<part number="41-6a-6"><catchline>Speed Restrictions</catchline><section number="41-6a-601"><histories><history>Amended by Chapter <modchap sess="2022GS">176</modchap>, 2022 General Session</history><modyear>2022</modyear></histories><catchline>Speed regulations -- Safe and appropriate speeds at certain locations -- Prima facie speed limits -- Emergency power of the governor.</catchline><subsection number="41-6a-601(1)">
A person may not operate a vehicle at a speed greater than is reasonable and prudent under the existing conditions, giving regard to the actual and potential hazards then existing, including when:
<subsection number="41-6a-601(1)(a)">
approaching and crossing an intersection or railroad grade crossing;</subsection><subsection number="41-6a-601(1)(b)">
approaching and going around a curve;</subsection><subsection number="41-6a-601(1)(c)">
approaching a hill crest;</subsection><subsection number="41-6a-601(1)(d)">
traveling upon any narrow or winding roadway;</subsection><subsection number="41-6a-601(1)(e)">
traveling in, through, or approaching other hazards that exist due to pedestrians, other traffic, weather, or highway conditions; and</subsection><subsection number="41-6a-601(1)(f)">
the speed causes the person to fail to maintain control of the vehicle or stay within a single lane of travel.</subsection></subsection><subsection number="41-6a-601(2)">
Subject to Subsections <xref depth="4" refnumber="41-6a-601(1)" start="0">(1)</xref> and <xref depth="4" refnumber="41-6a-601(4)" start="0">(4)</xref> and Sections <xref depth="3" refnumber="41-6a-602" start="0">41-6a-602</xref> and <xref depth="3" refnumber="41-6a-603" start="0">41-6a-603</xref>, the following speeds are lawful:
<subsection number="41-6a-601(2)(a)">
20 miles per hour in a reduced speed school zone as defined in Section <xref depth="3" refnumber="41-6a-303" start="0">41-6a-303</xref>;</subsection><subsection number="41-6a-601(2)(b)">
25 miles per hour in any urban district; and</subsection><subsection number="41-6a-601(2)(c)">
55 miles per hour in other locations.</subsection></subsection><subsection number="41-6a-601(3)">
Except as provided in Section <xref depth="3" refnumber="41-6a-604" start="0">41-6a-604</xref>, any speed in excess of the limits provided in  this section or established under Sections <xref depth="3" refnumber="41-6a-602" start="0">41-6a-602</xref> and <xref depth="3" refnumber="41-6a-603" start="0">41-6a-603</xref> is prima facie evidence that the speed is not reasonable or prudent and that it is unlawful.</subsection><subsection number="41-6a-601(4)"><subsection number="41-6a-601(4)(a)">
A violation of Subsection <xref depth="4" refnumber="41-6a-601(1)" start="0">(1)</xref> is an infraction.</subsection><subsection number="41-6a-601(4)(b)">
For an individual convicted of a speed violation where the individual was operating at a speed of 100 miles per hour or more, the court shall impose a fine not less than 150% of the suggested fine in the uniform fine schedule authorized in Section <xref depth="3" refnumber="76-3-301.5" start="0">76-3-301.5</xref> and in effect at the time of the citation.</subsection></subsection><subsection number="41-6a-601(5)">
The governor by proclamation in time of war or emergency may change the speed limits on the highways of the state.</subsection></section><section number="41-6a-602"><histories><history>Amended by Chapter <modchap sess="2022GS">42</modchap>, 2022 General Session</history><modyear>2022</modyear></histories><catchline>Speed limits established on state highways.</catchline><subsection number="41-6a-602(1)"><subsection number="41-6a-602(1)(a)">
The Department of Transportation shall determine the reasonable and safe speed limit for each highway or section of highway under its jurisdiction.</subsection><subsection number="41-6a-602(1)(b)">
