<section number="58-55-301"><effdate>5/7/2025</effdate><enddate type="SC">1/1/2027</enddate><histories><history>Amended by Chapter <modchap sess="2025GS">268</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>License required -- License classifications -- Scope.</catchline><subsection number="58-55-301(1)"><subsection number="58-55-301(1)(a)">A person engaged in the construction trades licensed under this chapter, as a contractor regulated under this chapter, as an alarm business or company, or as an alarm company agent, shall become licensed under this chapter before engaging in that trade or contracting activity in this state unless specifically exempted from licensure under Section <xref depth="3" refnumber="58-1-307" start="0">58-1-307</xref> or <xref depth="3" refnumber="58-55-305" start="0">58-55-305</xref>.</subsection><subsection number="58-55-301(1)(b)">The license issued under this chapter and the business license issued by the local jurisdiction in which the licensee has its principal place of business shall be the only licenses required for the licensee to engage in a trade licensed by this chapter, within the state.</subsection><subsection number="58-55-301(1)(c)">Neither the state nor any of its political subdivisions may require of a licensee any additional business licenses, registrations, certifications, contributions, donations, or anything else established for the purpose of qualifying a licensee under this chapter to do business in that local jurisdiction, except for contract prequalification procedures required by state agencies, or the payment of any fee for the license, registration, or certification established as a condition to do business in that local jurisdiction.</subsection></subsection><subsection number="58-55-301(2)">The division shall issue licenses under this chapter to qualified persons in the following classifications:<subsection number="58-55-301(2)(a)">alarm company;</subsection><subsection number="58-55-301(2)(b)">alarm company agent;</subsection><subsection number="58-55-301(2)(c)">apprentice electrician;</subsection><subsection number="58-55-301(2)(d)">apprentice plumber;</subsection><subsection number="58-55-301(2)(e)">construction trades instructor:<subsection number="58-55-301(2)(e)(i)">general building classification;</subsection><subsection number="58-55-301(2)(e)(ii)">general engineering classification;</subsection><subsection number="58-55-301(2)(e)(iii)">electrical classification;</subsection><subsection number="58-55-301(2)(e)(iv)">mechanical classification; and</subsection><subsection number="58-55-301(2)(e)(v)">plumbing classification;</subsection></subsection><subsection number="58-55-301(2)(f)">elevator contractor;</subsection><subsection number="58-55-301(2)(g)">elevator mechanic;</subsection><subsection number="58-55-301(2)(h)">general building contractor;</subsection><subsection number="58-55-301(2)(i)">general electrical contractor;</subsection><subsection number="58-55-301(2)(j)">general engineering contractor; </subsection><subsection number="58-55-301(2)(k)">general plumbing contractor;</subsection><subsection number="58-55-301(2)(l)">HVAC contractor;</subsection><subsection number="58-55-301(2)(m)">journeyman electrician;</subsection><subsection number="58-55-301(2)(n)">journeyman plumber;</subsection><subsection number="58-55-301(2)(o)">master electrician;</subsection><subsection number="58-55-301(2)(p)">master plumber;</subsection><subsection number="58-55-301(2)(q)">residential and small commercial contractor;</subsection><subsection number="58-55-301(2)(r)">residential electrical contractor;</subsection><subsection number="58-55-301(2)(s)">residential journeyman electrician;</subsection><subsection number="58-55-301(2)(t)">residential journeyman plumber;</subsection><subsection number="58-55-301(2)(u)">residential master electrician;</subsection><subsection number="58-55-301(2)(v)">residential master plumber;</subsection><subsection number="58-55-301(2)(w)">residential plumbing contractor; and </subsection><subsection number="58-55-301(2)(x)">specialty contractor.</subsection></subsection><subsection number="58-55-301(3)"><subsection number="58-55-301(3)(a)">An applicant may apply for a license in one or more classification or specialty contractor subclassification.</subsection><subsection number="58-55-301(3)(b)">A license shall be granted in each classification or subclassification for which the applicant qualifies.</subsection><subsection number="58-55-301(3)(c)">A separate application and fee must be submitted for each license classification or subclassification.</subsection></subsection><subsection number="58-55-301(4)">With the concurrence of the director, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the commission may further define the scope of work by rule for:<subsection number="58-55-301(4)(a)">a general electrical contractor;</subsection><subsection number="58-55-301(4)(b)">a general plumbing contractor;</subsection><subsection number="58-55-301(4)(c)">an HVAC contractor;</subsection><subsection number="58-55-301(4)(d)">a residential electrical contractor; and</subsection><subsection number="58-55-301(4)(e)">a residential plumbing contractor.</subsection></subsection></section>
