damage inflicted by the trespass if:
<subsection number="4-25-205(3)(a)">
the animal enters the premises from an historic livestock trail, as defined in Section <xref depth="3" refnumber="57-13b-102" start="0">57-13b-102</xref>; and</subsection><subsection number="4-25-205(3)(b)">
the premises that was trespassed is not enclosed by an adequate fence at the time the trespass occurs.</subsection></subsection></section><section number="4-25-206"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Animals running at large -- Prohibition -- Limited exception.</catchline><subsection number="4-25-206(1)">
Except as provided in Subsection <xref depth="4" refnumber="4-25-206(2)" start="0">(2)</xref>, no person who owns or is in possession of a stallion, jack, or ridgeling over 18 months old, or a ram over three months old, shall permit the animal to run at large within the limits of, or on the summer range of, any town or settlement.</subsection><subsection number="4-25-206(2)">
Two-thirds of the voters of any county or isolated part of a county may elect through an election to make this section ineffective in all or part of the county during part of the year.</subsection></section></part><part number="4-25-3"><catchline>Swine</catchline><section number="4-25-301"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Allowing swine to run at large -- Class B misdemeanor.</catchline><subsection number="4-25-301(1)">
A person is guilty of a class B misdemeanor if the person:
<subsection number="4-25-301(1)(a)">
is in control of a swine; and</subsection><subsection number="4-25-301(1)(b)">
allows the swine to run at large.</subsection></subsection><subsection number="4-25-301(2)">
A person described in Subsection <xref depth="4" refnumber="4-25-301(1)" start="0">(1)</xref> is liable for damage caused by the swine running at large.</subsection></section><section number="4-25-302"><histories><history>Renumbered and Amended by Chapter <modchap sess="2017GS">345</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Release of swine or feral swine for any purpose.</catchline><tab/>A person is guilty of a third degree felony if the person releases a:<subsection number="4-25-302(1)">
swine on public or private property for hunting purposes; or</subsection><subsection number="4-25-302(2)">
feral swine on public or private property for any purpose.</subsection></section><section number="4-25-303"><histories><history>Amended by Chapter <modchap sess="2025GS">173</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Feral swine detrimental to state's interests -- Seizure, capture, or destruction of feral swine.</catchline><subsection number="4-25-303(1)">Feral swine are detrimental to the state's interests in agriculture and wildlife.</subsection><subsection number="4-25-303(2)">Feral swine may be seized, captured, or destroyed at any time, in any place, and in any manner by:<subsection number="4-25-303(2)(a)">the department and the department's authorized agents;</subsection><subsection number="4-25-303(2)(b)">the Division of Wildlife Resources and the Division of Wildlife Resources' authorized agents; or</subsection><subsection number="4-25-303(2)(c)">a certified peace officer.</subsection></subsection><subsection number="4-25-303(3)"><subsection number="4-25-303(3)(a)">Notwithstanding Section <xref refnumber="76-13-202" depth="4">76-13-202</xref>, <xref refnumber="76-13-203" depth="4">76-13-203</xref>, or <xref refnumber="76-13-204" depth="4">76-13-204</xref>, and subject to the requirements of this section, an individual may kill a feral swine roaming on private or public land.</subsection><subsection number="4-25-303(3)(b)">An individual shall obtain the consent of the landowner before killing a feral swine on private land.</subsection><subsection number="4-25-303(3)(c)">Feral swine may be killed:<subsection number="4-25-303(3)(c)(i)">year-round;</subsection><subsection number="4-25-303(3)(c)(ii)">in any number; and</subsection><subsection number="4-25-303(3)(c)(iii)">with a firearm, bow and arrow, or crossbow.</subsection></subsection></subsection><subsection number="4-25-303(4)">Feral swine may not be hunted or killed under Subsection <xref depth="4" refnumber="4-25-303(3)(c)" start="0">(3)(c)</xref>:<subsection number="4-25-303(4)(a)">with the use of artificial light or night vision equipment, except as authorized by county ordinance; or</subsection><subsection number="4-25-303(4)(b)">from or with any airborne vehicle or device, except as provided in Section <xref depth="3" refnumber="4-23-106" start="0">4-23-106</xref>.</subsection></subsection><subsection number="4-25-303(5)">An individual may not receive compensation, or attempt to receive compensation, from hunting feral swine.