5/7/2025Amended by Chapter 173, 2025 General Session2025Amended by Chapter 208, 2025 General Session2025Prohibited dangerous weapon or ammunition in a secure area.As used in this section:"Correctional facility" means the same as that term is defined in Section 76-8-311.3."Dangerous weapon" means the same as that term is defined in Section 76-11-101."Firearm" means the same as that term is defined in Section 76-11-101."Higher education secure area" means a higher education secure area hearing room created under Section 76-8-311.1."Law enforcement facility" means the same as that term is defined in Section 76-8-311.1."Secure area" means the same as that term is defined in Section 76-8-311.1.Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.An actor commits prohibited dangerous weapon or ammunition in a secure area if the actor knowingly or intentionally transports a firearm or other dangerous weapon or ammunition into:a correctional facility;a secure area created by the State Tax Commission;a secure area in a law enforcement facility or a mental health facility; ora higher education secure area.Except as provided in Section 76-8-311.4, 76-8-311.6, or 76-8-311.7, a violation of Subsection (2) is a third degree felony.It is a defense to a prosecution under this section that the actor acted in conformity with the facility's rule or policy established under Section 76-8-311.1.
