<section number="57-8-59"><effdate>5/3/2023</effdate><histories><history>Amended by Chapter <modchap sess="2023GS">503</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Management committee.</catchline><subsection number="57-8-59(1)">
A member of the management committee shall be:
<subsection number="57-8-59(1)(a)">
a natural person; and</subsection><subsection number="57-8-59(1)(b)">
18 years old or older.</subsection></subsection><subsection number="57-8-59(2)">
An association's bylaws may prescribe other qualifications for members of the management committee in addition to the requirements described in Subsection <xref depth="4" refnumber="57-8-59(1)" start="0">(1)</xref>.</subsection><subsection number="57-8-59(3)">
Without limiting the qualifications an association prescribes under Subsection <xref depth="4" refnumber="57-8-59(2)" start="0">(2)</xref>, an association may, through governing documents or the management committee's internal procedures, disqualify an individual from serving as a member of the management committee because the individual:
<subsection number="57-8-59(3)(a)">
has been convicted of a felony; or</subsection><subsection number="57-8-59(3)(b)">
is a sex offender.</subsection></subsection><subsection number="57-8-59(4)">
A member of the management committee need not be a resident of this state or a lot owner in the association unless required by the association's bylaws.</subsection><subsection number="57-8-59(5)">
Except as limited in the declaration, the association of unit owners bylaws or articles of incorporation, or other provisions of this chapter, a management committee acts in all instances on behalf of the association of unit owners.</subsection></section>