</subsection><subsection number="4-25-303(6)">An authorized individual who kills a swine under this section is not liable to the owner for the loss of the swine, unless:<subsection number="4-25-303(6)(a)">the swine is conspicuously identified by an ear tag or other form of visual identification; and</subsection><subsection number="4-25-303(6)(b)">the individual who killed the swine knew the swine was identified by an ear tag or other form of usual identification.</subsection></subsection></section></part><part number="4-25-4"><catchline>Impounded Livestock</catchline><section number="4-25-401"><histories><history>Amended by Chapter <modchap sess="2023GS">435</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Impounded livestock -- Determination and location of owner -- Sale -- Disposition of proceeds -- Notice -- Title of purchaser -- Immunity from liability.</catchline><subsection number="4-25-401(1)">
As used in this section, "impounded livestock" means the following animals seized and retained in legal custody:
<subsection number="4-25-401(1)(a)">
cattle;</subsection><subsection number="4-25-401(1)(b)">
calves;</subsection><subsection number="4-25-401(1)(c)">
horses;</subsection><subsection number="4-25-401(1)(d)">
mules;</subsection><subsection number="4-25-401(1)(e)">
sheep;</subsection><subsection number="4-25-401(1)(f)">
goats;</subsection><subsection number="4-25-401(1)(g)">
hogs; or</subsection><subsection number="4-25-401(1)(h)">
domesticated elk.</subsection></subsection><subsection number="4-25-401(2)"><subsection number="4-25-401(2)(a)">
A county may:<subsection number="4-25-401(2)(a)(i)">
take physical possession of impounded livestock seized and retained within its boundaries; and</subsection><subsection number="4-25-401(2)(a)(ii)">
attempt to determine the name and location of the impounded livestock's owner.</subsection></subsection><subsection number="4-25-401(2)(b)">
The department shall assist a county who requests help in locating the name and location of the owner or other person responsible for the impounded livestock.</subsection><subsection number="4-25-401(2)(c)"><subsection number="4-25-401(2)(c)(i)">
Notwithstanding the requirements of <xref depth="1" refnumber="67-4a" start="0">Title 67, Chapter 4a, Revised Uniform Unclaimed Property Act</xref>, if the county cannot determine ownership of the impounded livestock, or, if having determined ownership, neither the county nor the department is able to locate the owner within a reasonable period of time, the impounded livestock shall be sold at a livestock or other appropriate market.</subsection><subsection number="4-25-401(2)(c)(ii)">
The proceeds of a sale under Subsection <xref depth="4" refnumber="4-25-401(2)(c)(i)" start="0">(2)(c)(i)</xref>, less the costs described in Subsection <xref depth="4" refnumber="4-25-401(2)(c)(iii)" start="0">(2)(c)(iii)</xref>, shall be paid to the State School Fund created by the <ext_ref type="Utah Constitution">Utah Constitution, Article X, Section 5</ext_ref>, Subsection <xref depth="4" refnumber="4-25-401(1)" start="0">(1)</xref>.</subsection><subsection number="4-25-401(2)(c)(iii)">
The livestock or other market conducting the sale under Subsection <xref depth="4" refnumber="4-25-401(2)(c)(i)" start="0">(2)(c)(i)</xref> may deduct the cost of feed, transportation, and other market costs from the proceeds of the sale.</subsection></subsection></subsection><subsection number="4-25-401(3)">
A county shall publish the intended sale of the impounded livestock within the county where the impounded livestock was taken into custody, as a class A notice under Section <xref depth="3" refnumber="63G-30-102" start="0">63G-30-102</xref>, for at least 10 days before the date of the sale.</subsection><subsection number="4-25-401(4)">
A purchaser of impounded livestock sold under this section shall receive title to the impounded livestock free and clear of all claims of the livestock's owner or a person claiming title through the owner.</subsection><subsection number="4-25-401(5)">
If a county complies with the provisions of this section, the county is immune from liability for the sale of impounded livestock sold at a livestock or other appropriate market.</subsection><subsection number="4-25-401(6)">
Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-25-401(2)(c)" start="0">(2)(c)</xref>, a county may employ a licensed veterinarian to euthanize an impounded livestock if the licensed veterinarian determines that the impounded livestock's physical condition prevents the impounded livestock from being sold.</subsection></section></part></chapter>
