<section number="76-6-206"><effdate>5/7/2025</effdate><histories><history>Amended by Chapter <modchap sess="2025GS">173</modchap>, 2025 General Session</history><modyear>2025</modyear><history>Amended by Chapter <modchap sess="2025GS">295</modchap>, 2025 General Session</history><modyear>2025</modyear></histories><catchline>Criminal trespass.</catchline><subsection number="76-6-206(1)"><subsection number="76-6-206(1)(a)">As used in this section:<subsection number="76-6-206(1)(a)(i)">"Enter" means intrusion of the entire body or the entire unmanned aircraft.</subsection><subsection number="76-6-206(1)(a)(ii)">"Graffiti" means the same as that term is defined in Section <xref depth="3" refnumber="76-6-101">76-6-101</xref>.</subsection><subsection number="76-6-206(1)(a)(iii)">"Remain unlawfully," as that term relates to an unmanned aircraft, means remaining on or over private property when:<subsection number="76-6-206(1)(a)(iii)(A)">the private property or any portion of the private property is not open to the public; and</subsection><subsection number="76-6-206(1)(a)(iii)(B)">the person operating the unmanned aircraft is not otherwise authorized to fly the unmanned aircraft over the private property or any portion of the private property.</subsection></subsection></subsection><subsection number="76-6-206(1)(b)">Terms defined in Sections <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref> and <xref depth="3" refnumber="76-6-201">76-6-201</xref> apply to this section.</subsection></subsection><subsection number="76-6-206(2)">An actor commits criminal trespass if, under circumstances not amounting to burglary as defined in Section <xref depth="3" refnumber="76-6-202">76-6-202</xref>, <xref depth="3" refnumber="76-6-203">76-6-203</xref>, or <xref depth="3" refnumber="76-6-204">76-6-204</xref>, a violation of Section <xref depth="3" refnumber="76-6-106.2">76-6-106.2</xref>, or a violation of Section <xref depth="3" refnumber="76-9-113">76-9-113</xref> regarding commercial obstruction or Section <xref depth="3" refnumber="76-9-114">76-9-114</xref> regarding aggravated commercial obstruction:<subsection number="76-6-206(2)(a)">the actor enters or remains unlawfully on or causes an unmanned aircraft to enter and remain unlawfully over property and:<subsection number="76-6-206(2)(a)(i)">intends to cause annoyance or injury to any person or damage to any property, including the use of graffiti;</subsection><subsection number="76-6-206(2)(a)(ii)">intends to commit any crime, other than theft or a felony; or</subsection><subsection number="76-6-206(2)(a)(iii)">is reckless as to whether the actor's or unmanned aircraft's presence will cause fear for the safety of another;</subsection></subsection><subsection number="76-6-206(2)(b)">knowing the actor's or unmanned aircraft's entry or presence is unlawful, the actor enters or remains on or causes an unmanned aircraft to enter or remain unlawfully over property to which notice against entering is given by:<subsection number="76-6-206(2)(b)(i)">personal communication to the actor by the owner or someone with apparent authority to act for the owner;</subsection><subsection number="76-6-206(2)(b)(ii)">fencing or other enclosure obviously designed to exclude intruders; or</subsection><subsection number="76-6-206(2)(b)(iii)">posting of signs reasonably likely to come to the attention of intruders; </subsection></subsection><subsection number="76-6-206(2)(c)">the actor enters a condominium unit in violation of Section <xref depth="4" refnumber="57-8-7(8)">57-8-7(8)</xref>; or</subsection><subsection number="76-6-206(2)(d)">the actor enters a sex-designated changing room in violation of Subsection <xref depth="4" refnumber="63G-31-302(3)">63G-31-302(3)</xref>.</subsection></subsection><subsection number="76-6-206(3)"><subsection number="76-6-206(3)(a)">Except as provided in Subsection <xref depth="4" refnumber="76-6-206(3)(b)">(3)(b)</xref>, a violation of Subsection <xref depth="4" refnumber="76-6-206(2)(a)">(2)(a)</xref> ,<xref refnumber="(b)" depth="4"> (b)</xref>, or <xref refnumber="(d)" depth="4">(d) </xref>is a class B misdemeanor.</subsection><subsection number="76-6-206(3)(b)">The following is a class A misdemeanor:<subsection number="76-6-206(3)(b)(i)">if a violation of Subsection <xref depth="4" refnumber="76-6-206(2)(a)">(2)(a)</xref> or <xref depth="4" refnumber="76-6-206(b)">(b)</xref> is committed in a dwelling;</subsection><subsection number="76-6-206(3)(b)(ii)">if a violation of Subsection <xref depth="4" refnumber="76-6-206(2)(d)">(2)(d)</xref> is committed while also committing the offense of:<subsection number="76-6-206(3)(b)(ii)(A)">lewdness under Section <xref depth="3" refnumber="76-5-419">76-5-419</xref>;</subsection><subsection number="76-6-206(3)(b)(ii)(B)">lewdness involving a child under Section <xref depth="3" refnumber="76-5-420">76-5-420</xref>;</subsection><subsection number="76-6-206(3)(b)(ii)(C)">voyeurism under Section <xref depth="3" refnumber="76-12-306">76-12-306</xref>;</subsection><subsection number="76-6-206(3)(b)(ii)(D)">recorded or photographed voyeurism under Section <xref depth="3" refnumber="76-12-307">76-12-307</xref>; </subsection><subsection number="76-6-206(3)(b)(ii)(E)">distribution of images obtained through voyeurism under Section <xref depth="3" refnumber="76-12-308">76-12-308</xref>; or</subsection><subsection number="76-6-206(3)(b)(ii)(F)">loitering in a privacy space under Section <xref depth="3" refnumber="76-12-309">76-12-309</xref>; or</subsection></subsection><subsection number="76-6-206(3)(b)(iii)">if a violation of Subsection <xref depth="4" refnumber="76-6-206(2)(d)">(2)(d)</xref> is committed in a sex-designated privacy space, as defined in Section <xref depth="3" refnumber="76-12-309">76-12-309</xref>, that is not designated for individuals of the actor's sex.</subsection></subsection><subsection number="76-6-206(3)(c)">A violation of Subsection <xref depth="4" refnumber="76-6-206(2)(c)">(2)(c)</xref> is an infraction.</subsection></subsection><subsection number="76-6-206(4)">It is a defense to prosecution under this section that:<subsection number="76-6-206(4)(a)">the property was at the time open to the public; and</subsection><subsection number="76-6-206(4)(b)">the defendant complied with all lawful conditions imposed on access to or remaining on the property.</subsection></subsection><subsection number="76-6-206(5)">In addition to an order for restitution under Section <xref depth="3" refnumber="77-38b-205">77-38b-205</xref>, an actor who commits a violation of Subsection <xref depth="4" refnumber="76-6-206(2)">(2)</xref> may also be liable for:<subsection number="76-6-206(5)(a)">statutory damages in the amount of three times the value of damages resulting from the violation of Subsection <xref depth="4" refnumber="76-6-206(2)">(2)</xref> or $500, whichever is greater; and</subsection><subsection number="76-6-206(5)(b)">reasonable attorney fees not to exceed $250, and court costs.</subsection></subsection><subsection number="76-6-206(6)">Civil damages under Subsection <xref depth="4" refnumber="76-6-206(5)">(5)</xref> may be collected in a separate action by the property owner or the owner's assignee.</subsection></section>
