<section number="75B-2-816"><effdate>5/7/2025</effdate><histories><history>Renumbered and Amended by Chapter <modchap sess="2025GS">310</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Recitals when title to real property is in trust -- Failure.</catchline><subsection number="75B-2-816(1)">When title to real property is granted to a person as trustee, the terms of the trust may be given either:<subsection number="75B-2-816(1)(a)">in the deed of transfer; or</subsection><subsection number="75B-2-816(1)(b)">in an instrument signed by the grantor and recorded in the same office as the grant to the trustee.</subsection></subsection><subsection number="75B-2-816(2)">If the terms of the trust are not made public as required in Subsection <xref depth="4" refnumber="75-7-816(1)">(1)</xref>, a conveyance from the trustee is absolute in favor of purchasers for value who take the property without notice of the terms of the trust.</subsection><subsection number="75B-2-816(3)">The terms of the trust recited in the deed of transfer or the instrument recorded under Subsection <xref depth="4" refnumber="75-7-816(1)(b)">(1)(b)</xref> shall include:<subsection number="75B-2-816(3)(a)">the name of the trustee;</subsection><subsection number="75B-2-816(3)(b)">the address of the trustee; and</subsection><subsection number="75B-2-816(3)(c)">the name and date of the trust.</subsection></subsection><subsection number="75B-2-816(4)">Any real property titled in a trust that has a restriction on transfer described in Section <xref depth="3" refnumber="75B-1-303">75B-1-303</xref> shall include in the title the words "asset protection trust."</subsection></section>
