5 AN ACT RELATING TO LABOR; AMENDING PROVISIONS RELATED TO
6 EMPLOYMENT OF MINORS OVER 16 YEARS OF AGE; AND MAKING TECHNICAL
7 CORRECTIONS.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 34-23-202, as renumbered and amended by Chapter 8, Laws of Utah 1990
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 34-23-202 is amended to read:
13 34-23-202. Employment of minors during school hours -- Hours of work limited.
14 (1) A minor under the age of 16 may not be employed or permitted to work during school
15 hours except as authorized by the proper school authorities.
16 (2) A minor under the age of 16 may not be permitted to work:
17 (a) before or after school in excess of four hours a day;
18 (b) before 5:00 a.m. or after 9:30 p.m., unless the next day is not a school day;
19 (c) in excess of eight hours in any 24-hour period; or
20 (d) more than 40 hours in any week.
21 (3) A minor 16 years of age or older attending secondary school may not be permitted to
22 work:
23 (a) before or after school in excess of four hours a day, unless the next day is not a school
24 day;
25 (b) before 5 a.m.; or
26 (c) after:
27 (i) the curfew imposed by ordinance by the municipality where the employer is located;
1 or
2 (ii) if the municipality where the employer is located has not imposed a curfew:
3 (A) 11:00 p.m. if the next day is a school day; and
4 (B) 1:00 a.m. if the next day is not a school day.
5 (4) Notwithstanding Subsection (3)(c)(i), if the ordinance imposing a curfew does not
6 allow for travel from a place of employment to a minor's residence after the curfew, a minor 16
7 years of age or older attending secondary school may not be permitted to work after 30 minutes
8 before the curfew imposed by the municipality.
