<?xml version="1.0" encoding="ISO-8859-1"?><section number="41-6a-1508"><effdate>1/1/2018</effdate><histories><history>Amended by Chapter <modchap sess="2017GS">406</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Low-speed vehicle.</catchline><subsection number="41-6a-1508(1)">
Except as otherwise provided in this section, a low-speed vehicle is considered a motor vehicle for purposes of the Utah Code including requirements for:
<subsection number="41-6a-1508(1)(a)">
traffic rules under <xref depth="1" refnumber="41-6a" start="0">Title 41, Chapter 6a, Traffic Code</xref>;</subsection><subsection number="41-6a-1508(1)(b)">
driver licensing under <xref depth="1" refnumber="53-3" start="0">Title 53, Chapter 3, Uniform Driver License Act</xref>;</subsection><subsection number="41-6a-1508(1)(c)">
motor vehicle insurance under <xref depth="1" refnumber="41-12a" start="0">Title 41, Chapter 12a, Financial Responsibility of Motor Vehicle Owners and Operators Act</xref>;</subsection><subsection number="41-6a-1508(1)(d)">
vehicle registration, titling, vehicle identification numbers, license plates, and registration fees under <xref depth="1" refnumber="41-1a" start="0">Title 41, Chapter 1a, Motor Vehicle Act</xref>;</subsection><subsection number="41-6a-1508(1)(e)">
vehicle taxation under <xref depth="1" refnumber="59-13" start="0">Title 59, Chapter 13, Motor and Special Fuel Tax Act</xref>, and fee in lieu of property taxes or in lieu fees under Section <xref depth="3" refnumber="59-2-405" start="0">59-2-405</xref>;</subsection><subsection number="41-6a-1508(1)(f)">
motor vehicle dealer licensing under <xref depth="1" refnumber="41-3" start="0">Title 41, Chapter 3, Motor Vehicle Business Regulation Act</xref>; and</subsection><subsection number="41-6a-1508(1)(g)">
safety belt requirements under <xref depth="2" refnumber="41-6a-18" start="2">Part 18, Motor Vehicle Safety Belt Usage Act</xref>.</subsection></subsection><subsection number="41-6a-1508(2)"><subsection number="41-6a-1508(2)(a)">
The owner of a low-speed vehicle shall ensure that the low-speed vehicle:<subsection number="41-6a-1508(2)(a)(i)">
complies with federal safety standards established in 49 C.F.R. 571.500; and</subsection><subsection number="41-6a-1508(2)(a)(ii)">
is equipped with:
<subsection number="41-6a-1508(2)(a)(ii)(A)">
headlamps;</subsection><subsection number="41-6a-1508(2)(a)(ii)(B)">
front and rear turn signals, tail lamps, and stop lamps;</subsection><subsection number="41-6a-1508(2)(a)(ii)(C)">
turn signal lamps;</subsection><subsection number="41-6a-1508(2)(a)(ii)(D)">
reflex reflectors one on the rear of the vehicle and one on the left and right side and as far to the rear of the vehicle as practical;</subsection><subsection number="41-6a-1508(2)(a)(ii)(E)">
a parking brake;</subsection><subsection number="41-6a-1508(2)(a)(ii)(F)">
a windshield that meets the standards under Section <xref depth="3" refnumber="41-6a-1635" start="0">41-6a-1635</xref>, including a device for cleaning rain, snow, or other moisture from the windshield; and</subsection><subsection number="41-6a-1508(2)(a)(ii)(G)">
an exterior rearview mirror on the driver's side and either an interior rearview mirror or an exterior rearview mirror on the passenger side.</subsection></subsection></subsection><subsection number="41-6a-1508(2)(b)">
A low-speed vehicle that complies with this Subsection <xref depth="4" refnumber="41-6a-1508(2)" start="0">(2)</xref> and Subsection <xref depth="4" refnumber="41-6a-1508(3)" start="0">(3)</xref> and that is not altered from the manufacturer is considered to comply with equipment requirements under <xref depth="2" refnumber="41-6a-16" start="2">Part 16, Vehicle Equipment</xref>.</subsection></subsection><subsection number="41-6a-1508(3)">
A person may not operate a low-speed vehicle that has been structurally altered from the original manufacturer's design.</subsection><subsection number="41-6a-1508(4)">
A low-speed vehicle is exempt from a motor vehicle emissions inspection and maintenance program requirements under Section <xref depth="3" refnumber="41-6a-1642" start="0">41-6a-1642</xref>.</subsection><subsection number="41-6a-1508(5)"><subsection number="41-6a-1508(5)(a)">
Except to cross a highway at an intersection, a low-speed vehicle may not be operated on a highway with a posted speed limit of more than 35 miles per hour.</subsection><subsection number="41-6a-1508(5)(b)">
In addition to the restrictions under Subsection <xref depth="4" refnumber="41-6a-1508(5)(a)" start="0">(5)(a)</xref>, a highway authority, may prohibit or restrict the operation of a low-speed vehicle on any highway under its jurisdiction, if the highway authority determines the prohibition or restriction is necessary for public safety.</subsection></subsection><subsection number="41-6a-1508(6)">
A person may not operate a low-speed vehicle on a highway without displaying on the rear of the low-speed vehicle, a slow-moving vehicle identification emblem that complies with the Society of Automotive Engineers standard SAE J943.</subsection><subsection number="41-6a-1508(7)">
A person who violates Subsection <xref depth="4" refnumber="41-6a-1508(2)" start="0">(2)</xref>, <xref depth="4" refnumber="41-6a-1508(3)" start="0">(3)</xref>, <xref depth="4" refnumber="41-6a-1508(5)" start="0">(5)</xref>, or <xref depth="4" refnumber="41-6a-1508(6)" start="0">(6)</xref> is guilty of an infraction.</subsection></section>
