<section number="57-8-42"><histories><history>Enacted by Chapter <modchap sess="2011GS">355</modchap>, 2011 General Session</history><modyear>2011</modyear></histories><catchline>Fair and reasonable notice.</catchline><subsection number="57-8-42(1)">
Notice that an association of unit owners provides by a method allowed under <xref depth="1" refid="C16-6a_1800010118000101" refnumber="16-6a" start="0">Title 16, Chapter 6a, Utah Revised Nonprofit Corporation Act</xref>, constitutes fair and reasonable notice, whether or not the association of unit owners is a nonprofit corporation.</subsection><subsection number="57-8-42(2)">
Notice that an association of unit owners provides by a method not referred to in Subsection <xref depth="4" refid="C57-8-S42_1800010118000101" refnumber="57-8-42(1)" start="0">(1)</xref>, including a method described in Subsection <xref depth="4" refid="C57-8-S42_1800010118000101" refnumber="57-8-42(3)" start="0">(3)</xref>, constitutes fair and reasonable notice if:
<subsection number="57-8-42(2)(a)">
the method is authorized in the declaration, articles, bylaws, or rules; and</subsection><subsection number="57-8-42(2)(b)">
considering all the circumstances, the notice is fair and reasonable.</subsection></subsection><subsection number="57-8-42(3)"><subsection number="57-8-42(3)(a)">
If provided in the declaration, articles, bylaws, or rules, an association of unit owners may provide notice by electronic means, including text message, email, or the website of the association of unit owners.</subsection><subsection number="57-8-42(3)(b)">
Notwithstanding Subsection <xref depth="4" refid="C57-8-S42_1800010118000101" refnumber="57-8-42(3)(a)" start="0">(3)(a)</xref>, a unit owner may, by written demand, require an association of unit owners to provide notice to the unit owner by mail.</subsection></subsection></section>