For each highway or section of highway, each speed limit shall be based on a traffic engineering and safety study consistent with the requirements and recommendations in the most current version of the "Manual on Uniform Traffic Control Devices."</subsection><subsection number="41-6a-602(1)(c)">
The traffic engineering and safety studies shall include:<subsection number="41-6a-602(1)(c)(i)">
the design speed;</subsection><subsection number="41-6a-602(1)(c)(ii)">
prevailing vehicle speeds;</subsection><subsection number="41-6a-602(1)(c)(iii)">
accident history;</subsection><subsection number="41-6a-602(1)(c)(iv)">
highway, traffic, and roadside conditions; and</subsection><subsection number="41-6a-602(1)(c)(v)">
other highway safety factors.</subsection></subsection></subsection><subsection number="41-6a-602(2)">
The Department of Transportation may establish different speed limits on a highway or section of highway based on:
<subsection number="41-6a-602(2)(a)">
time of day;</subsection><subsection number="41-6a-602(2)(b)">
highway construction;</subsection><subsection number="41-6a-602(2)(c)">
type of vehicle;</subsection><subsection number="41-6a-602(2)(d)">
weather conditions; and</subsection><subsection number="41-6a-602(2)(e)">
other highway safety factors.</subsection></subsection><subsection number="41-6a-602(3)"><subsection number="41-6a-602(3)(a)">
Except as provided in Subsection <xref depth="4" refnumber="41-6a-602(3)(b)" start="0">(3)(b)</xref> and <xref depth="4" refnumber="41-6a-602(3)(c)" start="0">(c)</xref>, a posted speed limit may not exceed 65 miles per hour.</subsection><subsection number="41-6a-602(3)(b)">
Except as provided in Subsection <xref depth="4" refnumber="41-6a-602(3)(c)" start="0">(3)(c)</xref>, a posted speed limit on a freeway or other limited access highway may not exceed 75 miles per hour.</subsection><subsection number="41-6a-602(3)(c)"><subsection number="41-6a-602(3)(c)(i)">
The Department of Transportation may establish a posted speed limit on a freeway or other limited access highway that exceeds the maximum speed limit in Subsection <xref depth="4" refnumber="41-6a-602(3)(b)" start="0">(3)(b)</xref> if the speed limit is based on a highway traffic engineering and safety study.</subsection><subsection number="41-6a-602(3)(c)(ii)">
If the Department of Transportation establishes a posted speed limit that exceeds the limit under Subsection <xref depth="4" refnumber="41-6a-602(3)(b)" start="0">(3)(b)</xref>, the Department of Transportation shall evaluate the results and impacts of increasing a speed limit under this Subsection <xref depth="4" refnumber="41-6a-602(3)(c)" start="0">(3)(c)</xref>.</subsection></subsection><subsection number="41-6a-602(3)(d)">
This Subsection <xref depth="4" refnumber="41-6a-602(3)" start="0">(3)</xref> is an exception to the provisions of Subsections <xref depth="4" refnumber="41-6a-602(1)" start="0">(1)</xref> and <xref depth="4" refnumber="41-6a-602(2)" start="0">(2)</xref>.</subsection></subsection><subsection number="41-6a-602(4)">
When establishing or changing a speed limit, the Department of Transportation shall consult with the following entities prior to erecting or changing a speed limit sign:
<subsection number="41-6a-602(4)(a)">
the county for state highways in an unincorporated area of the county;</subsection><subsection number="41-6a-602(4)(b)">
the municipality for state highways within the municipality's incorporated area;</subsection><subsection number="41-6a-602(4)(c)">
the Department of Public Safety; and</subsection><subsection number="41-6a-602(4)(d)">
the Transportation Commission.</subsection></subsection><subsection number="41-6a-602(5)">
The speed limit is effective when appropriate signs giving notice are erected along the highway or section of the highway.</subsection></section><section number="41-6a-603"><histories><history>Amended by Chapter <modchap sess="2022GS">42</modchap>, 2022 General Session</history><modyear>2022</modyear></histories><catchline>Speed limits established by counties and municipalities.</catchline><subsection number="41-6a-603(1)">
