<section number="57-8-24"><effdate>3/23/2016</effdate><histories><history>Amended by Chapter <modchap sess="2016GS">210</modchap>, 2016 General Session</history><modyear>2016</modyear></histories><catchline>Common profits, common expenses, and voting rights -- Unit -- Unconstructed unit.</catchline><subsection number="57-8-24(1)">
A unit is created by the recording of the declaration and a condominium plat that describes the unit.</subsection><subsection number="57-8-24(2)">
An association of unit owners shall, according to each unit owner's respective percentage or fractional undivided interests in the common areas and facilities:
<subsection number="57-8-24(2)(a)">
distribute the property's common profits among the unit owners;</subsection><subsection number="57-8-24(2)(b)">
except as otherwise provided in the declaration for unconstructed units, assess the unit owners the property's common expenses; and</subsection><subsection number="57-8-24(2)(c)">
make voting rights available to the unit owners.</subsection></subsection><subsection number="57-8-24(3)"><subsection number="57-8-24(3)(a)">
After the recording of a condominium project's declaration, an unconstructed unit is a unit for the purposes of the declaration and this chapter, including:<subsection number="57-8-24(3)(a)(i)">
allocation of undivided interests in the common areas and facilities in accordance with Subsection <xref depth="4" refnumber="57-8-7(2)" start="0">57-8-7(2)</xref>; and</subsection><subsection number="57-8-24(3)(a)(ii)">
voting rights in accordance with Section <xref depth="3" refnumber="57-8-24" start="0">57-8-24</xref>.</subsection></subsection><subsection number="57-8-24(3)(b)">
Subsection <xref depth="4" refnumber="57-8-24(3)(a)" start="0">(3)(a)</xref> applies to a condominium project regardless of when the condominium project's initial declaration was recorded.</subsection></subsection></section>
