<section number="75-2-501"><effdate>5/7/2025</effdate><histories><history>Amended by Chapter <modchap sess="2025GS">338</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Who may make will -- Testamentary capacity.</catchline><subsection number="75-2-501(1)">An individual may make a will if the individual:<subsection number="75-2-501(1)(a)">is 18 years old or older; and</subsection><subsection number="75-2-501(1)(b)">has testamentary capacity at the time that the will is executed.</subsection></subsection><subsection number="75-2-501(2)">A testator has testamentary capacity under Subsection <xref refnumber="75-2-501(1)" depth="4">(1)</xref><xref depth="4" refnumber="75-2-501(b)">(b)</xref> if the testator:<subsection number="75-2-501(2)(a)">can identify the testator's family members or other individuals in the testator's life;</subsection><subsection number="75-2-501(2)(b)">understands the testator's relationship to the individuals described in Subsection <xref refnumber="75-2-501(2)(a)" depth="4">(2)(a)</xref>;</subsection><subsection number="75-2-501(2)(c)">understands the nature and extent of the testator's property; and</subsection><subsection number="75-2-501(2)(d)">can form a plan in the testator's mind for the disposition of the testator's property.</subsection></subsection><subsection number="75-2-501(3)">A testator is not required to have any knowledge or understanding of the laws of inheritance by intestate succession for the testator to have testamentary capacity under Subsection <xref refnumber="75-2-501(2)" depth="4">(2)</xref>.</subsection><subsection number="75-2-501(4)">There is a rebuttable presumption that testamentary capacity exists at the time that a will was executed even if the testator is subject to a guardianship or conservatorship or is otherwise unable to independently manage the testator's affairs.</subsection></section>