A county or municipality may determine the reasonable and safe speed limit for each highway or section of highway under its jurisdiction as specified under <xref depth="1" refnumber="72-3" start="0">Title 72, Chapter 3, Highway Jurisdiction and Classification Act</xref>.</subsection><subsection number="41-6a-603(2)">
Each speed limit shall be established in accordance with the provisions of Subsections <xref depth="4" refnumber="41-6a-602(2)" start="0">41-6a-602(2)</xref>, <xref depth="4" refnumber="41-6a-602(3)" start="0">(3)</xref>, and <xref depth="4" refnumber="41-6a-602(5)" start="0">(5)</xref>.</subsection></section><section number="41-6a-604"><histories><history>Amended by Chapter <modchap sess="2026GS">382</modchap>, 2026 General Session</history><modyear>2026</modyear></histories><catchline>Maximum speed in a school zone -- Penalty -- Minimum fines -- Waiver -- Recordkeeping.</catchline><subsection number="41-6a-604(1)">An individual may not operate a vehicle at a speed greater than 20 miles per hour in a reduced speed school zone as defined in Section <xref depth="3" refnumber="41-6a-303">41-6a-303</xref>.</subsection><subsection number="41-6a-604(2)"><subsection number="41-6a-604(2)(a)">Except as provided in Subsection <xref refnumber="3-17">(2)(b)</xref>, a violation of Subsection <xref depth="4" refnumber="41-6a-604(1)">(1)</xref> is an infraction subject to the minimum fine described in Subsection <xref refnumber="3-19">(3)(a)</xref>.</subsection><subsection number="41-6a-604(2)(b)">A violation of Subsection <xref refnumber="3-null-1">(1)</xref> is a class C misdemeanor if the vehicle speed is 30 miles per hour or more and subject to the minimum fine described in Subsection <xref refnumber="3-19">(3)(a)</xref>.</subsection></subsection><subsection number="41-6a-604(3)"><subsection number="41-6a-604(3)(a)">The minimum fine for a violation of Subsection <xref refnumber="3-null-1">(1)</xref>:<subsection number="41-6a-604(3)(a)(i)">for a first offense shall be calculated according to the following schedule:<tbl colwidths="0,50,50"><row><cell/><cell>Vehicle Speed</cell><cell>Minimum Fine</cell></row><row><cell/><cell>21 - 29 MPH</cell><cell>$   260</cell></row><row><cell/><cell>30 - 39 MPH</cell><cell>$ 420</cell></row><row><cell/><cell>40 MPH and greater</cell><cell>$ 760</cell></row></tbl></subsection><subsection number="41-6a-604(3)(a)(ii)">for a second and subsequent offense within three years of a previous conviction shall be calculated according to the following schedule:<tbl colwidths="0,50,50"><row><cell/><cell>Vehicle Speed</cell><cell>Minimum Fine</cell></row><row><cell/><cell>21 - 29 MPH</cell><cell>$   320</cell></row><row><cell/><cell>30 - 39 MPH</cell><cell>$ 560</cell></row><row><cell/><cell>40 MPH and greater</cell><cell>$ 960</cell></row></tbl></subsection></subsection><subsection number="41-6a-604(3)(b)">Except as provided under Subsection <xref depth="4" refnumber="41-6a-604(3)(a)(ii)">(3)(a)(ii)</xref>, the court may order the person to perform compensatory service in lieu of the fine or any portion of the fine.</subsection></subsection><subsection number="41-6a-604(4)">The Driver License Division shall develop and implement a record system to distinguish:<subsection number="41-6a-604(4)(a)">a conviction under this section from other convictions; and</subsection><subsection number="41-6a-604(4)(b)">between a first and subsequent conviction under this section.</subsection></subsection><subsection number="41-6a-604(5)">The provisions of this section take precedence over the provisions of Sections <xref depth="3" refnumber="41-6a-601">41-6a-601</xref>, <xref depth="3" refnumber="41-6a-602">41-6a-602</xref>, <xref depth="3" refnumber="41-6a-603">41-6a-603</xref>, and <xref depth="3" refnumber="76-3-301">76-3-301</xref>.</subsection></section><section number="41-6a-604.5"><histories><history>Enacted by Chapter <modchap sess="2009GS">124</modchap>, 2009 General Session</history><modyear>2009</modyear></histories><catchline>Speeding in a school zone complaint procedure.</catchline><subsection number="41-6a-604.5(1)"><subsection number="41-6a-604.5(1)(a)">
