<section number="45-3-2"><effdate>5/6/2026</effdate><histories><history>Amended by Chapter <modchap sess="2026GS">489</modchap>, 2026 General Session</history><modyear>2026</modyear></histories><catchline>Definitions.</catchline><tab/>As used in this chapter:<subsection number="45-3-2(1)">"Advertisement" means a notice designed to attract public attention or patronage and includes a list of supporters for a particular cause.</subsection><subsection number="45-3-2(2)">"Cause the publication" means:<subsection number="45-3-2(2)(a)">that a person: <subsection number="45-3-2(2)(a)(i)">prepares or requests another to prepare: <subsection number="45-3-2(2)(a)(i)(A)">an advertisement of the type described in Subsection <xref depth="4" refnumber="45-3-3(2)(a)">45-3-3(2)(a)</xref>; or</subsection><subsection number="45-3-2(2)(a)(i)(B)">content that uses, simulates, or recreates an individual's personal identity; and</subsection></subsection><subsection number="45-3-2(2)(a)(ii)">submits or requests another to submit the advertisement or content for publication; and </subsection></subsection><subsection number="45-3-2(2)(b)">the advertisement or content has been published.</subsection></subsection><subsection number="45-3-2(3)"><subsection number="45-3-2(3)(a)">"Consent" means an individual's voluntary agreement to the use of that individual's personal identity.</subsection><subsection number="45-3-2(3)(b)">"Consent" may not be inferred by the failure of the individual to request that the individual's personal identity not be used or that the individual's name be removed from a mailing or supporter list.</subsection></subsection><subsection number="45-3-2(4)">"Content" means audio, video, image, text, or other media, regardless of format.</subsection><subsection number="45-3-2(5)">"Generative artificial intelligence" means an artificial intelligence technology system that:<subsection number="45-3-2(5)(a)">is trained on data;</subsection><subsection number="45-3-2(5)(b)">responds to human input; and</subsection><subsection number="45-3-2(5)(c)">is capable of generating content similar to content created by a human, with limited or no human involvement in the generation.</subsection></subsection><subsection number="45-3-2(6)">"Individual" means a natural person, living or dead.</subsection><subsection number="45-3-2(7)">"Person" means any natural person, firm, partnership, association, corporation, joint venture, or any other form of business organization or arrangement, and the agents or representatives of such persons.</subsection><subsection number="45-3-2(8)"><subsection number="45-3-2(8)(a)">"Personal identity" means an individual's: <subsection number="45-3-2(8)(a)(i)">picture;</subsection><subsection number="45-3-2(8)(a)(ii)">portrait;</subsection><subsection number="45-3-2(8)(a)(iii)">visual or video likeness;</subsection><subsection number="45-3-2(8)(a)(iv)">voice; or</subsection><subsection number="45-3-2(8)(a)(v)">audiovisual appearance.</subsection></subsection><subsection number="45-3-2(8)(b)">"Personal identity" includes any simulation, reproduction, or artificial recreation of the content described in Subsection <xref depth="4" refnumber="45-3-2(8)(a)">(8)(a)</xref>, whether created through:<subsection number="45-3-2(8)(b)(i)">generative artificial intelligence;</subsection><subsection number="45-3-2(8)(b)(ii)">computer animation;</subsection><subsection number="45-3-2(8)(b)(iii)">digital manipulation; or</subsection><subsection number="45-3-2(8)(b)(iv)">any other technological means.</subsection></subsection></subsection><subsection number="45-3-2(9)">"Publish" means that a person provides the instrumentality through which an advertisement or content is communicated to another person.</subsection><subsection number="45-3-2(10)">"Right holder" means the individual or a person to whom the individual's right in the individual's personal identity has descended or been transferred, including an executor, successor, heir, assignee, licensee, or devisee of the individual.</subsection><subsection number="45-3-2(11)">"Voice" means a computer-generated sound in a medium that is readily identifiable and attributable to a particular individual, regardless of whether the sound contains the actual voice of the individual.</subsection></section>
