An action may be brought within six years:
<subsection number="78B-2-309(1)(a)">
for the mesne profits of real property;</subsection><subsection number="78B-2-309(1)(b)">
subject to Subsection <xref depth="4" refnumber="78B-2-309(2)" start="0">(2)</xref>, upon any contract, obligation, or liability founded upon an instrument in writing, except those mentioned in Section <xref depth="3" refnumber="78B-2-311" start="0">78B-2-311</xref>; or</subsection><subsection number="78B-2-309(1)(c)">
to recover fire suppression costs or other damages caused by wildland fire.</subsection></subsection><subsection number="78B-2-309(2)">
For a credit agreement, as defined in Section <xref depth="3" refnumber="25-5-4" start="0">25-5-4</xref>, the six-year period described in Subsection <xref depth="4" refnumber="78B-2-309(1)" start="0">(1)</xref> begins the later of the day on which:
<subsection number="78B-2-309(2)(a)">
the debt arose;</subsection><subsection number="78B-2-309(2)(b)">
the debtor makes a written acknowledgment of the debt or a promise to pay the debt; or</subsection><subsection number="78B-2-309(2)(c)">
the debtor or a third party makes a payment on the debt.</subsection></subsection></section>