A school crossing guard who observes an operator of a vehicle violating Section <xref depth="3" refid="C41-6a-S604_1800010118000101" refnumber="41-6a-604" start="0">41-6a-604</xref> may prepare a report of the alleged violation, in a manner specified by the law enforcement agency with jurisdiction, for the law enforcement agency no more than two working days after the alleged violation occurred.</subsection><subsection number="41-6a-604.5(1)(b)">
The report under Subsection <xref depth="4" refid="C41-6a-S604.5_1800010118000101" refnumber="41-6a-604.5(1)(a)" start="0">(1)(a)</xref> shall contain:<subsection number="41-6a-604.5(1)(b)(i)">
the date, time, and location of the violation;</subsection><subsection number="41-6a-604.5(1)(b)(ii)">
the license plate number and state;</subsection><subsection number="41-6a-604.5(1)(b)(iii)">
a description of the offending vehicle;</subsection><subsection number="41-6a-604.5(1)(b)(iv)">
as much as practical, a description of the operator of the offending vehicle;</subsection><subsection number="41-6a-604.5(1)(b)(v)">
a description of the incident involving the violation;</subsection><subsection number="41-6a-604.5(1)(b)(vi)">
information on how to contact the school crossing guard who witnessed the offense; and</subsection><subsection number="41-6a-604.5(1)(b)(vii)">
the signature of the school crossing guard who witnessed the offense attesting to the accuracy of the report.</subsection></subsection></subsection><subsection number="41-6a-604.5(2)"><subsection number="41-6a-604.5(2)(a)">
Upon receiving a report in accordance with Subsection <xref depth="4" refid="C41-6a-S604.5_1800010118000101" refnumber="41-6a-604.5(1)" start="0">(1)</xref>, the law enforcement agency shall promptly send a notification letter to the last-known registered owner of the vehicle.</subsection><subsection number="41-6a-604.5(2)(b)">
The notification letter shall include:<subsection number="41-6a-604.5(2)(b)(i)">
the applicable information on the school crossing guard's report stating that the vehicle was observed speeding in a reduced speed school zone in violation of state law;</subsection><subsection number="41-6a-604.5(2)(b)(ii)">
a complete explanation of the applicable provisions of Section <xref depth="3" refid="C41-6a-S604_1800010118000101" refnumber="41-6a-604" start="0">41-6a-604</xref>; and</subsection><subsection number="41-6a-604.5(2)(b)(iii)">
an explanation that the notification letter is not a peace officer citation but is an effort to call attention to the seriousness of the incident.</subsection></subsection><subsection number="41-6a-604.5(2)(c)">
A law enforcement agency shall make reporting forms for a report under Subsection <xref depth="4" refid="C41-6a-S604.5_1800010118000101" refnumber="41-6a-604.5(1)" start="0">(1)</xref> available:<subsection number="41-6a-604.5(2)(c)(i)">
to a school crossing guard; and</subsection><subsection number="41-6a-604.5(2)(c)(ii)">
in school administrative offices.</subsection></subsection></subsection><subsection number="41-6a-604.5(3)">
A law enforcement agency that receives a report under Subsection <xref depth="4" refid="C41-6a-S604.5_1800010118000101" refnumber="41-6a-604.5(1)" start="0">(1)</xref> may have a peace officer initiate an investigation of the reported violation.</subsection></section><section number="41-6a-605"><histories><history>Amended by Chapter <modchap sess="2026GS">292</modchap>, 2026 General Session</history><modyear>2026</modyear></histories><catchline>Minimum speed regulations.</catchline><subsection number="41-6a-605(1)">An individual may not operate a motor vehicle at a speed so slow as to impede or block the normal and reasonable movement of traffic except when:<subsection number="41-6a-605(1)(a)">a reduced speed is necessary for safe operation;</subsection><subsection number="41-6a-605(1)(b)">upon a grade; or</subsection><subsection number="41-6a-605(1)(c)">in compliance with a traffic-control device.