5 AN ACT RELATING TO INSURANCE CODE; PROHIBITING CERTAIN INSURANCE
6 RATE INCREASES FOR VEHICLES UNDER CERTAIN CIRCUMSTANCES.
7 This act affects sections of Utah Code Annotated 1953 as follows:
8 ENACTS:
9 31A-19-211, Utah Code Annotated 1953
10 Be it enacted by the Legislature of the state of Utah:
11 Section 1. Section 31A-19-211 is enacted to read:
12 31A-19-211. Premium increases prohibited when not liable.
13 (1) Each rate, rating schedule, and rating manual filed with the commissioner for any
14 insurance covering a vehicle or the operation of a vehicle may not permit a premium increase due
15 to a claim resulting from an incident in which the person named in the policy or any other person
16 using the insured motor vehicle with the express or implied permission of the named insured is not
17 at fault.
18 (2) This section is an exception to the provisions of Section 31A-19-201.
