<chapter number="78B-25"><effdate>5/3/2023</effdate><catchline>Uniform Public Expression Protection Act</catchline><section number="78B-25-101"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Title.</catchline><tab/>This chapter may be cited as the "Uniform Public Expression Protection Act."</section><section number="78B-25-102"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Scope.</catchline><subsection number="78B-25-102(1)">
As used in this section:
<subsection number="78B-25-102(1)(a)">
"Goods or services" does not include the creation, dissemination, exhibition, or advertisement or similar promotion of a dramatic, literary, musical, political, journalistic, or artistic work.</subsection><subsection number="78B-25-102(1)(b)">
"Governmental unit" means a public corporation or government or governmental subdivision, agency, or instrumentality.</subsection><subsection number="78B-25-102(1)(c)">
"Person" means an individual, estate, trust, partnership, business or nonprofit entity, governmental unit, or other legal entity.</subsection></subsection><subsection number="78B-25-102(2)">
Except as provided in Subsection <xref depth="4" refnumber="78B-25-102(3)" start="0">(3)</xref>, this chapter applies to a cause of action asserted in a civil action against a person based on the person's:
<subsection number="78B-25-102(2)(a)">
communication in a legislative, executive, judicial, administrative, or other governmental proceeding;</subsection><subsection number="78B-25-102(2)(b)">
communication on an issue under consideration or review in a legislative, executive, judicial, administrative, or other governmental proceeding; or</subsection><subsection number="78B-25-102(2)(c)">
exercise of the right of freedom of speech or of the press, the right to assemble or petition, or the right of association, guaranteed by the United States Constitution or Utah Constitution, on a matter of public concern.</subsection></subsection><subsection number="78B-25-102(3)">
This chapter does not apply to a cause of action asserted:
<subsection number="78B-25-102(3)(a)">
against a governmental unit or an employee or agent of a governmental unit acting or purporting to act in an official capacity;</subsection><subsection number="78B-25-102(3)(b)">
by a governmental unit or an employee or agent of a governmental unit acting in an official capacity to enforce a law to protect against an imminent threat to public health or safety; or</subsection><subsection number="78B-25-102(3)(c)">
against a person primarily engaged in the business of selling or leasing goods or services if the cause of action arises out of a communication related to the person's sale or lease of the goods or services.</subsection></subsection></section><section number="78B-25-103"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Special motion for expedited relief.</catchline><tab/>Not later than 60 days after the day on which a party is served with a complaint, crossclaim, counterclaim, third-party claim, or other pleading that asserts a cause of action to which this chapter applies, or at a later time on a showing of good cause, the party may file a special motion for expedited relief to dismiss the cause of action or part of the cause of action.</section><section number="78B-25-104"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Stay.</catchline><subsection number="78B-25-104(1)">
Except as provided in Subsections <xref depth="4" refnumber="78B-25-104(4)" start="0">(4)</xref> through <xref depth="4" refnumber="78B-25-104(7)" start="0">(7)</xref>, on the filing of a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>:
<subsection number="78B-25-104(1)(a)">
all other proceedings between the moving party and responding party, including discovery and a pending hearing or motion, are stayed; and</subsection><subsection number="78B-25-104(1)(b)">
on motion by the moving party, the court may stay a hearing or motion involving another party, or discovery by another party, if the hearing or ruling on the motion would adjudicate, or the discovery would relate to, an issue material to the motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>.</subsection></subsection><subsection number="78B-25-104(2)">
A stay under Subsection <xref depth="4" refnumber="78B-25-104(1)" start="0">(1)</xref> remains in effect until the day on which an order ruling on the motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> is entered and expiration of the time under Utah Rules of Appellate Procedure, Rule 4, for the moving party to appeal the order.</subsection><subsection number="78B-25-104(3)"><subsection number="78B-25-104(3)(a)">
Except as provided in Subsections <xref depth="4" refnumber="78B-25-104(5)" start="0">(5)</xref> through <xref depth="4" refnumber="78B-25-104(7)" start="0">(7)</xref>, if a party appeals from an order ruling on a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>, all proceedings between all parties in the action are stayed.</subsection><subsection number="78B-25-104(3)(b)">
A stay under Subsection <xref depth="4" refnumber="78B-25-104(3)(a)" start="0">(3)(a)</xref> remains in effect until the day on which the appeal concludes.</subsection></subsection><subsection number="78B-25-104(4)">
During a stay under Subsection <xref depth="4" refnumber="78B-25-104(1)" start="0">(1)</xref>, the court may allow limited discovery if a party shows that specific information is necessary to establish whether a party has satisfied or failed to satisfy a burden under Subsection <xref depth="4" refnumber="78B-25-107(1)" start="0">78B-25-107(1)</xref> and the information is not reasonably available unless discovery is allowed.</subsection><subsection number="78B-25-104(5)">
A motion under Section <xref depth="3" refnumber="78B-25-110" start="0">78B-25-110</xref> for costs, attorney fees, and expenses is not subject to a stay under this section.</subsection><subsection number="78B-25-104(6)">
A stay under this section does not affect a party's ability to voluntarily dismiss a cause of action or part of a cause of action or move to sever a cause of action.</subsection><subsection number="78B-25-104(7)">
During a stay under this section, the court for good cause may hear and rule on:
<subsection number="78B-25-104(7)(a)">
a motion unrelated to the motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>; and</subsection><subsection number="78B-25-104(7)(b)">
a motion seeking a special or preliminary injunction to protect against an imminent threat to public health or safety.</subsection></subsection></section><section number="78B-25-105"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Hearing.</catchline><subsection number="78B-25-105(1)">
