<section number="75B-2-901"><effdate>5/7/2025</effdate><histories><history>Renumbered and Amended by Chapter <modchap sess="2025GS">310</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Prudent investor rule.</catchline><subsection number="75B-2-901(1)"><subsection number="75B-2-901(1)(a)">Except as otherwise provided in Subsection <xref depth="4" refid="C75-7-S901_1800010118000101" refnumber="75-7-901(2)" start="0">(2)</xref>, a trustee who invests and manages trust assets owes a duty to the beneficiaries of the trust to comply with the prudent investor rule described in this chapter.  </subsection><subsection number="75B-2-901(1)(b)">If a trustee is named on the basis of a trustee's representations of special skills or expertise, the trustee has a duty to use those special skills or expertise.</subsection></subsection><subsection number="75B-2-901(2)"><subsection number="75B-2-901(2)(a)">The prudent investor rule is a default rule and may be expanded, restricted, eliminated, or otherwise altered by the provisions of a trust.  </subsection><subsection number="75B-2-901(2)(b)">A trustee is not liable to a beneficiary to the extent that the trustee acted in reasonable reliance on the provisions of the trust.</subsection></subsection></section>
