<?xml version="1.0" encoding="ISO-8859-1"?><section number="78B-6-2302"><effdate>5/4/2022</effdate><histories><history>Enacted by Chapter <modchap sess="2022GS">428</modchap>, 2022 General Session</history><modyear>2022</modyear></histories><catchline>Violation of legislative preemption -- Exceptions.</catchline><subsection number="78B-6-2302(1)">
A local or state governmental entity may not enact or enforce a directive that violates legislative firearm preemption.</subsection><subsection number="78B-6-2302(2)">
This part does not prohibit the enactment or enforcement of a directive:
<subsection number="78B-6-2302(2)(a)">
by a law enforcement agency if the directive pertains to a firearm issued to or used by a peace officer in the course of the peace officer's official duties;</subsection><subsection number="78B-6-2302(2)(b)">
by a correctional facility or mental health facility under Section <xref depth="3" refnumber="76-8-311.3" start="0">76-8-311.3</xref>;</subsection><subsection number="78B-6-2302(2)(c)">
of judicial administration if the directive establishes a secure courthouse;</subsection><subsection number="78B-6-2302(2)(d)">
by the State Tax Commission if the directive establishes a secure area within a State Tax Commission facility; or</subsection><subsection number="78B-6-2302(2)(e)">
by a local or state governmental entity if the directive is developed in response to and in accordance with legislative authority.</subsection></subsection></section>
