<section number="57-8-45"><histories><history>Amended by Chapter <modchap sess="2013GS">95</modchap>, 2013 General Session</history><modyear>2013</modyear></histories><catchline>Enforcement of a lien.</catchline><subsection number="57-8-45(1)"><subsection number="57-8-45(1)(a)">
Except as provided in Section <xref depth="3" refid="C57-8-S13.1_1800010118000101" refnumber="57-8-13.1" start="0">57-8-13.1</xref>, to enforce a lien established under Section <xref depth="3" refid="C57-8-S44_1800010118000101" refnumber="57-8-44" start="0">57-8-44</xref>, an association of unit owners may:<subsection number="57-8-45(1)(a)(i)">
cause a unit to be sold through nonjudicial foreclosure as though the lien were a deed of trust, in the manner provided by:
<subsection number="57-8-45(1)(a)(i)(A)">
Sections <xref depth="3" refid="C57-1-S24_1800010118000101" refnumber="57-1-24" start="0">57-1-24</xref>, <xref depth="3" refid="C57-1-S25_1800010118000101" refnumber="57-1-25" start="0">57-1-25</xref>, <xref depth="3" refid="C57-1-S26_1800010118000101" refnumber="57-1-26" start="0">57-1-26</xref>, and <xref depth="3" refid="C57-1-S27_1800010118000101" refnumber="57-1-27" start="0">57-1-27</xref>; and</subsection><subsection number="57-8-45(1)(a)(i)(B)">
this chapter; or</subsection></subsection><subsection number="57-8-45(1)(a)(ii)">
foreclose the lien through a judicial foreclosure in the manner provided by:
<subsection number="57-8-45(1)(a)(ii)(A)">
law for the foreclosure of a mortgage; and</subsection><subsection number="57-8-45(1)(a)(ii)(B)">
this chapter.</subsection></subsection></subsection><subsection number="57-8-45(1)(b)">
For purposes of a nonjudicial or judicial foreclosure as provided in Subsection <xref depth="4" refid="C57-8-S45_1800010118000101" refnumber="57-8-45(1)(a)" start="0">(1)(a)</xref>:<subsection number="57-8-45(1)(b)(i)">
the association of unit owners is considered to be the beneficiary under a trust deed; and</subsection><subsection number="57-8-45(1)(b)(ii)">
the unit owner is considered to be the trustor under a trust deed.</subsection></subsection></subsection><subsection number="57-8-45(2)">
A unit owner's acceptance of the owner's interest in a unit constitutes a simultaneous conveyance of the unit in trust, with power of sale, to the trustee designated as provided in this section for the purpose of securing payment of all amounts due under the declaration and this chapter.</subsection><subsection number="57-8-45(3)"><subsection number="57-8-45(3)(a)">
A power of sale and other powers of a trustee under this part and under Sections <xref depth="3" refid="C57-1-S19_1800010118000101" refnumber="57-1-19" start="0">57-1-19</xref> through <xref depth="3" refid="C57-1-S34_1800010118000101" refnumber="57-1-34" start="0">57-1-34</xref> may not be exercised unless the association of unit owners appoints a qualified trustee.</subsection><subsection number="57-8-45(3)(b)">
An association of unit owners' execution of a substitution of trustee form authorized in Section <xref depth="3" refid="C57-1-S22_1800010118000101" refnumber="57-1-22" start="0">57-1-22</xref> is sufficient for appointment of a trustee under Subsection <xref depth="4" refid="C57-8-S45_1800010118000101" refnumber="57-8-45(3)(a)" start="0">(3)(a)</xref>.</subsection><subsection number="57-8-45(3)(c)">
A person may not be a trustee under this part unless the person qualifies as a trustee under Subsection <xref depth="4" refid="C57-1-S21_1800010118000101" refnumber="57-1-21(1)(a)(i)" start="0">57-1-21(1)(a)(i)</xref> or <xref depth="4" refid="C57-1-S21_1800010118000101" refnumber="57-1-21(1)(a)(iv)" start="0">(iv)</xref>.</subsection><subsection number="57-8-45(3)(d)">
A trustee under this part is subject to all duties imposed on a trustee under Sections <xref depth="3" refid="C57-1-S19_1800010118000101" refnumber="57-1-19" start="0">57-1-19</xref> through <xref depth="3" refid="C57-1-S34_1800010118000101" refnumber="57-1-34" start="0">57-1-34</xref>.</subsection></subsection><subsection number="57-8-45(4)">
This chapter does not prohibit an association of unit owners from bringing an action against a unit owner to recover an amount for which a lien is created under Section <xref depth="3" refid="C57-8-S44_1800010118000101" refnumber="57-8-44" start="0">57-8-44</xref> or from taking a deed in lieu of foreclosure, if the action is brought or deed taken before the sale or foreclosure of the unit owner's unit under this chapter.</subsection></section>
