<section number="57-8-57"><effdate>5/9/2017</effdate><histories><history>Amended by Chapter <modchap sess="2017GS">131</modchap>, 2017 General Session</history><modyear>2017</modyear></histories><catchline>Management committee meetings -- Open meetings.</catchline><subsection number="57-8-57(1)">
Except for an action taken without a meeting in accordance with Section <xref depth="3" refnumber="16-6a-813" start="0">16-6a-813</xref>, a management committee may take action only at a management committee meeting.</subsection><subsection number="57-8-57(2)"><subsection number="57-8-57(2)(a)">
At least 48 hours before a management committee meeting, the association of unit owners shall give written notice of the management committee meeting via email to each unit owner who requests notice of a management committee meeting, unless:<subsection number="57-8-57(2)(a)(i)">
notice of the management committee meeting is included in a meeting schedule that was previously provided to the unit owner; or</subsection><subsection number="57-8-57(2)(a)(ii)"><subsection number="57-8-57(2)(a)(ii)(A)">
the management committee meeting is to address an emergency; and</subsection><subsection number="57-8-57(2)(a)(ii)(B)">
each management committee member receives notice of the management committee meeting less than 48 hours before the management committee meeting.</subsection></subsection></subsection><subsection number="57-8-57(2)(b)">
A notice described in Subsection <xref depth="4" refnumber="57-8-57(2)(a)" start="0">(2)(a)</xref> shall:<subsection number="57-8-57(2)(b)(i)">
be delivered to the unit owner by email, to the email address that the unit owner provides to the management committee or the association of unit owners;</subsection><subsection number="57-8-57(2)(b)(ii)">
state the time and date of the management committee meeting;</subsection><subsection number="57-8-57(2)(b)(iii)">
state the location of the management committee meeting; and</subsection><subsection number="57-8-57(2)(b)(iv)">
if a management committee member may participate by means of electronic communication, provide the information necessary to allow the unit owner to participate by the available means of electronic communication.</subsection></subsection></subsection><subsection number="57-8-57(3)"><subsection number="57-8-57(3)(a)">
Except as provided in Subsection <xref depth="4" refnumber="57-8-57(3)(b)" start="0">(3)(b)</xref>, a management committee meeting shall be open to each unit owner or the unit owner's representative if the representative is designated in writing.</subsection><subsection number="57-8-57(3)(b)">
A management committee may close a management committee meeting to:<subsection number="57-8-57(3)(b)(i)">
consult with an attorney for the purpose of obtaining legal advice;</subsection><subsection number="57-8-57(3)(b)(ii)">
discuss ongoing or potential litigation, mediation, arbitration, or administrative proceedings;</subsection><subsection number="57-8-57(3)(b)(iii)">
discuss a personnel matter;</subsection><subsection number="57-8-57(3)(b)(iv)">
discuss a matter relating to contract negotiations, including review of a bid or proposal;</subsection><subsection number="57-8-57(3)(b)(v)">
discuss a matter that involves an individual if the discussion is likely to cause the individual undue embarrassment or violate the individual's reasonable expectation of privacy; or</subsection><subsection number="57-8-57(3)(b)(vi)">
discuss a delinquent assessment or fine.</subsection></subsection></subsection><subsection number="57-8-57(4)"><subsection number="57-8-57(4)(a)">
At each management committee meeting, the management committee shall provide each unit owner a reasonable opportunity to offer comments.</subsection><subsection number="57-8-57(4)(b)">
The management committee may limit the comments described in Subsection <xref depth="4" refnumber="57-8-57(4)(a)" start="0">(4)(a)</xref> to one specific time period during the meeting.</subsection></subsection><subsection number="57-8-57(5)">
A management committee member may not avoid or obstruct the requirements of this section.</subsection><subsection number="57-8-57(6)">
Nothing in this section shall affect the validity or enforceability of an action of a management committee.</subsection><subsection number="57-8-57(7)">
The provisions of this section do not apply during the period of administrative control.</subsection><subsection number="57-8-57(8)">
The provisions of this section apply regardless of when the condominium project's initial declaration was recorded.</subsection><subsection number="57-8-57(9)"><subsection number="57-8-57(9)(a)">
Subject to Subsection <xref depth="4" refnumber="57-8-57(9)(d)" start="0">(9)(d)</xref>, if an association of unit owners fails to comply with a provision of Subsections <xref depth="4" refnumber="57-8-57(1)" start="0">(1)</xref> through <xref depth="4" refnumber="57-8-57(5)" start="0">(5)</xref> and fails to remedy the noncompliance during the 90-day period described in Subsection <xref depth="4" refnumber="57-8-57(9)(d)" start="0">(9)(d)</xref>, a unit owner may file an action in court for:<subsection number="57-8-57(9)(a)(i)">
injunctive relief requiring the association of unit owners to comply with the provisions of Subsections <xref depth="4" refnumber="57-8-57(1)" start="0">(1)</xref> through <xref depth="4" refnumber="57-8-57(5)" start="0">(5)</xref>;</subsection><subsection number="57-8-57(9)(a)(ii)">
$500 or actual damages, whichever is greater; or</subsection><subsection number="57-8-57(9)(a)(iii)">
any other relief provided by law.</subsection></subsection><subsection number="57-8-57(9)(b)">
In an action described in Subsection <xref depth="4" refnumber="57-8-57(9)(a)" start="0">(9)(a)</xref>, the court may award costs and reasonable attorney fees to the prevailing party.</subsection><subsection number="57-8-57(9)(c)">
Upon motion from the unit owner, notice to the association of unit owners, and a hearing in which the court finds a likelihood that the association of unit owners has failed to comply with a provision of Subsections <xref depth="4" refnumber="57-8-57(1)" start="0">(1)</xref> through <xref depth="4" refnumber="57-8-57(5)" start="0">(5)</xref>, the court may order the association of unit owners to immediately comply with the provisions of Subsections <xref depth="4" refnumber="57-8-57(1)" start="0">(1)</xref> through <xref depth="4" refnumber="57-8-57(5)" start="0">(5)</xref>.</subsection><subsection number="57-8-57(9)(d)">
At least 90 days before the day on which a unit owner files an action described in Subsection <xref depth="4" refnumber="57-8-57(9)(a)" start="0">(9)(a)</xref>, the unit owner shall deliver a written notice to the association of unit owners that states:<subsection number="57-8-57(9)(d)(i)">
the unit owner's name, address, telephone number, and email address;</subsection><subsection number="57-8-57(9)(d)(ii)">
each requirement of Subsections <xref depth="4" refnumber="57-8-57(1)" start="0">(1)</xref> through <xref depth="4" refnumber="57-8-57(5)" start="0">(5)</xref> with which the association of unit owners has failed to comply;</subsection><subsection number="57-8-57(9)(d)(iii)">
a demand that the association of unit owners comply with each requirement with which the association of unit owners has failed to comply; and</subsection><subsection number="57-8-57(9)(d)(iv)">
a date by which the association of unit owners shall remedy the association of unit owners' noncompliance that is at least 90 days after the day on which the unit owner delivers the notice to the association of unit owners.</subsection></subsection></subsection></section>