</subsection></subsection><subsection number="41-6a-605(2)">Operating a motor vehicle on a limited access highway at less than the speed limit side by side with and at the same speed as a vehicle operated in the adjacent right lane is evidence of a violation of Subsection <xref depth="4" refnumber="41-6a-605(1)" start="0">(1)</xref>.</subsection><subsection number="41-6a-605(3)"><subsection number="41-6a-605(3)(a)">If, based on an engineering and traffic investigation, a highway authority determines that slow speeds on any part of a highway under the highway authority's jurisdiction consistently impede the normal and reasonable movement of traffic, the highway authority may post a minimum speed limit.</subsection><subsection number="41-6a-605(3)(b)">If a minimum speed limit is posted under this Subsection <xref depth="4" refnumber="41-6a-605(3)" start="0">(3)</xref>, an individual may not operate a vehicle at a speed below the posted minimum speed limit except:<subsection number="41-6a-605(3)(b)(i)">when necessary for safe operation; or</subsection><subsection number="41-6a-605(3)(b)(ii)">in accordance with Section <xref depth="3" refnumber="41-6a-205" start="0">41-6a-205</xref>.</subsection></subsection><subsection number="41-6a-605(3)(c)">The minimum speed limit is effective when appropriate signs giving notice are erected along the highway or section of the highway.</subsection></subsection><subsection number="41-6a-605(4)">An individual operating a classic vehicle as described in Section <xref depth="3" refnumber="41-28-102">41-28-102</xref> is exempt from the requirements of this section.</subsection><subsection number="41-6a-605(5)">A violation of this section is an infraction.</subsection></section><section number="41-6a-606"><histories><history>Amended by Chapter <modchap sess="2023GS">448</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Speed contest or exhibition on highway -- Barricade or obstruction -- -- Spectators of a speed contest -- Seizure of non-street legal vehicles.</catchline><subsection number="41-6a-606(1)">
A person may not engage in any motor vehicle speed contest or exhibition of speed on a highway.</subsection><subsection number="41-6a-606(2)">
A person may not, in any manner, obstruct or place any barricade or obstruction or assist or participate in placing any barricade or obstruction upon any highway for any purpose prohibited under Subsection <xref depth="4" refnumber="41-6a-606(1)" start="0">(1)</xref>.</subsection><subsection number="41-6a-606(3)"><subsection number="41-6a-606(3)(a)">
A person who violates Subsection <xref depth="4" refnumber="41-6a-606(1)" start="0">(1)</xref> is guilty of a class A misdemeanor.</subsection><subsection number="41-6a-606(3)(b)">
A person who violates Subsection <xref depth="4" refnumber="41-6a-606(2)" start="0">(2)</xref> is guilty of a class B misdemeanor.</subsection></subsection><subsection number="41-6a-606(4)"><subsection number="41-6a-606(4)(a)">
In addition to the penalty provided under this section or any other section, a person who violates Subsection <xref depth="4" refnumber="41-6a-606(1)" start="0">(1)</xref> shall have the person's driver license suspended under Subsection <xref depth="4" refnumber="53-3-220(1)(a)(xv)" start="0">53-3-220(1)(a)(xv)</xref> for a period of:<subsection number="41-6a-606(4)(a)(i)">
60 days for a first offense; and</subsection><subsection number="41-6a-606(4)(a)(ii)">
90 days for a second offense within three years of a prior offense.</subsection></subsection><subsection number="41-6a-606(4)(b)">
The court shall forward the report of the conviction to the Driver License Division in accordance with Section <xref depth="3" refnumber="53-3-218" start="0">53-3-218</xref>.</subsection></subsection><subsection number="41-6a-606(5)">