The court shall hear a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> not later than 60 days after the day on which the motion is filed, unless the court orders a later hearing:
<subsection number="78B-25-105(1)(a)">
to allow discovery under Subsection <xref depth="4" refnumber="78B-25-104(4)" start="0">78B-25-104(4)</xref>; or</subsection><subsection number="78B-25-105(1)(b)">
for other good cause.</subsection></subsection><subsection number="78B-25-105(2)">
If the court orders a later hearing under Subsection <xref depth="4" refnumber="78B-25-105(1)(a)" start="0">(1)(a)</xref>, the court shall hear the motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> not later than 60 days after the day on which the court issues an order allowing the discovery, unless the court orders a later hearing under Subsection <xref depth="4" refnumber="78B-25-105(1)(b)" start="0">(1)(b)</xref>.</subsection></section><section number="78B-25-106"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Proof.</catchline><tab/>In ruling on a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>, the court shall consider the pleadings, the motion, any reply or response to the motion, and any evidence that could be considered in ruling on a motion for summary judgment under Utah Rules of Civil Procedure, Rule 56.</section><section number="78B-25-107"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Dismissal of cause of action in whole or part.</catchline><subsection number="78B-25-107(1)">
In ruling on a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>, the court shall dismiss with prejudice a cause of action, or part of a cause of action, if:
<subsection number="78B-25-107(1)(a)">
the moving party establishes under Subsection <xref depth="4" refnumber="78B-25-102(2)" start="0">78B-25-102(2)</xref> that this chapter applies;</subsection><subsection number="78B-25-107(1)(b)">
the responding party fails to establish under Subsection <xref depth="4" refnumber="78B-25-102(3)" start="0">78B-25-102(3)</xref> that this chapter does not apply; and</subsection><subsection number="78B-25-107(1)(c)">
either:<subsection number="78B-25-107(1)(c)(i)">
the responding party fails to establish a prima facie case as to each essential element of the cause of action; or</subsection><subsection number="78B-25-107(1)(c)(ii)">
the moving party establishes that:
<subsection number="78B-25-107(1)(c)(ii)(A)">
the responding party failed to state a cause of action upon which relief can be granted; or</subsection><subsection number="78B-25-107(1)(c)(ii)(B)">
there is no genuine issue as to any material fact and the moving party is entitled to judgment as a matter of law on the cause of action or part of the cause of action.</subsection></subsection></subsection></subsection><subsection number="78B-25-107(2)">
A voluntary dismissal without prejudice of a responding party's cause of action, or part of a cause of action, that is the subject of a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> does not affect a moving party's right to obtain a ruling on the motion and seek costs, attorney fees, and expenses under Section <xref depth="3" refnumber="78B-25-110" start="0">78B-25-110</xref>.</subsection><subsection number="78B-25-107(3)">
A voluntary dismissal with prejudice of a responding party's cause of action, or part of a cause of action, that is the subject of a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> establishes for the purpose of Section <xref depth="3" refnumber="78B-25-110" start="0">78B-25-110</xref> that the moving party prevailed on the motion.</subsection></section><section number="78B-25-108"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Ruling.</catchline><tab/>The court shall rule on a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref> not later than 60 days after the day on which a hearing is held under Section <xref depth="3" refnumber="78B-25-105" start="0">78B-25-105</xref>.</section><section number="78B-25-109"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Appeal.</catchline><subsection number="78B-25-109(1)">
A moving party may appeal as a matter of right from an order denying, in whole or in part, a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>.</subsection><subsection number="78B-25-109(2)">
The appeal shall be filed in accordance with Utah Rules of Appellate Procedure, Rule 4.</subsection></section><section number="78B-25-110"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Costs, attorney fees, and expenses.</catchline><tab/>On a motion under Section <xref depth="3" refnumber="78B-25-103" start="0">78B-25-103</xref>, the court shall award court costs, reasonable attorney fees, and reasonable litigation expenses related to the motion:<subsection number="78B-25-110(1)">
to the moving party if the moving party prevails on the motion; or</subsection><subsection number="78B-25-110(2)">
to the responding party if the responding party prevails on the motion and the court finds that the motion was frivolous or filed solely with intent to delay the proceeding.</subsection></section><section number="78B-25-111"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Construction.</catchline><tab/>This chapter shall be broadly construed and applied to protect the exercise of the right of freedom of speech and of the press, the right to assemble and petition, and the right of association, guaranteed by the United States Constitution or the Utah Constitution.</section><section number="78B-25-112"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Uniformity of application and construction.</catchline><tab/>In applying and construing this uniform act, consideration shall be given to the need to promote uniformity of the law with respect to the uniform law's subject matter among states that enact the uniform law.</section><section number="78B-25-113"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Transitional provision.</catchline><tab/>This chapter applies to a civil action filed or cause of action asserted in a civil action on or after May 3, 2023.</section><section number="78B-25-114"><histories><history>Amended by Chapter <modchap sess="2024GS">381</modchap>, 2024 General Session</history><modyear>2024</modyear></histories><catchline>Savings clause.</catchline><tab/>This chapter does not affect a cause of action asserted before May 3, 2023, in a civil action or a motion under Laws of Utah 2008, Chapter 3, Sections 1087 and 1088, regarding the cause of action.</section><section number="78B-25-115"><histories><history>Enacted by Chapter <modchap sess="2023GS">488</modchap>, 2023 General Session</history><modyear>2023</modyear></histories><catchline>Severability.</catchline><tab/>If any provision of this chapter or the chapter's application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are severable.</section></chapter>
