The intestate share of a decedent's surviving spouse is:
<subsection number="75-2-102(1)(a)">
the entire intestate estate if:<subsection number="75-2-102(1)(a)(i)">
no descendant of the decedent survives the decedent; or</subsection><subsection number="75-2-102(1)(a)(ii)">
all of the decedent's surviving descendants are also descendants of the surviving spouse;</subsection></subsection><subsection number="75-2-102(1)(b)">
the first $75,000, plus 1/2 of any balance of the intestate estate, if one or more of the decedent's surviving descendants are not descendants of the surviving spouse.</subsection></subsection><subsection number="75-2-102(2)">
For purposes of Subsection <xref depth="4" refid="C75-2-S102_1800010118000101" refnumber="75-2-102(1)(b)" start="0">(1)(b)</xref>, if the intestate estate passes to both the decedent's surviving spouse and to other heirs, then any nonprobate transfer, as defined in Section <xref depth="3" refid="C75-2-S206_1800010118000101" refnumber="75-2-206" start="0">75-2-206</xref>, received by the surviving spouse is added to the probate estate in calculating the intestate heirs' shares and is conclusively treated as an advancement under Section <xref depth="3" refid="C75-2-S109_1800010118000101" refnumber="75-2-109" start="0">75-2-109</xref> in determining the spouse's share.</subsection></section>
