<?xml version="1.0" encoding="ISO-8859-1"?><section number="75-2-502"><histories><history>Repealed and Re-enacted by Chapter <modchap sess="1998GS">39</modchap>, 1998 General Session</history><modyear>1998</modyear></histories><catchline>Execution -- Witnessed wills -- Holographic wills.</catchline><subsection number="75-2-502(1)">
Except as provided in Subsection <xref depth="4" refid="C75-2-S502_1800010118000101" refnumber="75-2-502(2)" start="0">(2)</xref> and in Sections <xref depth="3" refid="C75-2-S503_1800010118000101" refnumber="75-2-503" start="0">75-2-503</xref>, <xref depth="3" refid="C75-2-S506_1800010118000101" refnumber="75-2-506" start="0">75-2-506</xref>, and <xref depth="3" refid="C75-2-S513_1800010118000101" refnumber="75-2-513" start="0">75-2-513</xref>, a will shall be:
<subsection number="75-2-502(1)(a)">
in writing;</subsection><subsection number="75-2-502(1)(b)">
signed by the testator or in the testator's name by some other individual in the testator's conscious presence and by the testator's direction;  and</subsection><subsection number="75-2-502(1)(c)">
signed by at least two individuals, each of whom signed within a reasonable time after he witnessed either the signing of the will as described in Subsection <xref depth="4" refid="C75-2-S502_1800010118000101" refnumber="75-2-502(1)(b)" start="0">(1)(b)</xref> or the testator's acknowledgment of that signature or acknowledgment of the will.</subsection></subsection><subsection number="75-2-502(2)">
A will that does not comply with Subsection <xref depth="4" refid="C75-2-S502_1800010118000101" refnumber="75-2-502(1)" start="0">(1)</xref> is valid as a holographic will, whether or not witnessed, if the signature and material portions of the document are in the testator's handwriting.</subsection><subsection number="75-2-502(3)">
Intent that the document constitutes the testator's will can be established by extrinsic evidence, including, for holographic wills, portions of the document that are not in the testator's handwriting.</subsection></section>
