<?xml version="1.0" encoding="ISO-8859-1"?><section number="41-6a-1105"><effdate>5/5/2021</effdate><histories><history>Amended by Chapter <modchap sess="2021GS">119</modchap>, 2021 General Session</history><modyear>2021</modyear></histories><catchline>Operation of bicycle or moped on and use of roadway -- Duties, prohibitions.</catchline><subsection number="41-6a-1105(1)">
A person operating a bicycle or a moped on a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as near as practicable to the right-hand edge of the roadway except when:
<subsection number="41-6a-1105(1)(a)">
overtaking and passing another bicycle or vehicle proceeding in the same direction;</subsection><subsection number="41-6a-1105(1)(b)">
preparing to make a left turn at an intersection or into a private road or driveway;</subsection><subsection number="41-6a-1105(1)(c)">
traveling straight through an intersection that has a right-turn only lane that is in conflict with the straight through movement; or</subsection><subsection number="41-6a-1105(1)(d)">
reasonably necessary to avoid conditions that make it unsafe to continue along the right-hand edge of the roadway including:<subsection number="41-6a-1105(1)(d)(i)">
fixed or moving objects;</subsection><subsection number="41-6a-1105(1)(d)(ii)">
parked or moving vehicles;</subsection><subsection number="41-6a-1105(1)(d)(iii)">
bicycles;</subsection><subsection number="41-6a-1105(1)(d)(iv)">
pedestrians;</subsection><subsection number="41-6a-1105(1)(d)(v)">
animals;</subsection><subsection number="41-6a-1105(1)(d)(vi)">
surface hazards; or</subsection><subsection number="41-6a-1105(1)(d)(vii)">
a lane that is too narrow for a bicycle and a vehicle to travel safely side by side within the lane.</subsection></subsection></subsection><subsection number="41-6a-1105(2)">
A person operating a bicycle or moped on a highway shall operate in the designated direction of traffic.</subsection><subsection number="41-6a-1105(3)"><subsection number="41-6a-1105(3)(a)">
A person riding a bicycle or moped on a roadway may not ride more than two abreast with another person except on paths or parts of roadways set aside for the exclusive use of bicycles.</subsection><subsection number="41-6a-1105(3)(b)">
If allowed under Subsection <xref depth="4" refnumber="41-6a-1105(3)(a)" start="0">(3)(a)</xref>, a person riding two abreast with another person may not impede the normal and reasonable movement of traffic and shall ride within a single lane.</subsection></subsection><subsection number="41-6a-1105(4)">
If a usable path for bicycles has been provided adjacent to a roadway, a bicycle rider may be directed by a traffic-control device to use the path and not the roadway.</subsection><subsection number="41-6a-1105(5)"><subsection number="41-6a-1105(5)(a)">
As used in this Subsection <xref depth="4" refnumber="41-6a-1105(5)" start="0">(5)</xref>, "immediate hazard" means a vehicle approaching an intersection at a proximity and rate of speed sufficient to indicate to a reasonable person that there is a danger of collision or accident.</subsection><subsection number="41-6a-1105(5)(b)">
Except as provided in Subsection <xref depth="4" refnumber="41-6a-1105(6)" start="0">(6)</xref>, an individual operating a bicycle approaching a stop sign may proceed through the intersection without stopping at the stop sign if:<subsection number="41-6a-1105(5)(b)(i)">
the individual slows to a reasonable speed; and</subsection><subsection number="41-6a-1105(5)(b)(ii)">
yields the right-of-way to:
<subsection number="41-6a-1105(5)(b)(ii)(A)">
any pedestrian within the intersection or an adjacent crosswalk;</subsection><subsection number="41-6a-1105(5)(b)(ii)(B)">
other traffic within the intersection; and</subsection><subsection number="41-6a-1105(5)(b)(ii)(C)">
oncoming traffic that poses an immediate hazard during the time the individual is traveling through the intersection.</subsection></subsection></subsection></subsection><subsection number="41-6a-1105(6)">
Subsection <xref depth="4" refnumber="41-6a-1105(5)(b)" start="0">(5)(b)</xref> does not apply to an intersection with an active railroad grade crossing as defined in Section <xref depth="3" refnumber="41-6a-1005" start="0">41-6a-1005</xref>.</subsection></section>