A motor vehicle that is not street legal that is operated or used in a manner that violates this section is subject to seizure in accordance with <xref depth="2" refnumber="77-11a-2" start="0">Title 77, Chapter 11a, Part 2, Seizure of Property and Contraband</xref>.</subsection></section><section number="41-6a-606.1"><histories><history>Enacted by Chapter <modchap sess="2025GS">220</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Prohibition on performing wheelie -- Penalty.</catchline><subsection number="41-6a-606.1(1)">An individual operating a motorcycle on a highway may not perform a wheelie.</subsection><subsection number="41-6a-606.1(2)"><subsection number="41-6a-606.1(2)(a)">A person who violates Subsection (1) is guilty of an infraction.</subsection><subsection number="41-6a-606.1(2)(b)">If an individual is convicted of a violation of Subsection (1), the Driver License Division shall:<subsection number="41-6a-606.1(2)(b)(i)">suspend the individual's motorcycle endorsement for a period of 90 days; or</subsection><subsection number="41-6a-606.1(2)(b)(ii)">if the individual does not have a valid motorcycle endorsement, suspend the individual's driver license for a period of 90 days.</subsection></subsection><subsection number="41-6a-606.1(2)(c)">If an individual with a motorcycle endorsement is convicted of a second violation of Subsection (1), the Driver License Division shall suspend the individual's motorcycle endorsement for a period of 180 days.</subsection><subsection number="41-6a-606.1(2)(d)">If an individual with a motorcycle endorsement is convicted of a third or subsequent violation of Subsection (1), the Driver License Division shall revoke the individual's motorcycle endorsement.</subsection></subsection><subsection number="41-6a-606.1(3)">The court shall forward the report of a conviction for a violation of Subsection (1) to the Driver License Division in accordance with Section <xref depth="3" refnumber="53-3-218">53-3-218</xref>.</subsection><subsection number="41-6a-606.1(4)">A law enforcement officer may impound a vehicle of a person who violates Subsection (1).</subsection></section><section number="41-6a-607"><histories><history>Renumbered and Amended by Chapter <modchap sess="2005GS">2</modchap>, 2005 General Session</history><modyear>2005</modyear></histories><catchline>Speed violation -- Complaint -- Civil negligence.</catchline><subsection number="41-6a-607(1)">
For a charge of violation of a speed provision under this part, the citation or information shall specify the:
<subsection number="41-6a-607(1)(a)">
speed at which the defendant is alleged to have operated a vehicle; and</subsection><subsection number="41-6a-607(1)(b)">
speed limit applicable to the section of the highway where the violation is alleged to have occurred.</subsection></subsection><subsection number="41-6a-607(2)">
The provisions of this part declaring prima facie speed limitations do not relieve the plaintiff in any civil action from the burden of proving negligence on the part of the defendant as the proximate cause of an accident.</subsection></section><section number="41-6a-608"><histories><history>Renumbered and Amended by Chapter <modchap sess="2005GS">2</modchap>, 2005 General Session</history><modyear>2005</modyear></histories><catchline>Photo radar -- Restrictions on use.</catchline><subsection number="41-6a-608(1)">
"Photo radar" means a device used primarily for highway speed limit enforcement substantially consisting of a low power doppler radar unit and camera mounted in or on a vehicle, which automatically produces a photograph of a vehicle traveling in excess of the legal speed limit, with the vehicle's speed, the date, time of day, and location of the violation printed on the photograph.</subsection><subsection number="41-6a-608(2)">
Photo radar may not be used except:
<subsection number="41-6a-608(2)(a)"><subsection number="41-6a-608(2)(a)(i)">
