<section number="41-6a-704.1"><effdate>1/1/2026</effdate><histories><history>Enacted by Chapter <modchap sess="2025GS">220</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Prohibition on lane splitting -- Penalty.</catchline><subsection number="41-6a-704.1(1)">An individual may not engage in lane splitting.</subsection><subsection number="41-6a-704.1(2)">A violation of Subsection <xref tempid="885" depth="4" refnumber="(1)">(1)</xref> is an infraction.</subsection><subsection number="41-6a-704.1(3)">If an individual is convicted of a violation of Subsection (1), the Driver License Division shall:<subsection number="41-6a-704.1(3)(a)">suspend the individual's motorcycle endorsement for a period of 90 days; or</subsection><subsection number="41-6a-704.1(3)(b)">if the individual does not have a valid motorcycle endorsement, suspend the individual's driver license for a period of 90 days.</subsection></subsection><subsection number="41-6a-704.1(4)">If an individual with a motorcycle endorsement is convicted of a second violation of Subsection (1), the Driver License Division shall suspend the individual's motorcycle endorsement for a period of 180 days.</subsection><subsection number="41-6a-704.1(5)">If an individual with a motorcycle endorsement is convicted of a third or subsequent violation of Subsection (1), the Driver License Division shall revoke the individual's motorcycle endorsement.</subsection><subsection number="41-6a-704.1(6)">The court shall forward the report of a conviction for a violation of Subsection (1) to the Driver License Division in accordance with Section <xref depth="3" refnumber="53-3-218">53-3-218</xref>.</subsection><subsection number="41-6a-704.1(7)">A law enforcement officer may impound a vehicle of a person who violates Subsection (1).</subsection></section>
