5/7/2025Renumbered and Amended by Chapter 173, 2025 General Session2025Renumbered and Amended by Chapter 208, 2025 General Session2025Unlawfully carrying a firearm in a vehicle.Terms defined in Sections 76-1-101.5, 76-11-101, and 76-11-201 apply to this section.An actor commits unlawfully carrying a firearm in a vehicle if the actor:is 18 years old or older; andis carrying a firearm that is readily accessible by the actor for immediate use; andis in a vehicle in which the actor is not lawfully present; oris carrying a loaded rifle, shotgun, or muzzle-loading rifle in any vehicle.A violation of Subsection (2) is a class B misdemeanor.This section does not prohibit the owner or lawful possessor of a vehicle from prohibiting another individual who may otherwise lawfully carry a firearm from carrying a firearm in the owner's or lawful possessor's vehicle.An actor is lawfully present in a vehicle while carrying a firearm under this section if:the vehicle is in the lawful possession of the actor; orthe actor has the consent of the person lawfully in possession of the vehicle to carry the firearm in the vehicle.This section does not apply if the actor has a concealed carry permit issued under Section 53-5a-303, a temporary concealed carry permit issued under Section 53-5a-304, a provisional concealed carry permit issued under Section 53-5a-305, or a concealed carry permit lawfully issued by or in another state.