in school zones; or</subsection><subsection number="41-6a-608(2)(a)(ii)">
in other areas that have a posted speed limit of 30 miles per hour or less;</subsection></subsection><subsection number="41-6a-608(2)(b)">
when a peace officer is present with the photo radar unit;</subsection><subsection number="41-6a-608(2)(c)">
when signs are posted on the highway providing notice to a motorist that photo radar may be used;</subsection><subsection number="41-6a-608(2)(d)">
when use of photo radar by a local highway authority is approved by the local highway authority's governing body; and</subsection><subsection number="41-6a-608(2)(e)">
when the citation is accompanied by the photograph produced by photo radar.</subsection></subsection><subsection number="41-6a-608(3)">
The restrictions under Subsection <xref depth="4" refid="C41-6a-S608_1800010118000101" refnumber="41-6a-608(2)" start="0">(2)</xref> on the use of photo radar do not apply when the information gathered is used for highway safety research or to issue warning citations not involving a fine, court appearance, or a person's driving record.</subsection><subsection number="41-6a-608(4)">
A contract or agreement regarding the purchase, lease, rental, or use of photo radar by the department or by a local highway authority may not specify any condition for issuing a citation.</subsection><subsection number="41-6a-608(5)">
The department and any local highway authority using photo radar, upon request, shall make the following information available for public inspection during regular office hours:
<subsection number="41-6a-608(5)(a)">
the terms of any contract regarding the purchase, lease, rental, or use of photo radar;</subsection><subsection number="41-6a-608(5)(b)">
the total fine revenue generated by using photo radar;</subsection><subsection number="41-6a-608(5)(c)">
the number of citations issued by the use of photo radar; and</subsection><subsection number="41-6a-608(5)(d)">
the amount paid to the person providing the photo radar unit.</subsection></subsection><subsection number="41-6a-608(6)">
A moving traffic violation obtained through the use of photo radar is not a reportable violation as defined under Section <xref depth="3" refid="C53-3-S102_1800010118000101" refnumber="53-3-102" start="0">53-3-102</xref>, and points may not be assessed against a person for the violation.</subsection></section><section number="41-6a-609"><histories><history>Amended by Chapter <modchap sess="2016GS">303</modchap>, 2016 General Session</history><modyear>2016</modyear></histories><catchline>Radar jamming devices and jamming radar prohibited -- Defense -- Exceptions -- Penalties.</catchline><subsection number="41-6a-609(1)">
As used in this section, "radar jamming device" means any instrument or mechanism designed or intended to interfere with the radar or any laser that is used by law enforcement personnel to measure the speed of a motor vehicle on a highway.</subsection><subsection number="41-6a-609(2)"><subsection number="41-6a-609(2)(a)">
A person may not operate a motor vehicle on a highway with a radar jamming device in the motor vehicle.</subsection><subsection number="41-6a-609(2)(b)">
A person may not knowingly use a radar jamming device to interfere with the radar signals or lasers used by law enforcement personnel to measure the speed of a motor vehicle on a highway.</subsection></subsection><subsection number="41-6a-609(3)">
It is an affirmative defense to a charge under Subsection <xref depth="4" refnumber="41-6a-609(2)(a)" start="0">(2)(a)</xref> that the radar jamming device was in an inoperative condition or could not be readily used at the time of the arrest or citation.</subsection><subsection number="41-6a-609(4)">
This section does not apply to law enforcement personnel acting in their official capacity.</subsection><subsection number="41-6a-609(5)">
A person who violates this section is guilty of an infraction.</subsection></section></part>
